(1) If an agreement under section 6c(1) sentence 1, section 10 or section 11 is not reached, in whole or in part, the arbitration board under section 18a(1) of the Hospital Financing Act (Krankenhausfinanzierungsgesetz) shall decide upon application by one of the contracting parties referred to in section 10 or section 11.

(3) If, for agreement periods from the agreement period 2029 onwards, an agreement under section 11 is not reached, or is reached only in part, by the end of 31 July of the year for which the agreement is to apply, the arbitration board under section 18a(1) of the Hospital Financing Act shall, by way of derogation from subsection (1) sentence 1 and subsection (2), decide without an application by a contracting party within eight weeks from 1 August of that year.
(3) Kommt eine Vereinbarung nach § 11 für Vereinbarungszeiträume ab dem Vereinbarungszeitraum 2029 nicht oder teilweise nicht bis zum Ablauf des 31. Juli des Jahres, für das die Vereinbarung gelten soll, zustande, entscheidet die Schiedsstelle nach § 18a Absatz 1 des Krankenhausfinanzierungsgesetzes abweichend von Absatz 1 Satz 1 und Absatz 2 ohne Antrag einer Vertragspartei innerhalb von acht Wochen ab dem 1. August dieses Jahres.

They may jointly notify the arbitration board in writing or electronically, by the end of 31 July of the respective year, that they will conclude the agreement under section 11 by the end of 30 September of that year.

If the contracting parties report under sentence 4 that they have not concluded the agreement, the arbitration board shall, by way of derogation from sentence 1, decide within eight weeks from 1 October of the respective year.

(7) If data, documents and information referred to in section 11(4) sentences 1 and 4 have not been transmitted, submitted or provided to the respective other contracting parties, or have not been so within the time limits referred to in section 11(4) sentences 1 and 4, the arbitration board may, in the arbitration proceedings under subsections (1) to (3) and (6), disregard such data, documents and information, or the court may, in the case of actions against the approval of the resolution of the arbitration board in these arbitration proceedings, decide not to admit such data, documents and information, provided that, in the free conviction of the arbitration board or of the court, taking them into account or admitting them would delay the resolution of the dispute and the failure to meet the time limits is due to reasons for which one of the contracting parties is responsible.
(7) Wenn in § 11 Absatz 4 Satz 1 und 4 genannte Daten, Unterlagen und Auskünfte den jeweils anderen Vertragsparteien nicht oder nicht innerhalb der in § 11 Absatz 4 Satz 1 und 4 genannten Fristen übermittelt, vorgelegt oder erteilt wurden, so kann die Schiedsstelle in den Schiedsverfahren nach den Absätzen 1 bis 3 und 6 solche Daten, Unterlagen und Auskünfte unberücksichtigt lassen oder das Gericht im Fall von Klagen gegen die Genehmigung des Beschlusses der Schiedsstelle in diesen Schiedsverfahren entscheiden, solche Daten, Unterlagen und Auskünfte nicht zuzulassen, sofern die Berücksichtigung oder die Zulassung nach der freien Überzeugung der Schiedsstelle oder des Gerichts die Erledigung des Rechtsstreits verzögern würde und die Nichteinhaltung der Fristen auf von einer der Vertragsparteien zu vertretenden Gründen beruht.
