(1) Material changes within the meaning of this Ordinance are those which

1. change the details and information announced in the directory of digital health applications, or
1. die im Verzeichnis für digitale Gesundheitsanwendungen bekannt gemachten Angaben und Informationen ändern oder
2. have a material influence on the fulfilment of the requirements regarding
2. einen wesentlichen Einfluss ausüben auf die Erfüllung der Anforderungen an
a) safety, functional suitability and quality of the digital health application,
a) Sicherheit, Funktionstauglichkeit und Qualität der digitalen Gesundheitsanwendung,
c) evidence of positive care effects or evidence of the maintenance of earning capacity, including changes to the patient groups for which the positive care effects or the maintenance of earning capacity have been or are to be demonstrated.
c) den Nachweis positiver Versorgungseffekte oder den Nachweis des Erhalts der Erwerbsfähigkeit, einschließlich Änderungen der Patientengruppen, für die die positiven Versorgungseffekte oder der Erhalt der Erwerbsfähigkeit nachgewiesen wurden oder werden sollen.
(2) Changes to the details and information in the directory of digital health applications which are minor in scope and merely editorial shall not constitute material changes under subsection (1).
(2) Im Umfang geringfügige und lediglich redaktionelle Änderungen der Angaben und Informationen in dem Verzeichnis für digitale Gesundheitsanwendungen stellen keine wesentlichen Veränderungen nach Absatz 1 dar.
By way of derogation from section 18 subsection (1) item 1, changes to the details under section 2 subsection (1) sentence 2 items 1 to 4 and 21 to 23 and to the results of the outcome measurement accompanying use under section 139e subsection (13) sentence 1 of Book V of the Social Code (Fünftes Buch Sozialgesetzbuch) shall not constitute material changes.

The manufacturer shall notify the Federal Institute for Drugs and Medical Devices (BfArM) of the need for changes that are minor in scope and merely editorial by way of a simple notification.

Simple notifications shall be combined by the manufacturer and are permissible four times a year for each digital health application.

For a simple notification, the electronic forms for application and notification procedures provided by the Federal Institute for Drugs and Medical Devices under section 139e subsection (8) sentence 1 of Book V of the Social Code shall be used.
Für eine einfache Anzeige sind die von dem Bundesinstitut für Arzneimittel und Medizinprodukte nach § 139e Absatz 8 Satz 1 des Fünften Buches Sozialgesetzbuch bereitgestellten elektronischen Formulare für Antrags- und Anzeigeverfahren zu verwenden.
(3) The Federal Institute for Drugs and Medical Devices shall make available electronically to manufacturers of digital health applications a checklist which assists manufacturers in assessing whether a change to the digital health application constitutes a material change under subsection (1).
(3) Das Bundesinstitut für Arzneimittel und Medizinprodukte stellt den Herstellern digitaler Gesundheitsanwendungen elektronisch einen Prüfbogen zur Verfügung, der die Hersteller bei der Einschätzung unterstützt, ob es sich bei einer Veränderung der digitalen Gesundheitsanwendung um eine wesentliche Veränderung nach Absatz 1 handelt.
In the checklist, the Federal Institute for Drugs and Medical Devices shall draw manufacturers' attention to the legal consequences of a failure to notify under section 139e subsection (6) sentences 5 and 6 of Book V of the Social Code.
