(1) Approval of the state-wide base rate under section 10, of the revenue budget under section 4, of the charges under section 6, of the nursing budget under section 6a, of the supplements and deductions determined on a hospital-specific basis, of the total volume agreed under section 6c(1) sentence 1 and of the hospital-specific daily charges agreed under section 6c(1) sentence 2 items 2 to 4, as agreed or as determined by the arbitration board under section 13, shall be applied for by one of the contracting parties to the competent state authority.

It shall decide on the following approvals within the following time limits:

1. on approval of the state-wide base rate, within four weeks of receipt of the application and
1. über die Genehmigung des landesweit geltenden Basisfallwerts innerhalb von vier Wochen nach Eingang des Antrags und
2. on approval of the revenue budget under section 4, of the charges under section 6, of the nursing budget under section 6a or of the supplements and deductions determined on a hospital-specific basis, within eight weeks of receipt of the respective application.
2. über die Genehmigung des Erlösbudgets nach § 4, der Entgelte nach § 6, des Pflegebudgets nach § 6a oder der krankenhausindividuell ermittelten Zu- und Abschläge innerhalb von acht Wochen nach Eingang des jeweiligen Antrags.
If the competent state authority does not decide on an approval referred to in sentence 3 item 2 within eight weeks of receipt of the respective application, the respective approval shall be deemed to have been granted, unless otherwise provided under state law.
Sofern die zuständige Landesbehörde über eine in Satz 3 Nummer 2 genannte Genehmigung nicht innerhalb von acht Wochen nach Eingang des jeweiligen Antrags entscheidet, gilt die jeweilige Genehmigung als erteilt, soweit landesrechtlich nichts Abweichendes bestimmt ist.

The competent state authority shall decide on each of the applications referred to in sentence 1 within 14 days of receipt.
Die zuständige Landesbehörde entscheidet jeweils innerhalb von 14 Tagen nach Eingang über die in Satz 1 genannten Anträge.
(1b) The competent state authority shall inform the Association of Private Health Insurance (Verband der Privaten Krankenversicherung) of its decision on the approval referred to in subsections (1) and (1a).

(2) The contracting parties and the arbitration boards shall submit to the competent state authority the documents, and provide the information, required for examining lawfulness.

In all other respects, the legal provisions applicable to the contracting parties with regard to the agreement shall apply accordingly.

The approval may be combined with ancillary provisions where this is necessary to remove legal obstacles that stand in the way of an unrestricted approval.

(3) If approval of an arbitration award is refused, the arbitration board shall be obliged, upon application, to decide anew, having regard to the legal opinion of the approving authority.
(3) Wird die Genehmigung eines Schiedsspruches versagt, ist die Schiedsstelle auf Antrag verpflichtet, unter Beachtung der Rechtsauffassung der Genehmigungsbehörde erneut zu entscheiden.
(4) With regard to the approval of the state-wide base rate, recourse to the administrative courts shall be available only to the contracting parties at state level.
(4) Im Hinblick auf die Genehmigung des landesweit geltenden Basisfallwerts ist der Verwaltungsrechtsweg nur für die Vertragsparteien auf Landesebene gegeben.
No preliminary (objection) proceedings shall take place; the action shall have no suspensive effect.
