(1) The authorities competent for the supervision of tattoo agents, cosmetic products and consumer goods (Bedarfsgegenstände) within the meaning of section 2(6) sentence 1 items 2 to 9 shall issue the necessary orders and take the necessary measures that are required
(1) Die für die Überwachung von Mitteln zum Tätowieren, kosmetischen Mitteln und Bedarfsgegenständen im Sinne von § 2 Absatz 6 Satz 1 Nummer 2 bis 9 zuständigen Behörden treffen die notwendigen Anordnungen und Maßnahmen, die erforderlich sind
1. to establish or dispel a reasonable suspicion of an infringement of provisions of this Act, of the statutory ordinances issued on the basis of this Act and of the directly applicable legal acts of the European Community or the European Union within the scope of this Act,
1. zur Feststellung oder zur Ausräumung eines hinreichenden Verdachts eines Verstoßes gegen Vorschriften dieses Gesetzes, der aufgrund dieses Gesetzes erlassenen Rechtsverordnungen und der unmittelbar geltenden Rechtsakte der Europäischen Gemeinschaft oder der Europäischen Union im Anwendungsbereich dieses Gesetzes,
2. to eliminate infringements that have been established,
2. zur Beseitigung festgestellter Verstöße,
4. to protect against risks to health or against deception.
4. zum Schutz vor Gefahren für die Gesundheit oder vor Täuschung.
1. order that any person who has manufactured, treated or placed on the market a product referred to in sentence 1, or intends to do so,
1. anordnen, dass derjenige, der ein in Satz 1 genanntes Erzeugnis hergestellt, behandelt oder in den Verkehr gebracht hat oder dies beabsichtigt,
a) carry out or have carried out an examination and communicate the result of the examination to the competent authority,
a) eine Prüfung durchführt oder durchführen lässt und das Ergebnis der Prüfung der zuständigen Behörde mitteilt,
b) notify the competent authority of the receipt of such a product,
b) der zuständigen Behörde den Eingang eines solchen Erzeugnisses anzeigt,
where there is reason to believe that such a product does not comply with the provisions of this Act, of the statutory ordinances issued on the basis of this Act or of the directly applicable legal acts of the European Community or the European Union within the scope of this Act,
wenn Grund zu der Annahme besteht, dass ein solches Erzeugnis den Vorschriften dieses Gesetzes, der aufgrund dieses Gesetzes erlassenen Rechtsverordnungen oder der unmittelbar geltenden Rechtsakte der Europäischen Gemeinschaft oder der Europäischen Union im Anwendungsbereich dieses Gesetzes nicht entspricht,
2. temporarily prohibit a product referred to in sentence 1 from being placed on the market until the result of a sample taken or of an examination ordered under item 1 is available,
2. vorübergehend verbieten, dass ein in Satz 1 genanntes Erzeugnis in den Verkehr gebracht wird, bis das Ergebnis einer entnommenen Probe oder einer nach Nummer 1 angeordneten Prüfung vorliegt,
3. prohibit or restrict the manufacture, treatment or placing on the market of products referred to in sentence 1,
3. das Herstellen, Behandeln oder Inverkehrbringen von in Satz 1 genannten Erzeugnissen verbieten oder beschränken,
4. monitor or, where necessary, order a measure
4. eine Maßnahme überwachen oder, falls erforderlich, anordnen,
a) intended to prevent a product referred to in sentence 1 that has not yet reached the final consumer from being placed on the market further, including by other business operators (withdrawal), or
a) mit der verhindert werden soll, dass ein in Satz 1 genanntes Erzeugnis, das den Endverbraucher noch nicht erreicht hat, auch durch andere Wirtschaftsbeteiligte weiter in den Verkehr gebracht wird (Rücknahme), oder
b) aimed at the return of a product placed on the market that has already reached, or may have reached, the final consumer or the user (recall),
b) die auf die Rückgabe eines in den Verkehr gebrachten Erzeugnisses abzielt, das den Endverbraucher oder den Verwender bereits erreicht hat oder erreicht haben könnte (Rückruf),
5. seize products referred to in sentence 1, including on a provisional basis, and, where necessary to achieve the purposes referred to in section 1(1) item 1 or item 4(a)(aa) or section 1(2), in each case always also in conjunction with section 1(3), arrange for the harmless disposal of these products,
5. in Satz 1 genannte Erzeugnisse, auch vorläufig, sicherstellen und, soweit dies zum Erreichen der in § 1 Absatz 1 Nummer 1 oder 4 Buchstabe a Doppelbuchstabe aa oder Absatz 2, stets jeweils auch in Verbindung mit § 1 Absatz 3, genannten Zwecke erforderlich ist, die unschädliche Beseitigung dieser Erzeugnisse veranlassen,
6. in individual cases temporarily prohibit or restrict the bringing of products referred to in sentence 1 into Germany if
6. das Verbringen von in Satz 1 genannten Erzeugnissen in das Inland im Einzelfall vorübergehend verbieten oder beschränken, wenn
a) the Federal Republic of Germany has been authorised to do so by the Commission and the Federal Ministry has published this in the Federal Gazette (Bundesanzeiger), or
a) die Bundesrepublik Deutschland von der Kommission hierzu ermächtigt worden ist und das Bundesministerium dies im Bundesanzeiger bekannt gemacht hat oder
b) there are facts suggesting that these products pose a risk to human or animal health,
b) Tatsachen vorliegen, die darauf schließen lassen, dass diese Erzeugnisse ein Risiko für die Gesundheit von Mensch oder Tier mit sich bringen,
7. order that those who may be exposed to a risk posed by a product referred to in sentence 1 that has been placed on the market be warned of this risk in good time and in a suitable form, and
7. anordnen, dass diejenigen, die einer Gefahr, die von einem in Verkehr gebrachten Erzeugnis nach Satz 1 ausgeht, ausgesetzt sein können, rechtzeitig in geeigneter Form auf diese Gefahr hingewiesen werden und
8. inform the public in accordance with section 40.
8. die Öffentlichkeit nach Maßgabe von § 40 informieren.

L 307 vom 28.11.2019, S. 15) geändert worden ist, bleiben unberührt.
(3) Objections and actions for annulment against orders serving to enforce prohibitions under section 26 sentence 1 or section 30 or obligations under Article 5(1) in conjunction with Article 3 sentence 1 point (a), (b) or (c) of Regulation (EC) No 1223/2009 shall not have suspensive effect.
(3) Widerspruch und Anfechtungsklage gegen Anordnungen, die der Durchführung von Verboten nach § 26 Satz 1 oder § 30 oder Geboten nach Artikel 5 Absatz 1 in Verbindung mit Artikel 3 Satz 1 Buchstabe a, b oder c der Verordnung (EU) Nr. 1223/2009 dienen, haben keine aufschiebende Wirkung.
(4) Where, in an individual case, a necessary order or other necessary measure cannot be taken on the basis of subsections (1) and (2), more extensive rules of the Länder, including rules in the field of police law, on the basis of which such an order can be taken shall remain applicable.
(4) Soweit im Einzelfall eine notwendige Anordnung oder eine sonstige notwendige Maßnahme nicht aufgrund der Absätze 1 und 2 getroffen werden kann, bleiben weitergehende Regelungen der Länder, einschließlich der Regelungen auf dem Gebiet des Polizeirechts, aufgrund derer eine solche Anordnung getroffen werden kann, anwendbar.
