(1) The Federal Ministry is empowered, by statutory ordinance with the consent of the Bundesrat,

2. to extend the provisions on marketing authorisation to medicinal products which are not subject to the marketing authorisation requirement under section 21(1), and to medicinal products which are exempted from marketing authorisation under section 21(2) item 1g, insofar as this is necessary to prevent a direct or indirect risk to human health,
2. die Vorschriften über die Zulassung auf Arzneimittel, die nicht der Zulassungspflicht nach § 21 Absatz 1 unterliegen, sowie auf Arzneimittel, die nach § 21 Absatz 2 Nummer 1g von der Zulassung freigestellt sind, auszudehnen, soweit es geboten ist, um eine unmittelbare oder mittelbare Gefährdung der menschlichen Gesundheit zu verhüten,
3. to extend the provisions on the release of a batch and on official batch testing to other medicinal products which are subject to fluctuations in their composition or in their active substance content, insofar as this is necessary to prevent a direct or indirect risk to human health,
3. die Vorschriften über die Freigabe einer Charge und die staatliche Chargenprüfung auf andere Arzneimittel, die in ihrer Zusammensetzung oder in ihrem Wirkstoffgehalt Schwankungen unterworfen sind, auszudehnen, soweit es geboten ist, um eine unmittelbare oder mittelbare Gefährdung der menschlichen Gesundheit zu verhüten,
4. to exempt certain medicinal products from official batch testing where the manufacturer's manufacturing procedure and testing procedure have reached a stage of development at which quality, efficacy and safety are ensured.
4. bestimmte Arzneimittel von der staatlichen Chargenprüfung freizustellen, wenn das Herstellungsverfahren und das Prüfungsverfahren des Herstellers einen Entwicklungsstand erreicht haben, bei dem die Qualität, Wirksamkeit und Unbedenklichkeit gewährleistet sind.
(2) The statutory ordinances under subsection (1) items 2 to 4 shall be issued in agreement with the Federal Ministry for Economic Affairs and Energy and, insofar as radioactive medicinal products and medicinal products in whose manufacture ionising radiation is used are concerned, in agreement with the Federal Ministry for the Environment, Nature Conservation and Nuclear Safety.
