(1) Any person who engages in the wholesale distribution of medicinal products shall require an authorisation.
(1) Wer Großhandel mit Arzneimitteln betreibt, bedarf einer Erlaubnis.
Exempted from this authorisation requirement are the finished medicinal products referred to in section 51(1) item 2 that are released for sale outside pharmacies.
Ausgenommen von dieser Erlaubnispflicht sind die in § 51 Absatz 1 Nummer 2 genannten und für den Verkehr außerhalb von Apotheken freigegebenen Fertigarzneimittel.
1. specify the particular premises as well as the activities and the medicinal products for which the authorisation is to be granted,
1. die bestimmte Betriebsstätte sowie die Tätigkeiten und die Arzneimittel zu benennen, für die die Erlaubnis erteilt werden soll,
2. submit evidence that he or she has suitable and adequate premises, installations and equipment to ensure proper storage and proper distribution and, where intended, proper decanting, packaging and labelling of medicinal products,
2. Nachweise darüber vorzulegen, dass er über geeignete und ausreichende Räumlichkeiten, Anlagen und Einrichtungen verfügt, um eine ordnungsgemäße Lagerung und einen ordnungsgemäßen Vertrieb und, soweit vorgesehen, ein ordnungsgemäßes Umfüllen, Abpacken und Kennzeichnen von Arzneimitteln zu gewährleisten,
3. designate a responsible person who possesses the expertise required to carry out the activity, and
3. eine verantwortliche Person zu benennen, die die zur Ausübung der Tätigkeit erforderliche Sachkenntnis besitzt, und
4. enclose a declaration in which he or she undertakes in writing to comply with the rules applicable to the proper operation of a wholesale business.
4. eine Erklärung beizufügen, in der er sich schriftlich verpflichtet, die für den ordnungsgemäßen Betrieb eines Großhandels geltenden Regelungen einzuhalten.
(3) The decision on the granting of the authorisation shall be taken by the competent authority of the Land in which the premises are located or are to be located.
(3) Die Entscheidung über die Erteilung der Erlaubnis trifft die zuständige Behörde des Landes, in dem die Betriebsstätte liegt oder liegen soll.
The competent authority shall take a decision on the application for the granting of the authorisation within a period of three months.
Die zuständige Behörde hat eine Entscheidung über den Antrag auf Erteilung der Erlaubnis innerhalb einer Frist von drei Monaten zu treffen.
If the competent authority requests further information from the applicant concerning the conditions under subsection (2), the period referred to in sentence 2 shall be suspended until the required supplementary information has been received by the competent authority.
Verlangt die zuständige Behörde vom Antragsteller weitere Angaben zu den Voraussetzungen nach Absatz 2, so wird die in Satz 2 genannte Frist so lange ausgesetzt, bis die erforderlichen ergänzenden Angaben der zuständigen Behörde vorliegen.

2. facts justify the assumption that the applicant or the responsible person under subsection (2) item 3 does not possess the reliability required to carry out their activity, or
2. Tatsachen die Annahme rechtfertigen, dass der Antragsteller oder die verantwortliche Person nach Absatz 2 Nr. 3 die zur Ausübung ihrer Tätigkeit erforderliche Zuverlässigkeit nicht besitzt oder
3. the wholesaler is not in a position to ensure that the rules applicable to proper operation are complied with.
3. der Großhändler nicht in der Lage ist, zu gewährleisten, dass die für den ordnungsgemäßen Betrieb geltenden Regelungen eingehalten werden.
(5) The authorisation shall be withdrawn if it subsequently becomes known that one of the grounds for refusal under subsection (4) existed at the time it was granted.
(5) Die Erlaubnis ist zurückzunehmen, wenn nachträglich bekannt wird, dass einer der Versagungsgründe nach Absatz 4 bei der Erteilung vorgelegen hat.
The authorisation shall be revoked if the conditions for granting the authorisation are no longer met; instead of revocation, the suspension of the authorisation may also be ordered.
Die Erlaubnis ist zu widerrufen, wenn die Voraussetzungen für die Erteilung der Erlaubnis nicht mehr vorliegen; anstelle des Widerrufs kann auch das Ruhen der Erlaubnis angeordnet werden.
(6) An authorisation under section 13 or section 72 shall also include authorisation for the wholesale distribution of the medicinal products covered by the authorisation under section 13 or section 72.
(6) Eine Erlaubnis nach § 13 oder § 72 umfasst auch die Erlaubnis zum Großhandel mit den Arzneimitteln, auf die sich die Erlaubnis nach § 13 oder § 72 erstreckt.
(7) Subsections (1) to (5) shall not apply to the activities of pharmacies within the scope of normal pharmacy operations.
(7) Die Absätze 1 bis 5 gelten nicht für die Tätigkeit der Apotheken im Rahmen des üblichen Apothekenbetriebes.
(8) The holder of the authorisation shall notify the competent authority in advance of any change in the information referred to in subsection (2) and of any significant change in the wholesale activity, submitting the relevant supporting evidence.
(8) Der Inhaber der Erlaubnis hat jede Änderung der in Absatz 2 genannten Angaben sowie jede wesentliche Änderung der Großhandelstätigkeit unter Vorlage der Nachweise der zuständigen Behörde vorher anzuzeigen.
In the event of an unforeseen change of the responsible person under subsection (2) item 3, the notification shall be made without undue delay.
Bei einem unvorhergesehenen Wechsel der verantwortlichen Person nach Absatz 2 Nr. 3 hat die Anzeige unverzüglich zu erfolgen.
