2. the documents submitted, including the clinical investigation plan, the investigator's brochure and the arrangements for the selection of subjects, do not reflect the current state of scientific knowledge, in particular where the clinical investigation is unsuitable for providing evidence of the safety, the performance characteristics or the benefit of the device for the subjects or patients, or
2. die vorgelegten Unterlagen einschließlich des Prüfplans, des Handbuchs des Prüfers und der Modalitäten für die Auswahl der Prüfungsteilnehmer nicht dem Stand der wissenschaftlichen Erkenntnisse entsprechen, insbesondere wenn die klinische Prüfung ungeeignet ist, Nachweise für die Sicherheit, die Leistungsmerkmale oder den Nutzen des Produktes für die Prüfungsteilnehmer oder Patienten zu erbringen, oder
3. the requirements laid down in Division 1, sections 25 to 29, section 47(1) items 1 to 5 and Article 62(3), first subparagraph, Article 62(4)(c), (d), (f) and (h) and Article 62(6) of Regulation (EU) 2017/745 are not met.
