(1) The charges for general hospital services shall be charged uniformly to all users of the hospital; section 17(5) of the Hospital Financing Act (Krankenhausfinanzierungsgesetz) shall remain unaffected.
(1) Die Entgelte für allgemeine Krankenhausleistungen sind für alle Benutzer des Krankenhauses einheitlich zu berechnen; § 17 Abs. 5 des Krankenhausfinanzierungsgesetzes bleibt unberührt.
For patients treated within the framework of a clinical study, the charges for general hospital services shall be charged in accordance with section 7; this shall also apply to clinical trials with medicinal products.
Bei Patienten, die im Rahmen einer klinischen Studie behandelt werden, sind die Entgelte für allgemeine Krankenhausleistungen nach § 7 zu berechnen; dies gilt auch bei klinischen Studien mit Arzneimitteln.
The charges may be charged only within the scope of the care mandate; this shall not apply to the treatment of emergency patients.
Die Entgelte dürfen nur im Rahmen des Versorgungsauftrags berechnet werden; dies gilt nicht für die Behandlung von Notfallpatienten.
1. in the case of a plan hospital (Plankrankenhaus), from the specifications of the hospital plan in conjunction with the notices implementing it under section 6(1) in conjunction with section 8(1) sentence 3 of the Hospital Financing Act and from a supplementary agreement under section 109(1) sentence 4 of Book V of the Social Code,

4. in the case of other hospitals, from the care contract under section 108 item 3 of Book V of the Social Code.

(2) Case-based flat rates and the remuneration of a provision budget shall be charged for the treatment cases specified in the case-based flat-rate catalogue under section 9(1) sentence 1 item 1.
(2) Fallpauschalen sowie die Vergütung eines Vorhaltebudgets werden für die Behandlungsfälle berechnet, die in dem Fallpauschalen-Katalog nach § 9 Abs. 1 Satz 1 Nr. 1 bestimmt sind.
Separate case-based flat rates shall be charged for the patients of affiliated physicians (Belegärzte).
Für die Patienten von Belegärzten werden gesonderte Fallpauschalen berechnet.
In addition to a case-based flat rate, the following may be charged:
Zusätzlich zu einer Fallpauschale dürfen berechnet werden:
1. supplementary charges according to the catalogue under section 9(1) sentence 1 item 2 or under section 6(1) to (2a), in particular for the treatment of haemophiliacs with blood coagulation factors and for dialysis where the treatment of the kidney failure is not the main service,
1. Zusatzentgelte nach dem Katalog nach § 9 Abs. 1 Satz 1 Nr. 2 oder nach § 6 Abs. 1 bis 2a, insbesondere für die Behandlung von Blutern mit Blutgerinnungsfaktoren sowie für eine Dialyse, wenn die Behandlung des Nierenversagens nicht die Hauptleistung ist,
2. supplements and deductions under section 17b(1a) of the Hospital Financing Act and under this Act,

3. post-inpatient treatment under section 115a of Book V of the Social Code, insofar as the sum of the inpatient occupancy days and the pre- and post-inpatient treatment days exceeds the length-of-stay threshold of the case-based flat rate; pre-inpatient treatment may not be charged separately in addition to the case-based flat rate; this shall also apply to corresponding treatment of private patients as a general hospital service,
3. eine nachstationäre Behandlung nach § 115a des Fünften Buches Sozialgesetzbuch, soweit die Summe aus den stationären Belegungstagen und den vor- und nachstationären Behandlungstagen die Grenzverweildauer der Fallpauschale übersteigt; eine vorstationäre Behandlung ist neben der Fallpauschale nicht gesondert berechenbar; dies gilt auch für eine entsprechende Behandlung von Privatpatienten als allgemeine Krankenhausleistung,
4. supplements under sections 139c, 91(2) sentence 6 and section 377(1) and (2) of Book V of the Social Code,

5. per-day nursing charges under section 6a per full or day-patient occupancy day.

(3) If, according to the result of an inspection under section 275c(1) of Book V of the Social Code, there was no need for inpatient treatment, the services provided by the hospital shall be remunerated in accordance with the agreements concluded for pre-inpatient treatment under section 115a of Book V of the Social Code, insofar as there is no other possibility of billing the service provided.
(3) Hat nach dem Ergebnis einer Prüfung nach § 275c Absatz 1 des Fünften Buches Sozialgesetzbuch eine vollstationäre Behandlungsbedürftigkeit nicht vorgelegen, sind die vom Krankenhaus erbrachten Leistungen nach den für vorstationäre Behandlungen nach § 115a des Fünften Buches Sozialgesetzbuch getroffenen Vereinbarungen zu vergüten, soweit keine andere Möglichkeit zur Abrechnung der erbrachten Leistung besteht.
(4) If the hospital does not comply with its quality assurance obligations, deductions under section 137(1) or (2) or under section 137i(5) of Book V of the Social Code shall be made from the case-based flat rates and supplementary charges.
(4) Hält das Krankenhaus seine Verpflichtungen zur Qualitätssicherung nicht ein, sind von den Fallpauschalen und Zusatzentgelten Abschläge nach § 137 Absatz 1 oder 2 oder nach § 137i Absatz 5 des Fünften Buches Sozialgesetzbuch vorzunehmen.
Charges shall not be charged for a service if a hospital does not meet the minimum volume requirements under section 136b(1) sentence 1 item 2 of Book V of the Social Code, unless an exception under section 136b(5a) of Book V of the Social Code can be invoked or a justified volume expectation under section 136b(5) of Book V of the Social Code is demonstrated.

Furthermore, charges shall not be charged for services if the inspection under section 275a(1) sentence 1 item 2 of Book V of the Social Code establishes that the structural criteria relevant to the provision of the services are not met.
Ferner dürfen Entgelte für Leistungen nicht berechnet werden, wenn die Prüfung nach § 275a Absatz 1 Satz 1 Nummer 2 des Fünften Buches Sozialgesetzbuch ergibt, dass die für die Leistungserbringung maßgeblichen Strukturmerkmale nicht erfüllt werden.
From 1 January 2028, charges shall not be charged for services from a service group that has not been allocated to a hospital under section 6a(1) sentence 1 of the Hospital Financing Act; this shall not apply to the treatment of emergency patients.
Ab dem 1. Januar 2028 dürfen Entgelte nicht für Leistungen aus einer Leistungsgruppe berechnet werden, die einem Krankenhaus nicht nach § 6a Absatz 1 Satz 1 des Krankenhausfinanzierungsgesetzes zugewiesen wurde; dies gilt nicht für die Behandlung von Notfallpatienten.
From 1 January 2028, charges under section 7(1) sentence 1 item 6b shall not be charged for services from a service group if the hospital concerned does not meet the relevant minimum provision number (Mindestvorhaltezahl) under section 135f(1) of Book V of the Social Code for that service group and the state authority responsible for hospital planning has not made a determination under section 6b(2) sentence 1 for the hospital concerned and the service group concerned.
Entgelte nach § 7 Absatz 1 Satz 1 Nummer 6b dürfen ab dem 1. From 1 January 2028, for hospital sites named in the list published under section 40(2) sentence 3 of the Hospital Financing Act, charges under section 7(1) sentence 1 items 1 to 6 and 8 shall not be charged for cases assigned to an indication area defined under section 40(1) sentence 3 of the Hospital Financing Act; for the assignment of cases to these indication areas, hospitals shall use exclusively data processing solutions certified under section 40(1) sentence 6 of the Hospital Financing Act.
Ab dem 1. Januar 2028 dürfen für Krankenhausstandorte, die in der nach § 40 Absatz 2 Satz 3 des Krankenhausfinanzierungsgesetzes veröffentlichten Liste genannt sind, für einem nach § 40 Absatz 1 Satz 3 des Krankenhausfinanzierungsgesetzes definierten Indikationsbereich zugeordnete Fälle Entgelte nach § 7 Absatz 1 Satz 1 Nummer 1 bis 6 und 8 nicht berechnet werden; für die Zuordnung von Fällen zu diesen Indikationsbereichen haben die Krankenhäuser ausschließlich nach § 40 Absatz 1 Satz 6 des Krankenhausfinanzierungsgesetzes zertifizierte Datenverarbeitungslösungen zu verwenden.
(5) If patients for whom a case-based flat rate is billable are admitted to a hospital, the hospital shall combine the case data into a single case and reclassify it into a case-based flat rate if

1. the admission is a readmission to the same hospital because of a complication in connection with the service performed, within the upper length-of-stay threshold, or
1. es sich bei der Aufnahme um eine Wiederaufnahme in dasselbe Krankenhaus wegen einer Komplikation im Zusammenhang mit der durchgeführten Leistung innerhalb der oberen Grenzverweildauer handelt, oder
2. from 1 January 2028, the admission to the hospital takes place within 30 calendar days of the admission date of another hospital stay and the services provided during the stay are to be grouped into the same major diagnostic category as the case-based flat rate billable for the other hospital stay.
2. ab dem 1. Januar 2028 die Aufnahme in das Krankenhaus innerhalb von 30 Kalendertagen nach dem Aufnahmedatum eines anderen Krankenhausaufenthalts erfolgt und die während des Aufenthalts erbrachten Leistungen in dieselbe Hauptdiagnosegruppe der für den anderen Krankenhausaufenthalt abrechenbaren Fallpauschale einzugruppieren sind.
Details or derogations shall be regulated by the contracting parties under section 17b(2) sentence 1 of the Hospital Financing Act.
Näheres oder Abweichendes regeln die Vertragsparteien nach § 17b Abs. 2 Satz 1 des Krankenhausfinanzierungsgesetzes.
In cases other than those determined by contract or by law, merging of cases shall not be permissible, in particular on grounds of the requirement of cost-effectiveness (Wirtschaftlichkeitsgebot).
In anderen als den vertraglich oder gesetzlich bestimmten Fällen ist eine Fallzusammenführung insbesondere aus Gründen des Wirtschaftlichkeitsgebots nicht zulässig.
(5a) The charging of short-stay case-based flat rates within the meaning of section 17b(2a) sentence 1 of the Hospital Financing Act shall be excluded if the service provided is contained in the catalogue agreed under section 115b(1) sentence 1 item 1 of Book V of the Social Code or determined under section 115b(3) sentence 1 of Book V of the Social Code.
(5a) Die Berechnung von Kurzzeitfallpauschalen im Sinne des § 17b Absatz 2a Satz 1 des Krankenhausfinanzierungsgesetzes ist ausgeschlossen, wenn die erbrachte Leistung in dem nach § 115b Absatz 1 Satz 1 Nummer 1 des Fünften Buches Sozialgesetzbuch vereinbarten oder nach § 115b Absatz 3 Satz 1 des Fünften Buches Sozialgesetzbuch festgesetzten Katalog enthalten ist.

(6) If the services remunerated by a charge are provided by several hospitals without the patient being transferred, the charge shall be charged by the hospital that admitted the patient as an inpatient.
(6) Werden die mit einem Entgelt vergüteten Leistungen ohne Verlegung des Patienten durch mehrere Krankenhäuser erbracht, wird das Entgelt durch das Krankenhaus berechnet, das den Patienten stationär aufgenommen hat.
(7) The hospital may demand a reasonable advance payment if and insofar as health insurance cover is not demonstrated.
(7) Das Krankenhaus kann eine angemessene Vorauszahlung verlangen, wenn und soweit ein Krankenversicherungsschutz nicht nachgewiesen wird.
From the eighth day of the hospital stay, the hospital may demand a reasonable payment on account, the amount of which shall be based on the services provided to date in conjunction with the amount of the charges expected to be payable.
Ab dem achten Tag des Krankenhausaufenthalts kann das Krankenhaus eine angemessene Abschlagszahlung verlangen, deren Höhe sich an den bisher erbrachten Leistungen in Verbindung mit der Höhe der voraussichtlich zu zahlenden Entgelte zu orientieren hat.
Sentences 1 to 2 shall not apply insofar as other rules on the timely remuneration of general hospital services are laid down in rules binding on the hospital under sections 112 to 114 of Book V of the Social Code or in the agreement under section 11(1).
Die Sätze 1 bis 2 gelten nicht, soweit andere Regelungen über eine zeitnahe Vergütung der allgemeinen Krankenhausleistungen in für das Krankenhaus verbindlichen Regelungen nach den §§ 112 bis 114 des Fünften Buches Sozialgesetzbuch oder in der Vereinbarung nach § 11 Abs. 1 getroffen werden.
(8) The hospital shall notify self-paying patients or their legal representatives, in writing or in text form, as soon as possible of the charges likely to be applicable to them, unless the patient is fully insured for hospital treatment.
(8) Das Krankenhaus hat dem selbstzahlenden Patienten oder seinem gesetzlichen Vertreter die für ihn voraussichtlich maßgebenden Entgelte so bald wie möglich schriftlich oder in Textform bekannt zu geben, es sei denn, der Patient ist in vollem Umfang für Krankenhausbehandlung versichert.
Otherwise, every patient may request to be informed, on a non-binding basis, of the case-based flat rate likely to be billed and its amount, as well as of any supplementary charges likely to be payable, or of the hospital-specific or provisional daily charges likely to be billed.
Im Übrigen kann jeder Patient verlangen, dass ihm unverbindlich die voraussichtlich abzurechnende Fallpauschale und deren Höhe sowie voraussichtlich zu zahlende, ergänzende Entgelte oder die voraussichtlich abzurechnenden krankenhausindividuellen oder vorläufigen Tagesentgelte mitgeteilt werden.
If the charges have not yet been finally determined at the time of admission of a self-paying patient, this shall be pointed out.
Stehen bei der Aufnahme eines selbstzahlenden Patienten die Entgelte noch nicht endgültig fest, ist hierauf hinzuweisen.
In doing so, it shall be stated that the charge payable will increase if the new charge enters into force during the patient's inpatient treatment.
Dabei ist mitzuteilen, dass das zu zahlende Entgelt sich erhöht, wenn das neue Entgelt während der stationären Behandlung des Patienten in Kraft tritt.
(9) The hospital's invoices for self-paying patients shall be designed in an understandable and comprehensible form.
(9) Die Rechnungen des Krankenhauses für selbstzahlende Patientinnen oder selbstzahlende Patienten sind in einer verständlichen und nachvollziehbaren Form zu gestalten.
In this context, the case-based flat rates and supplementary charges shall be shown with the numbering and the full texts from the applicable catalogue of charges, the relevant diagnosis and procedure codes and, in the case of case-based flat rates, the effective cost weights and the state base rate.
Dabei sind die Fallpauschalen und Zusatzentgelte mit der Nummerierung und den vollständigen Texten aus dem jeweils anzuwendenden Entgeltkatalog, den maßgeblichen Diagnose- und Prozedurenschlüsseln sowie bei Fallpauschalen den effektiven Bewertungsrelationen und dem Landesbasisfallwert auszuweisen.
The corresponding text versions shall also be given for the diagnosis and procedure codes.
Zu den Diagnose- und Prozedurenschlüsseln sind außerdem die entsprechenden Textfassungen anzugeben.
Other charges and supplements or deductions shall be designated by brief, understandable texts.
Weitere Entgelte sowie Zu- oder Abschläge sind mit kurzen verständlichen Texten zu bezeichnen.
The supplements under section 7(1) sentence 3 shall be combined in the invoice and shown together as a "system supplement" ("Systemzuschlag").
Die Zuschläge nach § 7 Abs. 1 Satz 3 werden in der Rechnung zusammengefasst und gemeinsam als „Systemzuschlag“ ausgewiesen.
The German Hospital Federation shall issue a corresponding recommendation on the design of the invoice in consultation with the Association of Private Health Insurance.
Die Deutsche Krankenhausgesellschaft gibt zur Gestaltung der Rechnung eine entsprechende Empfehlung im Benehmen mit dem Verband der privaten Krankenversicherung ab.
The procedure under section 301 of Book V of the Social Code shall remain unaffected.
Das Verfahren nach § 301 des Fünften Buches Sozialgesetzbuch bleibt unberührt.
(10) To promote nursing care, a nursing supplement shall be billed, for admissions from 1 January 2017, for patients admitted to the hospital for inpatient treatment, and shall be shown separately in the invoice.
(10) Zur Förderung der pflegerischen Versorgung ist bei Patientinnen oder Patienten, die zur vollstationären Behandlung in das Krankenhaus aufgenommen werden, für Aufnahmen ab dem 1. Januar 2017 ein Pflegezuschlag abzurechnen und gesondert in der Rechnung auszuweisen.
The amount of the nursing supplement shall be determined by dividing the hospital's annual funding amount by the number of inpatient cases agreed or determined for the agreement period of the revenue budget and the revenue sum.
Die Höhe des Pflegezuschlags ist zu ermitteln, indem die jährliche Fördersumme für das Krankenhaus durch die vollstationäre Fallzahl geteilt wird, die für den Vereinbarungszeitraum des Erlösbudgets und der Erlössumme vereinbart oder festgesetzt wurde.
The hospital's annual funding amount shall be determined by the contracting parties under section 11 by calculating the share of the hospital's personnel costs for nursing staff in the personnel costs for nursing staff of all hospitals within the scope of this Act and applying this hospital-specific share to the funding amount of EUR 500 million available annually nationwide.
Die jährliche Fördersumme für das Krankenhaus ist von den Vertragsparteien nach § 11 zu ermitteln, indem der Anteil der Personalkosten des Krankenhauses für das Pflegepersonal an den Personalkosten für das Pflegepersonal aller Krankenhäuser im Anwendungsbereich dieses Gesetzes errechnet wird und dieser krankenhausindividuelle Anteil auf die jährlich bundesweit zur Verfügung stehende Fördersumme von 500 Millionen Euro bezogen wird.
The basis for the personnel costs for nursing staff of all hospitals under sentence 3 shall in each case be the full-time positions in nursing, with and without a direct employment relationship with the hospital, shown by the Federal Statistical Office in Subject-Matter Series 12, Series 6.1 (Fachserie 12 Reihe 6.1).
Grundlage für die Personalkosten für das Pflegepersonal aller Krankenhäuser nach Satz 3 sind jeweils die vom Statistischen Bundesamt in der Fachserie 12 Reihe 6.1 ausgewiesenen Vollzeitstellen in der Pflege mit und ohne direktem Beschäftigungsverhältnis mit dem Krankenhaus.
The full-time positions shown in psychiatric and psychosomatic facilities and in hospitals without a care contract shall be deducted from these full-time positions.
Von diesen Vollzeitstellen sind die ausgewiesenen Vollzeitstellen in Einrichtungen der Psychiatrie und der Psychosomatik sowie in Krankenhäusern ohne Versorgungsvertrag abzuziehen.
The number of full-time positions determined under sentences 4 and 5 shall be multiplied by the federal average costs per nurse shown in Subject-Matter Series 12, Series 6.3 (Fachserie 12 Reihe 6.3), in each case for the year lying two years before the year in which the nursing supplement for the following year is to be agreed.
Die nach den Sätzen 4 und 5 ermittelte Zahl der Vollzeitstellen ist zu multiplizieren mit den in der Fachserie 12 Reihe 6.3 ausgewiesenen bundesdurchschnittlichen Kosten pro Pflegekraft jeweils für das Jahr, das zwei Jahre vor dem Jahr liegt, in dem der Pflegezuschlag für das Folgejahr zu vereinbaren ist.
The basis for the personnel costs for nursing staff of the individual hospital shall be the full-time positions in nursing, with and without a direct employment relationship with the hospital, which were transmitted by the hospital to the State Statistical Office for the same year and which have been included in the statistics.
Grundlage für die Personalkosten für Pflegepersonal des einzelnen Krankenhauses sind die Vollzeitstellen in der Pflege mit und ohne direktem Beschäftigungsverhältnis mit dem Krankenhaus, die für dasselbe Jahr vom Krankenhaus an das Statistische Landesamt übermittelt wurden und die Eingang in die Statistik gefunden haben.
The full-time positions shown in its psychiatric and psychosomatic specialist departments shall be deducted from these full-time positions.
Von diesen Vollzeitstellen sind die ausgewiesenen Vollzeitstellen in seinen Fachabteilungen der Psychiatrie und der Psychosomatik abzuziehen.
The number of full-time positions determined under sentences 7 and 8 shall be multiplied by the average costs per nurse in the state concerned shown in Subject-Matter Series 12, Series 6.3.
Die nach den Sätzen 7 und 8 ermittelte Zahl der Vollzeitstellen ist zu multiplizieren mit den in der Fachserie 12 Reihe 6.3 ausgewiesenen durchschnittlichen Kosten pro Pflegekraft im jeweiligen Land.
Section 5(4) sentence 5, section 11(4) sentences 3 and 4 and section 15(2) shall apply mutatis mutandis.
§ 5 Absatz 4 Satz 5, § 11 Absatz 4 Satz 3 und 4 sowie § 15 Absatz 2 gelten entsprechend.
The nursing supplement shall be billed for patients who are admitted to the hospital for inpatient treatment before 1 January 2020.
Der Pflegezuschlag ist bei Patientinnen oder Patienten abzurechnen, die vor dem 1. Januar 2020 zur vollstationären Behandlung in das Krankenhaus aufgenommen werden.
(11) By way of derogation from subsection (1) sentence 1 first half-sentence, for patients who are insured under the statutory health insurance and who are admitted to the hospital for full or day-patient treatment in the period from 1 November 2025 to 31 October 2026, the hospital shall charge a supplement amounting to 3.25 per cent of the invoice amount and shall show it separately in the invoice.
(11) Das Krankenhaus berechnet abweichend von Absatz 1 Satz 1 erster Halbsatz bei Patientinnen und Patienten, die in der gesetzlichen Krankenversicherung versichert sind und im Zeitraum vom 1. November 2025 bis zum 31. Oktober 2026 zur voll- oder teilstationären Behandlung in das Krankenhaus aufgenommen werden, einen Zuschlag in Höhe von 3,25 Prozent des Rechnungsbetrags und weist diesen gesondert in der Rechnung aus.

(12) From 1 January 2028, for a hospital to which, for at least one of its hospital sites, at least one service group has been allocated for the calendar year concerned under section 6a(1) sentence 1 of the Hospital Financing Act that is assigned to the paediatrics area in the agreement under section 39(2) sentence 2 of the Hospital Financing Act applicable for the calendar year concerned or in the determination under section 39(2) sentence 4 of the Hospital Financing Act applicable for the calendar year concerned, the levying of deductions from the case-based flat rate where the stay falls below the lower length-of-stay threshold shall be excluded for cases that are to be assigned to one of these service groups on the basis of a data processing solution certified under section 21(3c) and applicable for the calendar year concerned, irrespective of whether the case-based flat-rate catalogue agreed for the calendar year concerned under section 9(1) sentence 1 item 1 and the rules agreed under section 9(1) sentence 1 item 1 provide for a deduction for the case-based flat rate concerned where the stay falls below the lower length-of-stay threshold.
(12) Ab dem 1. Januar 2028 ist für ein Krankenhaus, dem für mindestens einen seiner Krankenhausstandorte nach § 6a Absatz 1 Satz 1 des Krankenhausfinanzierungsgesetzes für das jeweilige Kalenderjahr mindestens eine Leistungsgruppe zugewiesen wurde, die in der für das jeweilige Kalenderjahr geltenden Vereinbarung nach § 39 Absatz 2 Satz 2 des Krankenhausfinanzierungsgesetzes oder in der für das jeweilige Kalenderjahr geltenden Festlegung nach § 39 Absatz 2 Satz 4 des Krankenhausfinanzierungsgesetzes dem Bereich Pädiatrie zugeordnet ist, für Fälle, die auf Basis einer für das jeweilige Kalenderjahr geltenden nach § 21 Absatz 3c zertifizierten Datenverarbeitungslösung einer dieser Leistungsgruppen zuzuordnen sind, die Erhebung von Abschlägen von der Fallpauschale bei Unterschreitung der unteren Grenzverweildauer ausgeschlossen unabhängig davon, ob für die entsprechende Fallpauschale in dem für das jeweilige Kalenderjahr nach § 9 Absatz 1 Satz 1 Nummer 1 vereinbarten Fallpauschalen-Katalog und den nach § 9 Absatz 1 Satz 1 Nummer 1 vereinbarten Regelungen ein Abschlag bei Unterschreitung der unteren Grenzverweildauer für die jeweilige Fallpauschale vorgesehen ist.
