(1) Any person who, as a pharmaceutical company, places finished medicinal products on the market shall appoint a person with the necessary expertise and the reliability required to carry out his or her activity to be responsible for the task of providing scientific information on the medicinal products (information officer).
(1) Wer als pharmazeutischer Unternehmer Fertigarzneimittel in den Verkehr bringt, hat eine Person mit der erforderlichen Sachkenntnis und der zur Ausübung ihrer Tätigkeit erforderlichen Zuverlässigkeit zu beauftragen, die Aufgabe der wissenschaftlichen Information über die Arzneimittel verantwortlich wahrzunehmen (Informationsbeauftragter).
The information officer shall in particular be responsible for ensuring that the prohibition in section 8(1) item 2 is observed and that the labelling, the package leaflet, the summary of product characteristics and the advertising are consistent with the content of the marketing authorisation or registration or, where the medicinal product is exempt from marketing authorisation or registration, with the content of the ordinances on exemption from marketing authorisation or from registration under section 36 or section 39(3).
Der Informationsbeauftragte ist insbesondere dafür verantwortlich, dass das Verbot des § 8 Abs. 1 Nr. 2 beachtet wird und die Kennzeichnung, die Packungsbeilage, die Fachinformation und die Werbung mit dem Inhalt der Zulassung oder der Registrierung oder, sofern das Arzneimittel von der Zulassung oder Registrierung freigestellt ist, mit den Inhalten der Verordnungen über die Freistellung von der Zulassung oder von der Registrierung nach § 36 oder § 39 Abs. 3 übereinstimmen.
Sentence 1 shall not apply to persons insofar as they do not require a manufacturing authorisation under section 13(2) item 1, 2 or 5.
Satz 1 gilt nicht für Personen, soweit sie nach § 13 Absatz 2 Nummer 1, 2 oder 5 keiner Herstellungserlaubnis bedürfen.
Persons other than those referred to in sentence 1 shall not carry out an activity as an information officer.
Andere Personen als in Satz 1 bezeichnet dürfen eine Tätigkeit als Informationsbeauftragter nicht ausüben.
(2) The information officer may at the same time be the graduated plan officer (Stufenplanbeauftragter).

(3) The pharmaceutical company shall notify the competent authority in advance of the information officer and of any change.
(3) Der pharmazeutische Unternehmer hat der zuständigen Behörde den Informationsbeauftragten und jeden Wechsel vorher mitzuteilen.
In the event of an unforeseen change of information officer, the notification shall be made without undue delay.
Bei einem unvorhergesehenen Wechsel des Informationsbeauftragten hat die Mitteilung unverzüglich zu erfolgen.
