(1) By way of derogation from sections 5 and 8(1) and (2), the medicinal products referred to therein may be exported or brought out of the territory to which the Act applies if the competent authority of the country of destination has approved the import or transfer.

The approval under sentence 1 must show that the competent authority of the country of destination is aware of the grounds for refusal which preclude placing on the market in the territory to which this Act applies.

(2) At the request of the pharmaceutical company, the manufacturer, the exporter or the competent authority of the country of destination, the competent authority or, insofar as information relating to the marketing authorisation is concerned and the marketing authorisation holder has its registered office outside the territory to which the Medicinal Products Act (Arzneimittelgesetz) applies, the competent higher federal authority shall issue a certificate in accordance with the certification scheme of the World Health Organization.
(2) Auf Antrag des pharmazeutischen Unternehmers, des Herstellers, des Ausführers oder der zuständigen Behörde des Bestimmungslandes stellt die zuständige Behörde oder die zuständige Bundesoberbehörde, soweit es sich um zulassungsbezogene Angaben handelt und der Zulassungsinhaber seinen Sitz außerhalb des Geltungsbereiches des Arzneimittelgesetzes hat, ein Zertifikat entsprechend dem Zertifikatsystem der Weltgesundheitsorganisation aus.
Where the request is made by the competent authority of the country of destination, the consent of the manufacturer shall be obtained before the certificate is issued.
