A penalty of imprisonment not exceeding one year or a criminal fine shall be imposed on anyone who

1. contrary to section 4b(3) sentence 1, supplies a medicinal product,
1. entgegen § 4b Absatz 3 Satz 1 ein Arzneimittel abgibt,
2. contrary to section 6(1) in conjunction with a statutory ordinance under section 6(2), in each case also in conjunction with a statutory ordinance under section 6(3), manufactures a medicinal product,
2. entgegen § 6 Absatz 1 in Verbindung mit einer Rechtsverordnung nach § 6 Absatz 2, jeweils auch in Verbindung mit einer Rechtsverordnung nach § 6 Absatz 3, ein Arzneimittel herstellt,
3. contrary to section 8(1) item 2, also in conjunction with section 73a, manufactures or places on the market medicinal products or active substances,
3. entgegen § 8 Abs. 1 Nr. 2, auch in Verbindung mit § 73a, Arzneimittel oder Wirkstoffe herstellt oder in den Verkehr bringt,
4. without an authorisation under section 13(1) sentence 1 or section 72(1) sentence 1, manufactures or imports a medicinal product, an active substance or a substance referred to therein,
4. ohne Erlaubnis nach § 13 Absatz 1 Satz 1 oder § 72 Absatz 1 Satz 1 ein Arzneimittel, einen Wirkstoff oder einen dort genannten Stoff herstellt oder einführt,
4a. without an authorisation under section 20b(1) sentence 1 or subsection (2) sentence 7, procures tissue or carries out laboratory testing, or, without an authorisation under section 20c(1) sentence 1, treats or processes, preserves, tests, stores or places on the market tissue or tissue preparations,
4a. ohne Erlaubnis nach § 20b Abs. 1 Satz 1 oder Abs. 2 Satz 7 Gewebe gewinnt oder Laboruntersuchungen durchführt oder ohne Erlaubnis nach § 20c Abs. 1 Satz 1 Gewebe oder Gewebezubereitungen be- oder verarbeitet, konserviert, prüft, lagert oder in den Verkehr bringt,
5. contrary to section 21(1) sentence 1, also in conjunction with a statutory ordinance under section 35(1) item 2, places on the market a finished medicinal product or a medicinal product,
5. entgegen § 21 Absatz 1 Satz 1, auch in Verbindung mit einer Rechtsverordnung nach § 35 Absatz 1 Nummer 2, ein Fertigarzneimittel oder ein Arzneimittel in den Verkehr bringt,
5a. without an approval under section 21a(1) sentence 1, places tissue preparations on the market,
5a. ohne Genehmigung nach § 21a Abs. 1 Satz 1 Gewebezubereitungen in den Verkehr bringt,
5b. without a certificate under section 21a(9) sentence 1, brings a tissue preparation into Germany for the first time,
5b. ohne Bescheinigung nach § 21a Absatz 9 Satz 1 eine Gewebezubereitung erstmalig verbringt,
6. does not provide completely or correctly a particular required under section 22(1) items 3, 5 to 9, 11, 12, 14 or 15, subsection (3b) or (3c) sentence 1, or does not submit completely or submits with incorrect content a document required under section 22(2) or (3), in each case also in conjunction with section 38(2) sentence 1, or a document demanded by an enforceable order under section 28(3), (3a), (3b) or (3c) sentence 1 item 2,
6. eine nach § 22 Abs. 1 Nr. 3, 5 bis 9, 11, 12, 14 oder 15, Abs. 3b oder 3c Satz 1 erforderliche Angabe nicht vollständig oder nicht richtig macht oder eine nach § 22 Absatz 2 oder 3, jeweils auch in Verbindung mit § 38 Absatz 2 Satz 1, erforderliche Unterlage oder durch vollziehbare Anordnung nach § 28 Absatz 3, 3a, 3b oder Absatz 3c Satz 1 Nummer 2 geforderte Unterlage nicht vollständig oder mit nicht richtigem Inhalt vorlegt,
7. contrary to section 30(4) sentence 1 item 1, also in conjunction with a statutory ordinance under section 35(1) item 2, places a medicinal product on the market,
7. entgegen § 30 Abs. 4 Satz 1 Nr. 1, auch in Verbindung mit einer Rechtsverordnung nach § 35 Abs. 1 Nr. 2, ein Arzneimittel in den Verkehr bringt,
8. contrary to section 32(1) sentence 1, also in conjunction with a statutory ordinance under section 35(1) item 3, places a batch on the market without release,
8. entgegen § 32 Abs. 1 Satz 1, auch in Verbindung mit einer Rechtsverordnung nach § 35 Abs. 1 Nr. 3, eine Charge ohne Freigabe in den Verkehr bringt,
9. contrary to section 38(1) sentence 1 or section 39a sentence 1, places finished medicinal products on the market as homeopathic or as traditional herbal medicinal products without registration,
9. entgegen § 38 Abs. 1 Satz 1 oder § 39a Satz 1 Fertigarzneimittel als homöopathische oder als traditionelle pflanzliche Arzneimittel ohne Registrierung in den Verkehr bringt,
10. contrary to section 40(1), commences the clinical trial,
10. entgegen § 40 Absatz 1 die klinische Prüfung beginnt,
11. contrary to section 40a sentence 1 item 2 or item 3, also in conjunction with sentence 2, contrary to section 40a sentence 1 item 4 point (a) or item 5, or contrary to section 40b(3), subsection (4) sentence 1 item 1, sentence 2, sentence 3 or sentence 9, or subsection (5), conducts a clinical trial,
11. entgegen § 40a Satz 1 Nummer 2 oder Nummer 3, auch in Verbindung mit Satz 2, entgegen § 40a Satz 1 Nummer 4 Buchstabe a oder Nummer 5 oder § 40b Absatz 3, Absatz 4 Satz 1 Nummer 1, Satz 2, Satz 3 oder Satz 9 oder Absatz 5 eine klinische Prüfung durchführt,
12. contrary to section 47a(1) sentence 1, supplies a medicinal product referred to therein without a prescription, where the act is not punishable under section 95(1) item 5a,
12. entgegen § 47a Abs. 1 Satz 1 ein dort bezeichnetes Arzneimittel ohne Verschreibung abgibt, wenn die Tat nicht nach § 95 Abs. 1 Nr. 5a mit Strafe bedroht ist,
13. contrary to section 48(1) sentence 1 item 1 in conjunction with a statutory ordinance under section 48(2) item 1, 2 or item 7, or contrary to section 48(1) sentence 1 item 2, also in conjunction with a statutory ordinance under section 48(2) sentence 1 item 1, supplies medicinal products,
13. entgegen § 48 Abs. 1 Satz 1 Nr. 1 in Verbindung mit einer Rechtsverordnung nach § 48 Abs. 2 Nr. 1, 2 oder Nummer 7 oder entgegen § 48 Absatz 1 Satz 1 Nummer 2, auch in Verbindung mit einer Rechtsverordnung nach § 48 Absatz 2 Satz 1 Nummer 1, Arzneimittel abgibt,
14. engages in wholesale distribution without an authorisation under section 52a(1) sentence 1,
14. ohne Erlaubnis nach § 52a Abs. 1 Satz 1 Großhandel betreibt,
14a. contrary to section 52c(2) sentence 1, takes up an activity as a broker of medicinal products,
14a. entgegen § 52c Absatz 2 Satz 1 eine Tätigkeit als Arzneimittelvermittler aufnimmt,
18b. without an authorisation under section 72(4) sentence 2, section 72b(1) sentence 3 or section 72c(1) sentence 2, also in conjunction with section 72c(4) sentence 1, imports haematopoietic stem cells, stem cell preparations, tissue or tissue preparations referred to therein,
18b. ohne Erlaubnis nach § 72 Absatz 4 Satz 2, § 72b Absatz 1 Satz 3 oder § 72c Absatz 1 Satz 2, auch in Verbindung mit § 72c Absatz 4 Satz 1, dort genannte hämatopoetische Stammzellen, Stammzellzubereitungen, Gewebe oder Gewebezubereitungen einführt,
18c. contrary to section 72a(1) sentence 1, also in conjunction with subsection (1b) or subsection (1d), or contrary to section 72a(1c), imports a medicinal product, an active substance or another substance referred to in the said subsections,
18c. entgegen § 72a Absatz 1 Satz 1, auch in Verbindung mit Absatz 1b oder Absatz 1d, oder entgegen § 72a Absatz 1c ein Arzneimittel, einen Wirkstoff oder einen in den genannten Absätzen anderen Stoff einführt,
18d. contrary to section 72b(2) sentence 1, imports tissue or tissue preparations,
18d. entgegen § 72b Abs. 2 Satz 1 Gewebe oder Gewebezubereitungen einführt,
18e. contrary to section 73(1b) sentence 1, brings a falsified medicinal product or a falsified active substance into the territory in which this Act applies,
18e. entgegen § 73 Absatz 1b Satz 1 ein gefälschtes Arzneimittel oder einen gefälschten Wirkstoff in den Geltungsbereich dieses Gesetzes verbringt,
19. places a medicinal product on the market although the liability insurance or the indemnity or guarantee undertaking required under section 94 does not exist or no longer exists,
19. ein Arzneimittel in den Verkehr bringt, obwohl die nach § 94 erforderliche Haftpflichtversicherung oder Freistellungs- oder Gewährleistungsverpflichtung nicht oder nicht mehr besteht,
20. contrary to Article 6(1) sentence 1 of Regulation (EC) No 726/2004 of the European Parliament and of the Council of 31 March 2004 laying down Union procedures for the authorisation and supervision of medicinal products for human use and establishing a European Medicines Agency (OJ L 136, 30.4.2004, p. 1), as last amended by Regulation (EU) 2019/5 (OJ L 4, 7.1.2019, p. 24), in conjunction with Article 8(3) first subparagraph point (c), point (ca) sentence 1, point (d), (e), (h) to (iaa) or point (ib) of Directive 2001/83/EC of the European Parliament and of the Council of 6 November 2001 on the Community code relating to medicinal products for human use (OJ L 311, 28.11.2001, p. 67; L 239, 12.8.2014, p. 81), as last amended by Regulation (EU) 2019/1243 (OJ L 198, 25.7.2019, p. 241), does not attach a particular or a document correctly or completely, or
20. entgegen Artikel 6 Absatz 1 Satz 1 der Verordnung (EG) Nr. 726/2004 des Europäischen Parlaments und des Rates vom 31. März 2004 zur Festlegung der Verfahren der Union für die Genehmigung und Überwachung von Humanarzneimitteln und zur Errichtung einer Europäischen Arzneimittel-Agentur (ABl. L 136 vom 30.4.2004, S. 1), die zuletzt durch die Verordnung (EU) Nr. 2019/5 (ABl. L 4 vom 7.1.2019, S. 24) geändert worden ist, in Verbindung mit Artikel 8 Absatz 3 Unterabsatz 1 Buchstabe c, ca Satz 1, Buchstabe d, e, h bis iaa oder Buchstabe ib der Richtlinie 2001/83/EG des Europäischen Parlaments und des Rates vom 6. November 2001 zur Schaffung eines Gemeinschaftskodexes für Humanarzneimittel (ABl. L 311 vom 28.11.2001, S. 67; L 239 vom 12.8.2014, S. 81), die zuletzt durch die Verordnung (EU) 2019/1243 (ABl. L 198 vom 25.7.2019, S. 241) geändert worden ist, eine Angabe oder eine Unterlage nicht richtig oder nicht vollständig beifügt oder
21. infringes Regulation (EU) No 536/2014 of the European Parliament and of the Council of 16 April 2014 on clinical trials on medicinal products for human use, and repealing Directive 2001/20/EC (OJ L 158, 27.5.2014, p. 1) by
21. gegen die Verordnung (EU) Nr. 536/2014 des Europäischen Parlaments und des Rates vom 16. April 2014 über klinische Prüfungen mit Humanarzneimitteln und zur Aufhebung der Richtlinie 2001/20/EG (ABl. L 158 vom 27.5.2014, S. 1) verstößt, indem er
a) contrary to Article 5(1) first subparagraph in conjunction with Article 25(1) sentence 1 point (c) or Annex I point 41 sentence 1, not submitting an application dossier correctly or completely, or
a) entgegen Artikel 5 Absatz 1 Unterabsatz 1 in Verbindung mit Artikel 25 Absatz 1 Satz 1 Buchstabe c oder Anhang I Nummer 41 Satz 1 ein Antragsdossier nicht richtig oder nicht vollständig übermittelt oder
b) contrary to Article 28(1) point (a), (c) or point (e) in conjunction with Article 29(1) sentence 1 or sentence 3, or contrary to Article 32(1) or Article 33, conducting a clinical trial.
b) entgegen Artikel 28 Absatz 1 Buchstabe a, c oder Buchstabe e in Verbindung mit Artikel 29 Absatz 1 Satz 1 oder Satz 3, entgegen Artikel 32 Absatz 1 oder Artikel 33 eine klinische Prüfung durchführt.
