(1) The National Association of Statutory Health Insurance Funds and the Association of Private Health Insurance (Verband der Privaten Krankenversicherung) shall jointly agree with the German Hospital Federation (contracting parties at federal level), with effect for the contracting parties under section 11, in particular on
(1) Der Spitzenverband Bund der Krankenkassen und der Verband der Privaten Krankenversicherung gemeinsam vereinbaren mit der Deutschen Krankenhausgesellschaft (Vertragsparteien auf Bundesebene) mit Wirkung für die Vertragsparteien nach § 11 insbesondere
1. a catalogue of case-based flat rates under section 17b(1) sentence 4 of the Hospital Financing Act (Krankenhausfinanzierungsgesetz), including the cost weights (Bewertungsrelationen) and rules on transfer cases and on the length-of-stay thresholds and on the charges to be paid additionally, or deductions to be made, depending on these (effective cost weights),
1. einen Fallpauschalen-Katalog nach § 17b Absatz 1 Satz 4 des Krankenhausfinanzierungsgesetzes einschließlich der Bewertungsrelationen sowie Regelungen zu Verlegungsfällen und zur Grenzverweildauer und der in Abhängigkeit von diesen zusätzlich zu zahlenden Entgelte oder vorzunehmenden Abschläge (effektive Bewertungsrelationen),
2. a catalogue of supplementary charges under section 17b(1) sentence 7 of the Hospital Financing Act, including the amount of remuneration,
2. einen Katalog ergänzender Zusatzentgelte nach § 17b Absatz 1 Satz 7 des Krankenhausfinanzierungsgesetzes einschließlich der Vergütungshöhe,
2a. a nursing revenue catalogue under section 17b(4) sentence 5 of the Hospital Financing Act, including the cost weights for the per-day drawdown of the agreed nursing budget under section 6a,
2a. einen Pflegeerlöskatalog nach § 17b Absatz 4 Satz 5 des Krankenhausfinanzierungsgesetzes einschließlich der Bewertungsrelationen für die tagesbezogene Abzahlung des vereinbarten Pflegebudgets nach § 6a,
3. the billing provisions for the charges under items 1, 2 and 2a and the rules on supplements and deductions and, until 31 March 2027, exceptions to the combining of cases referred to in section 8(5) sentence 1 item 2, where such combining is not economically appropriate or not medically justifiable,
3. die Abrechnungsbestimmungen für die Entgelte nach den Nummern 1, 2 und 2a sowie die Regelungen über Zu- und Abschläge und bis zum 31. März 2027 Ausnahmen von der in § 8 Absatz 5 Satz 1 Nummer 2 genannten Fallzusammenführung, soweit eine solche nicht wirtschaftlich geboten oder nicht medizinisch vertretbar ist,
4. recommendations for the calculation and remuneration of new examination and treatment methods for which separate charges may be agreed under section 6,
4. Empfehlungen für die Kalkulation und die Vergütung neuer Untersuchungs- und Behandlungsmethoden, für die nach § 6 gesonderte Entgelte vereinbart werden können,
5. the uniform structure of the data records and the procedure for the transmission of the data under section 11(4) sentence 1 and, for the first time by 26 January 2023, the details on the documentation of the receipt of data, documents and information and on the billing of the deduction under section 11(4) sentence 6,
5. den einheitlichen Aufbau der Datensätze und das Verfahren für die Übermittlung der Daten nach § 11 Absatz 4 Satz 1 sowie erstmals bis zum 26. Januar 2023 das Nähere zur Dokumentation des Eingangs von Daten, Unterlagen und Auskünften und zur Abrechnung des Abschlags nach § 11 Absatz 4 Satz 6,
6. for the first time by 31 July 2016, a catalogue of hospital services not susceptible to volume increases which are subject to only half of the deduction, and further details on the implementation of the deduction, in particular on the definition of the catchment area of a hospital and on a reduced deduction in the case of shifts of services,
6. erstmals bis zum 31. Juli 2016 einen Katalog nicht mengenanfälliger Krankenhausleistungen, die nur dem hälftigen Abschlag unterliegen, sowie nähere Einzelheiten zur Umsetzung des Abschlags, insbesondere zur Definition des Einzugsgebiets eines Krankenhauses und zu einem geminderten Abschlag im Falle von Leistungsverlagerungen,
7. the increase rate for collectively agreed pay increases under section 10(5) sentence 4, a pro rata increase rate and, by 31 March 2019, the details of proof that the additional funds for collectively agreed pay increases for nursing staff are used for their intended purpose of financing such staff, and a procedure ensuring that hospitals have to repay funds which they have not used for their intended purpose,
7. die Erhöhungsrate für Tariferhöhungen nach § 10 Absatz 5 Satz 4, eine anteilige Erhöhungsrate sowie bis zum 31. März 2019 die Einzelheiten für einen Nachweis, dass die zusätzlichen Mittel für Tariferhöhungen von Pflegepersonal zweckentsprechend für dessen Finanzierung verwendet werden, und ein Verfahren, das gewährleistet, dass Krankenhäuser Mittel zurückzuzahlen haben, die sie nicht zweckentsprechend verwendet haben,
8. for the first time by 31 July 2019, the further details on the negotiation of the nursing budget under section 6a, in particular on the documents to be submitted and on the procedure for handling the repayment of funds not used for their intended purpose, by 17 August 2021, on the uniform form of documentation of the amount of the agreed nursing budget and of the essential calculation parameters for deriving the agreed costs to be taken into account in the nursing budget and the amount of the nursing budget, and, by 31 May 2023, an adaptation of the agreement to the requirements of section 17b(4a) of the Hospital Financing Act,
8. erstmals bis zum 31. Juli 2019 die näheren Einzelheiten zur Verhandlung des Pflegebudgets nach § 6a, insbesondere zu den vorzulegenden Unterlagen und zu dem Verfahren der Rückzahlungsabwicklung von nicht zweckentsprechend verwendeten Mitteln, bis zum 17. August 2021 zu der einheitlichen Form der Dokumentation der Höhe des vereinbarten Pflegebudgets sowie der wesentlichen Rechengrößen zur Herleitung der vereinbarten, im Pflegebudget zu berücksichtigenden Kosten und der Höhe des Pflegebudgets sowie bis zum 31. Mai 2023 eine Anpassung der Vereinbarung an die Vorgaben des § 17b Absatz 4a des Krankenhausfinanzierungsgesetzes,
9. by 28 February 2019, the designation of procedure codes under section 301(2) sentence 2 of Book V of the Social Code which are to be deleted because, following the introduction of the nursing budget under section 6a, they are no longer needed for the remuneration system under section 17b of the Hospital Financing Act,
9. bis zum 28. Februar 2019 die Benennung von Prozedurenschlüsseln nach § 301 Absatz 2 Satz 2 des Fünften Buches Sozialgesetzbuch, die zu streichen sind, da sie nach Einführung des Pflegebudgets nach § 6a für das Vergütungssystem nach § 17b des Krankenhausfinanzierungsgesetzes nicht mehr benötigt werden,
10. within three months after an agreement under section 115g(3) sentence 1 of Book V of the Social Code has been reached or, in the case referred to in section 115g(3) sentence 3 of Book V of the Social Code, after the determination referred to therein, further details, in particular

c) zu der nach § 6c Absatz 1 Satz 2 Nummer 5 zu vereinbarenden sachgerechten Aufteilung,
d) on the content to be agreed under section 6c(1) sentence 2 items 1, 6 and 7,
d) zu den nach § 6c Absatz 1 Satz 2 Nummer 1, 6 und 7 zu vereinbarenden Inhalten,
e) on the documents to be submitted by the hospital in preparation for the negotiation referred to in letter (a),
e) zu den vom Krankenhaus zur Vorbereitung der in Buchstabe a genannten Verhandlung vorzulegenden Unterlagen,
f) on the essential calculation parameters for deriving the costs to be taken into account under section 6c(2) sentence 2, including the supplements and deductions to be taken into account in calculating the total volume under section 6c(2) sentence 1,
f) zu den wesentlichen Rechengrößen zur Herleitung der nach § 6c Absatz 2 Satz 2 zu berücksichtigenden Kosten einschließlich der bei der Kalkulation des Gesamtvolumens nach § 6c Absatz 2 Satz 1 zu berücksichtigenden Zu- und Abschläge,
g) on a uniform form of documentation of the amount of the total volume to be agreed under section 6c(1) sentence 1, of the hospital-specific daily charges to be agreed under section 6c(1) sentence 2 items 2 to 4, of the costs to be taken into account under section 6c(2) sentence 2 and of the essential calculation parameters referred to in letter (f),
g) zu einer einheitlichen Form der Dokumentation der Höhe des nach § 6c Absatz 1 Satz 1 zu vereinbarenden Gesamtvolumens, der nach § 6c Absatz 1 Satz 2 Nummer 2 bis 4 zu vereinbarenden krankenhausindividuellen Tagesentgelte, der nach § 6c Absatz 2 Satz 2 zu berücksichtigenden Kosten und der in Buchstabe f genannten wesentlichen Rechengrößen,
h) rules on the refinancing of collectively agreed pay increases during the year,
h) Regelungen zur unterjährigen Refinanzierung von Tarifsteigerungen,
i) provisional daily charges and their degression, and
i) vorläufige Tagesentgelte und deren Degression sowie
j) billing provisions for the hospital-specific daily charges to be agreed under section 6c(1) sentence 2 items 2 to 4 and for the provisional daily charges referred to in letter (i).
j) Abrechnungsbestimmungen für die nach § 6c Absatz 1 Satz 2 Nummer 2 bis 4 zu vereinbarenden krankenhausindividuellen Tagesentgelte und für die in Buchstabe i genannten vorläufigen Tagesentgelte.
11. for the first time by 30 September 2027, further details on short-stay case-based flat rates within the meaning of section 17b(2a) sentence 1 of the Hospital Financing Act, in particular
11. erstmals bis zum 30. September 2027 nähere Einzelheiten für Kurzzeitfallpauschalen im Sinne des § 17b Absatz 2a Satz 1 des Krankenhausfinanzierungsgesetzes, insbesondere
a) requirements ensuring that the introduction of the short-stay case-based flat rates does not result in an increase in the number of inpatient treatment cases with up to two overnight stays at the level of the individual hospital, and
a) Vorgaben, durch die sichergestellt wird, dass durch die Einführung der Kurzzeitfallpauschalen keine Fallzahlausweitung bei den stationären Behandlungsfällen mit bis zu zwei Übernachtungen auf der Ebene des einzelnen Krankenhauses stattfindet, und
b) the consequences if the individual hospital has increased its number of cases contrary to the requirements to be laid down under letter (a).
b) die Folgen, sofern das einzelne Krankenhaus entgegen den nach Buchstabe a festzulegenden Vorgaben eine Fallzahlausweitung vorgenommen hat.
(1a) On the basis of subsection (1) item 3, the contracting parties at federal level shall agree on

1. requirements, in particular regarding duration, for temporary supplements to finance additional costs arising from directives of the Federal Joint Committee and from framework agreements under section 137i(6) of Book V of the Social Code;
1. Vorgaben, insbesondere zur Dauer, für befristete Zuschläge für die Finanzierung von Mehrkosten auf Grund von Richtlinien des Gemeinsamen Bundesausschusses sowie auf Grund von Rahmenvereinbarungen nach § 137i Absatz 6 des Fünften Buches Sozialgesetzbuch;
3. by 31 October 2021, requirements for the performance of clinical autopsies for quality assurance purposes; in particular, they shall lay down the minimum requirements necessary for quality assurance and set requirements for the calculation of the supplement; the Institute for the Hospital Remuneration System (InEK) shall be commissioned with the annual calculation of the costs of a clinical autopsy, the costs arising from the calculation to be financed from the supplement under section 17b(5) sentence 1 item 1 of the Hospital Financing Act;
3. bis zum 31. Oktober 2021 Anforderungen an die Durchführung klinischer Sektionen zur Qualitätssicherung; insbesondere legen sie für die Qualitätssicherung erforderliche Mindestanforderungen fest und machen Vorgaben für die Berechnung des Zuschlags; das Institut für das Entgeltsystem im Krankenhaus ist mit der jährlichen Kalkulation der Kosten einer klinischen Sektion zu beauftragen, wobei die für die Kalkulation entstehenden Kosten aus dem Zuschlag nach § 17b Absatz 5 Satz 1 Nummer 1 des Krankenhausfinanzierungsgesetzes zu finanzieren sind;
5. the amount and the detailed arrangements of the supplements and deductions for the participation or non-participation of hospitals in emergency care, provision being made for support by the Institute for the Hospital Remuneration System in determining the amount of the supplements and deductions; the supplements and deductions shall relate to the tiered system of minimum requirements for participation in emergency care which is to be developed by the Federal Joint Committee in accordance with section 136c(4) of Book V of the Social Code; from 2028, the supplements for the participation of hospitals in emergency care shall be increased by EUR 33 million;
5. die Höhe und die nähere Ausgestaltung der Zu- und Abschläge für eine Teilnahme oder Nichtteilnahme von Krankenhäusern an der Notfallversorgung, wobei bei der Ermittlung der Höhe der Zu- und Abschläge eine Unterstützung durch das Institut für das Entgeltsystem im Krankenhaus vorzusehen ist; die Zu- und Abschläge müssen sich auf das Stufensystem zu den Mindestvoraussetzungen für eine Teilnahme an der Notfallversorgung beziehen, das gemäß § 136c Absatz 4 des Fünften Buches Sozialgesetzbuch vom Gemeinsamen Bundesausschuss zu entwickeln ist; ab dem Jahr 2028 sind die Zuschläge für eine Teilnahme von Krankenhäusern an der Notfallversorgung um 33 Millionen Euro zu erhöhen;
6. annually by 30 June, a list of the hospital sites, the children's hospital sites and the hospital sites with specialist departments for paediatrics and adolescent medicine which meet the requirements of the Federal Joint Committee relating to section 136c(3) of Book V of the Social Code; by way of derogation from the requirements of the Federal Joint Committee under section 136c(3) of Book V of the Social Code, provision shall be made for inclusion in the list even if the hospital at the site concerned does not meet the requirements for emergency care under the tiered system of emergency structures in hospitals adopted by the Federal Joint Committee in accordance with section 136c(4) of Book V of the Social Code, the contracting parties at federal level being required, by 9 January 2025, to examine and, where necessary, carry out an extension of the list of hospital sites already agreed for calendar year 2025;
6. jährlich zum 30. Juni eine Liste der Krankenhausstandorte, der Kinderkrankenhausstandorte und der Krankenhausstandorte mit Fachabteilungen für Kinder- und Jugendmedizin, welche die Vorgaben des Gemeinsamen Bundesausschusses zu § 136c Absatz 3 des Fünften Buches Sozialgesetzbuch erfüllen; eine Aufnahme in die Liste ist abweichend von den Vorgaben des Gemeinsamen Bundesausschusses nach § 136c Absatz 3 des Fünften Buches Sozialgesetzbuch vorzusehen, auch wenn das Krankenhaus an dem jeweiligen Standort nicht die Anforderungen an die Notfallversorgung nach dem vom Gemeinsamen Bundesausschuss gemäß § 136c Absatz 4 des Fünften Buches Sozialgesetzbuch beschlossenen gestuften System der Notfallstrukturen in Krankenhäusern erfüllt, wobei die Vertragsparteien auf Bundesebene bis zum 9. Januar 2025 eine Erweiterung der für das Kalenderjahr 2025 bereits vereinbarten Liste mit Krankenhausstandorten zu prüfen und bei Bedarf vorzunehmen haben;
7. by 31 December 2020, the amount and the detailed arrangements of the supplement under section 17b(1a) item 9 of the Hospital Financing Act and its regular adjustment to cost developments;
7. bis zum 31. Dezember 2020 die Höhe und die nähere Ausgestaltung des Zuschlags nach § 17b Absatz 1a Nummer 9 des Krankenhausfinanzierungsgesetzes sowie seine regelmäßige Anpassung an Kostenentwicklungen;
8. by 31 March 2021, the details of the conditions for, the amount of and the arrangements for deductions for hospitals which
8. bis zum 31. März 2021 das Nähere zu den Voraussetzungen, zur Höhe und zur Ausgestaltung von Abschlägen für Krankenhäuser, die
a) contrary to section 39(1) sentence 6 of Book V of the Social Code, do not carry out an assessment of ventilation status, or
a) entgegen § 39 Absatz 1 Satz 6 des Fünften Buches Sozialgesetzbuch keine Einschätzung des Beatmungsstatus vornehmen oder
b) in the case of necessary follow-up care for weaning from ventilation, contrary to section 39(1a) sentence 7 of Book V of the Social Code, do not issue a prescription;
b) im Falle einer erforderlichen Anschlussversorgung zur Beatmungsentwöhnung entgegen § 39 Absatz 1a Satz 7 des Fünften Buches Sozialgesetzbuch keine Verordnung vornehmen;
9. by 31 December 2020, requirements for supplements under section 5(3i) to finance additional costs not otherwise financed which hospitals incur owing to the coronavirus SARS-CoV-2 in connection with the inpatient or day-patient treatment of patients; in particular, they shall agree which costs are to be financed by the supplement under section 5(3i) and requirements for proof that the costs have been incurred, and shall issue recommendations for the calculation of the costs.
9. bis zum 31. Dezember 2020 Vorgaben für Zuschläge nach § 5 Absatz 3i zur Finanzierung von nicht anderweitig finanzierten Mehrkosten, die den Krankenhäusern auf Grund des Coronavirus SARS-CoV-2 im Zusammenhang mit der voll- oder teilstationären Behandlung von Patientinnen und Patienten entstehen; insbesondere vereinbaren sie, welche Kosten durch den Zuschlag nach § 5 Absatz 3i zu finanzieren sind und Anforderungen an den Nachweis des Vorliegens der Kosten und geben Empfehlungen für die Kalkulation der Kosten.
(1b) The contracting parties at federal level shall agree, with effect for the contracting parties at state level, by 31 October of each year, for the first time by 31 October 2029, on the change value (Veränderungswert) for limiting the development of the base rate under section 10(4); by way of derogation from this, the change value shall correspond
(1b) Die Vertragsparteien auf Bundesebene vereinbaren mit Wirkung für die Vertragsparteien auf Landesebene bis zum 31. Oktober jeden Jahres, erstmals bis zum 31. Oktober 2029, den Veränderungswert für die Begrenzung der Entwicklung des Basisfallwerts nach § 10 Absatz 4; abweichend hiervon entspricht der Veränderungswert
1. for 2026, to the orientation value published in 2025 under section 10(6) sentence 1, and
1. für das Jahr 2026 dem nach § 10 Absatz 6 Satz 1 im Jahr 2025 veröffentlichten Orientierungswert und
2. for the years 2027 to 2029, to the change value (Veränderungsrate) published in the respective preceding year under section 71(3) of Book V of the Social Code.
2. für die Jahre 2027 bis 2029 der im jeweiligen Vorjahr nach § 71 Absatz 3 des Fünften Buches Sozialgesetzbuch veröffentlichten Veränderungsrate.
If the orientation value published under section 10(6) sentence 1 exceeds the change value published in the same calendar year under section 71(3) sentence 5 of Book V of the Social Code, the contracting parties at federal level shall agree, by 31 October of the same calendar year, for the first time by 31 October 2029, on the change value in the amount of the change value.
Überschreitet der nach § 10 Absatz 6 Satz 1 veröffentlichte Orientierungswert die im selben Kalenderjahr nach § 71 Absatz 3 Satz 5 des Fünften Buches Sozialgesetzbuch veröffentlichte Veränderungsrate, vereinbaren die Vertragsparteien auf Bundesebene bis zum 31. Oktober desselben Kalenderjahres, erstmals bis zum 31. Oktober 2029, den Veränderungswert in Höhe der Veränderungsrate.
If the orientation value published under section 10(6) sentence 1 falls below the change value published in the same calendar year under section 71(3) sentence 5 of Book V of the Social Code, the contracting parties at federal level shall agree, by 31 October of the same calendar year, for the first time by 31 October 2029, on the change value in the amount of the orientation value.
Unterschreitet der nach § 10 Absatz 6 Satz 1 veröffentlichte Orientierungswert die im selben Kalenderjahr nach § 71 Absatz 3 Satz 5 des Fünften Buches Sozialgesetzbuch veröffentlichte Veränderungsrate, vereinbaren die Vertragsparteien auf Bundesebene bis zum 31. Oktober desselben Kalenderjahres, erstmals bis zum 31. Oktober 2029, den Veränderungswert in Höhe des Orientierungswerts.
The contracting parties at federal level may issue recommendations to the contracting parties at state level on the agreement of the base rates and of the factors to be taken into account, in particular on the exploitation of cost-effectiveness reserves under section 10(3) sentence 1 item 3, and shall specify which factors that cannot be implemented in the further development of the cost weights, and therefore have to be implemented in the agreement of the base rate under section 10(3) sentence 1 item 1 and sentence 2, are to be taken into account or compensated, and in what amount.
Die Vertragsparteien auf Bundesebene können Empfehlungen an die Vertragsparteien auf Landesebene zur Vereinbarung der Basisfallwerte und der zu berücksichtigenden Tatbestände, insbesondere zur Ausschöpfung von Wirtschaftlichkeitsreserven nach § 10 Absatz 3 Satz 1 Nummer 3, abgeben und geben vor, welche Tatbestände, die bei der Weiterentwicklung der Bewertungsrelationen nicht umgesetzt werden können und deshalb nach § 10 Absatz 3 Satz 1 Nummer 1 und Satz 2 bei der Vereinbarung des Basisfallwerts umzusetzen sind, in welcher Höhe zu berücksichtigen oder auszugleichen sind.
(1c) In order to implement section 17b(1) sentence 5, second half-sentence, of the Hospital Financing Act, the contracting parties at federal level shall, by 31 May 2016, for services in respect of which there are indications of increases in case numbers that are economically motivated to an increased extent, prescribe a targeted reduction or graduation of the valuation of the services, which shall be taken into account in the calculation of the remuneration system for the following calendar year.
(1c) Zur Umsetzung von § 17b Absatz 1 Satz 5 zweiter Halbsatz des Krankenhausfinanzierungsgesetzes haben die Vertragsparteien auf Bundesebene bis zum 31. Mai 2016 bei Leistungen, bei denen es Anhaltspunkte für im erhöhten Maße wirtschaftlich begründete Fallzahlsteigerungen gibt, eine gezielte Absenkung oder Abstufung der Bewertung der Leistungen vorzugeben, die bei der Kalkulation des Vergütungssystems für das folgende Kalenderjahr zu berücksichtigen ist.
(2) If an agreement referred to in this provision is not reached, or is reached only in part, the arbitration board under section 18a(6) of the Hospital Financing Act shall decide upon application by a contracting party; the arbitration board shall take a decision on the change value to be agreed under subsection (1b) sentence 1 by 31 October of a year by 15 November of the year concerned.
(2) Kommt eine in dieser Vorschrift genannte Vereinbarung nicht oder teilweise nicht zustande, entscheidet auf Antrag einer Vertragspartei die Schiedsstelle nach § 18a Absatz 6 des Krankenhausfinanzierungsgesetzes; eine Entscheidung über den nach Absatz 1b Satz 1 bis zum 31. Oktober eines Jahres zu vereinbarenden Veränderungswert hat die Schiedsstelle bis zum 15. November des jeweiligen Jahres zu treffen.
If an agreement under subsection (1a) item 5 or item 8 is not reached, the Federal Ministry of Health may also refer the matter to the arbitration board.
Kommt eine Vereinbarung nach Absatz 1a Nummer 5 oder Nummer 8 nicht zustande, kann auch das Bundesministerium für Gesundheit die Schiedsstelle anrufen.
