(1) The National Association of Statutory Health Insurance Funds shall agree with pharmaceutical companies, in consultation with the Association of Private Health Insurance (Verband der privaten Krankenversicherung), on the basis of the resolution of the Federal Joint Committee on the benefit assessment under section 35a subsection (3), with effect for all health insurance funds, reimbursement amounts for medicinal products which were not assigned to a reference price group by that resolution.
(1) Der Spitzenverband Bund der Krankenkassen vereinbart mit pharmazeutischen Unternehmern im Benehmen mit dem Verband der privaten Krankenversicherung auf Grundlage des Beschlusses des Gemeinsamen Bundesausschusses über die Nutzenbewertung nach § 35a Absatz 3 mit Wirkung für alle Krankenkassen Erstattungsbeträge für Arzneimittel, die mit diesem Beschluss keiner Festbetragsgruppe zugeordnet wurden.
A representative of a health insurance fund shall in each case take part in the negotiation; the details shall be laid down by the National Association of Statutory Health Insurance Funds in its statutes.
Dabei soll jeweils ein Vertreter einer Krankenkasse an der Verhandlung teilnehmen; das Nähere regelt der Spitzenverband Bund der Krankenkassen in seiner Satzung.
For medicinal products under section 129a, at most the reimbursement amount may be agreed with the pharmaceutical company.
Für Arzneimittel nach § 129a kann mit dem pharmazeutischen Unternehmer höchstens der Erstattungsbetrag vereinbart werden.
Section 130a subsection (8) sentence 6 shall apply accordingly.

The negotiations and their preparation, including the deliberation documents and minutes relating to the agreement of the reimbursement amount, shall be confidential.
Die Verhandlungen und deren Vorbereitung einschließlich der Beratungsunterlagen und Niederschriften zur Vereinbarung des Erstattungsbetrages sind vertraulich.
(1a) In an agreement under subsection (1), volume-related aspects, such as volume-related tiering or an annual total volume, shall be agreed and the total expenditure volume of the medicinal product shall be taken into account having regard to its significance in health care provision (price-volume arrangement).
(1a) Bei einer Vereinbarung nach Absatz 1 müssen mengenbezogene Aspekte, wie eine mengenbezogene Staffelung oder ein jährliches Gesamtvolumen, vereinbart und das Gesamtausgabenvolumen des Arzneimittels unter Beachtung seines Stellenwerts in der Versorgung berücksichtigt werden (Preis-Mengen-Regelung).
The subject matter of a price-volume arrangement may in particular be a cap on the pack-related reimbursement amount.
Gegenstand einer Preis-Mengen-Regelung kann insbesondere eine Begrenzung des packungsbezogenen Erstattungsbetrags sein.
If no price-volume arrangement is agreed in an agreement under subsection (1), an adjustment of the reimbursement amount in accordance with sentences 5 to 16 shall be deemed to have been agreed, subject to the subsequent agreement of such an arrangement.
Wird in einer Vereinbarung nach Absatz 1 keine Preis-Mengen-Regelung vereinbart, gilt vorbehaltlich der nachträglichen Vereinbarung einer solchen eine Anpassung des Erstattungsbetrags nach Maßgabe der Sätze 5 bis 16 als vereinbart.
The arbitration board under subsection (5) may set a different price-volume arrangement only with the consent of the contracting parties.

The reimbursement amount shall be adjusted annually, for the first time from the fourth year after the first placing on the market of a medicinal product containing the active substance.
Der Erstattungsbetrag ist jährlich, erstmals ab dem vierten Jahr nach dem erstmaligen Inverkehrbringen eines Arzneimittels mit dem Wirkstoff, anzupassen.
For the purpose of the adjustment, the agreed or set reimbursement amount shall be changed by a rebate rate.
Zur Anpassung wird der vereinbarte oder festgesetzte Erstattungsbetrag um einen Rabattsatz geändert.
1. the product of 1.7 per cent and the quotient of

2. the product of 1.5 per cent and the quotient, rounded down to the next lower whole number, of the total expenditure volume of the medicinal product in the previous-year period and EUR 100 million.

If the sum is negative, the agreed or set reimbursement amount shall not be changed.
Ist die Summe negativ, wird der vereinbarte oder festgesetzte Erstattungsbetrag nicht geändert.
The previous-year period under sentence 7 shall in each case be the twelve-month period which begins with the eighteenth month before the date referred to in sentence 5 for the adjustment of the reimbursement amount and ends with the seventh month before the date referred to in sentence 5 for the adjustment of the reimbursement amount, for the first time the nineteenth to thirtieth month after the first placing on the market of a medicinal product containing the active substance.
Der Vorjahreszeitraum nach Satz 7 ist jeweils der Zwölf-Monats-Zeitraum, der mit dem achtzehnten Monat vor dem in Satz 5 genannten Zeitpunkt für die Anpassung des Erstattungsbetrags beginnt und mit dem siebten Monat vor dem in Satz 5 genannten Zeitpunkt für die Anpassung des Erstattungsbetrags endet, erstmals der neunzehnte bis dreißigste Monat nach dem erstmaligen Inverkehrbringen eines Arzneimittels mit dem Wirkstoff.
The reference-year period under sentence 7 item 1 letter a shall be the seventh to eighteenth month after the first placing on the market of a medicinal product containing the active substance.
Der Referenzjahreszeitraum nach Satz 7 Nummer 1 Buchstabe a ist der siebte bis achtzehnte Monat nach dem erstmaligen Inverkehrbringen eines Arzneimittels mit dem Wirkstoff.
The total expenditure volume of an annual period shall be the sum of the products of the respective number of reference units of the medicinal product billed by pharmacies at the expense of the health insurance funds and the reimbursement amount per reference unit applicable in each case.
Das Gesamtausgabenvolumen eines Jahreszeitraums ist die Summe der Produkte der jeweiligen Anzahl der von Apotheken zu Lasten der Krankenkassen abgerechneten Bezugsgrößen des Arzneimittels und dem jeweils geltenden Erstattungsbetrag pro Bezugsgröße.
The medicinal product referred to in sentences 7 and 11 shall also include imported medicinal products dispensed under section 129 subsection (1) sentence 1 item 2; all medicinal products with the same new active substance to which, under subsection (3a) sentence 1, the reimbursement amount agreed under subsection (1) applies shall be treated as equivalent to the medicinal product.

The National Association of Statutory Health Insurance Funds shall annually determine the number of reference units of the medicinal product billed in the previous-year period and in the reference-year period on the basis of the data under section 84 subsection (5), ascertain the total expenditure volume of the medicinal product in the previous-year period and in the reference-year period and calculate the level of the rebate rate.
Der Spitzenverband Bund der Krankenkassen stellt jährlich die Anzahl der im Vorjahreszeitraum und der im Referenzjahreszeitraum abgerechneten Bezugsgrößen des Arzneimittels anhand der Daten nach § 84 Absatz 5 fest, ermittelt das Gesamtausgabenvolumen des Arzneimittels im Vorjahreszeitraum und im Referenzjahreszeitraum und berechnet die Höhe des Rabattsatzes.
If the calculated rebate rate leads to a change in the agreed or set reimbursement amount, the National Association of Statutory Health Insurance Funds shall make available to the pharmaceutical company the level of the rebate rate, including the reference units determined and the total expenditure volumes ascertained, annually by the end of the second month before the date referred to in sentence 5 for the adjustment of the reimbursement amount, for the first time by the end of the thirty-fifth month after the first placing on the market of a medicinal product containing the active substance.
Führt der berechnete Rabattsatz zu einer Änderung des vereinbarten oder festgesetzten Erstattungsbetrags, stellt der Spitzenverband Bund der Krankenkassen dem pharmazeutischen Unternehmer die Höhe des Rabattsatzes einschließlich der festgestellten Bezugsgrößen und der ermittelten Gesamtausgabenvolumina jährlich bis zum Ablauf des zweiten Monats vor dem in Satz 5 genannten Zeitpunkt für die Anpassung des Erstattungsbetrags, erstmals bis zum Ablauf des fünfunddreißigsten Monats nach dem erstmaligen Inverkehrbringen eines Arzneimittels mit dem Wirkstoff, zur Verfügung.
The reimbursement amount to be adjusted under sentence 3 shall apply for the first time from the latest of the following dates:
Der nach Satz 3 anzupassende Erstattungsbetrag gilt erstmals ab dem spätesten der folgenden Zeitpunkte:
2. from the date referred to in sentence 5 for the first adjustment of the reimbursement amount,
2. ab dem in Satz 5 genannten Zeitpunkt für die erstmalige Anpassung des Erstattungsbetrags,
3. in the cases referred to in subsection (3a) sentence 2, 3, 4, 5, 6 or 8, from the date referred to there in each case,
3. in den in Absatz 3a Satz 2, 3, 4, 5, 6 oder 8 genannten Fällen ab dem dort jeweils genannten Zeitpunkt,
4. in the case of a new agreement under subsection (1) on account of the termination of an agreement under subsection (1) or of an arbitration award under subsection (4), from the date on which the new agreement takes effect, but no later than from the seventh month after the termination takes effect.
4. im Fall einer neuen Vereinbarung nach Absatz 1 aufgrund der Kündigung einer Vereinbarung nach Absatz 1 oder eines Schiedsspruchs nach Absatz 4 ab dem Wirksamwerden der neuen Vereinbarung, jedoch spätestens ab dem siebten Monat nach dem Wirksamwerden der Kündigung.
If the adjustment of the reimbursement amount under sentence 3 is deemed to have been agreed only after expiry of the deadline referred to in sentence 14 which is relevant for the reimbursement amount to be adjusted that applies for the first time under sentence 15, the National Association of Statutory Health Insurance Funds shall make the information referred to in sentence 14 available to the pharmaceutical company without undue delay after the conclusion of the agreement under subsection (1) or the setting under subsection (4).
Gilt die Anpassung des Erstattungsbetrags nach Satz 3 erst nach Ablauf der in Satz 14 genannten, für den nach Satz 15 erstmals geltenden anzupassenden Erstattungsbetrag maßgeblichen Frist als vereinbart, stellt der Spitzenverband Bund der Krankenkassen die in Satz 14 genannten Informationen dem pharmazeutischen Unternehmer unverzüglich nach dem Zustandekommen der Vereinbarung nach Absatz 1 oder der Festsetzung nach Absatz 4 zur Verfügung.
The details of the implementation of price-volume arrangements in relation to the health insurance funds, in particular with regard to their duties to cooperate, shall be laid down by the National Association of Statutory Health Insurance Funds in its statutes.
Das Nähere zur Umsetzung von Preis-Mengen-Regelungen im Verhältnis zu den Krankenkassen insbesondere im Hinblick auf deren Mitwirkungspflichten regelt der Spitzenverband Bund der Krankenkassen in seiner Satzung.
(1b) If, for a medicinal product, no economical pack sizes are available for the patient groups specified in the marketing authorisation which allow dosing appropriate to the therapy, and if wastage of more than 20 per cent of the content of the packs placed on the market is therefore to be expected for one or more patient groups, this wastage shall be taken into account in an agreement under subsection (1) so as to reduce the price in relation to the respective patient group.
(1b) Stehen für ein Arzneimittel keine wirtschaftlichen Packungsgrößen für die in der Zulassung genannten Patientengruppen zur Verfügung, die eine therapiegerechte Dosierung ermöglichen, und ist daher bei einer oder mehreren Patientengruppen ein Verwurf von mehr als 20 Prozent des Inhalts der in Verkehr gebrachten Packungen zu erwarten, ist dieser Verwurf bei einer Vereinbarung nach Absatz 1 im Verhältnis zu der jeweiligen Patientengruppe preismindernd zu berücksichtigen.
(1c) Within five days after an agreement under subsection (1) concluded by 30 June 2028 or a setting under subsection (4) made by 30 June 2028 on account of the first placing on the market of a medicinal product with a new active substance, the pharmaceutical company may, by declaration to the National Association of Statutory Health Insurance Funds, determine that, until the expiry of regulatory data protection for that medicinal product, the transmission of information under section 131 subsection (4) sentence 3 item 3 shall take the place of the transmission of information under section 131 subsection (4) sentence 3 item 2, provided that it submits documents demonstrating a pharmaceutical research department of the company within the territorial scope of this Act and, in addition, relevant own projects and cooperations with public institutions in pre-clinical or clinical pharmaceutical research within the territorial scope of this Act.
(1c) Der pharmazeutische Unternehmer kann innerhalb von fünf Tagen nach einer bis zum 30. Juni 2028 zustande gekommenen Vereinbarung nach Absatz 1 oder einer bis zum 30. Juni 2028 getroffenen Festsetzung nach Absatz 4 aufgrund des erstmaligen Inverkehrbringens eines Arzneimittels mit einem neuen Wirkstoff durch Erklärung gegenüber dem Spitzenverband Bund der Krankenkassen bestimmen, dass bis zum Wegfall des Unterlagenschutzes für dieses Arzneimittel an die Stelle der Übermittlung von Angaben nach § 131 Absatz 4 Satz 3 Nummer 2 die Übermittlung von Angaben nach § 131 Absatz 4 Satz 3 Nummer 3 tritt, wenn er Unterlagen vorlegt, die eine Arzneimittelforschungsabteilung des Unternehmens im Geltungsbereich dieses Gesetzes und zusätzlich relevante eigene Projekte und Kooperationen mit öffentlichen Einrichtungen in präklinischer oder klinischer Arzneimittelforschung im Geltungsbereich dieses Gesetzes nachweisen.
The National Association of Statutory Health Insurance Funds shall determine, within seven days of submission and on the basis of the pharmaceutical company's documents, whether the conditions referred to in sentence 1 are met.
Der Spitzenverband Bund der Krankenkassen stellt innerhalb von sieben Tagen ab Vorlage anhand der Unterlagen des pharmazeutischen Unternehmers fest, ob die in Satz 1 genannten Voraussetzungen vorliegen.
If the National Association of Statutory Health Insurance Funds determines that the conditions referred to in sentence 1 are not met, the arbitration board under subsection (5) shall decide within a further seven days, on the basis of the pharmaceutical company's documents, whether the conditions referred to in sentence 1 are met; this decision shall take the place of the decision of the National Association of Statutory Health Insurance Funds under sentence 2.
Stellt der Spitzenverband Bund der Krankenkassen fest, dass die in Satz 1 genannten Voraussetzungen nicht vorliegen, entscheidet die Schiedsstelle nach Absatz 5 innerhalb von weiteren sieben Tagen anhand der Unterlagen des pharmazeutischen Unternehmers, ob die in Satz 1 genannten Voraussetzungen vorliegen; diese Entscheidung tritt an die Stelle der Entscheidung des Spitzenverbandes Bund der Krankenkassen nach Satz 2.
If the National Association of Statutory Health Insurance Funds determines, or the arbitration board under subsection (5) decides, that the conditions referred to in sentence 1 are met, the reimbursement amount for the medicinal product concerned shall be the amount agreed under subsection (1) or set under subsection (4) less a discount of 9 per cent and, until the expiry of regulatory data protection for that medicinal product, the transmission of information under section 131 subsection (4) sentence 3 item 3 shall take the place of the transmission of information under section 131 subsection (4) sentence 3 item 2.
Stellt der Spitzenverband Bund der Krankenkassen fest oder entscheidet die Schiedsstelle nach Absatz 5, dass die in Satz 1 genannten Voraussetzungen vorliegen, ist der Erstattungsbetrag für das jeweilige Arzneimittel der nach Absatz 1 vereinbarte oder nach Absatz 4 festgesetzte Betrag abzüglich eines Abschlags in Höhe von 9 Prozent und tritt bis zum Wegfall des Unterlagenschutzes für dieses Arzneimittel an die Stelle der Übermittlung von Angaben nach § 131 Absatz 4 Satz 3 Nummer 2 die Übermittlung von Angaben nach § 131 Absatz 4 Satz 3 Nummer 3.
If the pharmaceutical company submits the documents for the evidence referred to in sentence 1 within six months after the medicinal product has been placed on the market, sentences 2 and 3 shall apply accordingly with regard to that evidence, subject to the proviso that the decision shall be valid for one year.
Legt der pharmazeutische Unternehmer die Unterlagen zu dem in Satz 1 genannten Nachweis innerhalb von sechs Monaten nach Inverkehrbringen des Arzneimittels vor, sind die Sätze 2 und 3 hinsichtlich dieser Nachweise entsprechend anzuwenden mit der Maßgabe, dass die Entscheidung ein Jahr gültig ist.
If a new reimbursement amount is agreed or set for a medicinal product for which a determination under sentence 1 has been made, sentences 1 to 4 shall apply accordingly.
Wird für ein Arzneimittel, für das eine Bestimmung nach Satz 1 erfolgt ist, ein neuer Erstattungsbetrag vereinbart oder festgesetzt, gelten die Sätze 1 bis 4 entsprechend.
(3) The reimbursement amount shall be agreed under subsection (1) or set under subsection (4) on the basis of the extent of the added benefit, and its probability, as established in the resolution on the benefit assessment under section 35a subsection (3).
(3) Der Erstattungsbetrag ist auf Grundlage des im Beschluss über die Nutzenbewertung nach § 35a Absatz 3 festgestellten Ausmaßes des Zusatznutzens und dessen Wahrscheinlichkeit nach Absatz 1 zu vereinbaren oder nach Absatz 4 festzusetzen.
For a medicinal product which, according to the resolution of the Federal Joint Committee under section 35a subsection (3) sentence 1, has no added benefit and cannot be assigned to a reference price group, a reimbursement amount shall be agreed which does not lead to higher annual therapy costs than the appropriate comparator therapy determined by the Federal Joint Committee.
Für ein Arzneimittel, das nach dem Beschluss des Gemeinsamen Bundesausschusses nach § 35a Absatz 3 Satz 1 keinen Zusatznutzen hat und keiner Festbetragsgruppe zugeordnet werden kann, soll ein Erstattungsbetrag vereinbart werden, der nicht zu höheren Jahrestherapiekosten führt als die durch den Gemeinsamen Bundesausschuss bestimmte zweckmäßige Vergleichstherapie.
For a medicinal product for which an added benefit is deemed not proven under section 35a subsection (1) sentence 5, a reimbursement amount shall be agreed which leads to annual therapy costs that are lower, to an appropriate extent, than those of the appropriate comparator therapy determined by the Federal Joint Committee.
Für ein Arzneimittel, für das ein Zusatznutzen nach § 35a Absatz 1 Satz 5 als nicht belegt gilt, ist ein Erstattungsbetrag zu vereinbaren, der zu in angemessenem Umfang geringeren Jahrestherapiekosten führt als die durch den Gemeinsamen Bundesausschuss bestimmte zweckmäßige Vergleichstherapie.
Where the Federal Joint Committee has determined several alternatives for the appropriate comparator therapy, the application of sentences 2 and 3 shall be based on the appropriate comparator therapy which, in terms of annual therapy costs, constitutes the most cost-effective alternative.
Sind durch den Gemeinsamen Bundesausschuss mehrere Alternativen für die zweckmäßige Vergleichstherapie bestimmt, ist für die Anwendung der Sätze 2 und 3 auf die zweckmäßige Vergleichstherapie abzustellen, die nach den Jahrestherapiekosten die wirtschaftlichste Alternative darstellt.
If the Federal Joint Committee has determined as the appropriate comparator therapy a medicinal product with a patent-protected active substance which is not subject to the benefit assessment under section 35a, or if such a medicinal product is taken into account as a comparable medicinal product pursuant to subsection (9) sentence 3, a discount of 15 per cent shall be applied to the annual therapy costs of that medicinal product to be used for the comparison.
Hat der Gemeinsame Bundesausschuss ein Arzneimittel mit einem patentgeschützten Wirkstoff, der nicht der Nutzenbewertung nach § 35a unterfällt, als zweckmäßige Vergleichstherapie bestimmt, oder findet ein solches Arzneimittel gemäß Absatz 9 Satz 3 als vergleichbares Arzneimittel Berücksichtigung, ist auf die zum Vergleich heranzuziehenden Jahrestherapiekosten des Arzneimittels ein Abschlag in Höhe von 15 Prozent in Ansatz zu bringen.
For medicinal products under section 35a subsection (3b) sentence 1, the reimbursement amount shall as a rule be renegotiated after expiry of the deadline set by the Federal Joint Committee for conducting an application-accompanying data collection and after a new resolution on the benefit assessment.
Für Arzneimittel nach § 35a Absatz 3b Satz 1 wird der Erstattungsbetrag regelmäßig nach Ablauf der vom Gemeinsamen Bundesausschuss gesetzten Frist zur Durchführung einer anwendungsbegleitenden Datenerhebung und nach erneutem Beschluss über die Nutzenbewertung neu verhandelt.
If, in the case of medicinal products authorised for the treatment of a rare disease under Regulation (EC) No 141/2000, no quantification of the added benefit can be demonstrated on the basis of the data obtained, a reimbursement amount shall be agreed which leads to annual therapy costs that are lower, to an appropriate extent, than under the previously agreed reimbursement amount.
Sofern sich im Fall der Arzneimittel, die zur Behandlung eines seltenen Leidens nach der Verordnung (EG) Nr. 141/2000 zugelassen sind, anhand der gewonnenen Daten keine Quantifizierung des Zusatznutzens belegen lässt, ist ein Erstattungsbetrag zu vereinbaren, der in angemessenem Umfang zu geringeren Jahrestherapiekosten führt als der zuvor vereinbarte Erstattungsbetrag.
The National Association of Statutory Health Insurance Funds may also request a renegotiation of the reimbursement amount in accordance with sentences 6 and 7 before expiry of the deadline set by the Federal Joint Committee if the Federal Joint Committee, in the course of the review under section 35a subsection (3b) sentence 10, concludes that the data collection
Der Spitzenverband Bund der Krankenkassen kann auch vor Ablauf der vom Gemeinsamen Bundesausschuss gesetzten Frist eine Neuverhandlung des Erstattungsbetrags nach Maßgabe der Sätze 6 und 7 verlangen, wenn der Gemeinsame Bundesausschuss im Rahmen der Überprüfung nach § 35a Absatz 3b Satz 10 zu dem Ergebnis kommt, dass die Datenerhebung
1. will not be conducted or cannot be conducted or
1. nicht durchgeführt werden wird oder nicht durchgeführt werden kann oder
2. will, for other reasons, not provide sufficient evidence for a reassessment of the added benefit.
2. aus sonstigen Gründen keine hinreichenden Belege zur Neubewertung des Zusatznutzens erbringen wird.
(3a) The reimbursement amount agreed under subsection (1) shall apply to all medicinal products with the same new active substance that have been placed on the market since 1 January 2011.
(3a) Der nach Absatz 1 vereinbarte Erstattungsbetrag gilt für alle Arzneimittel mit dem gleichen neuen Wirkstoff, die ab dem 1. Januar 2011 in Verkehr gebracht worden sind.
It shall apply from the seventh month after the first placing on the market of a medicinal product containing the active substance.
Er gilt ab dem siebten Monat nach dem erstmaligen Inverkehrbringen eines Arzneimittels mit dem Wirkstoff.
If a new reimbursement amount is agreed on the basis of a benefit assessment following the authorisation of a new therapeutic indication, it shall apply from the seventh month after the authorisation of the new therapeutic indication.

If a new reimbursement amount is agreed on the basis of a benefit assessment initiated under section 35a subsection (1) sentence 12, it shall apply from the seventh month after the turnover threshold has been exceeded.

In other cases in which a reimbursement amount is agreed on the basis of a benefit assessment under section 35a, it shall apply from the seventh month after the event triggering the respective benefit assessment.

In cases in which the application of the reimbursement amount agreed for another medicinal product with the same active substance would not be appropriate with regard to health care provision or would constitute undue hardship, the National Association of Statutory Health Insurance Funds shall, by way of derogation from sentence 1, agree with the pharmaceutical company in particular a separate reimbursement amount.
In den Fällen, in denen die Geltung des für ein anderes Arzneimittel mit dem gleichen Wirkstoff vereinbarten Erstattungsbetrags im Hinblick auf die Versorgung nicht sachgerecht wäre oder eine unbillige Härte darstellen würde, vereinbart der Spitzenverband Bund der Krankenkassen mit dem pharmazeutischen Unternehmer abweichend von Satz 1 insbesondere einen eigenen Erstattungsbetrag.
This reimbursement amount shall apply from the seventh month after the first placing on the market of a medicinal product containing the active substance.

In the cases referred to in subsection (1a) sentence 15 or subsection (3a) sentence 2, 3, 4, 5, 6 or sentence 8, the difference between the reimbursement amount and the selling price actually paid until it was agreed, including the surcharges paid in excess under the Medicinal Products Price Ordinance (Arzneimittelpreisverordnung) and the value added tax paid in excess, shall be compensated.
In den Fällen des Absatzes 1a Satz 15 oder des Absatzes 3a Satz 2, 3, 4, 5, 6 oder Satz 8 ist die Differenz zwischen Erstattungsbetrag und dem bis zu dessen Vereinbarung tatsächlich gezahlten Abgabepreis einschließlich der zu viel entrichteten Zuschläge nach der Arzneimittelpreisverordnung und der zu viel entrichteten Umsatzsteuer auszugleichen.
The details, in particular regarding the delimitation of the cases under sentence 4, shall be laid down in the agreement under subsection (9).

(3b) For a reserve antibiotic in respect of which the Federal Joint Committee has resolved an exemption under section 35a subsection (1c) sentence 1 and which is placed on the market for the first time before 1 January 2031, the pharmaceutical company's selling price at the time of first placing on the market shall be deemed to be the reimbursement amount.
(3b) Für ein Reserveantibiotikum, hinsichtlich dessen der Gemeinsame Bundesausschuss eine Freistellung nach § 35a Absatz 1c Satz 1 beschlossen hat und das vor dem 1. Januar 2031 erstmalig in Verkehr gebracht wird, gilt der Abgabepreis des pharmazeutischen Unternehmers zum Zeitpunkt des erstmaligen Inverkehrbringens als Erstattungsbetrag.
The National Association of Statutory Health Insurance Funds shall conclude with the pharmaceutical company, in respect of the reserve antibiotic referred to in sentence 1, an agreement which is limited to the contents referred to in subsection (1a).
Der Spitzenverband Bund der Krankenkassen trifft hinsichtlich des in Satz 1 genannten Reserveantibiotikums mit dem pharmazeutischen Unternehmer eine Vereinbarung, die sich auf die in Absatz 1a genannten Inhalte beschränkt.
The subject matter of this agreement may be a reduction of the reimbursement amount under sentence 1.
Gegenstand dieser Vereinbarung kann eine Absenkung des Erstattungsbetrags nach Satz 1 sein.
Subsection (1) sentences 1, 2 and 7, subsection (4) sentences 1, 2 and 4 to 7 and subsection (7) shall apply accordingly to the agreement; subsection (3a) sentence 1 and subsection (8a) shall apply accordingly to the reimbursement amount.

For the purpose of implementing the agreement under sentence 2, the pharmaceutical company shall, upon request, notify the National Association of Statutory Health Insurance Funds of the dispensing figures and turnover of the reserve antibiotic.
Zum Zweck der Umsetzung der Vereinbarung nach Satz 2 teilt der pharmazeutische Unternehmer dem Spitzenverband Bund der Krankenkassen auf Verlangen die Abgabezahlen und Umsätze des Reserveantibiotikums mit.
(4) If an agreement under subsection (1) is not reached within six months after publication of the resolution under section 35a subsection (3) or under section 35b subsection (3), the arbitration board under subsection (5) shall set the content of the contract within three months.
(4) Kommt eine Vereinbarung nach Absatz 1 nicht innerhalb von sechs Monaten nach Veröffentlichung des Beschlusses nach § 35a Absatz 3 oder nach § 35b Absatz 3 zustande, setzt die Schiedsstelle nach Absatz 5 den Vertragsinhalt innerhalb von drei Monaten fest.
The arbitration board shall decide on the basis of a free assessment of all the circumstances of the individual case and shall take into account the special characteristics of the therapeutic area concerned.
Die Schiedsstelle entscheidet unter freier Würdigung aller Umstände des Einzelfalls und berücksichtigt dabei die Besonderheiten des jeweiligen Therapiegebietes.
The reimbursement amount laid down in the arbitration award shall apply from the seventh month after the event referred to in each case in subsection (1a) sentence 15 or subsection (3a) sentence 2, 3, 4, 5, 6 or sentence 8, subject to the proviso that the difference between the reimbursement amount laid down by the arbitration board and the selling price actually paid, including the surcharges paid in excess under the Medicinal Products Price Ordinance and the value added tax paid in excess, shall be compensated in the setting in accordance with subsection (3a) sentence 9.

The arbitration board shall give the Association of Private Health Insurance the opportunity to submit an opinion before its decision.

Actions against decisions of the arbitration board shall not have suspensive effect.

(4a) In the case of a determination under subsection (1c), the difference between the selling price actually paid and the reimbursement amount under subsection (1a) sentence 15, including the surcharges paid in excess under the Medicinal Products Price Ordinance and the value added tax paid in excess, shall be compensated for the period from the date from which the reimbursement amount applies under subsection (3a) sentence 2, 3, 4, 5, 6 or sentence 8 or under subsection (4) sentence 3.

The pharmaceutical company shall effect the compensation under sentence 1 within ten days of a corresponding request by payment to the health insurance fund.

The pharmaceutical company shall transmit the reimbursement amount, including the rebates under section 130a, the respective start of validity and the respective period of validity of the reimbursement amount and the amount to be compensated under sentence 1, without undue delay after the determination and after any changes to this information, to each health insurance fund and to the central body under section 2 sentence 1 of the Act on Rebates for Medicinal Products (Gesetz über Rabatte für Arzneimittel).

(4b) Upon request, the National Association of Statutory Health Insurance Funds shall provide information on the reimbursement amount for a medicinal product for which a determination pursuant to subsection (1c) has been made, and on the amount to be compensated pursuant to section 78 subsection (3a) sentence 5 of the Medicinal Products Act (Arzneimittelgesetz), to

1. hospitals, the supervisory authorities responsible for them and the Institute for the Hospital Remuneration System (InEK),

2. any legal person that proves to the National Association of Statutory Health Insurance Funds that it has acquired the medicinal product,
2. jeder juristischen Person, die den Erwerb des Arzneimittels gegenüber dem Spitzenverband Bund der Krankenkassen nachweist,
4. any pharmaceutical company that proves to the National Association of Statutory Health Insurance Funds that it has submitted an application for marketing authorisation of a generic medicinal product with reference to the documentation of this medicinal product as reference medicinal product; the information shall be provided no earlier than twelve months before the expiry of regulatory data protection.
4. jedem pharmazeutischen Unternehmer, der gegenüber dem Spitzenverband Bund der Krankenkassen nachweist, dass er einen Antrag auf Zulassung eines Generikums unter Bezugnahme auf die Unterlagen dieses Arzneimittels als Referenzarzneimittel gestellt hat; die Auskunft wird frühestens zwölf Monate vor dem Wegfall des Unterlagenschutzes erteilt.
The National Association of Statutory Health Insurance Funds may commission third parties to fulfil its obligation under sentence 1.
Der Spitzenverband Bund der Krankenkassen kann Dritte mit der Erfüllung seiner Verpflichtung nach Satz 1 beauftragen.
It shall set a flat-rate fee for the expenses actually incurred by it per item of information provided under sentence 1.
Er legt eine pauschalierte Vergütung für den ihm tatsächlich entstehenden Aufwand je Auskunft nach Satz 1 fest.
The pharmaceutical company concerning whose medicinal product the information under sentence 1 is provided shall pay the fee under sentence 3 to the National Association of Statutory Health Insurance Funds.
Der pharmazeutische Unternehmer, zu dessen Arzneimittel die Auskunft nach Satz 1 erteilt wird, hat die Vergütung nach Satz 3 an den Spitzenverband Bund der Krankenkassen zu leisten.
(4c) In the case of a determination under subsection (1c), the National Association of Statutory Health Insurance Funds and the health insurance funds may process the reimbursement amount applicable to that medicinal product and transmit it to third parties in order to fulfil their statutory tasks.
(4c) Im Fall einer Bestimmung nach Absatz 1c können der Spitzenverband Bund der Krankenkassen und die Krankenkassen zur Erfüllung ihrer gesetzlichen Aufgaben den für dieses Arzneimittel geltenden Erstattungsbetrag verarbeiten und an Dritte übermitteln.
In particular, the National Association of Statutory Health Insurance Funds may transmit the reimbursement amount to the Federal Joint Committee and to the Institute for Quality and Efficiency in Health Care (IQWiG).
Insbesondere kann der Spitzenverband Bund der Krankenkassen den Erstattungsbetrag an den Gemeinsamen Bundesausschuss und an das Institut für Qualität und Wirtschaftlichkeit im Gesundheitswesen übermitteln.
Publications of the Federal Joint Committee and of the Institute for Quality and Efficiency in Health Care shall not contain the reimbursement amount for a medicinal product for which a determination under subsection (1c) has been made.
Veröffentlichungen des Gemeinsamen Bundesausschusses und des Instituts für Qualität und Wirtschaftlichkeit im Gesundheitswesen dürfen den Erstattungsbetrag für ein Arzneimittel, für das eine Bestimmung nach Absatz 1c erfolgt ist, nicht enthalten.
(5) The National Association of Statutory Health Insurance Funds and the relevant umbrella organisations of pharmaceutical companies at federal level formed to represent their economic interests shall form a joint arbitration board.

It shall consist of an impartial chair and two further impartial members as well as two representatives each of the contracting parties under subsection (1).
Sie besteht aus einem unparteiischen Vorsitzenden und zwei weiteren unparteiischen Mitgliedern sowie aus jeweils zwei Vertretern der Vertragsparteien nach Absatz 1.
The Federal Ministry of Health may take part in the deliberations and decision-making of the arbitration board.
Das Bundesministerium für Gesundheit kann an der Beratung und Beschlussfassung der Schiedsstelle teilnehmen.
The patient organisations under section 140f may take part in the meetings of the arbitration board in an advisory capacity.
Die Patientenorganisationen nach § 140f können beratend an den Sitzungen der Schiedsstelle teilnehmen.
The associations under sentence 1 shall agree on the chair and the two further impartial members and their deputies.
Über den Vorsitzenden und die zwei weiteren unparteiischen Mitglieder sowie deren Stellvertreter sollen sich die Verbände nach Satz 1 einigen.
If no agreement is reached, section 89 subsection (6) sentence 3 shall apply accordingly.
Kommt eine Einigung nicht zustande, gilt § 89 Absatz 6 Satz 3 entsprechend.
(6) The arbitration board shall adopt its own rules of procedure.

The rules of procedure shall require the approval of the Federal Ministry of Health.

In all other respects, section 129 subsection (9) and subsection (10) sentence 1 shall apply accordingly.
Im Übrigen gilt § 129 Absatz 9 und 10 Satz 1 entsprechend.
The statutory ordinance under section 129 subsection (10) sentence 2 may lay down details concerning the number and appointment of the members, the reimbursement of cash expenses and the compensation of the members for time spent, the procedure, the right of the Federal Ministry of Health to attend the meetings and the apportionment of the costs.

(7) An agreement under subsection (1) or an arbitration award under subsection (4) may be terminated by a contracting party no earlier than after one year.

The agreement or the arbitration award shall continue to apply until a new agreement takes effect.
Die Vereinbarung oder der Schiedsspruch gilt bis zum Wirksamwerden einer neuen Vereinbarung fort.
Upon publication of a new resolution on the benefit assessment under section 35a subsection (3) or on the cost-benefit assessment under section 35b subsection (3) for the medicinal product, and where the conditions for forming a reference price group under section 35 subsection (1) are met, termination before the expiry of one year shall be possible.
Bei Veröffentlichung eines neuen Beschlusses zur Nutzenbewertung nach § 35a Absatz 3 oder zur Kosten-Nutzen-Bewertung nach § 35b Absatz 3 für das Arzneimittel sowie bei Vorliegen der Voraussetzungen für die Bildung einer Festbetragsgruppe nach § 35 Absatz 1 ist eine Kündigung vor Ablauf eines Jahres möglich.
Unless otherwise agreed, the National Association of Statutory Health Insurance Funds may, by way of derogation from sentence 1, terminate the agreement extraordinarily for the purpose of setting a reference price under section 35 subsection (3).
Soweit nichts anderes vereinbart wird, kann der Spitzenverband Bund der Krankenkassen zur Festsetzung eines Festbetrags nach § 35 Absatz 3 die Vereinbarung abweichend von Satz 1 außerordentlich kündigen.
(7a) For medicinal products for which a reimbursement amount was agreed under subsection (1) or set under subsection (4) by the end of 29 July 2026, the agreement or the arbitration award may be terminated by any contracting party by the end of 1 October 2026, even if the medicinal product is not on the market within the territorial scope of this Act.
(7a) Für Arzneimittel, für die bis zum Ablauf des 29. Juli 2026 ein Erstattungsbetrag nach Absatz 1 vereinbart oder nach Absatz 4 festgesetzt wurde, kann die Vereinbarung oder der Schiedsspruch von jeder Vertragspartei bis zum Ablauf des 1. Oktober 2026 gekündigt werden, auch wenn sich das Arzneimittel im Geltungsbereich dieses Gesetzes nicht im Verkehr befindet.
In the event of termination, a reimbursement amount shall be agreed anew without undue delay.
Im Fall einer Kündigung ist unverzüglich erneut ein Erstattungsbetrag zu vereinbaren.
The terminated agreement shall continue to apply until a new agreement takes effect.
Die gekündigte Vereinbarung gilt bis zum Wirksamwerden einer neuen Vereinbarung fort.
(8) Following an arbitration award under subsection (4), any contracting party may apply to the Federal Joint Committee for a cost-benefit assessment under section 35b.
(8) Nach einem Schiedsspruch nach Absatz 4 kann jede Vertragspartei beim Gemeinsamen Bundesausschuss eine Kosten-Nutzen-Bewertung nach § 35b beantragen.
The validity of the arbitration award shall remain unaffected thereby.
Die Geltung des Schiedsspruchs bleibt hiervon unberührt.
The reimbursement amount shall be agreed anew on the basis of the resolution on the cost-benefit assessment under section 35b subsection (3).
Der Erstattungsbetrag ist auf Grund des Beschlusses über die Kosten-Nutzen-Bewertung nach § 35b Absatz 3 neu zu vereinbaren.
(8a) The reimbursement amount agreed under subsection (1) or set under subsection (4) shall continue to apply to all medicinal products with the same active substance notwithstanding the expiry of regulatory data protection for the medicinal product first authorised.
(8a) Der nach Absatz 1 vereinbarte oder nach Absatz 4 festgesetzte Erstattungsbetrag gilt ungeachtet des Wegfalls des Unterlagenschutzes des erstmalig zugelassenen Arzneimittels für alle Arzneimittel mit dem gleichen Wirkstoff fort.
In the case of a medicinal product for which another medicinal product with the same active substance has already been placed on the market and for which the reimbursement amount continues to apply under sentence 1, the pharmaceutical company shall determine the maximum permissible selling price on the basis of the reimbursement amount that continues to apply and of the price structure model underlying it; the pharmaceutical company may supply the medicinal product below this price.
Bei einem Arzneimittel, für das bereits ein anderes Arzneimittel mit dem gleichen Wirkstoff in Verkehr gebracht worden ist und für das der Erstattungsbetrag nach Satz 1 fortgilt, bestimmt der pharmazeutische Unternehmer den höchstens zulässigen Abgabepreis auf Grundlage des fortgeltenden Erstattungsbetrages und des diesem zugrunde liegenden Preisstrukturmodells; der pharmazeutische Unternehmer kann das Arzneimittel unterhalb dieses Preises abgeben.
By way of derogation from sentence 1, subsections (1) to (8) and (9) to (10) shall apply accordingly notwithstanding the expiry of regulatory data protection for the medicinal product first authorised, insofar as and for as long as patent protection still exists for the active substance within the territorial scope of this Act.
Abweichend von Satz 1 gelten die Absätze 1 bis 8 und 9 bis 10 ungeachtet des Wegfalls des Unterlagenschutzes des erstmalig zugelassenen Arzneimittels entsprechend, soweit und solange im Geltungsbereich dieses Gesetzes für den Wirkstoff noch Patentschutz besteht.
If a reference price is set for medicinal products under section 35 subsection (3), sentences 1 and 3 shall not apply to those medicinal products.

The National Association of Statutory Health Insurance Funds may request information from the higher federal authority competent under section 77 of the Medicinal Products Act on the date of expiry of regulatory data protection for the medicinal product first authorised.
Der Spitzenverband Bund der Krankenkassen kann von der nach § 77 des Arzneimittelgesetzes zuständigen Bundesoberbehörde Auskunft über das Datum des Wegfalls des Unterlagenschutzes des erstmalig zugelassenen Arzneimittels verlangen.
Upon request, the pharmaceutical company shall transmit to the National Association of Statutory Health Insurance Funds, within four weeks of receipt of the request, the term of patent protection under sentence 3, stating the date of the patent application and the relevant patent number.
Der pharmazeutische Unternehmer übermittelt dem Spitzenverband Bund der Krankenkassen auf Anfrage die Laufzeit des Patentschutzes nach Satz 3 unter Angaben des Tages der Patentanmeldung sowie der entsprechenden Patentnummer innerhalb von vier Wochen nach Zugang der Anfrage.
The associations under subsection (5) sentence 1 shall lay down the details of the determination of the selling price under sentence 2 in the framework agreement under subsection (9) by 31 January 2022.

For the purpose of the determination of the selling price under sentence 2 by the pharmaceutical company on the basis of the provisions under sentence 7, the National Association of Statutory Health Insurance Funds shall publish on its website, without undue delay after the expiry of regulatory data protection and of patent protection under sentence 3 for the medicinal product first authorised, the price structure model of the reimbursement amount continuing to apply under sentence 1.

(9) The associations under subsection (5) sentence 1 shall conclude a framework agreement on the standards for agreements under subsections (1) and (3b).

The agreement under sentence 1 shall also lay down the details of the content, form and procedure of the analysis of the data under section 217f subsection (7) required in each case and of the transmission of the results of the analysis to the pharmaceutical company, as well as of the apportionment of the costs incurred.

If a framework agreement is not concluded, the impartial members of the arbitration board shall set the framework agreement in consultation with the associations at the request of a contracting party under sentence 1.

If a framework agreement is not concluded within a deadline set by the Federal Ministry of Health, sentence 6 shall apply accordingly.

An action against decisions of the arbitration board shall not have suspensive effect.

(10) The Federal Joint Committee, the National Association of Statutory Health Insurance Funds and the Institute for Quality and Efficiency in Health Care shall conclude with the Association of Private Health Insurance an agreement on the costs to be reimbursed by private health insurance undertakings for the benefit assessment under section 35a and for the cost-benefit assessment under section 35b as well as for the setting of a reimbursement amount under subsection (4).
(10) Der Gemeinsame Bundesausschuss, der Spitzenverband Bund der Krankenkassen und das Institut für Qualität und Wirtschaftlichkeit im Gesundheitswesen schließen mit dem Verband der privaten Krankenversicherung eine Vereinbarung über die von den Unternehmen der privaten Krankenversicherung zu erstattenden Kosten für die Nutzen-Bewertung nach § 35a und für die Kosten-Nutzen-Bewertung nach § 35b sowie für die Festsetzung eines Erstattungsbetrags nach Absatz 4.
(11) The Federal Ministry of Health shall evaluate the effects of the amendment of section 130b by the Medical Research Act (Medizinforschungsgesetz) of 23 October 2024 (BGBl. 2024 I No. 324) on access to innovative and cost-effective medicinal products, taking into account the compliance costs and expenditure on medicinal products.
