(1) The revenue budget to be agreed by the contracting parties under section 11(1) shall comprise, for inpatient and day-patient services, the case-based flat rates (DRGs) under section 7(1) sentence 1 item 1, in the years 2026 and 2027 in each case including the provision cost weights (Vorhaltebewertungsrelationen) resulting from the nationwide uniform catalogue of charges, and the supplementary charges under section 7(1) sentence 1 item 2.
(1) Das von den Vertragsparteien nach § 11 Absatz 1 zu vereinbarende Erlösbudget umfasst für voll- und teilstationäre Leistungen die Fallpauschalen nach § 7 Absatz 1 Satz 1 Nummer 1, in den Jahren 2026 und 2027 jeweils einschließlich der sich aus dem bundeseinheitlichen Entgeltkatalog ergebenden Vorhaltebewertungsrelationen, und die Zusatzentgelte nach § 7 Absatz 1 Satz 1 Nummer 2.
It shall not comprise the revenue volume under section 4a, the charges to be agreed individually for each hospital under section 6(1) to (2a), the supplementary charges for the treatment of haemophiliacs, the supplements and deductions under section 7(1), the charges for pilot projects under section 63 of Book V of the Social Code or the remuneration for integrated care under section 140a of Book V of the Social Code.
Es umfasst nicht das Erlösvolumen nach § 4a, nicht die krankenhausindividuell zu vereinbarenden Entgelte nach § 6 Absatz 1 bis 2a, nicht die Zusatzentgelte für die Behandlung von Blutern, nicht die Zu- und Abschläge nach § 7 Absatz 1, nicht die Entgelte für Modellvorhaben nach § 63 des Fünften Buches Sozialgesetzbuch und nicht die Vergütung nach § 140a des Fünften Buches Sozialgesetzbuch für die integrierte Versorgung.
(2) The revenue budget shall be determined on a service-related basis by multiplying, for the services expected to be provided, the type and quantity of the charges under subsection (1) sentence 1 by the relevant level of charge in each case.
(2) Das Erlösbudget wird leistungsorientiert ermittelt, indem für die voraussichtlich zu erbringenden Leistungen Art und Menge der Entgelte nach Absatz 1 Satz 1 mit der jeweils maßgeblichen Entgelthöhe multipliziert werden.
The level of charge for the case-based flat rates shall be determined by valuing them, in accordance with the requirements of the catalogue of charges and the billing rules, with the effective cost weights and with the state base rate under section 10.
Die Entgelthöhe für die Fallpauschalen wird ermittelt, indem diese nach den Vorgaben des Entgeltkatalogs und der Abrechnungsbestimmungen mit den effektiven Bewertungsrelationen und mit dem Landesbasisfallwert nach § 10 bewertet werden.
In the case of patients who receive inpatient treatment in the hospital over the turn of the year (patients spanning the year-end, Überlieger), the revenue from case-based flat rates shall be allocated in full to the year in which the patients are discharged.
Bei Patientinnen und Patienten, die über den Jahreswechsel im Krankenhaus stationär behandelt werden (Überlieger), werden die Erlöse aus Fallpauschalen in voller Höhe dem Jahr zugeordnet, in dem die Patientinnen und Patienten entlassen werden.
(2a) By way of derogation from subsection (2) sentence 2, for the last time for the year 2027, a remuneration deduction of 35 per cent, to be levied in each case for three years (fixed-cost degression deduction), shall be applied to services valued with case-based flat rates which are taken into account in the revenue budget in addition, compared with the agreement for the current calendar year.
(2a) Abweichend von Absatz 2 Satz 2 ist, letztmalig für das Jahr 2027, für mit Fallpauschalen bewertete Leistungen, die im Vergleich zur Vereinbarung für das laufende Kalenderjahr zusätzlich im Erlösbudget berücksichtigt werden, ein jeweils für drei Jahre zu erhebender Vergütungsabschlag von 35 Prozent (Fixkostendegressionsabschlag) anzuwenden.
The deduction under sentence 1 to be applied for the hospital shall apply
Der für das Krankenhaus anzuwendende Abschlag nach Satz 1 gilt
a) transplantations, polytraumas, patients with severe burns, the care of premature infants and services of neurological-neurosurgical early rehabilitation following a stroke or a very severe traumatic brain injury of the patient,
a) Transplantationen, Polytraumata, schwer brandverletzten Patientinnen und Patienten, der Versorgung von Frühgeborenen und bei Leistungen der neurologisch-neurochirurgischen Frührehabilitation nach einem Schlaganfall oder einer Schwerstschädelhirnverletzung der Patientin oder des Patienten,
b) services with a share of material costs of more than two thirds,
b) Leistungen mit einem Sachkostenanteil von mehr als zwei Dritteln,
c) additionally approved care mandates for which there was previously no possibility of billing,
c) zusätzlich bewilligten Versorgungsaufträgen, für die bislang keine Abrechnungsmöglichkeit bestand,
d) services of centres designated in hospital planning under section 2(2) sentence 4, and
d) Leistungen von nach § 2 Absatz 2 Satz 4 krankenhausplanerisch ausgewiesenen Zentren sowie
e) services whose valuation has been lowered or graduated under section 9(1c),
e) Leistungen, deren Bewertung nach § 9 Absatz 1c abgesenkt oder abgestuft wurde,
f) services for the treatment of patients with a SARS-CoV-2 infection or with a suspected SARS-CoV-2 infection,
f) Leistungen zur Behandlung von Patientinnen und Patienten mit einer SARS-CoV-2-Infektion oder mit Verdacht auf eine SARS-CoV-2-Infektion,
g) services which the contracting parties under section 11(1) exempt from the levying of the deduction in order to avoid unreasonable hardship,
g) Leistungen, die von den Vertragsparteien nach § 11 Absatz 1 von der Erhebung des Abschlags ausgenommen werden, um unzumutbare Härten zu vermeiden,
2. at half the rate for services listed in the catalogue of services not prone to volume increases under section 9(1) item 6.
2. hälftig für Leistungen, die in dem Katalog nicht mengenanfälliger Leistungen nach § 9 Absatz 1 Nummer 6 aufgeführt sind.
By way of derogation from sentence 1, for services resulting from a shift of services between hospitals which does not lead to an increase in the sum of the effective cost weights in the hospital's catchment area, the deduction under sentence 1 to be applied for the hospital shall be applied at half the rate; the hospital shall credibly demonstrate these shifts of services between hospitals on the basis of information available to the parties involved under section 18(1) sentence 2 of the Hospital Financing Act (Krankenhausfinanzierungsgesetz) in the hospital's catchment area.
Abweichend von Satz 1 ist für Leistungen, die durch eine Verlagerung von Leistungen zwischen Krankenhäusern begründet sind, die nicht zu einem Anstieg der Summe der effektiven Bewertungsrelationen im Einzugsgebiet des Krankenhauses führt, der für das Krankenhaus anzuwendende Abschlag nach Satz 1 in halber Höhe anzuwenden; diese Leistungsverlagerungen zwischen Krankenhäusern sind vom Krankenhaus auf der Grundlage von Informationen, die den Beteiligten nach § 18 Absatz 1 Satz 2 des Krankenhausfinanzierungsgesetzes im Einzugsgebiet des Krankenhauses vorliegen, glaubhaft darzulegen.
The remuneration deduction shall be implemented by means of a uniform deduction on all services of the hospital remunerated with the state base rate.
Der Vergütungsabschlag ist durch einen einheitlichen Abschlag auf alle mit dem Landesbasisfallwert vergüteten Leistungen des Krankenhauses umzusetzen.
A decrease, agreed during the relevant deduction period, in the services valued with case-based flat rates shall be taken into account as a reduction when determining the basis for calculating the deduction.
Ein während der maßgeblichen Abschlagsdauer vereinbarter Rückgang der mit Fallpauschalen bewerteten Leistungen ist bei der Ermittlung der Grundlage der Bemessung des Abschlags mindernd zu berücksichtigen.
For the implementation of the fixed-cost degression deduction, the requirements agreed by the contracting parties at federal level under section 9(1) item 6 shall be applied.
Für die Umsetzung des Fixkostendegressionsabschlags sind die Vorgaben, die die Vertragsparteien auf Bundesebene nach § 9 Absatz 1 Nummer 6 vereinbaren, anzuwenden.
The fixed-cost degression deduction shall not apply to the agreement of the revenue budget for the year 2020.
Der Fixkostendegressionsabschlag gilt nicht für die Vereinbarung des Erlösbudgets für das Jahr 2020.

3. relates to the services valued with case-based flat rates which were taken into account in the revenue budget for the year 2020 in addition to those for the year 2019 shall be levied only in the years 2021 and 2022,
3. sich auf die für das Jahr 2020 gegenüber dem Jahr 2019 zusätzlich im Erlösbudget berücksichtigten Leistungen bezieht, die mit Fallpauschalen bewertet werden, nur in den Jahren 2021 und 2022 zu erheben,
4. was agreed for the year 2021 shall be applied to the services valued with case-based flat rates which are taken into account in the revenue budget in addition, compared with the agreement for the year 2019.
4. für das Jahr 2021 vereinbart wurde, auf die mit Fallpauschalen bewerteten Leistungen anzuwenden, die im Vergleich zur Vereinbarung für das Jahr 2019 zusätzlich im Erlösbudget berücksichtigt werden.
By way of derogation from sentence 1, the fixed-cost degression deduction agreed for the years from 2022 onwards shall in each case be applied to the services valued with case-based flat rates which are taken into account in the revenue budget in addition, compared with the agreement for the year 2019.
Abweichend von Satz 1 ist der Fixkostendegressionsabschlag, der für die Jahre ab dem Jahr 2022 vereinbart wird, jeweils auf die mit Fallpauschalen bewerteten Leistungen anzuwenden, die im Vergleich zur Vereinbarung für das Jahr 2019 zusätzlich im Erlösbudget berücksichtigt werden.
Sentence 8 item 4 and sentence 9 shall not apply as soon as more services valued with case-based flat rates have been agreed in the revenue budget for the respective preceding year than for the year 2019.
Satz 8 Nummer 4 und Satz 9 finden keine Anwendung, sobald für das jeweilige Vorjahr mehr Leistungen, die mit Fallpauschalen bewertet werden, im Erlösbudget vereinbart wurden als für das Jahr 2019.
By way of derogation from sentence 1, the fixed-cost degression deduction shall not be applied to services valued with case-based flat rates which are taken into account in the revenue budget for the year 2025 in addition owing to the expiry of the years of application referred to in section 4a(1) sentence 1.
Abweichend von Satz 1 ist der Fixkostendegressionsabschlag nicht für mit Fallpauschalen bewertete Leistungen anzuwenden, die aufgrund des Ablaufs der in § 4a Absatz 1 Satz 1 genannten Anwendungsjahre für das Jahr 2025 zusätzlich im Erlösbudget berücksichtigt werden.
(3) For the purpose of determining compensation for additional or reduced revenue, the revenue budget agreed in accordance with subsections (1) and (2) and the revenue sum agreed under section 6(3) shall be combined into a total amount.
(3) Das nach den Absätzen 1 und 2 vereinbarte Erlösbudget und die nach § 6 Absatz 3 vereinbarte Erlössumme werden für die Ermittlung von Mehr- oder Mindererlösausgleichen zu einem Gesamtbetrag zusammengefasst.
Where the sum of the hospital's revenue attributable to the calendar year from the charges under section 7(1) sentence 1 items 1 and 2 and under section 6(1) sentence 1 and (2a) deviates from the total amount formed under sentence 1, the additional or reduced revenue shall be compensated in accordance with the following sentences.
Weicht die Summe der auf das Kalenderjahr entfallenden Erlöse des Krankenhauses aus den Entgelten nach § 7 Absatz 1 Satz 1 Nummer 1 und 2 und nach § 6 Absatz 1 Satz 1 und Absatz 2a von dem nach Satz 1 gebildeten Gesamtbetrag ab, werden die Mehr- oder Mindererlöse nach Maßgabe der folgenden Sätze ausgeglichen.
From the year 2007, reduced revenue shall in principle be compensated at 20 per cent and from the year 2028 shall not be compensated; reduced revenue from supplementary charges for medicinal products and medical supplies shall not be compensated.
Mindererlöse werden ab dem Jahr 2007 grundsätzlich zu 20 Prozent und ab dem Jahr 2028 nicht ausgeglichen; Mindererlöse aus Zusatzentgelten für Arzneimittel und Medikalprodukte werden nicht ausgeglichen.
Additional revenue from supplementary charges for medicinal products and medical supplies and from case-based flat rates for seriously injured patients, in particular patients with polytrauma or severe burns, shall be compensated at 25 per cent, and other additional revenue at 65 per cent.
Mehrerlöse aus Zusatzentgelten für Arzneimittel und Medikalprodukte und aus Fallpauschalen für schwerverletzte, insbesondere polytraumatisierte oder schwer brandverletzte Patienten werden zu 25 Prozent, sonstige Mehrerlöse zu 65 Prozent ausgeglichen.
For case-based flat rates with a very high share of material costs and for expensive case-based flat rates with a volume of services that is difficult to plan, in particular in the case of transplantations or long-term ventilation, the contracting parties should agree in advance on compensation deviating from sentences 3 and 4; for additional or reduced revenue arising as a result of an epidemic, the contracting parties may agree on compensation deviating from sentences 3 and 4 even after the end of the agreement period.
Für Fallpauschalen mit einem sehr hohen Sachkostenanteil sowie für teure Fallpauschalen mit einer schwer planbaren Leistungsmenge, insbesondere bei Transplantationen oder Langzeitbeatmung, sollen die Vertragsparteien im Voraus einen von den Sätzen 3 und 4 abweichenden Ausgleich vereinbaren; für Mehr- oder Mindererlöse, die auf Grund einer Epidemie entstehen, können die Vertragsparteien auch nach Ablauf des Vereinbarungszeitraums einen von den Sätzen 3 und 4 abweichenden Ausgleich vereinbaren.
From the year 2028, the agreement of compensation for reduced revenue shall be excluded even where the conditions referred to in sentence 5 are met.
Ab dem Jahr 2028 ist die Vereinbarung eines Ausgleichs für Mindererlöse auch bei Vorliegen der in Satz 5 genannten Voraussetzungen ausgeschlossen.
Additional or reduced revenue from supplementary charges for the treatment of haemophiliacs and as a result of deductions under section 8(4) shall not be compensated.
Mehr- oder Mindererlöse aus Zusatzentgelten für die Behandlung von Blutern sowie auf Grund von Abschlägen nach § 8 Absatz 4 werden nicht ausgeglichen.
In order to determine the additional or reduced revenue, the hospital operator shall submit a statement, certified by the annual auditor, of the revenue under section 7(1) sentence 1 items 1, 2, 5 and 6b.
Zur Ermittlung der Mehr- oder Mindererlöse hat der Krankenhausträger eine vom Jahresabschlussprüfer bestätigte Aufstellung über die Erlöse nach § 7 Absatz 1 Satz 1 Nummer 1, 2, 5 und 6b vorzulegen.
The compensatory amount determined in accordance with these requirements shall be invoiced by way of the supplement or deduction under section 5(4).
Der nach diesen Vorgaben ermittelte Ausgleichsbetrag wird im Rahmen des Zu- oder Abschlags nach § 5 Absatz 4 abgerechnet.
Where the compensatory amount has not yet been established at the time of the budget negotiations, partial amounts shall be taken into account as payments on account towards the compensation.
Steht bei der Budgetverhandlung der Ausgleichsbetrag noch nicht fest, sind Teilbeträge als Abschlagszahlung auf den Ausgleich zu berücksichtigen.
(4) At the request of the hospital, services for foreign patients who enter the Federal Republic of Germany for the purpose of hospital treatment, and services for recipients of health benefits under the Asylum Seekers' Benefits Act (Asylbewerberleistungsgesetz), shall not be remunerated within the revenue budget.
(4) Auf Verlangen des Krankenhauses werden Leistungen für ausländische Patienten, die mit dem Ziel einer Krankenhausbehandlung in die Bundesrepublik Deutschland einreisen, sowie Leistungen für Empfänger von Gesundheitsleistungen nach dem Asylbewerberleistungsgesetz nicht im Rahmen des Erlösbudgets vergütet.
(5) The contracting parties under section 11 shall be bound by the revenue budget.
(5) Die Vertragsparteien nach § 11 sind an das Erlösbudget gebunden.
At the request of a contracting party, the revenue budget for the current calendar year shall be renegotiated in the event of material changes in the assumptions on which the agreement of the revenue budget was based.
Auf Verlangen einer Vertragspartei ist bei wesentlichen Änderungen der der Vereinbarung des Erlösbudgets zu Grunde gelegten Annahmen das Erlösbudget für das laufende Kalenderjahr neu zu vereinbaren.
The contracting parties may agree in advance that, in certain cases, the revenue budget is to be only partially renegotiated.
Die Vertragsparteien können im Voraus vereinbaren, dass in bestimmten Fällen das Erlösbudget nur teilweise neu vereinbart wird.
The difference from the previous revenue budget shall be invoiced by way of the supplement or deduction under section 5(4).
Der Unterschiedsbetrag zum bisherigen Erlösbudget ist im Rahmen des Zu- oder Abschlags nach § 5 Abs. 4 abzurechnen.
(6) For as long as the contracting parties at federal level under section 9 have agreed in principle on a deduction under section 17b(1a) item 1 of the Hospital Financing Act for the non-participation of hospitals in emergency care but have not specified its amount, an amount of EUR 50 per inpatient case shall be deducted.
(6) Solange die Vertragsparteien auf Bundesebene nach § 9 für die Nichtteilnahme von Krankenhäusern an der Notfallversorgung dem Grunde nach einen Abschlag nach § 17b Absatz 1a Nummer 1 des Krankenhausfinanzierungsgesetzes vereinbart, diesen jedoch in der Höhe nicht festgelegt haben, ist ein Betrag in Höhe von 50 Euro je vollstationärem Fall abzuziehen.
(7) Where special facilities under section 6(1) previously excluded from the application of the DRG remuneration system are included in the revenue budget during the agreement period, the difference between the share of these services in the most recently agreed revenue sum under section 6(3) and the new share of remuneration agreed within the revenue budget shall be phased out over a period of three years.
(7) Werden von der Anwendung des DRG-Vergütungssystems bisher ausgenommene besondere Einrichtungen nach § 6 Abs. 1 im Vereinbarungszeitraum in das Erlösbudget einbezogen, wird die Differenz zwischen dem Anteil dieser Leistungen an der zuletzt vereinbarten Erlössumme nach § 6 Abs. 3 und dem neuen im Rahmen des Erlösbudgets vereinbarten Vergütungsanteil in einem Zeitraum von drei Jahren schrittweise abgebaut.
Where the share of remuneration previously agreed under section 6(3) was higher, the revenue budget under subsection (2) shall be increased in the first year by two thirds and in the second year by one third of the difference determined for the respective year; where the share of remuneration previously agreed was lower, the revenue budget under subsection (2) shall be reduced accordingly.
War der bisher nach § 6 Abs. 3 vereinbarte Vergütungsanteil höher, wird das Erlösbudget nach Absatz 2 im ersten Jahr um zwei Drittel und im zweiten Jahr um ein Drittel der für das jeweilige Jahr ermittelten Differenz erhöht; war der bisher vereinbarte Vergütungsanteil niedriger, wird das Erlösbudget nach Absatz 2 entsprechend vermindert.
The case-based flat rates shall be valued with the state base rate and invoiced at the corresponding amount.
Die Fallpauschalen werden mit dem Landesbasisfallwert bewertet und in entsprechender Höhe in Rechnung gestellt.
The resulting shortfall or surplus in coverage of the agreed revenue budget shall be financed by a supplement on, or deduction from, the invoiced amount of the DRG case-based flat rates and the supplementary charges (section 7(1) sentence 1 items 1 and 2) and the other charges under section 6(1) sentence 1 and (2a), and shall be shown separately on the invoice.
Die sich hierdurch ergebende Unter- oder Überdeckung des vereinbarten Erlösbudgets wird durch einen Zu- oder Abschlag auf die abgerechnete Höhe der DRG-Fallpauschalen und die Zusatzentgelte (§ 7 Abs. 1 Satz 1 Nr. 1 und 2) sowie auf die sonstigen Entgelte nach § 6 Abs. 1 Satz 1 und Abs. 2a finanziert und gesondert in der Rechnung ausgewiesen.
The amount of the supplement shall be calculated on the basis of a percentage to be determined from the ratio of the shortfall or surplus amount, on the one hand, to the total amount under subsection (3) sentence 1, on the other, and to be agreed by the contracting parties.
Die Höhe des Zuschlags ist anhand eines Prozentsatzes zu berechnen, der aus dem Verhältnis des Unter- oder Überdeckungsbetrags einerseits sowie des Gesamtbetrags nach Absatz 3 Satz 1 andererseits zu ermitteln und von den Vertragsparteien zu vereinbaren ist.
Compensation for previous years and for a delayed start of the term under section 15 shall be offset via the supplements under section 5(4).
Ausgleiche für Vorjahre und für einen verspäteten Beginn der Laufzeit nach § 15 sind über die Zuschläge nach § 5 Abs. 4 zu verrechnen.
(8a) With the aim of providing additional support for new hires or increases in the hours of existing part-time positions of trained nursing staff or of midwives (Hebammen and Entbindungspfleger), suitable measures to improve the compatibility of nursing work, family and career shall be financially supported at 50 per cent for the years 2019 to 2024.
(8a) Mit dem Ziel, Neueinstellungen oder Aufstockungen vorhandener Teilzeitstellen von ausgebildetem Pflegepersonal oder von Hebammen und Entbindungspflegern zusätzlich zu fördern, werden für die Jahre 2019 bis 2024 geeignete Maßnahmen zur Verbesserung der Vereinbarkeit von Pflege, Familie und Beruf zu 50 Prozent finanziell gefördert.
For this purpose, the contracting parties under section 11 shall, at the request of the hospital, agree on an additional amount which shall not exceed 0.1 per cent of the total amount under subsection (3) sentence 1 in the year 2019 and 0.12 per cent annually in the years 2020 to 2024.
Zu diesem Zweck vereinbaren die Vertragsparteien nach § 11 auf Verlangen des Krankenhauses einen zusätzlichen Betrag, der im Jahr 2019 0,1 Prozent und in den Jahren 2020 bis 2024 jährlich 0,12 Prozent des Gesamtbetrags nach Absatz 3 Satz 1 nicht überschreiten darf.
Where no amount was agreed for a calendar year, an additional amount up to the sum of the amounts applicable for both years may be agreed for the following year.
Wurde für ein Kalenderjahr ein Betrag nicht vereinbart, so kann für das Folgejahr ein zusätzlicher Betrag bis zur Summe der für beide Jahre geltenden Beträge vereinbart werden.
A precondition for this support is that the hospital demonstrates that it is taking measures to improve the compatibility of nursing work, family and career on the basis of a written or electronic agreement with the employee representative body.
Voraussetzung für diese Förderung ist, dass das Krankenhaus nachweist, dass es aufgrund einer schriftlichen oder elektronischen Vereinbarung mit der Arbeitnehmervertretung Maßnahmen zur Verbesserung der Vereinbarkeit von Pflege, Familie und Beruf ergreift.
The total amount to which the hospital is entitled under sentences 2 to 4 shall be financed by a supplement on the invoiced amount of the DRG case-based flat rates under section 7(1) sentence 1 item 1 and on the supplementary charges under section 7(1) sentence 1 item 2 and on the other charges under section 6(1) sentence 1 and (2a), and shall be shown separately on the hospital's invoice; subsection (8) sentences 6 to 8 shall apply mutatis mutandis to the determination of the amount of the supplement, to dispute resolution by the arbitration board under section 13 and to the requirements for the repayment of funds not used or the reduction of funds used only temporarily.
Der dem Krankenhaus nach den Sätzen 2 bis 4 insgesamt zustehende Betrag wird durch einen Zuschlag auf die abgerechnete Höhe der DRG-Fallpauschalen nach § 7 Absatz 1 Satz 1 Nummer 1 und auf die Zusatzentgelte nach § 7 Absatz 1 Satz 1 Nummer 2 sowie auf die sonstigen Entgelte nach § 6 Absatz 1 Satz 1 und Absatz 2a finanziert und gesondert in der Rechnung des Krankenhauses ausgewiesen; für die Ermittlung der Höhe des Zuschlags, für die Konfliktlösung durch die Schiedsstelle nach § 13 und für die Vorgaben zur Rückzahlung von nicht in Anspruch genommenen Mitteln oder die Minderung von nur zeitweise in Anspruch genommenen Mitteln gilt Absatz 8 Satz 6 bis 8 entsprechend.
The hospital operator shall submit to the other contracting parties a confirmation from the annual auditor showing the extent to which the additional funds were used for their intended purpose for the supported measures under sentence 1.
Der Krankenhausträger hat den anderen Vertragsparteien eine Bestätigung des Jahresabschlussprüfers vorzulegen, aus der hervorgeht, inwieweit die zusätzlichen Mittel zweckentsprechend für die geförderten Maßnahmen nach Satz 1 verwendet wurden.
The National Association of Statutory Health Insurance Funds shall report annually to the Federal Ministry of Health by 30 June, for the first time in 2020, on the type and number of the supported measures under sentence 1 and on the extent of new hires and increases in the hours of existing part-time positions resulting from the supported measures.
Der Spitzenverband Bund der Krankenkassen berichtet dem Bundesministerium für Gesundheit jährlich bis zum 30. Juni, erstmals im Jahr 2020, über die Art und die Anzahl der geförderten Maßnahmen nach Satz 1 sowie über den Umfang von Neueinstellungen und Aufstockungen vorhandener Teilzeitstellen, zu denen es aufgrund der geförderten Maßnahmen kommt.
The requirements under subsection (8) sentence 11 regarding the transmission of information for the reporting by the National Association of Statutory Health Insurance Funds and under section 5(4) sentence 5 regarding full compensation for any additional or reduced revenue arising shall apply mutatis mutandis.
Die Vorgaben nach Absatz 8 Satz 11 zur Übermittlung von Informationen für die Berichterstattung des Spitzenverbandes Bund der Krankenkassen sowie nach § 5 Absatz 4 Satz 5 zum vollständigen Ausgleich von entstehenden Mehr- oder Mindererlösen gelten entsprechend.
(9) The following measures to meet the staffing requirements of the Infection Protection Act (Infektionsschutzgesetz) shall be financially supported where the measures comply with the requirements regarding qualifications and need set out in the recommendation of the Commission for Hospital Hygiene and Infection Prevention on staffing and organisational prerequisites for the prevention of nosocomial infections (Bundesgesundheitsblatt 2009, p. 951) and in the recommendation on the scope of capacity for the support of hospitals and other medical facilities by hospital hygienists (Bundesgesundheitsblatt 2016, p. 1183):
(9) Die folgenden Maßnahmen zur Erfüllung von Anforderungen des Infektionsschutzgesetzes an die personelle Ausstattung werden finanziell gefördert, wenn die Maßnahmen die Anforderungen zur Qualifikation und zum Bedarf einhalten, die in der Empfehlung der Kommission für Krankenhaushygiene und Infektionsprävention zu personellen und organisatorischen Voraussetzungen zur Prävention nosokomialer Infektionen (Bundesgesundheitsblatt 2009, S. 951) sowie der Empfehlung zum Kapazitätsumfang für die Betreuung von Krankenhäusern und anderen medizinischen Einrichtungen durch Krankenhaushygieniker/-innen (Bundesgesundheitsblatt 2016, S. 1183) genannt sind:

b) von Krankenhaushygienikerinnen oder Krankenhaushygienikern mit abgeschlossener Weiterbildung zur Fachärztin oder zum Facharzt für Hygiene und Umweltmedizin oder für Mikrobiologie, Virologie und Infektionsepidemiologie: in Höhe von 75 Prozent der zusätzlich entstehenden Personalkosten für die Jahre 2013 bis 2022,
c) of hospital hygienists with structured curricular continuing education in hospital hygiene and with continuing education in rational antibiotic therapy counselling based on the continuing education of the German Society for Infectious Diseases (Deutsche Gesellschaft für Infektiologie), provided that the new hire, internal filling of newly created positions or increase in hours took place by 31 December 2019: at 50 per cent of the additional personnel costs incurred for the years 2013 to 2022,
c) von Krankenhaushygienikerinnen oder Krankenhaushygienikern mit strukturierter curricularer Fortbildung Krankenhaushygiene und mit Fortbildung im Bereich der rationalen Antibiotikatherapieberatung in Anlehnung an die Fortbildung der Deutschen Gesellschaft für Infektiologie, sofern die Neueinstellung, interne Besetzung neu geschaffener Stellen oder Aufstockung bis zum 31. Dezember 2019 vorgenommen worden ist: in Höhe von 50 Prozent der zusätzlich entstehenden Personalkosten für die Jahre 2013 bis 2022,
d) of hospital hygienists with structured curricular continuing education in hospital hygiene, provided that the new hire, internal filling of newly created positions or increase in hours took place after 31 December 2019: at 50 per cent of the additional personnel costs incurred for the years 2020 to 2022 and
d) von Krankenhaushygienikerinnen oder Krankenhaushygienikern mit strukturierter curricularer Fortbildung Krankenhaushygiene, sofern die Neueinstellung, interne Besetzung neu geschaffener Stellen oder Aufstockung nach dem 31. Dezember 2019 vorgenommen worden ist: in Höhe von 50 Prozent der zusätzlich entstehenden Personalkosten für die Jahre 2020 bis 2022 und
e) of physicians designated as hygiene officers: at 10 per cent of the additional personnel costs incurred for the years 2013 to 2016,
e) von hygienebeauftragten Ärztinnen oder Ärzten: in Höhe von 10 Prozent der zusätzlich entstehenden Personalkosten für die Jahre 2013 bis 2016,
2. continuing education or specialist training for the years 2013 to 2022:
2. Fort- oder Weiterbildungen für die Jahre 2013 bis 2022:
a) specialist training as a specialist in hygiene and environmental medicine for a maximum duration of five years by means of a flat-rate grant of EUR 30 000 per year, from the year 2020 of EUR 40 000 per year, including beyond the hospital's own requirements; specialist training commenced in the year 2022 at the latest shall also be supported beyond the year 2022,
a) Weiterbildung zur Fachärztin oder zum Facharzt für Hygiene und Umweltmedizin für die Dauer von maximal fünf Jahren durch einen pauschalen Zuschuss in Höhe von jährlich 30 000 Euro, ab dem Jahr 2020 in Höhe von jährlich 40 000 Euro, auch über den Eigenbedarf des jeweiligen Krankenhauses hinaus; spätestens im Jahr 2022 begonnene Weiterbildungen werden auch über das Jahr 2022 hinaus gefördert,
b) specialist training as a specialist in microbiology, virology and infection epidemiology for qualification and deployment in clinical microbiological counselling in the hospital for a maximum duration of five years by means of a flat-rate grant of EUR 15 000 per year, including beyond the hospital's own requirements; specialist training commenced in the year 2022 at the latest shall also be supported beyond the year 2022,
b) Weiterbildung zur Fachärztin oder zum Facharzt für Mikrobiologie, Virologie und Infektionsepidemiologie zur Befähigung und zum Einsatz in der klinisch-mikrobiologischen Beratung im Krankenhaus für die Dauer von maximal fünf Jahren durch einen pauschalen Zuschuss in Höhe von jährlich 15 000 Euro, auch über den Eigenbedarf des jeweiligen Krankenhauses hinaus; spätestens im Jahr 2022 begonnene Weiterbildungen werden auch über das Jahr 2022 hinaus gefördert,
c) continuing education to become a hospital hygienist through structured curricular continuing education in hospital hygiene for a maximum duration of two years by means of a flat-rate grant of EUR 5 000 per year; continuing education commenced in the year 2022 at the latest shall also be supported beyond the year 2022 and
c) Fortbildung zur Krankenhaushygienikerin oder zum Krankenhaushygieniker durch strukturierte curriculare Fortbildung Krankenhaushygiene für die Dauer von maximal zwei Jahren durch einen pauschalen Zuschuss in Höhe von jährlich 5 000 Euro; spätestens im Jahr 2022 begonnene Fortbildungen werden auch über das Jahr 2022 hinaus gefördert und
d) structured curricular continuing education 'Antibiotic Stewardship (ABS)' of physicians and hospital pharmacists by means of a flat-rate grant of EUR 5 000,
d) strukturierte curriculare Fortbildung „Antibiotic Stewardship (ABS)“ von Ärztinnen, Ärzten, Krankenhausapothekerinnen und Krankenhausapothekern durch einen pauschalen Zuschuss in Höhe von 5 000 Euro,
3. contractually agreed external advisory services provided by hospital hygienists who have completed specialist training as a specialist in hygiene and environmental medicine or in microbiology, virology and infection epidemiology, at a flat rate of EUR 400 per day of advice for the years 2013 to 2026.
3. vertraglich vereinbarte externe Beratungsleistungen durch Krankenhaushygienikerinnen oder Krankenhaushygieniker mit abgeschlossener Weiterbildung zur Fachärztin oder zum Facharzt für Hygiene und Umweltmedizin oder für Mikrobiologie, Virologie und Infektionsepidemiologie pauschal in Höhe von 400 Euro je Beratungstag für die Jahre 2013 bis 2026.
Irrespective of the conditions referred to in sentence 1, the following measures shall be financially supported:
Unabhängig von den in Satz 1 genannten Voraussetzungen werden die folgenden Maßnahmen finanziell gefördert:
1. new hires, internal filling of newly created positions or increases in the hours of existing part-time positions carried out after 31 December 2019 of
1. nach dem 31. Dezember 2019 vorgenommene Neueinstellungen, interne Besetzungen neu geschaffener Stellen oder Aufstockungen vorhandener Teilzeitstellen von
a) specialists in internal medicine and infectious diseases at 75 per cent of the additional personnel costs incurred for the years 2020 to 2025,
a) Fachärztinnen oder Fachärzten für Innere Medizin und Infektiologie in Höhe von 75 Prozent der zusätzlich entstehenden Personalkosten für die Jahre 2020 bis 2025,
b) specialists with additional specialist training in infectious diseases at 75 per cent of the additional personnel costs incurred for the years 2020 to 2022 and
b) Fachärztinnen und Fachärzten mit Zusatz-Weiterbildung Infektiologie in Höhe von 75 Prozent der zusätzlich entstehenden Personalkosten für die Jahre 2020 bis 2022 und
c) specialists acting as experts in antibiotic stewardship with structured curricular continuing education 'Antibiotic Stewardship (ABS)' at 50 per cent of the additional personnel costs incurred for the years 2020 to 2022 and at 30 per cent of the additional personnel costs incurred for the years 2023 to 2025,
c) Fachärztinnen und Fachärzten als Expertinnen oder Experten für Antibiotic Stewardship mit strukturierter curricularer Fortbildung „Antibiotic Stewardship (ABS)“ in Höhe von 50 Prozent der zusätzlich entstehenden Personalkosten für die Jahre 2020 bis 2022 und in Höhe von 30 Prozent der zusätzlich entstehenden Personalkosten für die Jahre 2023 bis 2025,
2. specialist training as a specialist in internal medicine and infectious diseases commenced in the years 2016 to 2028, in each case by means of a flat-rate grant of EUR 30 000 per year in the years 2016 to 2022 and, from the year 2023 up to and including the year 2028, of EUR 40 000 per year,
2. in den Jahren 2016 bis 2028 begonnene Weiterbildungen zur Fachärztin oder zum Facharzt für Innere Medizin und Infektiologie jeweils durch einen pauschalen Zuschuss in Höhe von jährlich 30 000 Euro in den Jahren 2016 bis 2022, ab dem Jahr 2023 bis einschließlich des Jahres 2028 in Höhe von jährlich 40 000 Euro,
3. additional specialist training in infectious diseases for specialists commenced in the years 2016 to 2028, in each case by means of a one-off flat-rate grant of EUR 30 000 and
3. in den Jahren 2016 bis 2028 begonnene Zusatzweiterbildungen Infektiologie für Fachärztinnen und Fachärzte jeweils durch einen pauschalen Zuschuss in Höhe von einmalig 30 000 Euro und
4. contractually agreed external advisory services in the field of antibiotic stewardship provided by specialists in internal medicine and infectious diseases or by specialists who have completed additional specialist training in infectious diseases, at a flat rate of EUR 400 per day of advice in the years 2016 to 2028.
4. vertraglich vereinbarte externe Beratungsleistungen im Bereich Antibiotic Stewardship durch Fachärztinnen und Fachärzte für Innere Medizin und Infektiologie oder durch Fachärztinnen und Fachärzte mit abgeschlossener Zusatzweiterbildung Infektiologie pauschal in Höhe von 400 Euro je Beratungstag in den Jahren 2016 bis 2028.
Costs within the scope of sentence 1 item 1 incurred from 1 August 2013 shall also be covered for necessary new hires or increases in hours carried out after 4 August 2011 to meet the requirements of the Infection Protection Act.
Kosten im Rahmen von Satz 1 Nummer 1, die ab dem 1. August 2013 entstehen, werden auch übernommen für nach dem 4. August 2011 vorgenommene erforderliche Neueinstellungen oder Aufstockungen zur Erfüllung der Anforderungen des Infektionsschutzgesetzes.
A precondition for support under sentence 2 item 1 is a written or electronic confirmation by the management of the hospital that the person works clinically and for at least 50 per cent of his or her working time in the field of antibiotic stewardship or infectious diseases, together with evidence that the staff were informed during the support period of the existing advisory services in the field of antibiotic stewardship.
Voraussetzung für die Förderung nach Satz 2 Nummer 1 ist eine schriftliche oder elektronische Bestätigung der Leitung des Krankenhauses, dass die Person klinisch und zu mindestens 50 Prozent ihrer Arbeitszeit im Bereich Antibiotic Stewardship oder Infektiologie tätig ist, sowie ein Nachweis, dass das Personal im Förderzeitraum über das bestehende Beratungsangebot im Bereich Antibiotic Stewardship informiert wurde.
For measures under sentences 1 to 3, the contracting parties shall agree annually on an additional amount as a percentage of the total amount under subsection (3) sentence 1.
Für Maßnahmen nach den Sätzen 1 bis 3 haben die Vertragsparteien jährlich einen zusätzlichen Betrag als Prozentsatz des Gesamtbetrags nach Absatz 3 Satz 1 zu vereinbaren.
New hires, internal filling of newly created positions or increases in the hours of existing part-time positions carried out under sentence 1 item 1 and sentence 2 item 1 letter (b) shall be taken into account, having regard to collectively agreed pay increases, when determining the amount under sentence 5.
Neueinstellungen, interne Besetzungen neu geschaffener Stellen oder Aufstockungen vorhandener Teilzeitstellen, die nach Satz 1 Nummer 1 und Satz 2 Nummer 1 Buchstabe b vorgenommen wurden, sind bei der Ermittlung des Betrags nach Satz 5 unter Beachtung von Tariferhöhungen zu berücksichtigen.
The total amount to which the hospital is entitled under sentences 5 and 6 shall be financed by a supplement on the invoiced amount of the DRG case-based flat rates and the supplementary charges under section 7(1) sentence 1 items 1 and 2 and on the other charges under section 6(1) sentence 1 and (2a); the supplement shall be shown separately on the invoice.
Der dem Krankenhaus nach den Sätzen 5 und 6 insgesamt zustehende Betrag wird durch einen Zuschlag auf die abgerechnete Höhe der DRG-Fallpauschalen und die Zusatzentgelte nach § 7 Absatz 1 Satz 1 Nummer 1 und 2 sowie auf die sonstigen Entgelte nach § 6 Absatz 1 Satz 1 und Absatz 2a finanziert; der Zuschlag wird gesondert in der Rechnung ausgewiesen.
Subsection (8) sentences 3 and 6 to 11 in the version in force on 31 December 2020 and section 5(4) sentence 5 shall apply mutatis mutandis, with the proviso that evidence of the filling of positions and of the use of funds for their intended purpose shall be provided separately for each occupational profile.
Absatz 8 Satz 3 und 6 bis 11 in der am 31. Dezember 2020 geltenden Fassung sowie § 5 Absatz 4 Satz 5 gelten entsprechend, wobei der Nachweis über die Stellenbesetzung und die zweckentsprechende Mittelverwendung berufsbildspezifisch zu erbringen ist.
The amount under sentences 5 and 6 shall not include any nursing staff costs financed through the nursing budget.
Der Betrag nach den Sätzen 5 und 6 darf keine Pflegepersonalkosten enthalten, die über das Pflegebudget finanziert werden.
(10) The personnel costs additionally incurred in the years 2021, 2022 and 2023 through new hires of, or increases in the hours of existing part-time positions of, midwives holding an authorisation to use the professional title under section 5(1), also in conjunction with sections 73 and 74(1), of the Midwives Act (Hebammengesetz), in the care of pregnant women in specialist departments for obstetrics and gynaecology of hospitals, shall be financed up to the amount of the costs of 0.5 full-time positions per 500 births in a hospital.
(10) Die Personalkosten, die bei der Neueinstellung oder Aufstockung vorhandener Teilzeitstellen von Hebammen mit einer Erlaubnis zum Führen der Berufsbezeichnung nach § 5 Absatz 1 auch in Verbindung mit den §§ 73 und 74 Absatz 1 des Hebammengesetzes in der Versorgung von Schwangeren in Fachabteilungen für Geburtshilfe und Gynäkologie von Krankenhäusern in den Jahren 2021, 2022 und 2023 zusätzlich entstehen, werden bis zur Höhe der Kosten für 0,5 Vollzeitstellen pro 500 Geburten in einem Krankenhaus finanziert.
The number of births shall be determined once for each hospital on the basis of the average number of annual births in the years 2017 to 2019.
Die Anzahl der Geburten wird für jedes Krankenhaus einmalig auf Grundlage der durchschnittlichen Anzahl an jährlichen Geburten in den Jahren 2017 bis 2019 bestimmt.
In order to relieve the burden on midwives, the personnel costs incurred in the years 2021, 2022 and 2023 for additional positions for specialist staff supporting midwives in specialist departments for obstetrics and gynaecology shall be financed, the total number of supported positions for specialist staff supporting midwives being limited to up to 25 per cent of the total number, converted into full-time equivalents, of the midwives employed as at 1 January 2020.
Zur Entlastung von Hebammen werden die Personalkosten, die für zusätzliche Personalstellen für Hebammen unterstützendes Fachpersonal in Fachabteilungen für Geburtshilfe und Gynäkologie in den Jahren 2021, 2022 und 2023 entstehen, finanziert, wobei die Gesamtzahl der geförderten Personalstellen für Hebammen unterstützendes Fachpersonal auf bis zu 25 Prozent der in Vollzeitkräfte umgerechneten Gesamtzahl der zum 1. Januar 2020 beschäftigten Hebammen begrenzt ist.
Specialist staff supporting midwives shall include
Zum Hebammen unterstützenden Fachpersonal gehören
1. medical assistants who have completed training in accordance with the Ordinance on Vocational Training as a Medical Assistant (Verordnung über die Berufsausbildung zum Medizinischen Fachangestellten/zur Medizinischen Fachangestellten) and
1. medizinische Fachangestellte, die eine Ausbildung nach der Verordnung über die Berufsausbildung zum Medizinischen Fachangestellten/zur Medizinischen Fachangestellten abgeschlossen haben und
2. specialist employees who have completed training in accordance with the Ordinance on Vocational Training as a Media and Information Services Specialist (Verordnung über die Berufsausbildung zum Fachangestellten für Medien- und Informationsdienste/zur Fachangestellten für Medien- und Informationsdienste) in the specialisation of medical documentation.
2. Fachangestellte, die eine Ausbildung nach der Verordnung über die Berufsausbildung zum Fachangestellten für Medien- und Informationsdienste/zur Fachangestellten für Medien- und Informationsdienste in der Fachrichtung Medizinische Dokumentation abgeschlossen haben.
In order to implement sentences 1 and 3, the contracting parties under section 11 shall agree annually on an additional amount.
Zur Umsetzung der Sätze 1 und 3 vereinbaren die Vertragsparteien nach § 11 jährlich einen zusätzlichen Betrag.
A precondition for the financing is that, compared with 1 January 2020, additional positions are created for midwives or for specialist staff supporting midwives or that corresponding part-time positions are increased.
Voraussetzung für die Finanzierung ist, dass im Vergleich zum 1. Januar 2020 zusätzliche Stellen für Hebammen oder für Hebammen unterstützendes Fachpersonal geschaffen oder dass entsprechende Teilzeitstellen aufgestockt werden.
The hospital shall substantiate the creation of new positions within the meaning of sentence 6 by means of a written agreement with the employee representative body.
Die Schaffung neuer Stellen im Sinne von Satz 6 hat das Krankenhaus durch eine schriftliche Vereinbarung mit der Arbeitnehmervertretung zu belegen.
In addition, it shall be substantiated that the new staff or staff with increased hours are employed in accordance with the written agreement with the employee representative body and do not work in direct patient care on bed-holding wards.
Zudem ist zu belegen, dass das neue oder aufgestockte Personal entsprechend der schriftlichen Vereinbarung mit der Arbeitnehmervertretung beschäftigt wird und nicht in der unmittelbaren Patientenversorgung auf bettenführenden Stationen tätig ist.
The total amount to which the hospital is entitled under sentences 5 and 6 shall be financed by a supplement on the invoiced amount of the DRG case-based flat rates under section 7(1) sentence 1 item 1 and on the supplementary charges under section 7(1) sentence 1 item 2 and on the other charges under section 6(1) sentence 1 and (2a), and shall be shown separately on the hospital's invoice.

The amount of the supplement shall be calculated on the basis of a percentage to be determined from the ratio of the total amount agreed under sentence 5 for the new hires or increases in the hours of existing part-time positions, on the one hand, to the total amount under subsection (3) sentence 1, on the other, and to be agreed by the contracting parties.
Die Höhe des Zuschlags ist anhand eines Prozentsatzes zu berechnen, der aus dem Verhältnis des nach Satz 5 für die Neueinstellungen oder Aufstockungen vorhandener Teilzeitstellen insgesamt vereinbarten Betrags einerseits sowie des Gesamtbetrags nach Absatz 3 Satz 1 andererseits zu ermitteln und von den Vertragsparteien zu vereinbaren ist.
In the agreement, wages and salaries shall be taken into account only up to the level of remuneration agreed in collective agreements; the benchmark for the determination shall in each case be the collective agreement which applies to the majority of employees in the hospital.
Bei der Vereinbarung sind nur Löhne und Gehälter bis zur Höhe tarifvertraglich vereinbarter Vergütungen zu berücksichtigen; Maßstab für die Ermittlung ist jeweils diejenige tarifvertragliche Vereinbarung, die in dem Krankenhaus für die meisten Beschäftigten maßgeblich ist.
If no agreement is reached, the arbitration board under section 13 shall decide upon application by a contracting party.
Kommt eine Vereinbarung nicht zustande, entscheidet die Schiedsstelle nach § 13 auf Antrag einer Vertragspartei.
Insofar as the new hires or increases in the hours of existing part-time positions financed with the additional amount are not implemented in the care of pregnant women in specialist departments for obstetrics and gynaecology, the corresponding share of the financing shall be repaid; where the staffing level established as at 1 January 2020 in the area supported under sentence 1 is reduced, the additional amount shall be reduced in accordance with the corresponding share of the financing.
Soweit die mit dem zusätzlichen Betrag finanzierten Neueinstellungen oder Aufstockungen vorhandener Teilzeitstellen nicht in der Versorgung von Schwangeren in Fachabteilungen für Geburtshilfe und Gynäkologie umgesetzt werden, ist der darauf entfallende Anteil der Finanzierung zurückzuzahlen; wird die zum 1. Januar 2020 festgestellte Stellenbesetzung in dem nach Satz 1 geförderten Bereich gemindert, ist der zusätzliche Betrag entsprechend dem darauf entfallenden Anteil der Finanzierung zu mindern.
For the examination of whether a repayment or reduction is necessary, the hospital operator shall submit to the other contracting parties the following confirmations from the annual auditor:
Für die Prüfung einer notwendigen Rückzahlung oder Minderung hat der Krankenhausträger den anderen Vertragsparteien folgende Bestätigungen des Jahresabschlussprüfers vorzulegen:
1. once, a confirmation of the number of births in the years 2017 to 2019,
1. einmalig eine Bestätigung über die Anzahl der Geburten in den Jahren 2017 bis 2019,
2. once, a confirmation of the staffing level established as at 1 January 2020 on obstetric wards, in total and broken down by midwives and the occupational groups referred to in sentence 4, in each case differentiated by full-time and part-time staff and converted into full-time equivalents,
2. einmalig eine Bestätigung über die zum 1. Januar 2020 festgestellte Stellenbesetzung auf Stationen für Geburtshilfe insgesamt und unterteilt nach Hebammen und den in Satz 4 genannten Berufsgruppen, jeweils differenziert in Voll- und Teilzeitkräfte und umgerechnet in Vollzeitkräfte,
3. a confirmation of the average annual staffing level on obstetric wards established as at 31 December of the respective funding year, broken down by midwives and the occupational groups referred to in sentence 4, in each case differentiated by full-time and part-time staff and converted into full-time equivalents, and
3. eine Bestätigung über die im jeweiligen Förderjahr zum 31. Dezember festgestellte jahresdurchschnittliche Stellenbesetzung auf Stationen für Geburtshilfe, unterteilt nach Hebammen und den in Satz 4 benannten Berufsgruppen, jeweils differenziert in Voll- und Teilzeitkräfte und umgerechnet in Vollzeitkräfte, und
4. a confirmation of the use of the funds for their intended purpose.

Where the confirmations under sentence 14 are not submitted or are not submitted in full, the additional amount shall be repaid in full.
Werden die Bestätigungen nach Satz 14 nicht oder nicht vollständig vorgelegt, ist der zusätzliche Betrag vollständig zurückzuzahlen.
The confirmations under sentence 14 shall be submitted by the hospital to the contracting partners by 28 February of the respective following year.
Die Vorlage der Bestätigungen nach Satz 14 hat durch das Krankenhaus gegenüber den Vertragspartnern bis zum 28. Februar des jeweiligen Folgejahres zu erfolgen.
The National Association of Statutory Health Insurance Funds shall report annually to the Federal Ministry of Health, for the first time as at 30 June 2022, on the number of full-time equivalents and the extent of the increased part-time positions, separately for midwives and for the specialist staff supporting midwives, who were newly hired or whose existing part-time positions were increased in the years 2021, 2022 and 2023 on the basis of the financing under sentences 1 and 3.

Juni 2022 über die Zahl der Vollzeitkräfte und den Umfang der aufgestockten Teilzeitstellen gesondert für Hebammen und für das Hebammen unterstützende Fachpersonal, die auf Grund der Finanzierung nach den Sätzen 1 und 3 in den Jahren 2021, 2022 und 2023 neu eingestellt oder deren vorhandene Teilzeitstellen aufgestockt wurden.
The health insurance funds shall be obliged to transmit to the National Association of Statutory Health Insurance Funds the information required for the reporting under sentence 17 on the agreements of the contracting parties concerning new hires or increases in the hours of existing part-time positions of staff financed under sentences 1 and 3.
Die Krankenkassen sind verpflichtet, dem Spitzenverband Bund der Krankenkassen die für die Berichterstattung nach Satz 17 erforderlichen Informationen über die Vereinbarungen der Vertragsparteien zur Neueinstellung oder Aufstockung vorhandener Teilzeitstellen von nach den Sätzen 1 und 3 finanziertem Personal zu übermitteln.
