(1) Medicinal products which are subject to the requirement of a marketing authorisation or of an authorisation under section 21a or of registration may be brought into the territory to which this Act applies only if they have been granted a marketing authorisation for that territory, have been authorised under section 21a, have been registered or are exempt from marketing authorisation or registration, and
(1) Arzneimittel, die der Pflicht zur Zulassung oder Genehmigung nach § 21a oder zur Registrierung unterliegen, dürfen in den Geltungsbereich dieses Gesetzes nur verbracht werden, wenn sie zum Verkehr im Geltungsbereich dieses Gesetzes zugelassen, nach § 21a genehmigt, registriert oder von der Zulassung oder der Registrierung freigestellt sind und
1. in the case of transfer from a Member State of the European Union or another Contracting State to the Agreement on the European Economic Area, the recipient is a pharmaceutical company, a wholesaler or a veterinarian, operates a pharmacy or, as the operator of a hospital, is supplied with medicinal products under the Pharmacies Act (Apothekengesetz) by a pharmacy of a Member State of the European Union or of another Contracting State to the Agreement on the European Economic Area,
1. der Empfänger in dem Fall des Verbringens aus einem Mitgliedstaat der Europäischen Union oder einem anderen Vertragsstaat des Abkommens über den Europäischen Wirtschaftsraum pharmazeutischer Unternehmer, Großhändler oder Tierarzt ist, eine Apotheke betreibt oder als Träger eines Krankenhauses nach dem Apothekengesetz von einer Apotheke eines Mitgliedstaates der Europäischen Union oder eines anderen Vertragsstaates des Abkommens über den Europäischen Wirtschaftsraum mit Arzneimitteln versorgt wird,
1a. in the case of dispatch to the end consumer, the medicinal product is dispatched, in accordance with the German provisions on mail order or electronic commerce, by a pharmacy of a Member State of the European Union or of another Contracting State to the Agreement on the European Economic Area which is authorised to conduct mail-order trade under its national law, insofar as that law corresponds to German pharmacy law as regards the provisions on mail-order trade, or under the German Pharmacies Act, or
1a. im Falle des Versandes an den Endverbraucher das Arzneimittel von einer Apotheke eines Mitgliedstaates der Europäischen Union oder eines anderen Vertragsstaates des Abkommens über den Europäischen Wirtschaftsraum, welche für den Versandhandel nach ihrem nationalen Recht, soweit es dem deutschen Apothekenrecht im Hinblick auf die Vorschriften zum Versandhandel entspricht, oder nach dem deutschen Apothekengesetz befugt ist, entsprechend den deutschen Vorschriften zum Versandhandel oder zum elektronischen Handel versandt wird oder
2. in the case of transfer from a state which is not a Member State of the European Union or another Contracting State to the Agreement on the European Economic Area, the recipient holds an authorisation under section 72, section 72b or section 72c.
2. der Empfänger in dem Fall des Verbringens aus einem Staat, der nicht Mitgliedstaat der Europäischen Union oder ein anderer Vertragsstaat des Abkommens über den Europäischen Wirtschaftsraum ist, eine Erlaubnis nach § 72, § 72b oder § 72c besitzt.
The medicinal products referred to in section 47a(1) sentence 1 may be brought into the territory to which this Act applies only if the recipient is one of the establishments referred to therein.
Die in § 47a Abs. 1 Satz 1 genannten Arzneimittel dürfen nur in den Geltungsbereich dieses Gesetzes verbracht werden, wenn der Empfänger eine der dort genannten Einrichtungen ist.
The Federal Ministry shall publish at regular intervals an updated overview of the Member States of the European Union and the other Contracting States to the European Economic Area in which safety standards comparable to those of German law apply to mail-order trade and electronic commerce in medicinal products.
Das Bundesministerium veröffentlicht in regelmäßigen Abständen eine aktualisierte Übersicht über die Mitgliedstaaten der Europäischen Union und die anderen Vertragsstaaten des Europäischen Wirtschaftsraums, in denen für den Versandhandel und den elektronischen Handel mit Arzneimitteln dem deutschen Recht vergleichbare Sicherheitsstandards bestehen.
(1b) It is prohibited to bring falsified medicinal products or falsified active substances into the territory to which this Act applies.
(1b) Es ist verboten, gefälschte Arzneimittel oder gefälschte Wirkstoffe in den Geltungsbereich dieses Gesetzes zu verbringen.
The competent authority may permit exemptions in justified cases, in particular for the purposes of examination or criminal prosecution.
Die zuständige Behörde kann in begründeten Fällen, insbesondere zum Zwecke der Untersuchung oder Strafverfolgung, Ausnahmen zulassen.
(2) Subsection (1) sentence 1 shall not apply to medicinal products which
(2) Absatz 1 Satz 1 gilt nicht für Arzneimittel, die
2. are intended for the own use of research and scientific institutions and are needed for scientific purposes, or which are to be used by the sponsor of a clinical trial or a person commissioned by the sponsor as auxiliary medicinal products in accordance with Article 59 of Regulation (EU) No 536/2014 for a clinical trial in accordance with the information in the protocol,
2. für den Eigenbedarf der Einrichtungen von Forschung und Wissenschaft bestimmt sind und zu wissenschaftlichen Zwecken benötigt werden oder die vom Sponsor einer klinischen Prüfung oder einer von diesem beauftragten Person als Hilfspräparate gemäß Artikel 59 der Verordnung (EU) Nr. 536/2014 für eine klinische Prüfung gemäß den Angaben des Prüfplans verwendet werden sollen,
2a. are needed in small quantities by a pharmaceutical company, an establishment holding an authorisation under section 13 or a testing laboratory as demonstration samples or for analytical purposes,
2a. in geringen Mengen von einem pharmazeutischen Unternehmer, einem Betrieb mit einer Erlaubnis nach § 13 oder von einem Prüflabor als Anschauungsmuster oder zu analytischen Zwecken benötigt werden,
2b. are brought in from a Member State of the European Union or another Contracting State to the Agreement on the European Economic Area by an establishment holding an authorisation under section 13, either for the purpose of processing and subsequent onward transfer or return, or for the purpose of manufacturing a medicinal product that has been granted a marketing authorisation or an authorisation for placing on the market within the territory,
2b. von einem Betrieb mit Erlaubnis nach § 13 entweder zum Zweck der Be- oder Verarbeitung und des anschließenden Weiter- oder Zurückverbringens oder zum Zweck der Herstellung eines zum Inverkehrbringen im Geltungsbereich zugelassenen oder genehmigten Arzneimittels aus einem Mitgliedstaat der Europäischen Union oder einem anderen Vertragsstaat des Abkommens über den Europäischen Wirtschaftsraum verbracht werden,
3. are transported through the territory to which this Act applies under customs supervision, or are placed under a customs warehousing procedure or in a free zone of control type II, or are brought into a free zone of control type I or a free warehouse,
3. unter zollamtlicher Überwachung durch den Geltungsbereich des Gesetzes befördert oder in ein Zolllagerverfahren oder eine Freizone des Kontrolltyps II übergeführt oder in eine Freizone des Kontrolltyps I oder ein Freilager verbracht werden,
3a. have been granted a marketing authorisation in a Member State of the European Union or another Contracting State to the Agreement on the European Economic Area and are re-exported, transferred onwards or returned, including after interim storage with a pharmaceutical company, manufacturer or wholesaler,
3a. in einem Mitgliedstaat der Europäischen Union oder einem anderen Vertragsstaat des Abkommens über den Europäischen Wirtschaftsraum zugelassen sind und auch nach Zwischenlagerung bei einem pharmazeutischen Unternehmer, Hersteller oder Großhändler wiederausgeführt oder weiterverbracht oder zurückverbracht werden,
4. are brought in for the head of a foreign state or his or her entourage and are intended for use during his or her stay in the territory to which this Act applies,
4. für das Oberhaupt eines auswärtigen Staates oder seine Begleitung eingebracht werden und zum Gebrauch während seines Aufenthalts im Geltungsbereich dieses Gesetzes bestimmt sind,
5. are intended for personal use or consumption by the members of a diplomatic mission or consular post in the territory to which this Act applies or by officials of international organisations having their seat there, and by their family members, insofar as these persons are neither German nationals nor permanently resident in the territory to which this Act applies,
5. zum persönlichen Gebrauch oder Verbrauch durch die Mitglieder einer diplomatischen Mission oder konsularischen Vertretung im Geltungsbereich dieses Gesetzes oder Beamte internationaler Organisationen, die dort ihren Sitz haben, sowie deren Familienangehörige bestimmt sind, soweit diese Personen weder Deutsche noch im Geltungsbereich dieses Gesetzes ständig ansässig sind,
6. are brought in upon entry into the territory to which this Act applies in a quantity corresponding to normal personal requirements,
6. bei der Einreise in den Geltungsbereich dieses Gesetzes in einer dem üblichen persönlichen Bedarf entsprechenden Menge eingebracht werden,
6a. may be placed on the market in the country of origin and are obtained from a Member State of the European Union or another Contracting State to the Agreement on the European Economic Area in a quantity corresponding to normal personal requirements without commercial or professional intermediation,
6a. im Herkunftsland in Verkehr gebracht werden dürfen und ohne gewerbs- oder berufsmäßige Vermittlung in einer dem üblichen persönlichen Bedarf entsprechenden Menge aus einem Mitgliedstaat der Europäischen Union oder einem anderen Vertragsstaat des Abkommens über den Europäischen Wirtschaftsraum bezogen werden,
7. are carried on means of transport and are intended exclusively for use or consumption by the persons carried by those means of transport,
7. in Verkehrsmitteln mitgeführt werden und ausschließlich zum Gebrauch oder Verbrauch der durch diese Verkehrsmittel beförderten Personen bestimmt sind,
8. are intended for use or consumption on seagoing vessels and are consumed on board those vessels,
8. zum Gebrauch oder Verbrauch auf Seeschiffen bestimmt sind und an Bord der Schiffe verbraucht werden,
9. are sent as samples to the competent higher federal authority for the purposes of marketing authorisation or official batch control,
9. als Proben der zuständigen Bundesoberbehörde zum Zwecke der Zulassung oder der staatlichen Chargenprüfung übersandt werden,
9a. are needed by the competent authority as samples for analytical purposes in the context of the supervision of medicinal products,
9a. als Proben zu analytischen Zwecken von der zuständigen Behörde im Rahmen der Arzneimittelüberwachung benötigt werden,
10. are obtained by federal or Land authorities in intergovernmental exchanges.
10. durch Bundes- oder Landesbehörden im zwischenstaatlichen Verkehr bezogen werden.
(3) By way of derogation from subsection (1) sentence 1, finished medicinal products which have not been granted a marketing authorisation or been registered for the territory to which this Act applies, or which are not exempt from marketing authorisation or registration, may be brought into the territory to which this Act applies if
(3) Abweichend von Absatz 1 Satz 1 dürfen Fertigarzneimittel, die nicht zum Verkehr im Geltungsbereich dieses Gesetzes zugelassen, registriert oder von der Zulassung oder Registrierung freigestellt sind, in den Geltungsbereich dieses Gesetzes verbracht werden, wenn
1. they are ordered by pharmacies in small quantities on the basis of an existing order from individual persons and are supplied by those pharmacies within the scope of the existing pharmacy operating licence,
1. sie von Apotheken auf vorliegende Bestellung einzelner Personen in geringer Menge bestellt und von diesen Apotheken im Rahmen der bestehenden Apothekenbetriebserlaubnis abgegeben werden,
2. they may lawfully be placed on the market in the state from which they are brought into the territory to which this Act applies, and
2. sie in dem Staat rechtmäßig in Verkehr gebracht werden dürfen, aus dem sie in den Geltungsbereich dieses Gesetzes verbracht werden, und
3. medicinal products that are identical in terms of active substance and comparable in terms of strength are not available for the indication concerned in the territory to which this Act applies,
3. für sie hinsichtlich des Wirkstoffs identische und hinsichtlich der Wirkstärke vergleichbare Arzneimittel für das betreffende Anwendungsgebiet im Geltungsbereich des Gesetzes nicht zur Verfügung stehen
or if they are ordered, in a reasonable quantity necessary to ensure the proper supply of the hospital's patients, for the purpose of temporary stockpiling, by a hospital pharmacy or hospital-supplying pharmacy subject to the conditions of item 2 and are supplied by that hospital pharmacy or hospital-supplying pharmacy, subject to the conditions of item 3 and within the scope of the existing pharmacy operating licence, for the purpose of administration to a patient of the hospital under the direct personal responsibility of a medical practitioner, or if they must be kept in stock for emergencies or procured at short notice under the provisions of pharmacy law or the requirements of the statutory employers' liability insurance associations (Berufsgenossenschaften) or within the remit of the Federal Ministry of Defence, where medicinal products for the indication concerned are not available in the territory to which this Act applies.
oder wenn sie in angemessenem Umfang, der zur Sicherstellung einer ordnungsgemäßen Versorgung der Patienten des Krankenhauses notwendig ist, zum Zwecke der vorübergehenden Bevorratung von einer Krankenhausapotheke oder krankenhausversorgenden Apotheke unter den Voraussetzungen der Nummer 2 bestellt und von dieser Krankenhausapotheke oder krankenhausversorgenden Apotheke unter den Voraussetzungen der Nummer 3 im Rahmen der bestehenden Apothekenbetriebserlaubnis zum Zwecke der Verabreichung an einen Patienten des Krankenhauses unter der unmittelbaren persönlichen Verantwortung einer ärztlichen Person abgegeben werden oder sie nach den apothekenrechtlichen Vorschriften oder berufsgenossenschaftlichen Vorgaben oder im Geschäftsbereich des Bundesministeriums der Verteidigung für Notfälle vorrätig zu halten sind oder kurzfristig beschafft werden müssen, wenn im Geltungsbereich dieses Gesetzes Arzneimittel für das betreffende Anwendungsgebiet nicht zur Verfügung stehen.
The order under sentence 1 item 1 and the supply of the medicinal products brought into the territory to which this Act applies under sentence 1 shall require a medical or dental prescription in the case of medicinal products which have not been obtained from Member States of the European Union or other Contracting States to the Agreement on the European Economic Area.

Further details shall be governed by the Pharmacy Operations Ordinance (Apothekenbetriebsordnung).

(3a) By way of derogation from subsection (1) sentence 1, tissue preparations which have not been authorised under section 21a(1) for the territory to which this Act applies, and haematopoietic stem cell preparations from peripheral blood or from umbilical cord blood which have not been granted a marketing authorisation under section 21 or been authorised under section 21a(1) for the territory to which this Act applies, may be brought into the territory to which this Act applies if
(3a) Abweichend von Absatz 1 Satz 1 dürfen Gewebezubereitungen, die nicht zum Verkehr im Geltungsbereich dieses Gesetzes nach § 21a Absatz 1 genehmigt sind, und hämatopoetische Stammzellzubereitungen aus dem peripheren Blut oder aus dem Nabelschnurblut, die nicht zum Verkehr im Geltungsbereich dieses Gesetzes nach § 21 zugelassen oder nach § 21a Absatz 1 genehmigt sind, in den Geltungsbereich dieses Gesetzes verbracht werden, wenn
1. they are ordered in small quantities, on the basis of an existing order from an individual person, by an establishment holding an authorisation under sections 13, 20c, 72, 72b or under section 72c for activities involving these tissue preparations or haematopoietic stem cell preparations from peripheral blood or from umbilical cord blood, and are supplied by that establishment to the administering hospital or the administering physician,
1. sie von einer Einrichtung, die Inhaber einer Erlaubnis nach den §§ 13, 20c, 72, 72b oder nach § 72c für Tätigkeiten mit diesen Gewebezubereitungen oder hämatopoetischen Stammzellzubereitungen aus dem peripheren Blut oder aus dem Nabelschnurblut ist, auf vorliegende Bestellung einer einzelnen Person in geringer Menge bestellt werden und von dieser Einrichtung an das anwendende Krankenhaus oder den anwendenden Arzt abgegeben werden,
2. they may lawfully be placed on the market in the state from which they are brought into the territory to which this Act applies,
2. sie in dem Staat, aus dem sie in den Geltungsbereich dieses Gesetzes verbracht werden, rechtmäßig in Verkehr gebracht werden dürfen,
3. medicinal products comparable in terms of functionality are not available for the indication concerned in the territory to which this Act applies, and
3. für sie hinsichtlich der Funktionalität vergleichbare Arzneimittel für das betreffende Anwendungsgebiet im Geltungsbereich dieses Gesetzes nicht zur Verfügung stehen und
4. in the case of transfer from a state which is neither a Member State of the European Union nor another Contracting State to the Agreement on the European Economic Area, the order and supply take place on the basis of a medical prescription.
4. im Fall des Verbringens aus einem Staat, der weder Mitgliedstaat der Europäischen Union noch anderer Vertragsstaat des Abkommens über den Europäischen Wirtschaftsraum ist, die Bestellung und Abgabe auf Grund einer ärztlichen Verschreibung erfolgt.
(4) The provisions of this Act shall not apply to medicinal products under subsection (2) items 4 and 5.
(4) Auf Arzneimittel nach Absatz 2 Nummer 4 und 5 finden die Vorschriften dieses Gesetzes keine Anwendung.
The provisions of this Act shall not apply to medicinal products under subsection (2) items 2 and 3 and 6 to 10 and subsections (3) and (3a), with the exception of sections 5, 8, 13 to 20a, 52a, 64 to 69 and 78, and furthermore, in the cases of subsection (2) item 2 and subsections (3) and (3a), also with the exception of sections 48, 95(1) items 1 and 3a, (2) to (4), section 96 items 3, 10 and 11 and section 97(1), (2) item 1 and (3), and furthermore, in the cases of subsection (3a), also with the exception of sections 20b to 20d, 72, 72b, 72c, 96 items 18b and 18d and section 97(2) item 7a.
Auf Arzneimittel nach Absatz 2 Nummer 2 und 3 und 6 bis 10 und den Absätzen 3 und 3a finden die Vorschriften dieses Gesetzes keine Anwendung mit Ausnahme der §§ 5, 8, 13 bis 20a, 52a, 64 bis 69 und 78, ferner in den Fällen des Absatzes 2 Nummer 2 und der Absätze 3 und 3a auch mit Ausnahme der §§ 48, 95 Absatz 1 Nummer 1 und 3a, Absatz 2 bis 4, § 96 Nummer 3, 10 und 11 sowie § 97 Absatz 1, 2 Nummer 1 sowie Absatz 3, ferner in den Fällen des Absatzes 3a auch mit Ausnahme der §§ 20b bis 20d, 72, 72b, 72c, 96 Nummer 18b und 18d und des § 97 Absatz 2 Nummer 7a.
(5) When practising their profession in local border traffic within the meaning of Regulation (EC) No 1931/2006 of the European Parliament and of the Council of 20 December 2006 laying down rules on local border traffic at the external land borders of the Member States and amending the provisions of the Schengen Convention (OJ L 405, 30.12.2006, p. 1; OJ L 29, 3.2.2007, p. 3), as amended by Regulation (EU) No 1342/2011 (OJ L 347, 30.12.2011, p. 41), physicians and veterinarians may carry with them only medicinal products which have been granted a marketing authorisation or been registered for the territory to which this Act applies or which are exempt from marketing authorisation or registration.
(5) Ärzte und Tierärzte dürfen bei der Ausübung ihres Berufes im kleinen Grenzverkehr im Sinne der Verordnung (EG) Nr. 1931/2006 des Europäischen Parlaments und des Rates vom 20. Dezember 2006 zur Festlegung von Vorschriften über den kleinen Grenzverkehr an den Landaußengrenzen der Mitgliedstaaten sowie zur Änderung der Bestimmungen des Übereinkommens von Schengen (ABl. L 405 vom 30.12.2006, S. 1; L 29 vom 3.2.2007, S. 3), die durch die Verordnung (EU) Nr. 1342/2011 (ABl. L 347 vom 30.12.2011, S. 41) geändert worden ist, nur Arzneimittel mitführen, die zum Verkehr im Geltungsbereich dieses Gesetzes zugelassen oder registriert sind oder von der Zulassung oder Registrierung freigestellt sind.
By way of derogation from subsection (1) sentence 1, physicians who provide healthcare within the meaning of Directive 2011/24/EU of the European Parliament and of the Council of 9 March 2011 on the application of patients' rights in cross-border healthcare (OJ L 88, 4.4.2011, p. 45), as amended by Directive 2013/64/EU (OJ L 353, 28.12.2013, p. 8), may carry with them, in their original packaging, medicinal products authorised at their place of establishment in small quantities, to the extent indispensable for the provision of cross-border healthcare, if and insofar as medicinal products of the same composition and for the same indications are also authorised in the territory to which this Act applies; the physician may only administer these medicinal products personally.
Abweichend von Absatz 1 Satz 1 dürfen Ärzte, die eine Gesundheitsdienstleistung im Sinne der Richtlinie 2011/24/EU des Europäischen Parlaments und des Rates vom 9. März 2011 über die Ausübung der Patientenrechte in der grenzüberschreitenden Gesundheitsversorgung (ABl. L 88 vom 4.4.2011, S. 45), die durch die Richtlinie 2013/64/EU (ABl. L 353 vom 28.12.2013, S. 8) geändert worden ist, erbringen, am Ort ihrer Niederlassung zugelassene Arzneimittel in kleinen Mengen in einem für das Erbringen der grenzüberschreitenden Gesundheitsversorgung unerlässlichen Umfang in der Originalverpackung mit sich führen, wenn und soweit Arzneimittel gleicher Zusammensetzung und für gleiche Anwendungsgebiete auch im Geltungsbereich dieses Gesetzes zugelassen sind; der Arzt darf diese Arzneimittel nur selbst anwenden.
(6) Customs clearance for release for free circulation in the case of subsection (1) sentence 1 item 2 shall require the presentation of a certificate from the authority competent for the recipient in which the medicinal products are identified and which confirms that the conditions under subsection (1) are met.
(6) Für die zollamtliche Abfertigung zum freien Verkehr im Falle des Absatzes 1 Satz 1 Nr. 2 ist die Vorlage einer Bescheinigung der für den Empfänger zuständigen Behörde erforderlich, in der die Arzneimittel bezeichnet sind und bestätigt wird, dass die Voraussetzungen nach Absatz 1 erfüllt sind.
The customs office shall send the certificate, at the expense of the party concerned in the customs procedure, to the authority which issued that certificate.
Die Zolldienststelle übersendet auf Kosten des Zollbeteiligten die Bescheinigung der Behörde, die diese Bescheinigung ausgestellt hat.
(7) In the case of subsection (1) sentence 1 item 1, a recipient who is a wholesaler or operates a pharmacy shall provide evidence of the existence of financial security (cover) under section 94.
(7) Im Falle des Absatzes 1 Satz 1 Nummer 1 hat ein Empfänger, der Großhändler ist oder eine Apotheke betreibt, das Bestehen der Deckungsvorsorge nach § 94 nachzuweisen.
