(1) The Federal Ministry is empowered, in order to achieve the purposes referred to in section 1, in particular to promote uniform conduct of official control, by statutory ordinance with the consent of the Bundesrat

a) the minimum staffing, instrumental and other technical equipment of facilities carrying out official examinations,

b) the requirements and the procedure for the approval of private experts authorised to examine official samples or samples officially left behind,
b) die Voraussetzungen und das Verfahren für die Zulassung privater Sachverständiger, die zur Untersuchung von amtlichen oder amtlich zurückgelassenen Proben befugt sind,
whereby the statutory ordinance under letter (b) may provide that private experts may use, for the examination of official samples or samples officially left behind, only such third parties as are approved or registered,
zu erlassen; in der Rechtsverordnung nach Buchstabe b kann vorgesehen werden, dass private Sachverständige sich nur solcher Dritter zur Untersuchung von amtlichen oder amtlich zurückgelassenen Proben bedienen dürfen, die zugelassen oder registriert sind,
a) on the manner of examination or on procedures for the examination of products, including live animals within the meaning of section 4(1) item 1, also in the cases of item 1 letter (b), including sampling procedures and methods of analysis,
a) über die Art und Weise der Untersuchung oder Verfahren zur Untersuchung von Erzeugnissen, einschließlich lebender Tiere im Sinne des § 4 Absatz 1 Nummer 1, auch in den Fällen der Nummer 1 Buchstabe b, einschließlich der Probenahmeverfahren und der Analysemethoden, zu erlassen,
b) on the manner of sampling, including in the case of distance selling of products, and to regulate the details of the procedure for this,
b) über die Art und Weise der Probenahme, auch im Falle des Fernabsatzes von Erzeugnissen, zu treffen und die Einzelheiten des Verfahrens hierfür zu regeln,
3. to make the marketability of a homogeneous lot of certain products dependent on the result of the random-sample examination of that lot,
3. die Verkehrsfähigkeit einer gleichartigen Partie von bestimmten Erzeugnissen vom Ergebnis der Stichprobenuntersuchung dieser Partie abhängig zu machen,
4. to prescribe devices for the official taking of samples in manufacturing establishments and on containers,
4. Vorrichtungen für die amtliche Entnahme von Proben in Herstellungsbetrieben und an Behältnissen vorzuschreiben,
5. to prescribe that, at what time, in what manner and by whom the manufacturer of a product, or another person responsible for a product under this Act, under the statutory ordinances issued on the basis of this Act or under the directly applicable legal acts of the European Community or the European Union within the scope of this Act, is to be informed of a sample left behind that was taken for the purpose of examination, or of a sampling.
5. vorzuschreiben, dass, zu welchem Zeitpunkt, in welcher Art und Weise und von wem der Hersteller eines Erzeugnisses oder ein anderer für ein Erzeugnis nach diesem Gesetz, den aufgrund dieses Gesetzes erlassenen Rechtsverordnungen oder den unmittelbar geltenden Rechtsakten der Europäischen Gemeinschaft oder der Europäischen Union im Anwendungsbereich dieses Gesetzes Verantwortlicher über eine zurückgelassene Probe, die zum Zweck der Untersuchung entnommen wurde, oder eine Probenahme zu unterrichten ist.
Insofar as statutory ordinances under section 13(5) sentence 1 are affected in the cases of sentence 1 items 1 to 4, the Federal Ministry for the Environment, Nature Conservation and Nuclear Safety, acting in agreement with the Federal Ministry, shall take the place of the Federal Ministry.

b) that products or substances intended for their manufacture or treatment may be placed on the market, brought into Germany or brought out of Germany only when accompanied by an accompanying document,
b) dass Erzeugnisse oder zu ihrer Herstellung oder Behandlung bestimmte Stoffe nur mit einem Begleitpapier in den Verkehr gebracht, in das Inland oder aus dem Inland verbracht werden dürfen,

1. undertakings and establishments that manufacture, treat or place on the market certain products shall be notified,
