(1) Hospital services within the meaning of section 1(1) are in particular medical treatment, including by physicians who are not permanently employed, nursing care, the provision of medicinal products, remedies and medical aids necessary for care in the hospital, and accommodation and board; they comprise general hospital services and optional (elective) services.
(1) Krankenhausleistungen nach § 1 Abs. 1 sind insbesondere ärztliche Behandlung, auch durch nicht fest angestellte Ärztinnen und Ärzte, Krankenpflege, Versorgung mit Arznei-, Heil- und Hilfsmitteln, die für die Versorgung im Krankenhaus notwendig sind, sowie Unterkunft und Verpflegung; sie umfassen allgemeine Krankenhausleistungen und Wahlleistungen.
Hospital services shall not include the services of affiliated physicians (Belegärzte) (section 18) or of affiliated midwives (Beleghebammen and Belegentbindungspfleger).
Zu den Krankenhausleistungen gehören nicht die Leistungen der Belegärzte (§ 18) sowie der Beleghebammen und -entbindungspfleger.
(2) General hospital services are those hospital services which, taking into account the capabilities of the hospital, are necessary in the individual case, according to the nature and severity of the illness, for medically appropriate and sufficient care of the patient.
(2) Allgemeine Krankenhausleistungen sind die Krankenhausleistungen, die unter Berücksichtigung der Leistungsfähigkeit des Krankenhauses im Einzelfall nach Art und Schwere der Krankheit für die medizinisch zweckmäßige und ausreichende Versorgung des Patienten notwendig sind.
1. measures for the early detection of diseases within the meaning of Book V of the Social Code carried out during the hospital stay,
1. die während des Krankenhausaufenthalts durchgeführten Maßnahmen zur Früherkennung von Krankheiten im Sinne des Fünften Buches Sozialgesetzbuch,
2. services of third parties arranged by the hospital,
2. die vom Krankenhaus veranlassten Leistungen Dritter,
3. the admission, where necessary for medical reasons, of a person accompanying the patient or the admission of a carer under section 11(3) of Book V of the Social Code,
3. die aus medizinischen Gründen notwendige Mitaufnahme einer Begleitperson des Patienten oder die Mitaufnahme einer Pflegekraft nach § 11 Absatz 3 des Fünften Buches Sozialgesetzbuch,
4. the special tasks of centres and specialised units for the inpatient care of patients, in particular the tasks of tumour centres and geriatric centres and corresponding specialised units,
4. die besonderen Aufgaben von Zentren und Schwerpunkten für die stationäre Versorgung von Patienten, insbesondere die Aufgaben von Tumorzentren und geriatrischen Zentren sowie entsprechenden Schwerpunkten,
5. early rehabilitation within the meaning of section 39(1) sentence 3 of Book V of the Social Code,
5. die Frührehabilitation im Sinne von § 39 Abs. 1 Satz 3 des Fünften Buches Sozialgesetzbuch,
6. discharge management within the meaning of section 39(1a) of Book V of the Social Code.

Hospital services under sentence 2 item 2 shall not include
Nicht zu den Krankenhausleistungen nach Satz 2 Nummer 2 gehören
1. dialysis, where this continues a corresponding treatment, the hospital does not have its own dialysis facility and there is no connection with the reason for the hospital treatment,
1. eine Dialyse, wenn hierdurch eine entsprechende Behandlung fortgeführt wird, das Krankenhaus keine eigene Dialyseeinrichtung hat und ein Zusammenhang mit dem Grund der Krankenhausbehandlung nicht besteht,
2. radiotherapy, where its performance by third parties is medically necessary,
2. eine Strahlentherapie, wenn ihre Durchführung durch Dritte medizinisch notwendig ist,
3. in the hospital treatment of persons with a hearing impairment, sign-language interpreting assistance services to compensate for the disability-related communication impairments.
3. bei der Krankenhausbehandlung von Menschen mit Hörbehinderung Leistungen der Dolmetscherassistenz zum Ausgleich der behinderungsbedingten Kommunikationsbeeinträchtigungen.
Special tasks under sentence 2 item 4 require that they be designated and specified in the hospital plan of the federal state (Land) or be specified in a comparable manner by the competent authority of the federal state in the individual case vis-à-vis the hospital; the designation and specification in the hospital plan or the specification in the individual case may be replaced by the approval, under section 14(1) sentence 2, of the supplement agreed under section 5(3).

The special tasks shall comprise only services which are not already remunerated by the case-based flat rates, under other provisions of this Act or under provisions of Book V of the Social Code; they may also comprise services which do not form part of direct inpatient patient care.

(3) Where general hospital services are provided by physicians who are not permanently employed in the hospital, the hospital shall ensure that, for their activities in the hospital, they meet the same requirements as apply to physicians permanently employed in the hospital.
(3) Bei der Erbringung von allgemeinen Krankenhausleistungen durch nicht im Krankenhaus fest angestellte Ärztinnen und Ärzte hat das Krankenhaus sicherzustellen, dass diese für ihre Tätigkeit im Krankenhaus die gleichen Anforderungen erfüllen, wie sie auch für fest im Krankenhaus angestellte Ärztinnen und Ärzte gelten.
(4) The German Hospital Federation shall examine by 31 December 2021 whether medical teleconsultation services provided between hospitals are appropriately remunerated.
(4) Die Deutsche Krankenhausgesellschaft prüft bis zum 31. Dezember 2021, ob zwischen Krankenhäusern erbrachte telekonsiliarärztliche Leistungen sachgerecht vergütet werden.
In doing so, it shall also be examined whether an adjustment of the remuneration is necessary.
Dabei ist auch zu prüfen, ob eine Anpassung der Vergütung notwendig ist.
