(1) The authorities competent for the official control of food, feed and consumer goods (Bedarfsgegenstände) within the meaning of section 2(6) sentence 1 item 1 shall take the measures that are necessary under Articles 137 and 138 of Regulation (EU) 2017/625 for monitoring compliance with the provisions of this Act, of the statutory ordinances issued on the basis of this Act and of the directly applicable legal acts of the European Community or the European Union within the scope of this Act.
(1) Die für die Überwachung von Lebensmitteln, Futtermitteln und Bedarfsgegenständen im Sinne von § 2 Absatz 6 Satz 1 Nummer 1 zuständigen Behörden treffen die Maßnahmen, die nach den Artikeln 137 und 138 der Verordnung (EU) 2017/625 erforderlich sind zur Überwachung der Einhaltung der Vorschriften dieses Gesetzes, der aufgrund dieses Gesetzes erlassenen Rechtsverordnungen und der unmittelbar geltenden Rechtsakte der Europäischen Gemeinschaft oder der Europäischen Union im Anwendungsbereich dieses Gesetzes.
(2) Without prejudice to Article 137(2) and (3) of Regulation (EU) 2017/625, the authorities competent for the official control of food, feed and consumer goods within the meaning of section 2(6) sentence 1 item 1 may, in order to establish or dispel a reasonable suspicion of an infringement,
(2) Unbeschadet des Artikels 137 Absatz 2 und 3 der Verordnung (EU) 2017/625 können die für die Überwachung von Lebensmitteln, Futtermitteln und Bedarfsgegenständen im Sinne von § 2 Absatz 6 Satz 1 Nummer 1 zuständigen Behörden zur Feststellung oder zur Ausräumung eines hinreichenden Verdachts eines Verstoßes
1. order that any person who has manufactured, treated or placed on the market a product referred to in subsection (1), or intends to do so,
1. anordnen, dass derjenige, der ein in Absatz 1 genanntes Erzeugnis hergestellt, behandelt oder in den Verkehr gebracht hat oder dies beabsichtigt,
a) carry out or have carried out an examination and communicate the result of the examination to the competent authority and
a) eine Prüfung durchführt oder durchführen lässt und das Ergebnis der Prüfung der zuständigen Behörde mitteilt und
b) notify the competent authority of the receipt of such a product,
b) der zuständigen Behörde den Eingang eines solchen Erzeugnisses anzeigt,
where there is reason to believe that this product does not comply with the provisions referred to in subsection (1), or
wenn Grund zu der Annahme besteht, dass dieses Erzeugnis den Vorschriften nach Absatz 1 nicht entspricht, oder
2. temporarily prohibit a product referred to in subsection (1) from being placed on the market until the result of a sample taken or of an examination ordered under item 1 is available.
2. vorübergehend verbieten, dass ein in Absatz 1 genanntes Erzeugnis in den Verkehr gebracht wird, bis das Ergebnis einer entnommenen Probe oder einer nach Nummer 1 angeordneten Prüfung vorliegt.
(3) Measures within the meaning of Article 138(2)(d) and (g) of Regulation (EU) 2017/625 may also be taken, mutatis mutandis, in relation to the feeding of a feed.
(3) Maßnahmen im Sinne von Artikel 138 Absatz 2 Buchstabe d und g der Verordnung (EU) 2017/625 können entsprechend auch in Bezug auf das Verfüttern eines Futtermittels ergehen.
(4) Measures within the meaning of Article 138(2) may also be taken, mutatis mutandis, to prevent a future infringement and to protect against risks to health or against deception.
(4) Maßnahmen im Sinne von Artikel 138 Absatz 2 können entsprechend auch zur Verhütung eines künftigen Verstoßes sowie zum Schutz vor Gefahren für die Gesundheit oder vor Täuschung ergehen.
(5) For the purpose of reducing or eliminating the causes of a substance undesirable from a health perspective that is contained in or on a food, the competent authorities shall, where it is established that action thresholds set by statutory ordinance under section 13(1) item 7 or section 13(5) sentence 1 item 2 have been exceeded, carry out investigations with the aim of determining the causes of the presence of the substance undesirable from a health perspective.
(5) Zum Zweck der Verringerung oder Beseitigung der Ursachen für einen gesundheitlich nicht erwünschten Stoff, der in oder auf einem Lebensmittel enthalten ist, führen die zuständigen Behörden, wenn eine Überschreitung von durch Rechtsverordnung nach § 13 Absatz 1 Nummer 7 oder § 13 Absatz 5 Satz 1 Nummer 2 festgesetzten Auslösewerten festgestellt wird, Untersuchungen mit dem Ziel durch, die Ursachen für das Vorhandensein des gesundheitlich nicht erwünschten Stoffs zu ermitteln.

The competent authorities shall inform the Federal Ministry, in the case of a statutory ordinance under section 13(5) sentence 1 item 2 also the Federal Ministry for the Environment, Nature Conservation and Nuclear Safety, or, in the case of a statutory ordinance under section 72 sentence 2, the Federal Office of Consumer Protection and Food Safety (BVL), without undue delay of the causes identified for the presence of the substance undesirable from a health perspective and of the measures ordered to reduce or eliminate those causes, for the purpose of informing the Commission and the other Member States.

(7a) Where, in an individual case, a necessary order or other necessary measure cannot be taken on the basis of subsections (1) to (4), more extensive rules of the Länder, including rules in the field of police law, on the basis of which such an order or measure can be taken shall remain applicable.
