(1) An administrative offence is committed by anyone who commits an act referred to in
(1) Ordnungswidrig handelt, wer eine in
1. section 96 items 1 to 5b, 7 to 18e or item 19, or
1. § 96 Nummer 1 bis 5b, 7 bis 18e oder Nummer 19 oder
(2) An administrative offence is also committed by anyone who, intentionally or negligently,
(2) Ordnungswidrig handelt auch, wer vorsätzlich oder fahrlässig
1. contrary to section 8(3), places a medicinal product on the market,
1. entgegen § 8 Absatz 3 ein Arzneimittel in den Verkehr bringt,
2. contrary to section 9(1), places on the market medicinal products which do not bear the name or the company name of the pharmaceutical company,
2. entgegen § 9 Abs. 1 Arzneimittel, die nicht den Namen oder die Firma des pharmazeutischen Unternehmers tragen, in den Verkehr bringt,
3. contrary to section 9(2) sentence 1, places medicinal products on the market without having his or her registered office within the territory in which this Act applies or in another Member State of the European Union or in another Contracting State to the Agreement on the European Economic Area,
3. entgegen § 9 Abs. 2 Satz 1 Arzneimittel in den Verkehr bringt, ohne seinen Sitz im Geltungsbereich dieses Gesetzes oder in einem anderen Mitgliedstaat der Europäischen Union oder in einem anderen Vertragsstaat des Abkommens über den Europäischen Wirtschaftsraum zu haben,
4. contrary to section 10, also in conjunction with section 109(1) sentence 1 or a statutory ordinance under section 12(1) item 1, places medicinal products on the market without the prescribed labelling,
4. entgegen § 10, auch in Verbindung mit § 109 Abs. 1 Satz 1 oder einer Rechtsverordnung nach § 12 Abs. 1 Nr. 1, Arzneimittel ohne die vorgeschriebene Kennzeichnung in den Verkehr bringt,
5. contrary to section 11(1) sentence 1, also in conjunction with subsections (2a) to (3b) or (4), in each case also in conjunction with a statutory ordinance under section 12(1) item 1, places medicinal products on the market without the prescribed package leaflet,
5. entgegen § 11 Abs. 1 Satz 1, auch in Verbindung mit Abs. 2a bis 3b oder 4, jeweils auch in Verbindung mit einer Rechtsverordnung nach § 12 Abs. 1 Nr. 1, Arzneimittel ohne die vorgeschriebene Packungsbeilage in den Verkehr bringt,
5a. contrary to section 11(7) sentence 1, supplies a partial quantity,
5a. entgegen § 11 Abs. 7 Satz 1 eine Teilmenge abgibt,
a) sections 20, 20b(5), section 20c(6), section 52a(8), section 67(8) sentence 1 or section 72b(2c) sentence 1,
a) den §§ 20, 20b Absatz 5, § 20c Absatz 6, § 52a Absatz 8, § 67 Absatz 8 Satz 1 oder § 72b Absatz 2c Satz 1,
b) section 21a(7) sentence 1, section 29(1) sentence 1, also in conjunction with sentence 2, contrary to section 29(1c) sentence 1, section 63c(2), section 63i(2) sentence 1, section 67(6) sentence 1, or
b) § 21a Absatz 7 Satz 1, § 29 Absatz 1 Satz 1, auch in Verbindung mit Satz 2, entgegen § 29 Absatz 1c Satz 1, § 63c Absatz 2, § 63i Absatz 2 Satz 1, § 67 Absatz 6 Satz 1 oder
c) section 67(1) sentence 1, also in conjunction with sentence 2, contrary to section 67(5) sentence 1 or section 67(9) sentence 1
c) § 67 Absatz 1 Satz 1, auch in Verbindung mit Satz 2, entgegen § 67 Absatz 5 Satz 1 oder § 67 Absatz 9 Satz 1
fails to make a notification, or fails to make it correctly, completely or in good time,
eine Anzeige nicht, nicht richtig, nicht vollständig oder nicht rechtzeitig erstattet,
7a. contrary to section 29(1a) sentence 1, subsection (1b) or (1d), fails to make a communication, or fails to make it correctly, completely or in good time,
7a. entgegen § 29 Abs. 1a Satz 1, Abs. 1b oder 1d eine Mitteilung nicht, nicht richtig, nicht vollständig oder nicht rechtzeitig macht,
8. contrary to section 30(4) sentence 1 item 2 or section 73(1), brings medicinal products into the territory in which this Act applies,
8. entgegen § 30 Abs. 4 Satz 1 Nr. 2 oder § 73 Absatz 1 Arzneimittel in den Geltungsbereich dieses Gesetzes verbringt,
9. contrary to section 42b(1), fails to make the reports available, or fails to make them available correctly, completely or in good time,
9. entgegen § 42b Absatz 1 die Berichte nicht, nicht richtig, nicht vollständig oder nicht rechtzeitig zur Verfügung stellt,
10. contrary to section 43(1), (2) or (3), places medicinal products on the market in the course of a profession or business, or trades in medicinal products which may be supplied to consumers without a prescription, or supplies such medicinal products,
10. entgegen § 43 Abs. 1, 2 oder 3 Arzneimittel berufs- oder gewerbsmäßig in den Verkehr bringt oder mit Arzneimitteln, die ohne Verschreibung an Verbraucher abgegeben werden dürfen, Handel treibt oder diese Arzneimittel abgibt,
12. supplies medicinal products which may be supplied to consumers without a prescription contrary to section 47(1) or subsection (2a), or obtains them contrary to section 47(2) sentence 1,
12. Arzneimittel, die ohne Verschreibung an Verbraucher abgegeben werden dürfen, entgegen § 47 Abs. 1 oder Absatz 2a abgibt oder entgegen § 47 Abs. 2 Satz 1 bezieht,
12a. contrary to section 47(4) sentence 1, supplies samples, or causes samples to be supplied, without a written request, in a pack size other than the smallest pack size or in excess of the permitted quantity,
12a. entgegen § 47 Abs. 4 Satz 1 Muster ohne schriftliche Anforderung, in einer anderen als der kleinsten Packungsgröße oder über die zulässige Menge hinaus abgibt oder abgeben lässt,
13. fails to keep, or fails to keep correctly, the records prescribed in section 47(4) sentence 3 or in section 47a(2) sentence 2, or fails to submit them to the competent authority on request,
13. die in § 47 Abs. 4 Satz 3 oder in § 47a Abs. 2 Satz 2 vorgeschriebenen Nachweise nicht oder nicht richtig führt, oder der zuständigen Behörde auf Verlangen nicht vorlegt,
13a. contrary to section 47a(2) sentence 1, supplies a medicinal product referred to therein without the prescribed labelling,
13a. entgegen § 47a Abs. 2 Satz 1 ein dort bezeichnetes Arzneimittel ohne die vorgeschriebene Kennzeichnung abgibt,
14. contrary to section 50(1), engages in the retail trade in medicinal products,
14. entgegen § 50 Abs. 1 Einzelhandel mit Arzneimitteln betreibt,
15. contrary to section 51(1), offers medicinal products for sale as an itinerant trader or solicits orders for them,
15. entgegen § 51 Abs. 1 Arzneimittel im Reisegewerbe feilbietet oder Bestellungen darauf aufsucht,
16. contrary to section 52(1), places medicinal products on the market by way of self-service,
16. entgegen § 52 Abs. 1 Arzneimittel im Wege der Selbstbedienung in den Verkehr bringt,
16a. contrary to section 52b(3e) sentence 1, fails to make a communication, or fails to make it correctly, completely or in good time,
16a. entgegen § 52b Absatz 3e Satz 1 eine Mitteilung nicht, nicht richtig, nicht vollständig oder nicht rechtzeitig macht,
16b. contrary to section 52b(3f) sentence 2, fails to transmit data, or fails to transmit them correctly, completely, in the prescribed manner or in good time,
16b. entgegen § 52b Absatz 3f Satz 2 Daten nicht, nicht richtig, nicht vollständig, nicht in der vorgeschriebenen Weise oder nicht rechtzeitig übermittelt,
17. contrary to section 55(8) sentence 1, also in conjunction with sentence 2, uses a substance, a container or a wrapping or prepares a pharmaceutical form,
17. entgegen § 55 Absatz 8 Satz 1 auch in Verbindung mit Satz 2, einen Stoff, ein Behältnis oder eine Umhüllung verwendet oder eine Darreichungsform anfertigt,
24c. contrary to section 63a(1) sentence 1, fails to appoint a graduated plan officer (Stufenplanbeauftragter), or, contrary to section 63a(3), fails to make a communication, or fails to make it completely or in good time,
24c. entgegen § 63a Abs. 1 Satz 1 einen Stufenplanbeauftragten nicht beauftragt oder entgegen § 63a Abs. 3 eine Mitteilung nicht, nicht vollständig oder nicht rechtzeitig erstattet,
24d. contrary to section 63a(1) sentence 6, carries out activities as a graduated plan officer,
24d. entgegen § 63a Abs. 1 Satz 6 eine Tätigkeit als Stufenplanbeauftragter ausübt,
24e. contrary to section 63b(1), fails to operate a pharmacovigilance system,
24e. entgegen § 63b Absatz 1 ein Pharmakovigilanz-System nicht betreibt,
24f. contrary to section 63b(2) item 1, fails to take a measure referred to therein, or fails to take it in good time,
24f. entgegen § 63b Absatz 2 Nummer 1 eine dort genannte Maßnahme nicht oder nicht rechtzeitig ergreift,
24g. contrary to section 63b(2) item 3, fails to maintain a pharmacovigilance system master file, or fails to maintain it correctly or completely, or fails to make it available, or fails to make it available correctly, completely or in good time,
24g. entgegen § 63b Absatz 2 Nummer 3 eine Pharmakovigilanz-Stammdokumentation nicht, nicht richtig oder nicht vollständig führt oder nicht, nicht richtig, nicht vollständig oder nicht rechtzeitig zur Verfügung stellt,
24h. contrary to section 63b(2) item 4, fails to operate a risk management system for each individual medicinal product, or fails to operate it correctly or completely,
24h. entgegen § 63b Absatz 2 Nummer 4 ein Risikomanagement-System für jedes einzelne Arzneimittel nicht, nicht richtig oder nicht vollständig betreibt,
24i. contrary to section 63b(3) sentence 1, publishes information referred to therein without the prior or simultaneous communication referred to therein,
24i. entgegen § 63b Absatz 3 Satz 1 eine dort genannte Information ohne die dort genannte vorherige oder gleichzeitige Mitteilung veröffentlicht,
24j. contrary to section 63d(1), also in conjunction with subsection (3) sentence 1 or subsection (3) sentence 4, fails to submit a periodic safety update report, or fails to submit it correctly, completely or in good time,
24j. entgegen § 63d Absatz 1, auch in Verbindung mit Absatz 3 Satz 1 oder Absatz 3 Satz 4, einen Unbedenklichkeitsbericht nicht, nicht richtig, nicht vollständig oder nicht rechtzeitig vorlegt,
24k. contrary to section 63f(1) sentence 3, fails to transmit a final report, or fails to transmit it in good time,
24k. entgegen § 63f Absatz 1 Satz 3 einen Abschlussbericht nicht oder nicht rechtzeitig übermittelt,
24l. contrary to section 63g(1), fails to submit a draft of the study protocol, or fails to submit it correctly or in good time,
24l. entgegen § 63g Absatz 1 einen Entwurf des Prüfungsprotokolls nicht, nicht richtig oder nicht rechtzeitig vorlegt,
24m. contrary to section 63g(2) sentence 1, commences a post-authorisation safety study,
24m. entgegen § 63g Absatz 2 Satz 1 mit einer Unbedenklichkeitsstudie beginnt,
24n. contrary to section 63g(4) sentence 1, fails to submit a study report, or fails to submit it correctly, completely or in good time,
24n. entgegen § 63g Absatz 4 Satz 1 einen Prüfungsbericht nicht, nicht richtig, nicht vollständig oder nicht rechtzeitig vorlegt,
24p. contrary to section 63i(3) sentence 1, fails to make a report, or fails to make it correctly or in good time,
24p. entgegen § 63i Absatz 3 Satz 1 eine Meldung nicht, nicht richtig oder nicht rechtzeitig macht,
24q. contrary to section 63i(4) sentence 1, fails to submit a report, or fails to submit it correctly or in good time,
24q. entgegen § 63i Absatz 4 Satz 1 einen Bericht nicht, nicht richtig oder nicht rechtzeitig vorlegt,
25. contravenes an enforceable order under section 64(4) item 4,
25. einer vollziehbaren Anordnung nach § 64 Absatz 4 Nummer 4 zuwiderhandelt,
26. contravenes an obligation to tolerate or to cooperate under section 66,
26. einer Duldungs- oder Mitwirkungspflicht nach § 66 zuwiderhandelt,
27. contrary to an enforceable order under section 74(1) sentence 2 item 3, fails to present a consignment,
27. entgegen einer vollziehbaren Anordnung nach § 74 Abs. 1 Satz 2 Nr. 3 eine Sendung nicht vorführt,
27a. contrary to section 74a(1) sentence 1, fails to appoint an information officer, or, contrary to section 74a(3), fails to make a communication, or fails to make it completely or in good time,
27a. entgegen § 74a Abs. 1 Satz 1 einen Informationsbeauftragten nicht beauftragt oder entgegen § 74a Abs. 3 eine Mitteilung nicht, nicht vollständig oder nicht rechtzeitig erstattet,
27b. contrary to section 74a(1) sentence 4, carries out activities as an information officer,
27b. entgegen § 74a Abs. 1 Satz 4 eine Tätigkeit als Informationsbeauftragter ausübt,
28. contrary to section 75(1) sentence 1, engages a person as a pharmaceutical sales representative (Pharmaberater),
28. entgegen § 75 Abs. 1 Satz 1 eine Person als Pharmaberater beauftragt,
29. contrary to section 75(1) sentence 3, carries out activities as a pharmaceutical sales representative,
29. entgegen § 75 Abs. 1 Satz 3 eine Tätigkeit als Pharmaberater ausübt,
30. contravenes an obligation to keep records, to communicate or to provide evidence under section 76(1) sentence 2 or subsection (2),
30. einer Aufzeichnungs-, Mitteilungs- oder Nachweispflicht nach § 76 Abs. 1 Satz 2 oder Abs. 2 zuwiderhandelt,
31. contravenes a statutory ordinance under section 7(2) sentence 2, section 12(1) item 3 point (a), section 12(1b), section 54(1) or section 74(2), or an enforceable order issued on the basis of such a statutory ordinance, in so far as the statutory ordinance refers to this provision on administrative fines for a specific offence,
31. einer Rechtsverordnung nach § 7 Abs. 2 Satz 2, § 12 Abs. 1 Nr. 3 Buchstabe a, § 12 Abs. 1b, § 54 Abs. 1 oder § 74 Abs. 2 oder einer vollziehbaren Anordnung auf Grund einer solchen Rechtsverordnung zuwiderhandelt, soweit die Rechtsverordnung für einen bestimmten Tatbestand auf diese Bußgeldvorschrift verweist,
(2b) An administrative offence is committed by anyone who infringes Regulation (EC) No 726/2004 by, intentionally or negligently,
(2b) Ordnungswidrig handelt, wer gegen die Verordnung (EG) Nr. 726/2004 verstößt, indem er vorsätzlich oder fahrlässig
1. contrary to Article 16(2) sentence 1 or sentence 2 of Regulation (EC) No 726/2004 in conjunction with Article 8(3) first subparagraph points (c) to (e), (h) to (iaa) or point (ib) of Directive 2001/83/EC, in each case in conjunction with section 29(4) sentence 2, failing to make a communication referred to therein to the European Medicines Agency or to the competent higher federal authority, or failing to make it correctly, completely or in good time, or
1. entgegen Artikel 16 Absatz 2 Satz 1 oder Satz 2 der Verordnung (EG) Nr. 726/2004 in Verbindung mit Artikel 8 Absatz 3 Unterabsatz 1 Buchstabe c bis e, h bis iaa oder Buchstabe ib der Richtlinie 2001/83/EG, jeweils in Verbindung mit § 29 Absatz 4 Satz 2, der Europäischen Arzneimittel-Agentur oder der zuständigen Bundesoberbehörde eine dort genannte Mitteilung nicht, nicht richtig, nicht vollständig oder nicht rechtzeitig macht oder
2. contrary to Article 28(1) of Regulation (EC) No 726/2004 in conjunction with Article 107(1) second subparagraph of Directive 2001/83/EC, failing to ensure that a report is available at a point referred to therein.
2. entgegen Artikel 28 Absatz 1 der Verordnung (EG) Nr. 726/2004 in Verbindung mit Artikel 107 Absatz 1 Unterabsatz 2 der Richtlinie 2001/83/EG nicht dafür sorgt, dass eine Meldung an einer dort genannten Stelle verfügbar ist.
(2c) An administrative offence is committed by anyone who infringes Regulation (EC) No 1901/2006 of the European Parliament and of the Council of 12 December 2006 on medicinal products for paediatric use and amending Regulation (EEC) No 1768/92, Directive 2001/20/EC, Directive 2001/83/EC and Regulation (EC) No 726/2004 (OJ L 378, 27.12.2006, p. 1; L 339, 26.11.2014, p. 14), as last amended by Regulation (EU) 2019/5 (OJ L 4, 7.1.2019, p. 24), by, intentionally or negligently,
(2c) Ordnungswidrig handelt, wer gegen die Verordnung (EG) Nr. 1901/2006 des Europäischen Parlaments und des Rates vom 12. Dezember 2006 über Kinderarzneimittel und zur Änderung der Verordnung (EWG) Nr. 1768/92, der Richtlinien 2001/20/EG und 2001/83/EG sowie der Verordnung (EG) Nr. 726/2004 (ABl. L 378 vom 27.12.2006, S. 1; L 339 vom 26.11.2014, S. 14), die zuletzt durch die Verordnung (EU) 2019/5 (ABl. L 4 vom 7.1.2019, S. 24) geändert worden ist, verstößt, indem er vorsätzlich oder fahrlässig
1. contrary to Article 33 sentence 1, failing to place a medicinal product referred to therein on the market, or failing to do so correctly or in good time,
1. entgegen Artikel 33 Satz 1 ein dort genanntes Arzneimittel nicht, nicht richtig oder nicht rechtzeitig in den Verkehr bringt,
2. contravening an enforceable order under Article 34(2) sentence 4,
2. einer vollziehbaren Anordnung nach Artikel 34 Absatz 2 Satz 4 zuwiderhandelt,
3. contrary to Article 34(4) sentence 1, failing to submit the report referred to therein, or failing to submit it in good time,
3. entgegen Artikel 34 Absatz 4 Satz 1 den dort genannten Bericht nicht oder nicht rechtzeitig vorlegt,
4. contrary to Article 35 sentence 1, failing to transfer the marketing authorisation to a third party referred to therein, or failing to do so in good time, and failing to allow that third party to refer to the documentation referred to therein, or failing to do so in good time,
4. entgegen Artikel 35 Satz 1 die Genehmigung für das Inverkehrbringen nicht oder nicht rechtzeitig auf einen dort genannten Dritten überträgt und diesem einen Rückgriff auf die dort genannten Unterlagen nicht oder nicht rechtzeitig gestattet,
5. contrary to Article 35 sentence 2, failing to provide information, or failing to provide it correctly or in good time, or
5. entgegen Artikel 35 Satz 2 eine Unterrichtung nicht, nicht richtig oder nicht rechtzeitig vornimmt, oder
6. contrary to Article 41(2) sentence 2, failing to submit a result of the study referred to therein, or failing to submit it correctly or in good time.
6. entgegen Artikel 41 Absatz 2 Satz 2 ein Ergebnis der dort genannten Prüfung nicht, nicht richtig oder nicht rechtzeitig vorlegt.
(2d) An administrative offence is committed by anyone who infringes Regulation (EU) No 536/2014 of the European Parliament and of the Council of 16 April 2014 on clinical trials on medicinal products for human use, and repealing Directive 2001/20/EC (OJ L 158, 27.5.2014, p. 1; L 311, 17.11.2016, p. 25) by, intentionally or negligently,
(2d) Ordnungswidrig handelt, wer gegen die Verordnung (EU) Nr. 536/2014 des Europäischen Parlaments und des Rates vom 16. April 2014 über klinische Prüfungen mit Humanarzneimitteln und zur Aufhebung der Richtlinie 2001/20/EG (ABl. L 158 vom 27.5.2014, S. 1; L 311 vom 17.11.2016, S. 25) verstößt, indem er vorsätzlich oder fahrlässig
1. contrary to Article 36, Article 37(1), (2), (3) or (5) or Article 54(2), failing to inform the competent higher federal authority, or failing to do so in good time,
1. entgegen Artikel 36, Artikel 37 Absatz 1, 2, 3 oder 5 oder Artikel 54 Absatz 2 die zuständige Bundesoberbehörde nicht oder nicht rechtzeitig unterrichtet,
2. contrary to Article 37(4) first subparagraph sentence 1 in conjunction with sentence 2, second subparagraph or third subparagraph, contrary to Article 37(4) fourth subparagraph or paragraph 8 or Article 43(1), failing to submit a document referred to therein, or failing to submit it correctly, completely or in good time,
2. entgegen Artikel 37 Absatz 4 Unterabsatz 1 Satz 1 in Verbindung mit Satz 2, Unterabsatz 2 oder Unterabsatz 3, entgegen Artikel 37 Absatz 4 Unterabsatz 4 oder Absatz 8 oder Artikel 43 Absatz 1 ein dort genanntes Dokument nicht, nicht richtig, nicht vollständig oder nicht rechtzeitig übermittelt,
3. contrary to Article 37(6), failing to notify the competent higher federal authority, or failing to do so in good time,
3. entgegen Artikel 37 Absatz 6 die zuständige Bundesoberbehörde nicht oder nicht rechtzeitig in Kenntnis setzt,
4. contrary to Article 38(1), failing to make a notification, or failing to make it in good time, or
4. entgegen Artikel 38 Absatz 1 eine Mitteilung nicht oder nicht rechtzeitig macht oder
a) Article 41(1) or (2) first subparagraph sentence 2 in conjunction with the second subparagraph sentence 1, or contrary to Article 41(4), or
a) Artikel 41 Absatz 1 oder 2 Unterabsatz 1 Satz 2 in Verbindung mit Unterabsatz 2 Satz 1 oder entgegen Artikel 41 Absatz 4 oder
b) Article 42(1) in conjunction with paragraph 2 sentence 1, contrary to Article 52(1) or Article 53(1)
b) Artikel 42 Absatz 1 in Verbindung mit Absatz 2 Satz 1, entgegen Artikel 52 Absatz 1 oder Artikel 53 Absatz 1
failing to make a report, or failing to make it correctly, completely or in good time.
eine Meldung nicht, nicht richtig, nicht vollständig oder nicht rechtzeitig macht.
(2e) An administrative offence is committed by anyone who infringes Commission Delegated Regulation (EU) 2016/161 of 2 October 2015 supplementing Directive 2001/83/EC of the European Parliament and of the Council by laying down detailed rules for the safety features appearing on the packaging of medicinal products for human use (OJ L 32, 9.2.2016, p. 1) by, intentionally or negligently,
(2e) Ordnungswidrig handelt, wer gegen die Delegierte Verordnung (EU) 2016/161 der Kommission vom 2. Oktober 2015 zur Ergänzung der Richtlinie 2001/83/EG des Europäischen Parlaments und des Rates durch die Festlegung genauer Bestimmungen über die Sicherheitsmerkmale auf der Verpackung von Humanarzneimitteln (ABl. L 32 vom 9.2.2016, S. 1) verstößt, indem er vorsätzlich oder fahrlässig
1. contrary to Article 18, placing on the market a product referred to therein, or failing to provide information, or failing to provide it in good time,
1. entgegen Artikel 18 ein dort genanntes Produkt in den Verkehr bringt oder eine Information nicht oder nicht rechtzeitig gibt,
2. contrary to Article 24 sentence 1, supplying or exporting a product referred to therein,
2. entgegen Artikel 24 Satz 1 ein dort genanntes Produkt abgibt oder ausführt,
3. contrary to Article 24 sentence 2, failing to provide information, or failing to provide it in good time,
3. entgegen Artikel 24 Satz 2 eine Information nicht oder nicht rechtzeitig gibt,
4. contrary to Article 30, supplying a medicinal product, or failing to provide information, or failing to provide it in good time, or
4. entgegen Artikel 30 ein Arzneimittel abgibt oder eine Information nicht oder nicht rechtzeitig gibt oder
5. contrary to Article 37 point (d), failing to ensure that a competent authority, the European Medicines Agency or the Commission is alerted.
5. entgegen Artikel 37 Buchstabe d nicht für die Warnung einer zuständigen Behörde, der Europäischen Arzneimittel-Agentur oder der Kommission sorgt.
(3) The administrative offence may be punished by an administrative fine of up to EUR 25,000.
