A marketing authorisation granted by another state for a medicinal product shall also be deemed to be a marketing authorisation within the meaning of section 21, insofar as this is so determined by statutory ordinance of the Federal Ministry.

(2) The Federal Ministry is empowered to issue a statutory ordinance under subsection (1), which shall not require the consent of the Bundesrat, in order to implement a Council directive or insofar as international treaties provide for the mutual recognition of marketing authorisations of medicinal products as equivalent.
