(1) Health insurance funds, their regional associations or working groups shall conclude, by way of contract negotiations, contracts with service providers or with associations or other groupings of service providers on the details of the provision of medical aids, their reuse, the quality of the medical aids and of additional services to be provided, the requirements for the continuing training of service providers, the prices and invoicing; section 71 subsections (1) to (3) shall apply.

In addition, the contracting parties may also agree in the contracts under sentence 1 on compensation for the costs of increased hygiene measures resulting from the COVID-19 pandemic.

(1a) In the event of failure to reach agreement, the disputed content of the contracts under subsection (1) shall be determined, at the request of one of the negotiating parties, by an independent arbitrator to be appointed by the respective contracting partners, within three months of the appointment of the arbitrator.

(1b) For each provision of medical aids under section 33 that was commenced in the period from 1 January 2027 to 31 December 2028, service providers may invoice only a price that is reduced by three per cent compared with the price agreed by contract under subsection (1) or (3).

A provision of care shall be deemed to have commenced as soon as the service provider, once the conditions for entitlement to the benefit under benefits law have been met, has begun the care activity relating to the specific insured person.

Sentences 1 and 2 shall apply mutatis mutandis to contracts that were concluded before 1 April 2007 and continue to apply.

(3) Insofar as there are no contracts of the health insurance fund with service providers under subsection (1) for a necessary medical aid, or the provision of care to insured persons by contracting partners is not possible in a manner that is reasonable for them, the health insurance fund shall conclude an agreement with a service provider in the individual case; subsection (1) sentences 2, 4 and 5 shall apply mutatis mutandis.

The prices agreed under subsection (1) or set under subsection (1a) for the provision of these medical aids may, in justified cases, exceed or fall below the respective reference price applicable at the start of the contract negotiations as follows:

1. by up to 15 per cent where the reference price has not yet been adjusted under section 36 subsection (4) sentence 9,

2. by up to 15 per cent where the reference price is being reviewed under section 36 subsection (4) sentence 10 at the request of the relevant central organisations at federal level of the manufacturers and service providers concerned, and

Exceeding or falling below the reference price under sentence 2 shall be justified where particular features of the respective provision of care, of the care structure or of the contractually agreed services objectively justify a deviation from the reference price.
Eine Über- oder Unterschreitung nach Satz 2 ist begründet, wenn Besonderheiten der jeweiligen Versorgung, der Versorgungsstruktur oder der vertraglich vereinbarten Leistungen eine Abweichung vom Festbetrag sachlich rechtfertigen.
This shall be the case in particular where special care, quality or service performance is to be trialled or ensured and the quality of care can be improved by trialling or ensuring it.

(5) Before the insured persons make use of the benefit, service providers shall advise them as to which medical aids and additional services under section 33 subsection (1) sentences 1 and 5 are suitable and necessary for the specific care situation in the individual case.

Service providers shall document the advice under sentence 1 in writing or electronically and shall have it confirmed by the signature of the insured persons.
Die Leistungserbringer haben die Beratung nach Satz 1 schriftlich oder elektronisch zu dokumentieren und sich durch Unterschrift der Versicherten bestätigen zu lassen.
The details shall be regulated in the contracts under section 127.

In the case of section 33 subsection (1) sentence 9, insured persons shall also be informed, before choosing the medical aids or additional services, of the additional costs to be borne by them.

(6) The health insurance funds shall inform their insured persons of the contracting partners entitled to provide care and of the essential content of the contracts.

By way of derogation from sentence 1, the health insurance funds shall inform their insured persons upon request where the latter have already chosen a service provider or where the health insurance funds have waived approval of the requested provision of medical aids.

(7) The health insurance funds shall monitor compliance by service providers with their contractual and statutory obligations under this Act.

To ensure quality in the provision of medical aids, they shall carry out audits based on irregularities and random sample audits.
Zur Sicherung der Qualität in der Hilfsmittelversorgung führen sie Auffälligkeits- und Stichprobenprüfungen durch.
Service providers shall be obliged to provide the health insurance funds, upon request, with the facility-related information and particulars required for the audits under sentence 1 and to submit the confirmation signed by the insured persons that the advice under subsection (5) sentence 1 was provided.

Juni 2017 Rahmenempfehlungen zur Sicherung der Qualität in der Hilfsmittelversorgung ab, in denen insbesondere Regelungen zum Umfang der Stichprobenprüfungen in den jeweiligen Produktbereichen, zu möglichen weiteren Überwachungsinstrumenten und darüber getroffen werden, wann Auffälligkeiten anzunehmen sind.
(9) The National Association of Statutory Health Insurance Funds and the central organisations at federal level that are authoritative for representing the interests of service providers shall jointly issue, by 31 December 2017, framework recommendations on simplifying and standardising the performance and invoicing of the provision of medical aids.
(9) Der Spitzenverband Bund der Krankenkassen und die für die Wahrnehmung der Interessen der Leistungserbringer maßgeblichen Spitzenorganisationen auf Bundesebene geben bis zum 31. If no agreement is reached by the expiry of the deadline specified under sentence 1, the content of the recommendations shall be determined by an independent arbitrator to be named jointly by the recommendation partners under sentence 1.
