(1) The hospital shall transmit, on a machine-readable data carrier, by 31 March of each year for the respective preceding calendar year, the data under subsection (2) to the data office at federal level operated by the Institute for the Hospital Remuneration System (InEK).
(1) Das Krankenhaus übermittelt auf einem maschinenlesbaren Datenträger jeweils zum 31. März für das jeweils vorangegangene Kalenderjahr die Daten nach Absatz 2 an die vom Institut für das Entgeltsystem im Krankenhaus geführte Datenstelle auf Bundesebene.

b) characteristics for the agreement of supplements and deductions under section 17b(1a) of the Hospital Financing Act (Krankenhausfinanzierungsgesetz),
b) Merkmale für die Vereinbarung von Zu- und Abschlägen nach § 17b Absatz 1a des Krankenhausfinanzierungsgesetzes,
c) number of training places, costs of theoretical and practical instruction, costs of practical training, costs of the training establishment, broken down by material expenses, overhead costs and agreed total costs, as well as the number of trainers and trainees, in each case broken down by occupational title under section 2 item 1a of the Hospital Financing Act; the number of trainees by occupational title additionally broken down by the respective year of training,
c) Anzahl der Ausbildungsplätze, Kosten des theoretischen und praktischen Unterrichts, Kosten der praktischen Ausbildung, Kosten der Ausbildungsstätte, gegliedert nach Sachaufwand, Gemeinkosten und vereinbarten Gesamtkosten sowie Anzahl der Ausbildenden und Auszubildenden, jeweils gegliedert nach Berufsbezeichnung nach § 2 Nr. 1a des Krankenhausfinanzierungsgesetzes; die Anzahl der Auszubildenden nach Berufsbezeichnungen zusätzlich gegliedert nach jeweiligem Ausbildungsjahr,
d) total of the agreed and invoiced DRG cases, of the agreed and invoiced total of the cost weights (Bewertungsrelationen) of the catalogue of case-based flat rates and of the nursing revenue catalogue, as well as of the compensatory amounts under section 5(4) and section 6b(5) sentence 1 and of the payments to compensate for the differences between the actual and the agreed nursing staff costs under section 6a(2), the total of the agreed and invoiced cases which are invoiced with hospital-specific daily charges referred to in section 6c(1) sentence 2 or with provisional daily charges referred to in section 6c(7) sentence 4, and of the compensatory amounts determined under section 6c(5) sentence 1, in each case for the preceding calendar year; in calendar years 2027 and 2028, additionally the total of the agreed and invoiced provision cost weights (Vorhaltebewertungsrelationen) and, from calendar year 2029, additionally the invoiced provision cost weights, in each case for the preceding calendar year,

in each case converted into full-time equivalents, broken down by the site identifier under section 293(6) of Book V of the Social Code and by the specialist departments of the site; for the nursing-sensitive areas laid down in an agreement under section 137i(1) of Book V of the Social Code or in a statutory ordinance under section 137i(3) of Book V of the Social Code, the number of nursing staff employed in total, the number of nursing staff employed in total in direct patient care on bed-holding wards, the number of midwives employed in total, the number of midwives employed in total in the delivery room and the number of midwives employed in total in direct patient care on bed-holding wards shall additionally be transmitted, in each case broken down by the respective nursing-sensitive areas,

f) the number of medical staff employed in total and the number of medical staff employed in total in direct patient care, in each case including the specialist title and, where applicable, the sub-specialty title, and, for medical staff undergoing further training, in each case stating the field of further training, in each case converted into full-time equivalents, broken down by the site identifier under section 293(6) of Book V of the Social Code, by the service groups relevant under section 135e(2) sentence 2 of Book V of the Social Code and by the specialist departments of the site,

h) information on participation in the tiered system of emergency structures in hospitals adopted by the Federal Joint Committee pursuant to section 136c(4) sentence 1 of Book V of the Social Code, broken down by the site identifier under section 293(6) of Book V of the Social Code;
h) Informationen über die Teilnahme an dem vom Gemeinsamen Bundesausschuss gemäß § 136c Absatz 4 Satz 1 des Fünften Buches Sozialgesetzbuch beschlossenen gestuften System von Notfallstrukturen in Krankenhäusern, gegliedert nach dem Kennzeichen des Standorts nach § 293 Absatz 6 des Fünften Buches Sozialgesetzbuch;

Januar 2020 dessen Kennzeichen nach § 293 Absatz 6 des Fünften Buches Sozialgesetzbuch für den aufnehmenden, den weiterbehandelnden und den entlassenden Standort sowie bei einer nach Standorten differenzierten Festlegung des Versorgungsauftrags bis zum 30. d) year of birth and sex of the patient as well as the postcode and place of residence of the patient, in the city states the city district, and, for children up to the completion of their first year of life, also the month of birth,

e) date of admission, reason for and occasion of admission, admitting specialist department, in the event of transfer those of the specialist departments providing further treatment, and the associated periods, periods of intensive care, date of discharge or transfer, reason for discharge or transfer, and, for children up to the completion of their first year of life, also the admission weight in grams,
e) Aufnahmedatum, Aufnahmegrund und -anlass, aufnehmende Fachabteilung, bei Verlegung die der weiter behandelnden Fachabteilungen, und der dazugehörigen Zeiträume, Zeiträume der Intensivbehandlung, Entlassungs- oder Verlegungsdatum, Entlassungs- oder Verlegungsgrund, bei Kindern bis zur Vollendung des ersten Lebensjahres außerdem das Aufnahmegewicht in Gramm,
f) principal and secondary diagnoses as well as the date and type of the operations and procedures performed, in accordance with the respectively applicable versions of the codes under section 301(2) sentences 1 and 2 of Book V of the Social Code, including an indication of the respective versions, in ventilation cases the ventilation time in hours in accordance with the coding rules under section 17b(5) item 1 of the Hospital Financing Act, and an indication of whether provided by an affiliated surgeon, affiliated anaesthetist or affiliated midwife, in each case broken down by the site identifier under section 293(6) of Book V of the Social Code,
f) Haupt- und Nebendiagnosen sowie Datum und Art der durchgeführten Operationen und Prozeduren nach den jeweils gültigen Fassungen der Schlüssel nach § 301 Abs. 2 Satz 1 und 2 des Fünften Buches Sozialgesetzbuch, einschließlich der Angabe der jeweiligen Versionen, bei Beatmungsfällen die Beatmungszeit in Stunden entsprechend der Kodierregeln nach § 17b Abs. 5 Nr. 1 des Krankenhausfinanzierungsgesetzes und Angabe, ob durch Belegoperateur, -anästhesist oder Beleghebamme erbracht, jeweils gegliedert nach dem Kennzeichen des Standorts nach § 293 Absatz 6 des Fünften Buches Sozialgesetzbuch,
g) type of all charges invoiced in the individual treatment case,

(3) The data office shall check the data under subsection (1) for plausibility and shall transmit, by 1 July of each year, the

1. data under subsection (2) item 1 and item 2 letters b to i, for the further development of the DRG remuneration system under section 17b of the Hospital Financing Act and for the further development of the remuneration system under section 17d of the Hospital Financing Act and of the investment cost weights under section 10(2) of the Hospital Financing Act, to the contracting parties under section 17b(2) sentence 1 of the Hospital Financing Act,
1. Daten nach Absatz 2 Nummer 1 und 2 Buchstabe b bis i zur Weiterentwicklung des DRG-Vergütungssystems nach § 17b des Krankenhausfinanzierungsgesetzes sowie zur Weiterentwicklung des Entgeltsystems nach § 17d des Krankenhausfinanzierungsgesetzes und der Investitionsbewertungsrelationen nach § 10 Abs. 2 des Krankenhausfinanzierungsgesetzes an die Vertragsparteien nach § 17b Abs. 2 Satz 1 des Krankenhausfinanzierungsgesetzes,
2. state-related data under subsection (2) item 1 letters c and d and item 2 letters g and h, for the agreement of the base rate under section 10(1), to the contracting parties at state level,
2. landesbezogenen Daten nach Absatz 2 Nr. 1 Buchstabe c und d und Nr. 2 Buchstabe g und h zur Vereinbarung des Basisfallwerts nach § 10 Abs. 1 an die Vertragsparteien auf der Landesebene,
3. state-related data under subsection (2) item 1 letters a to c, e, f and h and item 2 letters b, d to g and i for the purposes of hospital planning, and additionally under subsection (2) item 2 letter h for the purposes of investment funding where the federal state (Land) uses or intends to use investment lump sums under section 10 of the Hospital Financing Act for that purpose, and, where a joint state committee under section 90a of Book V of the Social Code exists, for recommendations on cross-sectoral care issues, to the competent state authorities; the use of the data for the purposes of recommendations on cross-sectoral care issues, in particular the safeguarding of the hospitals' trade secrets, shall be regulated by the federal states in an ordinance, involving the data protection commissioner of the respective federal state,
3. landesbezogenen Daten nach Absatz 2 Nummer 1 Buchstabe a bis c, e, f und h und Nummer 2 Buchstabe b, d bis g und i für Zwecke der Krankenhausplanung sowie zusätzlich nach Absatz 2 Nummer 2 Buchstabe h für Zwecke der Investitionsförderung, sofern das Land hierfür Investitionspauschalen nach § 10 des Krankenhausfinanzierungsgesetzes verwendet oder dies beabsichtigt, und, sofern ein gemeinsames Landesgremium nach § 90a des Fünften Buches Sozialgesetzbuch besteht, für Empfehlungen zu sektorenübergreifenden Versorgungsfragen an die zuständigen Landesbehörden; die Datennutzung für Zwecke der Empfehlungen zu sektorenübergreifenden Versorgungsfragen, insbesondere die Wahrung der Betriebsgeheimnisse der Krankenhäuser, regeln die Länder unter Einbeziehung des Datenschutzbeauftragten des jeweiligen Landes in einer Verordnung,
4. data under subsection (2) item 1 letters a, c, d, g and h and item 2 letters b and d to i, for the purposes of official hospital statistics, to the Federal Statistical Office; the latter may transmit state-related data to the statistical offices of the federal states.

After completion of the plausibility check, it shall no longer be possible to establish a link to an identifiable person.
Nach Abschluss der Plausibilitätsprüfung darf die Herstellung eines Personenbezugs nicht mehr möglich sein.
The data office shall publish aggregated data under subsection (1) by 1 July of each year, broken down by federal and state-wide results; use of the published data by third parties shall be permitted exclusively for non-commercial purposes.
Die Datenstelle veröffentlicht zusammengefasste Daten nach Absatz 1 jeweils bis zum 1. Juli, gegliedert nach bundes- und landesweiten Ergebnissen; eine Nutzung der veröffentlichten Daten durch Dritte ist ausschließlich zu nicht-kommerziellen Zwecken zulässig.
The Federal Ministry of Health shall, upon request, be provided without delay with analyses for its purposes and for analyses recommended under sentence 5; the Federal Ministry of Health shall also transmit these analyses to the state authorities responsible for hospital planning.
Dem Bundesministerium für Gesundheit sind auf Anforderung unverzüglich Auswertungen für seine Belange und für empfohlene Auswertungen nach Satz 5 zur Verfügung zu stellen; diese Auswertungen übermittelt das Bundesministerium für Gesundheit auch den für die Krankenhausplanung zuständigen Landesbehörden.
The federal states may recommend additional analyses to the Federal Ministry of Health.
Die Länder können dem Bundesministerium für Gesundheit zusätzliche Auswertungen empfehlen.
The data office shall transmit or publish data under this subsection only if no link to individual patients can be established.
Die Datenstelle übermittelt oder veröffentlicht Daten nach diesem Absatz nur, wenn ein Bezug zu einzelnen Patienten nicht hergestellt werden kann.
The data recipients under sentence 1 items 3 and 4 may process the postcode and the place of residence, in the city states the city district, only for the compilation of catchment area statistics for a hospital or, where the care mandate is differentiated by site, for a site; in so doing, only the following data may be combined: postcode, place of residence, in the city states city district, number of patients and specialist department in conjunction with DRG case-based flat rates or principal diagnosis or procedure.
Die Datenempfänger nach Satz 1 Nr. 3 und 4 dürfen die Postleitzahl und den Wohnort, in den Stadtstaaten den Stadtteil, nur für die Erstellung von Einzugsgebietsstatistiken für ein Krankenhaus oder bei nach Standorten differenziertem Versorgungsauftrag für einen Standort verarbeiten; dabei dürfen nur folgende Daten verbunden werden: Postleitzahl, Wohnort, in den Stadtstaaten Stadtteil, Patientenzahl und Fachabteilung in Verbindung mit DRG-Fallpauschalen oder Hauptdiagnose oder Prozedur.
The Federal Cartel Office (Bundeskartellamt) shall, upon request, be provided, for selected hospitals, with data under subsection (2) item 1 letters a and d and item 2 letters b, d, e, g and h for merger control under the Act against Restraints of Competition (Gesetz gegen Wettbewerbsbeschränkungen), insofar as the hospitals are affected by merger control proceedings to be specified in each case.
Dem Bundeskartellamt sind auf Anforderung für ausgewählte Krankenhäuser Daten nach Absatz 2 Nummer 1 Buchstabe a und d und Nummer 2 Buchstabe b, d, e, g und h zur Fusionskontrolle nach dem Gesetz gegen Wettbewerbsbeschränkungen zur Verfügung zu stellen, soweit die Krankenhäuser von einem jeweils zu benennenden Fusionskontrollverfahren betroffen sind.
Processing of the data other than that referred to in this subsection, in section 17b(8) of the Hospital Financing Act and in section 186a(4) of the Act against Restraints of Competition shall be prohibited.
Andere als die in diesem Absatz, in § 17b Absatz 8 des Krankenhausfinanzierungsgesetzes und in § 186a Absatz 4 des Gesetzes gegen Wettbewerbsbeschränkungen genannten Verarbeitungen der Daten sind unzulässig.
(3a) The Institute under section 137a of Book V of the Social Code or another body commissioned by the Federal Joint Committee under section 91 of Book V of the Social Code may request selected service data under subsection (2) item 2 letters a to f that have been transmitted pursuant to subsection (1), insofar as these are necessary and suitable, in nature and scope, for carrying out quality assurance measures under section 137a(3) of Book V of the Social Code.
(3a) Das Institut nach § 137a des Fünften Buches Sozialgesetzbuch oder eine andere vom Gemeinsamen Bundesausschuss nach § 91 des Fünften Buches Sozialgesetzbuch beauftragte Stelle kann ausgewählte, gemäß Absatz 1 übermittelte Leistungsdaten nach Absatz 2 Nummer 2 Buchstabe a bis f anfordern, soweit diese nach Art und Umfang notwendig und geeignet sind, um Maßnahmen der Qualitätssicherung nach § 137a Absatz 3 des Fünften Buches Sozialgesetzbuch durchführen zu können.
The Institute or another body commissioned under sentence 1 may also request corresponding data for the purposes of cross-institutional quality assurance at state level and transmit them to the respective competent institution at state level.
Das Institut oder eine andere nach Satz 1 beauftragte Stelle kann entsprechende Daten auch für Zwecke der einrichtungsübergreifenden Qualitätssicherung auf Landesebene anfordern und diese an die jeweils zuständige Institution auf Landesebene übermitteln.
The data office shall transmit the data insofar as the necessity under sentence 1 has been credibly demonstrated by the Institute or another body commissioned under sentence 1.
Die Datenstelle übermittelt die Daten, soweit die Notwendigkeit nach Satz 1 vom Institut oder einer anderen nach Satz 1 beauftragten Stelle glaubhaft dargelegt wurde.
(3b) For the review under section 24 of the Hospital Financing Act, for supplementary analyses for the purpose of the further development of the remuneration systems and for the purposes of hospital planning, the hospital shall transmit the data pursuant to subsection (2) item 1 letters a and h and item 2 to the data office at federal level operated by the Institute for the Hospital Remuneration System, on machine-readable data carriers, in addition to the transmission under subsection (1),

2. bis zum 15. Oktober jeden Jahres für Patientinnen und Patienten, die zwischen dem 1. Januar und dem 30. September des laufenden Kalenderjahres nach voll- oder teilstationärer Behandlung aus dem Krankenhaus entlassen worden sind, und
3. by 15 January of each year for patients who were discharged from the hospital after inpatient or day-patient treatment between 1 January and 31 December of the preceding calendar year.

(3d) The Institute for the Hospital Remuneration System shall analyse, by site, specialist department and service group, the data transmitted to the data office operated by it under subsections (1) and (3b), in the most recent version in each case, beginning with the data for calendar year 2022, and the data transmitted under subsection (7) sentence 1 and under section 137i(4) sentences 1 to 3, 6 and 7 of Book V of the Social Code, insofar as this is suitable and necessary, following coordination with the body commissioned under section 135d(2) sentence 1 of Book V of the Social Code, for the publication and updating of the transparency register under section 135d(1) sentence 1 of Book V of the Social Code and the body commissioned under section 135d(2) sentence 1 of Book V of the Social Code has credibly demonstrated the necessity.

(3e) The Institute for the Hospital Remuneration System shall analyse the data transmitted to the data office operated by it under subsections (1) and (3b), in the current version in each case, insofar as this is suitable and necessary, following coordination with the Institute for Quality and Efficiency in Health Care (IQWiG), for the fulfilment of a commission issued under section 135f(2) sentence 1 of Book V of the Social Code and the Institute for Quality and Efficiency in Health Care has credibly demonstrated the necessity.

From 1 January 2019, the agreement under sentence 1 shall be adapted by the data office under subsection (1) in accordance with the statutory requirements.

(5) The contracting parties under section 17b(2) sentence 1 of the Hospital Financing Act shall agree a deduction from the flat-rate hospital charges (pauschalierte Pflegesätze) under section 17(1) of the Hospital Financing Act for hospitals which fail to fulfil, fail to fulfil completely or fail to fulfil in good time their obligation to transmit the data under subsection (1) or subsection (3b); where the data under subsection (3b) are not transmitted, not transmitted completely or not transmitted in good time, the deduction to be agreed shall amount to at least EUR 20,000 for each site of the hospital, insofar as this does not result in undue hardship for the hospital; the data office shall regulate the details of the conditions for cases of undue hardship.
(5) Die Vertragsparteien nach § 17b Absatz 2 Satz 1 des Krankenhausfinanzierungsgesetzes vereinbaren einen Abschlag von den pauschalierten Pflegesätzen nach § 17 Absatz 1 des Krankenhausfinanzierungsgesetzes für die Krankenhäuser, die ihre Verpflichtung zur Übermittlung der Daten nach Absatz 1 oder Absatz 3b nicht, nicht vollständig oder nicht rechtzeitig erfüllen; im Fall einer nicht, nicht vollständigen oder nicht rechtzeitigen Übermittlung der Daten nach Absatz 3b hat der zu vereinbarende Abschlag mindestens 20 000 Euro für jeden Standort des Krankenhauses zu betragen, soweit hierdurch für das Krankenhaus keine unbillige Härte entsteht; die Datenstelle regelt das Nähere zu den Voraussetzungen unbilliger Härtefälle.
In addition, the data office shall set a flat-rate deduction per hospital site for each failure to transmit, incomplete transmission or late transmission of the data under subsection (2) item 1 letters e and f; this shall also apply where the transmitted data are not accepted by the data office in the course of the plausibility check; the data office shall lay down the details of the plausibility check and shall publish the specifications on its website.

The deduction under sentence 2 shall amount to at least EUR 20,000 and at most EUR 500,000.

To determine the deduction under sentence 2, a deduction factor shall be formed by dividing the total number of full-time nursing staff or of full-time medical staff of a hospital site by the number of full-time nursing staff or full-time medical staff for whom data were transmitted completely and in good time, the denominator being taken to be at least 1.

The deduction factor shall be rounded commercially to three decimal places and multiplied by the minimum deduction amount of EUR 20,000.

The data office shall in each case inform the contracting parties under section 18(2) of the Hospital Financing Act of infringements and of the amount of the respective deduction under sentence 2.

(7) For publication in the transparency register under section 135d of Book V of the Social Code and for the purposes of staff assessment (Personalbemessung), the hospital shall transmit the data referred to in subsection (2) item 1 letters a and f to the data office operated by the Institute for the Hospital Remuneration System, on machine-readable data carriers, in addition to the transmission under subsection (1), for each calendar quarter by the 15th of the following month, for the first time by 15 January 2024.
