(1) As the basis for determining a revenue volume for the care of children and adolescents for the years 2023 and 2024 (years of application), the Institute for the Hospital Remuneration System (InEK) shall calculate, on the basis of the data transmitted to it under section 21(1), the sum of the effective cost weights per hospital provided in the year 2019 for the relevant cases under sentence 3.
(1) Als Grundlage der Ermittlung eines Erlösvolumens für die Versorgung von Kindern und Jugendlichen für die Jahre 2023 und 2024 (Anwendungsjahre) berechnet das Institut für das Entgeltsystem im Krankenhaus auf der Grundlage der ihm nach § 21 Absatz 1 übermittelten Daten die im Jahr 2019 für die maßgeblichen Fälle nach Satz 3 erbrachte Summe der effektiven Bewertungsrelationen je Krankenhaus.
In doing so, the per-diem nursing charges under section 7(1) sentence 1 item 6a shall not be taken into account.
Dabei sind die tagesbezogenen Pflegeentgelte nach § 7 Absatz 1 Satz 1 Nummer 6a nicht zu berücksichtigen.
Relevant cases are all patients treated on a inpatient or day-patient basis who, at the time of admission to the hospital, are more than 28 days and less than 16 years old.

In order to determine a hospital-specific revenue volume for the care of children and adolescents for the respective year of application, the sum of the effective cost weights calculated under sentence 1 shall in each case be multiplied by InEK by the state base rate agreed or set for the respective year of application; where a state base rate has not yet been agreed or set for the respective year of application, InEK shall determine the respective hospital-specific revenue volume for the care of children and adolescents by multiplying the sum of the effective cost weights calculated under sentence 1 by the state base rate which was agreed or set for the year preceding the respective year of application and which is to be increased by the change value (Veränderungswert) under section 9(1b) sentence 1 applicable to the respective year of application.

The hospital-specific revenue volume for the year 2023 determined under sentence 4 shall be increased by InEK by the percentage under subsection (2) sentence 1, and the hospital-specific revenue volume for the year 2024 determined under sentence 4 shall be increased by InEK by the percentage under subsection (2) sentence 2.

(2) InEK shall calculate a percentage for the year 2023 as the ratio of an amount of EUR 300 million to the sum of the hospital-specific revenue volumes determined for the year 2023 under subsection (1) sentence 4, that sum to be increased by EUR 90 million.

The percentages calculated under sentences 1 to 4 shall be rounded commercially to three decimal places.

(3) The revenue volumes determined and updated under subsection (1) sentences 7 and 8 and the supplements calculated under subsection (4) sentences 3 and 4 shall be used exclusively for the care of children and adolescents.

Upon conclusion of the next agreement under section 11 to be concluded after the end of the respective year of application, the hospital operator shall submit to the other contracting parties under section 11 a confirmation from the annual auditor which shows, or for which the hospital has credibly demonstrated, the extent to which the funds were used for their intended purpose.

(4) In order to pay out the hospital-specific revenue volume determined for the year 2023 under subsection (1) sentence 5, the hospital shall charge, for the relevant cases under subsection (1) sentence 3 admitted for inpatient or day-patient treatment in the period from 1 January 2023 to 31 December 2023, a supplement equal to the percentage under subsection (2) sentence 1 on the case-based flat rates under section 7(1) sentence 1 item 1 valued in the catalogue of charges agreed at federal level, and shall in each case show it separately on the invoice.
(4) Zur Auszahlung des nach Absatz 1 Satz 5 für das Jahr 2023 ermittelten krankenhausindividuellen Erlösvolumens berechnet das Krankenhaus für die maßgeblichen Fälle nach Absatz 1 Satz 3, die im Zeitraum vom 1. (5) Where the sum of the revenue attributable to the calendar year 2023 or 2024 from case-based flat rates under section 7(1) sentence 1 item 1 valued in the catalogue of charges agreed at federal level for the care of the relevant cases under subsection (1) sentence 3, including the respective supplement under subsection (4), deviates from the revenue volume for the respective calendar year determined and updated under subsection (1) sentence 7 or sentence 8, reduced revenue shall be compensated in full where the revenue volume determined and updated under subsection (1) sentence 7 or sentence 8 is undershot by up to 20 per cent, and additional revenue shall be compensated at 65 per cent.

Reduced revenue where the revenue volume determined and updated under subsection (1) sentence 7 or sentence 8 is undershot by more than 20 per cent shall be compensated at 65 per cent.

By way of derogation from sentence 1, the following additional revenue shall be compensated in full:

2. additional revenue resulting from the fact that the hospital-specific revenue volume determined for the year 2024 under subsection (1) sentence 5 exceeds the revenue volume determined and updated under subsection (1) sentence 8, or
2. die daraus resultieren, dass das nach Absatz 1 Satz 5 für das Jahr 2024 ermittelte krankenhausindividuelle Erlösvolumen das nach Absatz 1 Satz 8 ermittelte und aktualisierte Erlösvolumen übersteigt oder
3. additional revenue resulting from the levying of the supplement under subsection (4).

The contracting parties under section 11(1) may agree on a level of compensation deviating from sentences 1 and 2 in order to avoid unreasonable hardship.

(6) The contracting parties under section 17b(2) sentence 1 of the Hospital Financing Act shall jointly report to the Federal Ministry of Health by 31 December 2024, taking into account the annual auditors' confirmations under subsection (3) sentence 2 for the year 2023, on the effects of the revenue volume determined and updated under subsection (1) sentence 7.
(6) Die Vertragsparteien nach § 17b Absatz 2 Satz 1 des Krankenhausfinanzierungsgesetzes berichten dem Bundesministerium für Gesundheit bis zum 31. Dezember 2024 unter Berücksichtigung der Bestätigungen der Jahresabschlussprüfer nach Absatz 3 Satz 2 für das Jahr 2023 gemeinsam über die Auswirkungen des nach Absatz 1 Satz 7 ermittelten und aktualisierten Erlösvolumens.
