(1) The inpatient and day-patient services of DRG hospitals shall be remunerated in accordance with this Act and the Hospital Financing Act (Krankenhausfinanzierungsgesetz).
(1) Die vollstationären und teilstationären Leistungen der DRG-Krankenhäuser werden nach diesem Gesetz und dem Krankenhausfinanzierungsgesetz vergütet.
(2) This Act shall also apply to the remuneration of services of Federal Armed Forces hospitals, insofar as these treat civilian patients, and of the hospitals of the institutions providing statutory accident insurance, insofar as the costs are not borne by the statutory accident insurance.
(2) Dieses Gesetz gilt auch für die Vergütung von Leistungen der Bundeswehrkrankenhäuser, soweit diese Zivilpatienten behandeln, und der Krankenhäuser der Träger der gesetzlichen Unfallversicherung, soweit nicht die gesetzliche Unfallversicherung die Kosten trägt.
1. hospitals to which the Hospital Financing Act does not apply pursuant to section 3 sentence 1 thereof,

2. hospitals which are not eligible for funding under section 5(1) items 2, 4 or 7 of the Hospital Financing Act,
2. Krankenhäuser, die nach § 5 Abs. 1 Nr. 2, 4 oder 7 des Krankenhausfinanzierungsgesetzes nicht gefördert werden,
3. hospitals and independent departments headed by a specialist physician for the specialist fields of psychiatry and psychotherapy, child and adolescent psychiatry and psychotherapy, and psychosomatic medicine and psychotherapy, unless otherwise provided in the Hospital Financing Act or in the Federal Hospital Charges Ordinance (Bundespflegesatzverordnung).
3. Krankenhäuser und selbständige, gebietsärztlich geleitete Abteilungen für die Fachgebiete Psychiatrie und Psychotherapie, Kinder- und Jugendpsychiatrie und -psychotherapie sowie Psychosomatische Medizin und Psychotherapie, soweit im Krankenhausfinanzierungsgesetz oder in der Bundespflegesatzverordnung nichts Abweichendes bestimmt wird.
(3) Pre-inpatient and post-inpatient treatment shall be remunerated uniformly for all users in accordance with section 115a of Book V of the Social Code.
(3) Die vor- und nachstationäre Behandlung wird für alle Benutzer einheitlich nach § 115a des Fünften Buches Sozialgesetzbuch vergütet.
Outpatient operations and other procedures replacing inpatient treatment shall be remunerated, for patients covered by statutory health insurance, in accordance with section 115b of Book V of the Social Code and, for other patients, in accordance with the provisions, agreements or tariffs applicable to them.
Die ambulante Durchführung von Operationen und sonstiger stationsersetzender Eingriffe wird für die gesetzlich versicherten Patienten nach § 115b des Fünften Buches Sozialgesetzbuch und für sonstige Patienten nach den für sie geltenden Vorschriften, Vereinbarungen oder Tarifen vergütet.
The services agreed under section 115f(1) sentence 1 item 2 of Book V of the Social Code or determined under section 115f(4) sentence 2 or sentence 5 of Book V of the Social Code shall be remunerated uniformly for all users of the hospital in accordance with section 115f of Book V of the Social Code.
Die nach § 115f Absatz 1 Satz 1 Nummer 2 des Fünften Buches Sozialgesetzbuch vereinbarten oder nach § 115f Absatz 4 Satz 2 oder Satz 5 des Fünften Buches Sozialgesetzbuch bestimmten Leistungen werden für alle Benutzer und Benutzerinnen des Krankenhauses einheitlich nach § 115f des Fünften Buches Sozialgesetzbuch vergütet.
(4) For hospitals in a federal state (Land) in which service groups were allocated under the law of that federal state by 31 December 2024, the provisions of this Act shall apply subject to the following modifications:
(4) Für Krankenhäuser in einem Land, in dem bis zum 31. Dezember 2024 Leistungsgruppen nach landesrechtlichen Vorschriften zugewiesen wurden, gelten die Regelungen dieses Gesetzes mit folgenden Maßgaben:

2. by way of derogation from section 4(1) sentence 1, the revenue budget for inpatient and day-patient services to be agreed by the contracting parties under section 11(1) shall comprise the case-based flat rates (DRGs) under section 7(1) sentence 1 item 1, in the years 2026 to 2030 including the provision cost weights (Vorhaltebewertungsrelationen) resulting from the nationwide uniform catalogue of charges, and the supplementary charges under section 7(1) sentence 1 item 2,
2. abweichend von § 4 Absatz 1 Satz 1 umfasst das von den Vertragsparteien nach § 11 Absatz 1 zu vereinbarende Erlösbudget für voll- und teilstationäre Leistungen die Fallpauschalen nach § 7 Absatz 1 Satz 1 Nummer 1, in den Jahren 2026 bis 2030 einschließlich der sich aus dem bundeseinheitlichen Entgeltkatalog ergebenden Vorhaltebewertungsrelationen, und die Zusatzentgelte nach § 7 Absatz 1 Satz 1 Nummer 2,
3. by way of derogation from section 4(2a) sentence 1, a fixed-cost degression deduction shall be applied for the last time for the year 2030,
3. abweichend von § 4 Absatz 2a Satz 1 ist letztmalig für das Jahr 2030 ein Fixkostendegressionsabschlag anzuwenden,
4. by way of derogation from section 4(3) sentence 3, reduced revenue shall not be compensated from the year 2031 onwards,
4. abweichend von § 4 Absatz 3 Satz 3 werden Mindererlöse ab dem Jahr 2031 nicht ausgeglichen,
5. by way of derogation from section 4(3) sentence 6, the agreement of compensation for reduced revenue shall be excluded from the year 2031 onwards, even where the conditions referred to in section 4(3) sentence 5 are met,
5. abweichend von § 4 Absatz 3 Satz 6 ist die Vereinbarung eines Ausgleichs für Mindererlöse auch bei Vorliegen der in § 4 Absatz 3 Satz 5 genannten Voraussetzungen ab dem Jahr 2031 ausgeschlossen,
6. by way of derogation from section 7(2) sentence 3, the effective cost weight shall, also in the years 2028 to 2030, also include the provision cost weight resulting from the nationwide uniform catalogue of charges,
6. abweichend von § 7 Absatz 2 Satz 3 umfasst die effektive Bewertungsrelation auch in den Jahren 2028 bis 2030 auch die sich aus dem bundeseinheitlichen Entgeltkatalog ergebende Vorhaltebewertungsrelation,
7. by way of derogation from section 21(2) item 1 letter (d) second half-sentence, hospitals shall, in the years 2029 to 2031, transmit, in addition to the sum of the provision cost weights invoiced, also the sum of the provision cost weights agreed, in each case for the preceding calendar year,
7. abweichend von § 21 Absatz 2 Nummer 1 Buchstabe d zweiter Halbsatz haben Krankenhäuser in den Jahren 2029 bis 2031 zusätzlich zu der Summe der abgerechneten Vorhaltebewertungsrelationen auch die Summe der vereinbarten Vorhaltebewertungsrelationen jeweils für das vorangegangene Kalenderjahr zu übermitteln,
8. in addition to the charges referred to in section 7(1) sentence 1, for those hospital sites to which an amount under section 39(1) of the Hospital Financing Act has been allocated, in respect of the cases in which services from a service group were provided which has been assigned to the area relevant for that allocation under section 39(2) of the Hospital Financing Act, the difference between the increased provision cost weight referred to in section 17b(4b) sentence 5 of the Hospital Financing Act and the non-increased provision cost weight, multiplied by the state base rate agreed or set for the respective calendar year, shall be invoiced and shown separately on the invoice, and
8. zusätzlich zu den in § 7 Absatz 1 Satz 1 genannten Entgelten ist für diejenigen Krankenhausstandorte, auf die ein Betrag nach § 39 Absatz 1 des Krankenhausfinanzierungsgesetzes aufgeteilt wurde, für die Fälle, in denen Leistungen aus einer Leistungsgruppe erbracht wurden, die dem für diese Aufteilung maßgeblichen Bereich nach § 39 Absatz 2 des Krankenhausfinanzierungsgesetzes zugeordnet wurden, die Differenz zwischen der in § 17b Absatz 4b Satz 5 des Krankenhausfinanzierungsgesetzes genannten erhöhten Vorhaltebewertungsrelation und der nicht erhöhten Vorhaltebewertungsrelation multipliziert mit dem für das jeweilige Kalenderjahr vereinbarten oder festgesetzten Landesbasisfallwert abzurechnen und gesondert in der Rechnung auszuweisen und
9. in addition to the compensation for additional or reduced revenue under section 4(3), where the sum of all revenue of the hospital referred to in item 8 attributable to the calendar year for its hospital sites deviates from the level, established under section 37(5) sentence 1 of the Hospital Financing Act, of the amount allocated to the respective hospital site for the service group under section 39(3) sentence 5 of the Hospital Financing Act, the difference shall be compensated in full; in order to determine the compensatory amount for a calendar year, the respective hospital operator shall submit to the other contracting parties under section 18(2) of the Hospital Financing Act a statement, certified by an annual auditor, of the sum of all revenue of the hospital referred to in item 8 attributable to the calendar year for its hospital sites; the sum may be shown in the statement referred to in section 4(3) sentence 8; the compensatory amount determined in accordance with these requirements shall be invoiced by way of the supplement or deduction under section 5(4); where the compensatory amount has not yet been established at the time of the budget negotiations, partial amounts shall be taken into account as payments on account towards the compensation.
9. zusätzlich zu den Mehr- oder Mindererlösausgleichen nach § 4 Absatz 3 ist, sofern die Summe aller auf das Kalenderjahr entfallenden in Nummer 8 genannten Erlöse des Krankenhauses für seine Krankenhausstandorte von der nach § 37 Absatz 5 Satz 1 des Krankenhausfinanzierungsgesetzes festgestellten Höhe des für den jeweiligen Krankenhausstandort für die Leistungsgruppe nach § 39 Absatz 3 Satz 5 des Krankenhausfinanzierungsgesetzes aufgeteilten Betrags abweicht, die Differenz vollständig auszugleichen; zur Ermittlung des Ausgleichsbetrags für ein Kalenderjahr hat der jeweilige Krankenhausträger den anderen Vertragsparteien nach § 18 Absatz 2 des Krankenhausfinanzierungsgesetzes eine von einem Jahresabschlussprüfer bestätigte Aufstellung der Summe aller auf das Kalenderjahr entfallenden in Nummer 8 genannten Erlöse des Krankenhauses für seine Krankenhausstandorte vorzulegen; die Summe kann in der in § 4 Absatz 3 Satz 8 genannten Aufstellung ausgewiesen werden; der nach diesen Vorgaben ermittelte Ausgleichsbetrag wird im Rahmen des Zu- oder Abschlags nach § 5 Absatz 4 abgerechnet; steht bei der Budgetverhandlung der Ausgleichsbetrag noch nicht fest, sind Teilbeträge als Abschlagszahlung auf den Ausgleich zu berücksichtigen.
