(1) The holders of the land, premises, facilities and equipment referred to in section 42(2) and the representatives appointed by them shall be obliged to tolerate the measures under sections 42 to 43a and under Delegated Regulation (EU) 2019/2090 and to support the persons engaged in official control in the performance of their task, in particular, upon request,

2. is necessary for the traceability of certain food or feed

The competent authority may, in individual cases, permit exceptions from the requirements of sentence 2 insofar as this appears necessary to avoid undue hardship for the food or feed business operator and is compatible with the purposes referred to in section 1(1) item 1.

(4a) Where the person responsible for a laboratory that carries out analyses of food has reason to believe, on the basis of an analysis prepared by the laboratory of a sample taken from a food in Germany, that the food would be subject to a prohibition on placing on the market under Article 14(1) of Regulation (EC) No 178/2002, that person shall without undue delay inform the competent authority in writing or electronically of the time and the result of the analysis, the analytical method applied and the person who commissioned the analysis.
