(1) Subject to sections 3 to 6b and having regard to the hospital's care mandate under section 8(1) sentences 3 and 4, having regard to the results of the inspections under section 275a(1) sentence 1 item 2 of Book V of the Social Code (Sozialgesetzbuch) and in compliance with the requirements of the catalogue of minimum volumes under section 136b(1) sentence 1 item 2 of Book V of the Social Code, the contracting parties under section 18(2) of the Hospital Financing Act (Krankenhausfinanzierungsgesetz) (contracting parties) shall lay down in the agreement the revenue budget under section 4, the sum of the cost weights, the other charges under section 6, the revenue total under section 6(3), the nursing budget under section 6a, the supplements and deductions, the compensations for additional and reduced revenue and the compensation relating to the provision budget to be carried out under section 6b(5) sentence 5 and (6) sentence 6.
(1) Nach Maßgabe der §§ 3 bis 6b und unter Beachtung des Versorgungsauftrags des Krankenhauses nach § 8 Absatz 1 Satz 3 und 4, der Beachtung der Ergebnisse der Prüfungen nach § 275a Absatz 1 Satz 1 Nummer 2 des Fünften Buches Sozialgesetzbuch und der Einhaltung der Vorgaben des Mindestmengenkatalogs nach § 136b Absatz 1 Satz 1 Nummer 2 des Fünften Buches Sozialgesetzbuch regeln die Vertragsparteien nach § 18 Abs. 2 des Krankenhausfinanzierungsgesetzes (Vertragsparteien) in der Vereinbarung das Erlösbudget nach § 4, die Summe der Bewertungsrelationen, die sonstigen Entgelte nach § 6, die Erlössumme nach § 6 Absatz 3, das Pflegebudget nach § 6a, die Zu- und Abschläge, die Mehr- und Mindererlösausgleiche und den nach § 6b Absatz 5 Satz 5 und Absatz 6 Satz 6 vorzunehmenden Ausgleich des Vorhaltebudgets.
The agreement shall be concluded for a future period (agreement period).

The agreement shall contain provisions ensuring prompt payment of the charges to the hospital; to this end, rules on appropriate monthly instalments and on default interest in the event of late payment shall in particular be laid down.
Die Vereinbarung muss Bestimmungen enthalten, die eine zeitnahe Zahlung der Entgelte an das Krankenhaus gewährleisten; hierzu sollen insbesondere Regelungen über angemessene monatliche Teilzahlungen und Verzugszinsen bei verspäteter Zahlung getroffen werden.
The agreement shall be reached by consensus between the contracting parties who took part in the negotiation; it shall be concluded in writing or electronically and shall be documented on machine-readable data carriers using the documents referred to in subsection (4) sentence 1.

The agreement shall provide that funds which are not used for their intended purpose of financing pay-scale increases for nursing staff are to be repaid.

(2) The agreement period shall be one calendar year if the hospital is operated throughout the year.

A period covering several calendar years may be agreed.

(3) The contracting parties shall commence the negotiation without delay after a contracting party has requested them to do so in writing or electronically.
(3) Die Vertragsparteien nehmen die Verhandlung unverzüglich auf, nachdem eine Vertragspartei dazu schriftlich oder elektronisch aufgefordert hat.
The negotiation shall be concluded in sufficient time for the new revenue budget, the new nursing budget and the new charges to be able to enter into force at the end of the year preceding the year for which the agreement is to apply; the negotiation shall be concluded within six weeks of the request by a contracting party referred to in sentence 1.
Die Verhandlung soll so rechtzeitig abgeschlossen werden, dass das neue Erlösbudget, das neue Pflegebudget und die neuen Entgelte mit Ablauf des Jahres, das dem Jahr vorausgeht, für das die Vereinbarung gelten soll, in Kraft treten können; die Verhandlung ist innerhalb von sechs Wochen nach der in Satz 1 genannten Aufforderung einer Vertragspartei abzuschließen.
The revenue budget to be agreed for the year 2025 shall be agreed taking into account the change value (Veränderungswert) agreed under section 9(1b) sentence 1 second half-sentence; agreements on this revenue budget concluded by the end of 11 December 2024 shall be adjusted accordingly by 12 February 2025.

(4) In preparation for the negotiation, the hospital operator shall transmit, by 31 December of the year preceding the year for which the agreement is to apply at the latest, to the other contracting parties, to the parties involved referred to in section 18(1) sentence 2 of the Hospital Financing Act and to the competent state authority Parts E1 to E3 and B1 in accordance with Annex 1 to this Act, the documents under section 6a(3) sentences 1 and 2 and the evidence under section 9(1) item 7; where, as at 31 December of the year preceding the year for which the agreement is to apply, a state base rate for the year for which the agreement is to apply has not yet been approved under section 14(1), the documents shall be transmitted within six weeks of the approval of that state base rate under section 14(1).

Dezember des Jahres, das dem Jahr vorausgeht, für das die Vereinbarung gelten soll, den anderen Vertragsparteien, den in § 18 Absatz 1 Satz 2 des Krankenhausfinanzierungsgesetzes genannten Beteiligten und der zuständigen Landesbehörde die Abschnitte E1 bis E3 und B1 nach Anlage 1 dieses Gesetzes, die Unterlagen nach § 6a Absatz 3 Satz 1 und 2 und den Nachweis nach § 9 Absatz 1 Nummer 7; soweit zum 31. Dezember des Jahres, das dem Jahr vorausgeht, für das die Vereinbarung gelten soll, ein Landesbasisfallwert für das Jahr, für das die Vereinbarung gelten soll, noch nicht nach § 14 Absatz 1 genehmigt wurde, sind die Unterlagen innerhalb von sechs Wochen nach der Genehmigung dieses Landesbasisfallwerts nach § 14 Absatz 1 zu übermitteln.

Where this is necessary in the individual case for assessing the services of the hospital within the scope of its care mandate, the other contracting parties under section 18(2) items 1 and 2 of the Hospital Financing Act may, within six weeks of submission of the data, jointly and on one occasion only request the submission of additional documents and the provision of information.
Soweit dies zur Beurteilung der Leistungen des Krankenhauses im Rahmen seines Versorgungsauftrags im Einzelfall erforderlich ist, können die anderen Vertragsparteien nach § 18 Absatz 2 Nummer 1 und 2 des Krankenhausfinanzierungsgesetzes innerhalb von sechs Wochen nach Vorlage der Daten gemeinsam einmalig die Vorlage von zusätzlichen Unterlagen und die Erteilung von Auskünften verlangen.
The hospital shall submit the additional documents and provide the information within six weeks of receipt of the request under sentence 3.
Das Krankenhaus hat innerhalb von sechs Wochen nach Eingang des Verlangens nach Satz 3 die zusätzlichen Unterlagen vorzulegen und die Auskünfte zu erteilen.
In the case of a request under sentence 3, the expected benefit must clearly exceed the effort caused.
Bei dem Verlangen nach Satz 3 muss der zu erwartende Nutzen den verursachten Aufwand deutlich übersteigen.
The other contracting parties under section 18(2) items 1 and 2 of the Hospital Financing Act shall agree, for the period from 1 July of the year for which the agreement under subsection (1) sentence 1 is to apply until one month after the agreement under subsection (1) sentence 1 or after the determination under section 13(1) or (3), a deduction of 1 per cent of the invoice amount for each full or day-patient case, provided that the hospital operator fails to comply with its obligations under sentence 1 or sentence 4 and the other contracting parties have offered the hospital at least three reasonable dates for the negotiation for the period before a deduction may be levied.

Juli des Jahres, für das die Vereinbarung nach Absatz 1 Satz 1 gelten soll, bis einen Monat nach der Vereinbarung nach Absatz 1 Satz 1 oder nach der Festsetzung nach § 13 Absatz 1 oder Absatz 3 einen Abschlag in Höhe von 1 Prozent des Rechnungsbetrags für jeden voll- oder teilstationären Fall, sofern der Krankenhausträger seinen Pflichten nach Satz 1 oder Satz 4 nicht nachkommt und die anderen Vertragsparteien für die Zeit vor einer möglichen Erhebung eines Abschlags dem Krankenhaus mindestens drei zumutbare Termine für die Verhandlung angeboten haben.
The date of conclusion of the agreement under subsection (1) sentence 1 shall be documented by the contracting parties in writing or electronically; in the case of a determination under section 13(1) or (3), the date of the decision of the arbitration board shall apply.

The hospital operator shall transmit the agreements under subsection (1) sentences 1 and 6 in machine-readable form to the Association of Private Health Insurance (Verband der Privaten Krankenversicherung).

The approval of the agreed deduction shall be applied for by the other contracting parties under section 18(2) items 1 and 2 of the Hospital Financing Act to the state authority responsible for hospital planning.

The other contracting parties under section 18(2) items 1 and 2 of the Hospital Financing Act shall inform the hospital operator and the arbitration board under section 18a(1) of the Hospital Financing Act of the application at the time the application is filed.

The state authority responsible for hospital planning shall approve the levying of the deduction within four weeks of receipt of the application if the agreement complies with applicable law.
Die für die Krankenhausplanung zuständige Landesbehörde genehmigt die Erhebung des Abschlags innerhalb von vier Wochen ab dem Eingang des Antrags, wenn die Vereinbarung dem geltenden Recht entspricht.
The state authority responsible for hospital planning shall inform the Association of Private Health Insurance of its decision on the approval.
Die für die Krankenhausplanung zuständige Landesbehörde informiert den Verband der Privaten Krankenversicherung über ihre Entscheidung über die Genehmigung.
(5) The contracting parties shall be obliged to clarify jointly in advance essential questions concerning the care mandate and the service structure of the hospital and concerning the amount of the supplements and deductions under section 5 early enough for the negotiation to be conducted swiftly.
(5) Die Vertragsparteien sind verpflichtet, wesentliche Fragen zum Versorgungsauftrag und zur Leistungsstruktur des Krankenhauses sowie zur Höhe der Zu- und Abschläge nach § 5 so frühzeitig gemeinsam vorzuklären, dass die Verhandlung zügig durchgeführt werden kann.
(6) For the agreement periods up to and including the agreement period 2025 for which no agreement under subsection (1) sentence 1 had yet been concluded by 29 December 2022, the hospital operator shall transmit the data referred to in subsection (4) sentence 1
(6) Für die Vereinbarungszeiträume bis einschließlich des Vereinbarungszeitraums 2025, für die bis zum 29. Dezember 2022 noch keine Vereinbarung nach Absatz 1 Satz 1 geschlossen wurde, sind von dem Krankenhausträger die in Absatz 4 Satz 1 genannten Daten zu übermitteln
1. by 31 October 2023 for the agreement periods up to and including the agreement period 2021,
1. bis zum 31. Oktober 2023 für die Vereinbarungszeiträume bis einschließlich des Vereinbarungszeitraums 2021,
2. by 31 March 2024 for the agreement period 2022,
2. bis zum 31. März 2024 für den Vereinbarungszeitraum 2022,
3. by 30 September 2024 for the agreement period 2023,
3. bis zum 30. September 2024 für den Vereinbarungszeitraum 2023,
4. by 31 March 2025 for the agreement period 2024 and
4. bis zum 31. März 2025 für den Vereinbarungszeitraum 2024 und
5. by 30 September 2025 for the agreement period 2025.
5. bis zum 30. September 2025 für den Vereinbarungszeitraum 2025.
Subsection (4) sentences 2 to 10 shall apply to the submission of the documents and to the provision of information, subject to the proviso that the deduction under subsection (4) sentence 6 shall be agreed as follows:

Section 13(1), (2) and (3) sentence 3 shall apply accordingly.

(7) The contracting parties shall notify the Institute for the Hospital Remuneration System (InEK) in writing or electronically by 30 September of a year if a hospital or parts of a hospital

1. was or were previously excluded from the remuneration system as a special facility under section 17b(1) sentence 10 of the Hospital Financing Act and is or are to be included in the remuneration system in the respective following calendar year, or
1. bisher nach § 17b Absatz 1 Satz 10 des Krankenhausfinanzierungsgesetzes als besondere Einrichtung aus dem Vergütungssystem ausgenommen war oder waren und in dem jeweils folgenden Kalenderjahr in das Vergütungssystem einbezogen wird oder werden oder
2. is or are to be excluded from the remuneration system as a special facility under section 17b(1) sentence 10 of the Hospital Financing Act in the respective following calendar year.
2. in dem jeweils folgenden Kalenderjahr nach § 17b Absatz 1 Satz 10 des Krankenhausfinanzierungsgesetzes als besondere Einrichtung aus dem Vergütungssystem ausgenommen wird oder werden.
