(1) An establishment that intends to procure tissue within the meaning of section 1a no. 4 of the Transplantation Act (Transplantationsgesetz) intended for use in humans (removal establishment (Entnahmeeinrichtung)) or to carry out the laboratory tests required for procurement shall require an authorisation from the competent authority.
(1) Eine Einrichtung, die zur Verwendung bei Menschen bestimmte Gewebe im Sinne von § 1a Nr. 4 des Transplantationsgesetzes gewinnen (Entnahmeeinrichtung) oder die für die Gewinnung erforderlichen Laboruntersuchungen durchführen will, bedarf einer Erlaubnis der zuständigen Behörde.
Procurement within the meaning of sentence 1 is the direct or extracorporeal removal of tissue, including all measures intended to keep the tissue in a condition suitable for processing, to identify it unambiguously and to transport it.
Gewinnung im Sinne von Satz 1 ist die direkte oder extrakorporale Entnahme von Gewebe einschließlich aller Maßnahmen, die dazu bestimmt sind, das Gewebe in einem be- oder verarbeitungsfähigen Zustand zu erhalten, eindeutig zu identifizieren und zu transportieren.
1. an appropriately trained person with the necessary professional experience (responsible person under section 20b) is not available who, in the case of a removal establishment, may at the same time be the physician within the meaning of section 8e subsection (1) sentence 1 of the Transplantation Act,
1. eine angemessen ausgebildete Person mit der erforderlichen Berufserfahrung (verantwortliche Person nach § 20b) nicht vorhanden ist, die, soweit es sich um eine Entnahmeeinrichtung handelt, zugleich die ärztliche Person im Sinne von § 8e Absatz 1 Satz 1 des Transplantationsgesetzes sein kann,
2. other participating personnel are not sufficiently qualified,
2. weiteres mitwirkendes Personal nicht ausreichend qualifiziert ist,
3. appropriate premises for the respective tissue procurement or for the laboratory tests are not available,
3. angemessene Räume für die jeweilige Gewebegewinnung oder für die Laboruntersuchungen nicht vorhanden sind,
4. it is not ensured that the tissue procurement or the laboratory tests are carried out in accordance with the state of the art in medical science and technology and with the provisions of Divisions 2, 3 and 3a of the Transplantation Act, or
4. nicht gewährleistet wird, dass die Gewebegewinnung oder die Laboruntersuchungen nach dem Stand der medizinischen Wissenschaft und Technik und nach den Vorschriften der Abschnitte 2, 3 und 3a des Transplantationsgesetzes vorgenommen werden, oder
5. the responsible person under section 20b or the applicant does not possess the reliability required to carry out his or her activity.
5. die verantwortliche Person nach § 20b oder der Antragsteller die zur Ausübung ihrer oder seiner Tätigkeit erforderliche Zuverlässigkeit nicht besitzt.
The competent authority may dispense with an inspection within the meaning of section 64 subsection (3) sentence 2 before granting the authorisation under this provision.
Von einer Besichtigung im Sinne von § 64 Abs. 3 Satz 2 kann die zuständige Behörde vor Erteilung der Erlaubnis nach dieser Vorschrift absehen.
The authorisation shall be granted by the competent authority to the removal establishment for a specific operating site and for specific tissue, and to the laboratory for a specific operating site and for specific activities, and may provide for the possibility of tissue removal outside the premises under sentence 3 item 3 by personnel dispatched by the removal establishment.
Die Erlaubnis wird der Entnahmeeinrichtung von der zuständigen Behörde für eine bestimmte Betriebsstätte und für bestimmtes Gewebe und dem Labor für eine bestimmte Betriebsstätte und für bestimmte Tätigkeiten erteilt und kann die Möglichkeit der Gewebeentnahme außerhalb der Räume nach Satz 3 Nummer 3 durch von der Entnahmeeinrichtung entsandtes Personal vorsehen.
In this context, the competent authority may involve the competent higher federal authority.

(1a) Section 20c subsection (4) sentences 1 and 2 and subsection (5) shall apply mutatis mutandis.

(2) A separate authorisation under subsection (1) shall not be required by any person who carries out these activities under a contractual arrangement with a manufacturer or a processor holding an authorisation under section 13 or section 20c for the processing of tissue or tissue preparations.
(2) Einer eigenen Erlaubnis nach Absatz 1 bedarf nicht, wer diese Tätigkeiten unter vertraglicher Bindung mit einem Hersteller oder einem Be- oder Verarbeiter ausübt, der eine Erlaubnis nach § 13 oder § 20c für die Be- oder Verarbeitung von Gewebe oder Gewebezubereitungen besitzt.
In this case, the manufacturer or the processor shall notify the removal establishment or the laboratory to the authority locally competent for each of them and shall attach to the notification the particulars and documents under subsection (1) sentence 3.
In diesem Fall hat der Hersteller oder der Be- oder Verarbeiter die Entnahmeeinrichtung oder das Labor der für diese jeweils örtlich zuständigen Behörde anzuzeigen und der Anzeige die Angaben und Unterlagen nach Absatz 1 Satz 3 beizufügen.
Once one month has elapsed following the notification under sentence 2, the manufacturer or the processor shall notify the removal establishment or the laboratory to the authority competent for him, unless the authority competent for the removal establishment or the laboratory has objected.

In exceptional cases, the time limit under sentence 3 shall be extended by a further two months.
In Ausnahmefällen verlängert sich die Frist nach Satz 3 um weitere zwei Monate.
The manufacturer or the processor shall be informed of this before the time limit expires, stating the reasons.
Der Hersteller oder der Be- oder Verarbeiter ist hiervon vor Fristablauf unter Mitteilung der Gründe in Kenntnis zu setzen.
If the competent authority has objected, the time limits in sentences 3 and 4 shall be suspended until the ground for the objection has been remedied.
Hat die zuständige Behörde widersprochen, sind die Fristen in Satz 3 und 4 gehemmt, bis der Grund für den Widerspruch behoben ist.
Subsection (1) sentences 3 to 6 shall apply mutatis mutandis, subject to the proviso that the authorisation under subsection (1) sentence 5 is granted to the manufacturer or the processor.
Absatz 1 Satz 3 bis 6 gilt entsprechend mit der Maßgabe, dass die Erlaubnis nach Absatz 1 Satz 5 dem Hersteller oder dem Be- oder Verarbeiter erteilt wird.
(3) The authorisation shall be withdrawn if it subsequently becomes known that one of the grounds for refusal under subsection (1) sentence 3 existed at the time it was granted.

If one of these grounds for refusal has arisen subsequently, the authorisation shall be revoked; instead of revocation, suspension of the authorisation may also be ordered.
Ist einer dieser Versagungsgründe nachträglich eingetreten, so ist die Erlaubnis zu widerrufen; an Stelle des Widerrufs kann auch das Ruhen der Erlaubnis angeordnet werden.
The competent authority may provisionally prohibit the procurement of tissue or the laboratory tests if the removal establishment, the laboratory or the manufacturer or the processor fails to submit the records required to be kept for the tissue procurement or the laboratory tests.

(4) Subsections (1) to (3) shall apply mutatis mutandis to the procurement and laboratory testing of autologous blood for the manufacture of biotechnologically processed tissue products.

(5) The holder of the authorisation shall notify the competent authority in advance of any change in the requirements for the authorisation referred to in subsection (1) sentence 3, submitting the supporting evidence, and may make the change only once the competent authority has granted written authorisation.
(5) Der Inhaber der Erlaubnis hat der zuständigen Behörde jede Änderung der in Absatz 1 Satz 3 genannten Voraussetzungen für die Erlaubnis unter Vorlage der Nachweise vorher anzuzeigen und er darf die Änderung erst vornehmen, wenn die zuständige Behörde eine schriftliche Erlaubnis erteilt hat.
In the event of an unforeseen change of the appropriately trained person under section 20b, the notification shall be made without undue delay.
Bei einem unvorhergesehenen Wechsel der angemessen ausgebildeten Person nach § 20b hat die Anzeige unverzüglich zu erfolgen.
