(1) A penalty of imprisonment not exceeding three years or a criminal fine shall be imposed on anyone who

1. contrary to section 5(1), places a medicinal product on the market or administers it to others,
1. entgegen § 5 Absatz 1 ein Arzneimittel in den Verkehr bringt oder bei anderen anwendet,
2. contrary to section 6(1) in conjunction with a statutory ordinance under section 6(2), in each case also in conjunction with a statutory ordinance under section 6(3), places a medicinal product on the market or administers it to another human being,
2. entgegen § 6 Absatz 1 in Verbindung mit einer Rechtsverordnung nach § 6 Absatz 2, jeweils auch in Verbindung mit einer Rechtsverordnung nach § 6 Absatz 3, ein Arzneimittel in den Verkehr bringt oder bei einem anderen Menschen anwendet,
3. contrary to section 7(1), places on the market radioactive medicinal products or medicinal products in whose manufacture ionising radiation has been used,
3. entgegen § 7 Abs. 1 radioaktive Arzneimittel oder Arzneimittel, bei deren Herstellung ionisierende Strahlen verwendet worden sind, in den Verkehr bringt,
3a. contrary to section 8(1) item 1 or subsection (2), also in conjunction with section 73(4) or section 73a, manufactures or places on the market medicinal products or active substances or otherwise trades in them,
3a. entgegen § 8 Abs. 1 Nr. 1 oder Absatz 2, auch in Verbindung mit § 73 Abs. 4 oder § 73a, Arzneimittel oder Wirkstoffe herstellt, in den Verkehr bringt oder sonst mit ihnen Handel treibt,
4. contrary to section 43(1) sentence 2, subsection (2) or (3), trades in medicinal products which may be supplied to consumers only on prescription, or supplies such medicinal products,
4. entgegen § 43 Abs. 1 Satz 2, Abs. 2 oder 3 mit Arzneimitteln, die nur auf Verschreibung an Verbraucher abgegeben werden dürfen, Handel treibt oder diese Arzneimittel abgibt,
5. supplies medicinal products which may be supplied to consumers only on prescription contrary to section 47(1) or subsection (2a), or obtains them contrary to section 47(2) sentence 1, or
5. Arzneimittel, die nur auf Verschreibung an Verbraucher abgegeben werden dürfen, entgegen § 47 Abs. 1 oder Absatz 2a abgibt oder entgegen § 47 Abs. 2 Satz 1 bezieht oder
5a. contrary to section 47a(1), supplies a medicinal product referred to therein to establishments other than those referred to therein, or places it on the market.
5a. entgegen § 47a Abs. 1 ein dort bezeichnetes Arzneimittel an andere als die dort bezeichneten Einrichtungen abgibt oder in den Verkehr bringt.
(3) In especially serious cases, the penalty shall be imprisonment of one year to ten years.
(3) In besonders schweren Fällen ist die Strafe Freiheitsstrafe von einem Jahr bis zu zehn Jahren.
An especially serious case shall, as a rule, exist where the offender
Ein besonders schwerer Fall liegt in der Regel vor, wenn der Täter
1. by one of the acts referred to in subsection (1)
1. durch eine der in Absatz 1 bezeichneten Handlungen
a) endangers the health of a large number of people,
a) die Gesundheit einer großen Zahl von Menschen gefährdet,
b) exposes another person to the risk of death or of serious damage to body or health, or
b) einen anderen der Gefahr des Todes oder einer schweren Schädigung an Körper oder Gesundheit aussetzt oder
c) out of gross self-interest obtains for himself or herself or for another person financial advantages of a large scale, or
c) aus grobem Eigennutz für sich oder einen anderen Vermögensvorteile großen Ausmaßes erlangt oder
2. in the cases of subsection (1) item 3a, manufactures or places on the market falsified medicinal products or active substances and in doing so acts on a commercial basis or as a member of a gang which has joined together for the continued commission of such offences.
2. in den Fällen des Absatzes 1 Nr. 3a gefälschte Arzneimittel oder Wirkstoffe herstellt oder in den Verkehr bringt und dabei gewerbsmäßig oder als Mitglied einer Bande handelt, die sich zur fortgesetzten Begehung solcher Taten verbunden hat.
(4) Where the offender acts negligently in the cases of subsection (1), the penalty shall be imprisonment not exceeding one year or a criminal fine.
(4) Handelt der Täter in den Fällen des Absatzes 1 fahrlässig, so ist die Strafe Freiheitsstrafe bis zu einem Jahr oder Geldstrafe.
