(1) Pharmaceutical companies may supply a medicinal product authorised for the termination of pregnancy only to institutions within the meaning of section 13 of the Pregnancy Conflict Act (Schwangerschaftskonfliktgesetz) of 27 July 1992 (Federal Law Gazette I p. 1398), as amended by Article 1 of the Act of 21 August 1995 (Federal Law Gazette I p. 1050), and only on the prescription of a physician providing treatment there.
(1) Pharmazeutische Unternehmer dürfen ein Arzneimittel, das zur Vornahme eines Schwangerschaftsabbruchs zugelassen ist, nur an Einrichtungen im Sinne des § 13 des Schwangerschaftskonfliktgesetzes vom 27. Juli 1992 (BGBl. I S. 1398), geändert durch Artikel 1 des Gesetzes vom 21. August 1995 (BGBl. I S. 1050), und nur auf Verschreibung eines dort behandelnden Arztes abgeben.
Other persons shall not place the medicinal products referred to in sentence 1 on the market.
Andere Personen dürfen die in Satz 1 genannten Arzneimittel nicht in den Verkehr bringen.
(2) Pharmaceutical companies shall number consecutively the packs of the medicinal products referred to in subsection (1) sentence 1 that are intended for supply; without this marking the medicinal product shall not be supplied.
(2) Pharmazeutische Unternehmer haben die zur Abgabe bestimmten Packungen der in Absatz 1 Satz 1 genannten Arzneimittel fortlaufend zu nummerieren; ohne diese Kennzeichnung darf das Arzneimittel nicht abgegeben werden.
Pharmaceutical companies shall keep records of the supply, and the institution and the treating physician shall keep records of the receipt and administration, and these records shall be submitted to the competent authority for inspection on request.
Über die Abgabe haben pharmazeutische Unternehmer, über den Erhalt und die Anwendung haben die Einrichtung und der behandelnde Arzt Nachweise zu führen und diese Nachweise auf Verlangen der zuständigen Behörde zur Einsichtnahme vorzulegen.
(2a) Pharmaceutical companies and the institution shall store the medicinal products referred to in subsection (1) sentence 1 that are in their possession separately and shall secure them against unauthorised removal.
(2a) Pharmazeutische Unternehmer sowie die Einrichtung haben die in Absatz 1 Satz 1 genannten Arzneimittel, die sich in ihrem Besitz befinden, gesondert aufzubewahren und gegen unbefugte Entnahme zu sichern.
(3) Sections 43 and 47 shall not apply to the medicinal products referred to in subsection (1) sentence 1.
(3) Die §§ 43 und 47 finden auf die in Absatz 1 Satz 1 genannten Arzneimittel keine Anwendung.
