(1) Health insurance funds or their associations may define groups of medicinal products with patent-protected active substances which have a therapeutically comparable effect in a therapeutic area, and may agree rebate agreements under section 130a subsection (8) or section 130c with pharmaceutical companies for medicinal products of a group.
(1) Krankenkassen oder ihre Verbände können Gruppen von Arzneimitteln mit patentgeschützten Wirkstoffen festlegen, die in einem Therapiegebiet eine therapeutisch vergleichbare Wirkung haben, und mit pharmazeutischen Unternehmen Rabattverträge nach § 130a Absatz 8 oder § 130c für Arzneimittel einer Gruppe vereinbaren.
The agreements may be put out to tender on an exclusive basis and across active substances.

Contracted physicians shall prescribe, from a defined group of medicinal products, those medicinal products for which rebate agreements have been concluded, unless medical reasons argue against this in the individual case.
Vertragsärzte haben aus einer festgelegten Gruppe von Arzneimitteln die Arzneimittel zu verordnen, für die Rabattverträge vereinbart wurden, es sei denn, im Einzelfall sprechen medizinische Gründe dagegen.
(2) Prescriptions of medicinal products from a group defined under subsection (1) sentence 1 for which rebate agreements under subsection (1) sentence 1 have been concluded shall be recognised by the review body as special features of the practice to be taken into account in the cost-effectiveness reviews under sections 106 to 106c.
(2) Verordnungen von Arzneimitteln aus einer nach Absatz 1 Satz 1 festgelegten Gruppe, für die Rabattverträge nach Absatz 1 Satz 1 vereinbart wurden, sind von der Prüfungsstelle als bei den Wirtschaftlichkeitsprüfungen nach den §§ 106 bis 106c zu berücksichtigende Praxisbesonderheiten anzuerkennen.
The contracting parties referred to in section 106b subsection (1) sentence 1 may agree that prescriptions of non-rebated medicinal products from a group defined under subsection (1) sentence 1 which also contains medicinal products for which rebate agreements under subsection (1) sentence 1 have been concluded are to be exempted from measures under sections 106 to 106c if a prescription quota agreed under section 106b subsection (1) sentence 5 for those medicinal products of the group for which rebate agreements under subsection (1) sentence 1 have been concluded has been reached.

The details, including on the recognition as cost-effective of the prescription of non-rebated medicinal products made in the individual case for medical reasons, shall be agreed by the contracting parties referred to in section 106b subsection (1) sentence 1.
Das Nähere, auch zur Anerkennung der im Einzelfall aus medizinischen Gründen erfolgenden Verordnung nicht rabattierter Arzneimittel als wirtschaftlich, vereinbaren die in § 106b Absatz 1 Satz 1 genannten Vertragspartner.
(3) Until the end of 31 December 2030, the definition of groups and the conclusion of rebate agreements under subsection (1) sentence 1 shall be permissible only within the following groups of active substances:

4. Proproteinkonvertase Subtilisin/Kexin Typ 9 (PCSK9)-Inhibitoren und
5. programmed cell death-1 receptor/programmed cell death-ligand 1 (PD-1/PD-L1) inhibitors.

(4) The National Association of Statutory Health Insurance Funds shall submit to the Federal Ministry of Health, by 31 July 2030, a report on the effects of section 130e on the quality and cost-effectiveness of the supply of medicinal products and on its effects on expenditure on medicinal products.
