(1) In order to finance the nursing staff costs under section 17b(4) of the Hospital Financing Act (Krankenhausfinanzierungsgesetz) incurred by the individual hospital, the contracting parties under section 11 shall agree a nursing budget; this shall not apply to the cross-sectoral care facilities referred to in section 115g(1) sentence 1 of Book V of the Social Code (Fünftes Buch Sozialgesetzbuch).
(1) Die Vertragsparteien nach § 11 vereinbaren zur Finanzierung der Pflegepersonalkosten nach § 17b Absatz 4 des Krankenhausfinanzierungsgesetzes, die dem einzelnen Krankenhaus entstehen, ein Pflegebudget; dies gilt nicht für die in § 115g Absatz 1 Satz 1 des Fünften Buches Sozialgesetzbuch genannten sektorenübergreifenden Versorgungseinrichtungen.
1. the charges taken into account in the revenue budget under section 4 or in the revenue total under section 6(3),
1. die Entgelte, die im Erlösbudget nach § 4 oder in der Erlössumme nach § 6 Absatz 3 berücksichtigt werden,
2. the supplements and deductions under section 7(1) sentence 1 item 4,
2. die Zu- und Abschläge nach § 7 Absatz 1 Satz 1 Nummer 4,
4. the supplementary charges for the treatment of patients with haemophilia.
4. die Zusatzentgelte für die Behandlung von Blutern.
The nursing budget shall be used exclusively for the purpose of financing the nursing staff costs under sentence 1.
Das Pflegebudget ist zweckgebunden für die Finanzierung der Pflegepersonalkosten nach Satz 1 zu verwenden.
Funds not used for their intended purpose shall be repaid.
Nicht zweckentsprechend verwendete Mittel sind zurückzuzahlen.
(2) The starting basis for determining the nursing budget shall be the total nursing staff costs incurred for the hospital concerned in the previous year that correspond to the requirements, applicable for the agreement year, on the nationally uniform definition of the nursing staff costs to be carved out under section 17b(4) sentence 2 or (4a) of the Hospital Financing Act; by way of derogation, the contracting parties under section 17b(2) sentence 1 of the Hospital Financing Act may stipulate in the agreement under section 17b(4) sentence 2 of the Hospital Financing Act that the number of full-time equivalents without a nursing qualification for the year 2018 reported by the hospital operators to the State Statistical Office for the year 2018 pursuant to the Ordinance on Federal Statistics for Hospitals (Verordnung über die Bundesstatistik für Krankenhäuser) is to be taken as the basis.
(2) Ausgangsgrundlage für die Ermittlung des Pflegebudgets ist die Summe der im Vorjahr für das jeweilige Krankenhaus entstandenen Pflegepersonalkosten, die den für das Vereinbarungsjahr geltenden Vorgaben zur bundeseinheitlichen Definition der auszugliedernden Pflegepersonalkosten nach § 17b Absatz 4 Satz 2 oder Absatz 4a des Krankenhausfinanzierungsgesetzes entsprechen; abweichend hiervon können die Vertragsparteien nach § 17b Absatz 2 Satz 1 des Krankenhausfinanzierungsgesetzes in der Vereinbarung nach § 17b Absatz 4 Satz 2 des Krankenhausfinanzierungsgesetzes bestimmen, dass die Anzahl der Vollkräfte ohne pflegerische Qualifikation des Jahres 2018 zugrunde zu legen ist, die die Krankenhausträger an das Statistische Landesamt gemäß der Verordnung über die Bundesstatistik für Krankenhäuser für das Jahr 2018 gemeldet haben.
In the determination, the changes compared with the previous year expected for the agreement year shall also be taken into account, in particular in the number and professional qualification of the full-time equivalent nursing staff and in the development of costs; to the extent that this is stipulated in the agreement under section 17b(4) sentence 2 of the Hospital Financing Act, the changes compared with the year 2018 expected for the agreement year shall instead be taken into account with regard to the number and professional qualification of the full-time equivalents without a nursing qualification.
Bei der Ermittlung sind weiterhin die für das Vereinbarungsjahr zu erwartenden Veränderungen gegenüber dem Vorjahr zu berücksichtigen, insbesondere bei der Zahl und der beruflichen Qualifikation der Pflegevollkräfte sowie bei der Kostenentwicklung; soweit dies in der Vereinbarung nach § 17b Absatz 4 Satz 2 des Krankenhausfinanzierungsgesetzes bestimmt ist, sind bei der Zahl und der beruflichen Qualifikation der Vollkräfte ohne pflegerische Qualifikation stattdessen die für das Vereinbarungsjahr zu erwartenden Veränderungen gegenüber dem Jahr 2018 zu berücksichtigen.
Where the actual nursing staff costs differ from the agreed nursing staff costs, the additional or reduced costs shall be taken into account in the agreement of the nursing budgets for the year following the agreement year by correcting the nursing budget for the agreement year and making compensation payments for the agreement year; the nursing staff costs for the years 2023 and 2024 for the number of full-time equivalents without a nursing qualification agreed by the contracting parties under section 11 on the basis of the year 2018 shall be deemed to have been demonstrated upon the confirmation by the auditor of the annual financial statements under subsection (3) sentence 4.
Weichen die tatsächlichen Pflegepersonalkosten von den vereinbarten Pflegepersonalkosten ab, sind die Mehr- oder Minderkosten bei der Vereinbarung der Pflegebudgets für das auf das Vereinbarungsjahr folgende Jahr zu berücksichtigen, indem das Pflegebudget für das Vereinbarungsjahr berichtigt wird und Ausgleichszahlungen für das Vereinbarungsjahr geleistet werden; die Pflegepersonalkosten der Jahre 2023 und 2024 für die von den Vertragsparteien nach § 11 auf der Grundlage des Jahres 2018 vereinbarte Anzahl der Vollkräfte ohne pflegerische Qualifikation gelten mit der Bestätigung des Jahresabschlussprüfers nach Absatz 3 Satz 4 als nachgewiesen.
The development of the nursing budget shall not be limited by the change value (Veränderungswert) under section 9(1b) sentence 1.
Das Pflegebudget ist in seiner Entwicklung nicht durch den Veränderungswert nach § 9 Absatz 1b Satz 1 begrenzt.
The cost-effectiveness of the nursing staff costs incurred by the individual hospital shall not be examined, and section 275c(6) item 1 of Book V of the Social Code shall be observed; the payment of salaries up to the level of remuneration agreed under collective agreements shall be deemed cost-effective, and any remuneration in excess thereof shall require an objective reason.
Die Wirtschaftlichkeit der dem einzelnen Krankenhaus entstehenden Pflegepersonalkosten wird nicht geprüft und § 275c Absatz 6 Nummer 1 des Fünften Buches Sozialgesetzbuch ist zu beachten; die Bezahlung von Gehältern bis zur Höhe tarifvertraglich vereinbarter Vergütungen gilt als wirtschaftlich, für eine darüber hinausgehende Vergütung bedarf es eines sachlichen Grundes.
Where, from the year 2020 onwards, the hospital takes measures, or continues measures already taken, that relieve nursing staff in direct patient care on wards with beds, the contracting parties under section 11 shall agree the extent to which nursing staff costs are thereby saved without any impairment of patient safety.
Sofern das Krankenhaus ab dem Jahr 2020 Maßnahmen ergreift oder bereits ergriffene Maßnahmen fortsetzt, die zu einer Entlastung von Pflegepersonal in der unmittelbaren Patientenversorgung auf bettenführenden Stationen führen, ist von den Vertragsparteien nach § 11 zu vereinbaren, inwieweit hierdurch ohne eine Beeinträchtigung der Patientensicherheit Pflegepersonalkosten eingespart werden.
The amount of the nursing staff costs saved shall be taken into account in the nursing budget as an increase of up to 4 per cent of the nursing budget.
Die Höhe der eingesparten Pflegepersonalkosten ist im Pflegebudget in einer Höhe von bis zu 4 Prozent des Pflegebudgets erhöhend zu berücksichtigen.
The measures taken under sentence 6 and the effect of these measures in saving nursing staff costs shall be specified by the hospital to the other contracting parties under section 11, and the implementation of the measures shall be demonstrated to the other contracting parties under section 11 by submitting an agreement with the employee representative body of the hospital and, where possible, by submitting invoices.
Die ergriffenen Maßnahmen nach Satz 6 sowie die Pflegepersonalkosten einsparende Wirkung dieser Maßnahmen sind vom Krankenhaus gegenüber den anderen Vertragsparteien nach § 11 zu benennen und die Durchführung der Maßnahmen ist den anderen Vertragsparteien nach § 11 durch Vorlage einer Vereinbarung mit der Vertretung der Arbeitnehmerinnen und Arbeitnehmer des Krankenhauses und, soweit möglich, durch die Vorlage von Rechnungen nachzuweisen.
Where nursing staff are employed without a direct employment relationship with the hospital, in particular temporary agency workers within the meaning of the Temporary Employment Act (Arbeitnehmerüberlassungsgesetz), the part of the remuneration that exceeds the pay agreed under collective agreements for nursing staff with a direct employment relationship with the hospital, and thus also the payment of placement fees, shall not be taken into account in the nursing budget.
Bei Beschäftigung von Pflegepersonal ohne direktes Arbeitsverhältnis mit dem Krankenhaus, insbesondere von Leiharbeitnehmern im Sinne des Arbeitnehmerüberlassungsgesetzes, ist der Teil der Vergütungen, der über das tarifvertraglich vereinbarte Arbeitsentgelt für das Pflegepersonal mit direktem Arbeitsverhältnis mit dem Krankenhaus hinausgeht, und damit auch die Zahlung von Vermittlungsentgelten, nicht im Pflegebudget zu berücksichtigen.
In order to support measures that relieve nursing staff in direct patient care on wards with beds, a flat-rate amount of 2.5 per cent of the nursing budget shall be taken into account as an increase, for the first time in the agreement of the nursing budget for the year 2025; no evidence of the implementation or the costs of the measures shall be required.
Zur Förderung von Maßnahmen, die zu einer Entlastung von Pflegepersonal in der unmittelbaren Patientenversorgung auf bettenführenden Stationen führen, ist erstmalig für die Vereinbarung des Pflegebudgets für das Jahr 2025 pauschal eine Höhe von 2,5 Prozent des Pflegebudgets erhöhend zu berücksichtigen; ein Nachweis über die Durchführung und die Kosten der Maßnahmen ist nicht erforderlich.
Sentences 6 to 8 shall apply for the last time to the agreement of the nursing budget for the year 2024.
Die Sätze 6 bis 8 sind letztmalig für die Vereinbarung des Pflegebudgets für das Jahr 2024 anzuwenden.
Sentences 1 to 5, 9 and 10 shall apply for the last time to the agreement of the nursing budget for the year 2026.
Die Sätze 1 bis 5, 9 und 10 sind letztmalig für die Vereinbarung des Pflegebudgets für das Jahr 2026 anzuwenden.
(2a) The starting basis for the agreement of the nursing budget for the year 2027 shall be the nursing budget agreed for the year 2026, less 86 per cent of the amount agreed for the measures to relieve nursing staff referred to in subsection (2) sentence 10; where the actual nursing staff costs for the year 2026 differ from the agreed nursing staff costs for the year 2026, the contracting parties under section 11(1) shall, at the request of one of the contracting parties, be obliged to take the additional or reduced costs into account in the agreement of the nursing budget for the next possible charge period (Pflegesatzzeitraum) by correcting the starting basis for the agreement of the nursing budget for the next possible charge period and carrying out a compensation.
(2a) Ausgangsgrundlage für die Vereinbarung des Pflegebudgets für das Jahr 2027 ist das für das Jahr 2026 vereinbarte Pflegebudget abzüglich von 86 Prozent des für die in Absatz 2 Satz 10 genannten Maßnahmen zur Entlastung von Pflegepersonal vereinbarten Betrags; weichen die tatsächlichen Pflegepersonalkosten für das Jahr 2026 von den vereinbarten Pflegepersonalkosten für das Jahr 2026 ab, sind die Vertragsparteien nach § 11 Absatz 1 auf Verlangen einer der Vertragsparteien verpflichtet, die Mehr- oder Minderkosten bei der Vereinbarung des Pflegebudgets für den nächstmöglichen Pflegesatzzeitraum zu berücksichtigen, indem sie eine Berichtigung der Ausgangsgrundlage für die Vereinbarung des Pflegebudgets für den nächstmöglichen Pflegesatzzeitraum und einen Ausgleich vornehmen.

Where an increase rate under section 9(1) item 7 has been agreed in the previous year concerned, the nursing budget to be agreed for the following calendar year shall be increased by half of that increase rate.
Ist im jeweiligen Vorjahr nach § 9 Absatz 1 Nummer 7 eine Erhöhungsrate vereinbart worden, ist das für das folgende Kalenderjahr zu vereinbarende Pflegebudget um die Hälfte dieser Erhöhungsrate zu erhöhen.

The nursing budget for a calendar year may exceed the previous year's nursing budget, as adjusted by the change value agreed or laid down for that calendar year under section 9(1b) sentences 1 to 3 or determined under section 9(2) sentence 1, only to the extent that the excess is due to

1. compliance with staffing requirements under federal acts, under statutory ordinances issued on the basis of Book V of the Social Code, or under directives or resolutions of the Federal Joint Committee,
1. die Einhaltung von Personalvorgaben aus Bundesgesetzen, Rechtsverordnungen, die auf Grund des Fünften Buches Sozialgesetzbuch erlassen worden sind, aus Richtlinien oder Beschlüssen des Gemeinsamen Bundesausschusses,
2. the settlement of a compensatory amount under subsection (5) sentence 3, or
2. die Abwicklung eines Ausgleichsbetrags nach Absatz 5 Satz 3 oder
3. the agreement of an increase rate under section 9(1) item 7 in the previous year concerned.

Where the excess is due to the agreement of an increase rate under section 9(1) item 7 in the previous year concerned, an excess in the amount of half of the increase rate agreed in the previous year concerned shall be permissible.

Where, from the year 2027 onwards, the actual nursing staff costs in a calendar year differ from the nursing staff costs agreed for that calendar year, additional costs shall not, and reduced costs shall, be taken into account in the agreement of the nursing budget for the following calendar year by correcting the nursing budget for the agreement year and carrying out a compensation.
Weichen ab dem Jahr 2027 in einem Kalenderjahr die tatsächlichen Pflegepersonalkosten von den für dieses Kalenderjahr vereinbarten Pflegepersonalkosten ab, sind Mehrkosten nicht und Minderkosten bei der Vereinbarung des Pflegebudgets für das folgende Kalenderjahr zu berücksichtigen, indem für das Vereinbarungsjahr das Pflegebudget berichtigt und ein Ausgleich vorgenommen wird.
Nursing staff costs for activities that do not serve direct patient care on wards with beds and in delivery rooms, in particular housekeeping, logistical, administrative or technical activities, shall not be taken into account in the nursing budget, irrespective of the staff member's organisational assignment within the hospital.
Pflegepersonalkosten für Tätigkeiten, die nicht der unmittelbaren Patientenversorgung auf bettenführenden Stationen und in Kreißsälen dienen, insbesondere hauswirtschaftliche, logistische, administrative oder technische Tätigkeiten, sind unabhängig von der dienstlichen Zuordnung im Krankenhaus nicht im Pflegebudget zu berücksichtigen.
(3) Before the agreement of the nursing budget concerned, the hospital operator shall provide evidence to the other contracting parties under section 11(1) of the average annual staffing in full-time equivalent nursing staff, broken down by job title, and of the nursing staff costs.
(3) Der Krankenhausträger hat vor der Vereinbarung des jeweiligen Pflegebudgets den anderen Vertragsparteien nach § 11 Absatz 1 die jahresdurchschnittliche Stellenbesetzung in Pflegevollkräften, gegliedert nach Berufsbezeichnungen, sowie die Pflegepersonalkosten nachzuweisen.
For this purpose, the hospital operator shall in each case submit the corresponding actual data for the past year, the actual data for the current year and the claimed data for the agreement period; in addition, data and evidence for the year 2018 shall be submitted where, under the agreement under section 17b(4) sentence 2 of the Hospital Financing Act, these are to be used as the basis for the allocation of nursing staff costs.
Dazu hat der Krankenhausträger jeweils die entsprechenden Ist-Daten des abgelaufenen Jahres, die Ist-Daten des laufenden Jahres sowie die Forderungsdaten für den Vereinbarungszeitraum vorzulegen; zusätzlich sind Daten und Nachweise für das Jahr 2018 vorzulegen, sofern diese nach der Vereinbarung nach § 17b Absatz 4 Satz 2 des Krankenhausfinanzierungsgesetzes für die Zuordnung von Kosten von Pflegepersonal zugrunde zu legen sind.
The agreed nursing budget, including the average annual staffing in full-time equivalent nursing staff broken down by job title, shall be documented by the contracting parties under section 11(1); the documentation must show the amount of the nursing budget and the essential calculation parameters used to derive the agreed costs to be taken into account in the nursing budget and the amount of the nursing budget.
Das vereinbarte Pflegebudget einschließlich der jahresdurchschnittlichen Stellenbesetzung der Pflegevollkräfte, gegliedert nach Berufsbezeichnungen, ist von den Vertragsparteien nach § 11 Absatz 1 zu dokumentieren; aus der Dokumentation müssen die Höhe des Pflegebudgets sowie die wesentlichen Rechengrößen zur Herleitung der vereinbarten, im Pflegebudget zu berücksichtigenden Kosten und der Höhe des Pflegebudgets hervorgehen.
The hospital operator shall, for the purpose of the further development of the remuneration system under section 17b of the Hospital Financing Act and irrespective of whether a nursing budget under subsection (1) sentence 1 has been agreed or determined, submit annually to the other contracting parties under section 11(1) and to the Institute for the Hospital Remuneration System (InEK), in each case by 1 June or, where no nursing budget for the year 2020 or for the year 2021 had been agreed or determined by 30 June 2022, by 31 July 2022, a confirmation by the auditor of the annual financial statements for the preceding calendar year concerning

Juli 2022, eine Bestätigung des Jahresabschlussprüfers für das vorangegangene Kalenderjahr vorzulegen über
1. the average annual staffing in full-time equivalent nursing staff in total, broken down by job title,
1. die jahresdurchschnittliche Stellenbesetzung der Pflegevollkräfte insgesamt, gegliedert nach Berufsbezeichnungen,
3. the verification of the following, to be taken into account in the nursing budget in accordance with the requirements of the agreement under section 17b(4) sentence 2 or (4a) of the Hospital Financing Act and of the agreement under subsection (1) sentence 1, where such agreement exists:
3. die Überprüfung der nach den Vorgaben der Vereinbarung nach § 17b Absatz 4 Satz 2 oder Absatz 4a des Krankenhausfinanzierungsgesetzes und der Vereinbarung nach Absatz 1 Satz 1, sofern diese vorliegt, im Pflegebudget
a) the average annual staffing in full-time equivalent nursing staff, broken down by job title, and
a) zu berücksichtigenden jahresdurchschnittlichen Stellenbesetzung der Pflegevollkräfte, gegliedert nach Berufsbezeichnungen, und
4. the verification of a statement of the total revenue of the hospital from the per-diem nursing charges under section 7(1) sentence 1 item 6a, and
4. die Überprüfung einer Aufstellung der Summe der Erlöse des Krankenhauses aus den tagesbezogenen Pflegeentgelten nach § 7 Absatz 1 Satz 1 Nummer 6a und
5. the verification of the use of the funds for their intended purpose within the meaning of subsection (1) sentence 3, provided that a nursing budget for the preceding calendar year was agreed, or determined by the arbitration board under section 13(1), by 31 March of the year concerned.
5. die Überprüfung der zweckentsprechenden Verwendung der Mittel im Sinne des Absatzes 1 Satz 3, sofern jeweils bis zum 31. März eines Jahres ein Pflegebudget für das vorangegangene Kalenderjahr vereinbart oder von der Schiedsstelle nach § 13 Absatz 1 festgesetzt wurde.
The requirements of the agreement under section 9(1) item 8 shall be observed for the submission of the data under sentence 2, the documentation under sentence 3 and the confirmation to be submitted under sentence 4.
Für die Vorlage der Daten nach Satz 2, die Dokumentation nach Satz 3 und die nach Satz 4 vorzulegende Bestätigung sind die Vorgaben der Vereinbarung nach § 9 Absatz 1 Nummer 8 zu beachten.
The health insurance funds that are contracting parties under section 11 shall transmit the data under sentence 2 and the documentation under sentence 3 electronically to the Institute for the Hospital Remuneration System without undue delay after the agreement of the nursing budget; the Institute for the Hospital Remuneration System shall publish the information referred to in sentence 3 and sentence 4 items 1 to 3 and 5 on a hospital-by-hospital basis, in an accessible format, on its website.

The detailed arrangements for the transmission of the information under sentence 6 and for measures in the event that transmission does not take place or does not take place without undue delay, and in the event that the confirmation by the auditor of the annual financial statements under sentence 4 or the separate confirmation by the auditor of the annual financial statements under sentence 8 is not submitted, is incomplete or is not submitted in time, shall be laid down by the Institute for the Hospital Remuneration System in consultation with the National Association of Statutory Health Insurance Funds.

Where a nursing budget for the preceding calendar year is agreed, or determined by the arbitration board under section 13(1), after 31 March of a year, or where a nursing budget for the year 2020 or 2021 is agreed, or determined by the arbitration board under section 13(1), after 30 June 2022, the hospital operator shall submit to the other contracting parties under section 11(1) and to the Institute for the Hospital Remuneration System a separate confirmation by the auditor of the annual financial statements concerning the verification of the use of the funds for their intended purpose within the meaning of subsection (1) sentence 3 within eight weeks of the conclusion of the agreement on the nursing budget or of the determination of the nursing budget by the arbitration board; where a nursing budget for the year 2020 or 2021 is agreed, or determined by the arbitration board under section 13(1), between 31 March 2022 and 30 June 2022, the hospital operator shall submit to the other contracting parties under section 11(1) and to the Institute for the Hospital Remuneration System a separate confirmation by the auditor of the annual financial statements concerning the verification of the use of the funds for their intended purpose within the meaning of subsection (1) sentence 3 within eight weeks after 30 June 2022.
Sofern ein Pflegebudget für das vorangegangene Kalenderjahr nach dem 31. März eines Jahres vereinbart oder von der Schiedsstelle nach § 13 Absatz 1 festgesetzt wird oder sofern ein Pflegebudget für das Jahr 2020 oder 2021 nach dem 30. Juni 2022 vereinbart oder von der Schiedsstelle nach § 13 Absatz 1 festgesetzt wird, hat der Krankenhausträger den anderen Vertragsparteien nach § 11 Absatz 1 und dem Institut für das Entgeltsystem im Krankenhaus eine gesonderte Bestätigung des Jahresabschlussprüfers über die Überprüfung der zweckentsprechenden Verwendung der Mittel im Sinne des Absatzes 1 Satz 3 innerhalb von acht Wochen nach Abschluss der Vereinbarung des Pflegebudgets oder der Festsetzung des Pflegebudgets durch die Schiedsstelle vorzulegen; sofern ein Pflegebudget für das Jahr 2020 oder 2021 zwischen dem 31. März 2022 und dem 30. Juni 2022 vereinbart oder von der Schiedsstelle nach § 13 Absatz 1 festgesetzt wird, hat der Krankenhausträger den anderen Vertragsparteien nach § 11 Absatz 1 und dem Institut für das Entgeltsystem im Krankenhaus eine gesonderte Bestätigung des Jahresabschlussprüfers über die Überprüfung der zweckentsprechenden Verwendung der Mittel im Sinne des Absatzes 1 Satz 3 innerhalb von acht Wochen nach dem 30. Juni 2022 vorzulegen.
The confirmation by the auditor of the annual financial statements under sentence 4 shall not replace an agreement under subsection (1) sentence 1, nor the evidence to be provided under sentences 1 and 2, nor the allocation of nursing staff costs to be carried out in the negotiations under subsection (1) sentence 1 in accordance with the agreement under section 17b(4) sentence 2 of the Hospital Financing Act and the agreement under section 9(1) item 8.

(4) The nursing budget shall be paid out by means of a hospital-specific nursing charge value (Pflegeentgeltwert).

The hospital-specific nursing charge value shall be calculated by dividing the nursing budget agreed for the agreement year by the expected sum of the cost weights for the agreement year determined in accordance with the nursing revenue catalogue under section 17b(4) sentence 5 of the Hospital Financing Act.

The hospital-specific nursing charge value applicable for the year concerned shall be used as the basis for billing the per-diem nursing charges under section 7(1) sentence 1 item 6a, valued with cost weights, for inpatient and day-patient occupancy days.

From the day on which the agreement of an increase rate for collectively agreed pay increases under section 9(1) item 7 enters into force, the hospital-specific nursing charge value under sentence 3, increased by 50 per cent of the increase rate, shall, by way of derogation from sentence 3, be applied for the remainder of the year concerned.

(5) Where the total revenue of the hospital from the per-diem nursing charges under section 7(1) sentence 1 item 6a attributable to the agreement year differs from the agreed nursing budget, the additional or reduced revenue shall be fully compensated.

Section 4(3) sentences 8 and 10 shall apply mutatis mutandis.

(6) By way of derogation from subsection (1) sentence 1, in the agreement of the nursing budget for the year 2020, the total of the funds agreed on a hospital-specific basis under section 4(8) and the funds under section 4(9) shall be subsumed into the nursing budget for the year 2020.
(6) Abweichend von Absatz 1 Satz 1 gehen bei der Vereinbarung des Pflegebudgets für das Jahr 2020 die Summe der krankenhausindividuell vereinbarten Mittel nach § 4 Absatz 8 und die Mittel nach § 4 Absatz 9 in dem Pflegebudget für das Jahr 2020 auf.
The funds under section 4(9) shall be subsumed into the nursing budget for the year 2020 only to the extent that they are attributable to the nursing staff costs under subsection (1) sentence 1 and constitute running costs.

Where the sum of the total amount under section 4(3) sentence 1 and the nursing budget to be agreed is, for the year 2020, more than 2 per cent lower and, for the year 2021, more than 4 per cent lower than the value agreed for the respective previous year, the nursing budget for those years shall be increased so that the reduction in the sum of the total amount and the nursing budget is limited to 2 per cent for the year 2020 and to 4 per cent for the year 2021.
Ist die für das Jahr 2020 zu vereinbarende Summe aus dem Gesamtbetrag nach § 4 Absatz 3 Satz 1 und dem zu vereinbarenden Pflegebudget um mehr als 2 Prozent und für das Jahr 2021 um mehr als 4 Prozent niedriger als der jeweils vereinbarte Vorjahreswert, ist für diese Jahre das Pflegebudget so zu erhöhen, dass damit die Minderung der Summe aus Gesamtbetrag und Pflegebudget für das Jahr 2020 auf 2 Prozent und für das Jahr 2021 auf 4 Prozent begrenzt wird.
This increase in the nursing budget shall not be subject to the obligation to repay funds not used for their intended purpose under the agreement under section 9(1) item 8.
Diese Erhöhung des Pflegebudgets unterliegt nicht der Pflicht zur Rückzahlung für nicht zweckentsprechend verwendete Mittel nach der Vereinbarung nach § 9 Absatz 1 Nummer 8.
Sentence 3 shall not apply where the reduction in the sum of the total amount and the nursing budget is due to decreases in services.
Satz 3 findet keine Anwendung bei einer Minderung der Summe aus Gesamtbetrag und Pflegebudget auf Grund von Leistungsrückgängen.
(7) Where the contracting parties under section 11 have not yet agreed a nursing budget under subsection (1) sentence 1 for the year 2020 by 20 July 2021, they shall base it on the definition, agreed under section 17b(4) sentence 2 of the Hospital Financing Act, of the nursing staff costs to be carved out and of the allocation of nursing staff costs for the agreement year 2021.
(7) Sofern die Vertragsparteien nach § 11 bis zum 20. Juli 2021 noch kein Pflegebudget nach Absatz 1 Satz 1 für das Jahr 2020 vereinbart haben, legen sie hierfür die nach § 17b Absatz 4 Satz 2 des Krankenhausfinanzierungsgesetzes vereinbarte Definition der auszugliedernden Pflegepersonalkosten und der Zuordnung von Kosten von Pflegepersonal für das Vereinbarungsjahr 2021 zugrunde.
