(1) Competence for supervisory measures under this Act, the statutory ordinances issued on the basis of this Act and the directly applicable legal acts of the European Community or the European Union within the scope of this Act shall be governed by the law of the Länder, unless otherwise provided in this Act.
(1) Die Zuständigkeit für die Überwachungsmaßnahmen nach diesem Gesetz, den aufgrund dieses Gesetzes erlassenen Rechtsverordnungen und den unmittelbar geltenden Rechtsakten der Europäischen Gemeinschaft oder der Europäischen Union im Anwendungsbereich dieses Gesetzes richtet sich nach Landesrecht, soweit in diesem Gesetz nichts anderes bestimmt ist.
(2) Within the remit of the Federal Ministry of Defence, the implementation of this Act, the statutory ordinances issued on the basis of this Act and the directly applicable legal acts of the European Community or the European Union within the scope of this Act shall be the responsibility of the competent offices and experts of the Bundeswehr (Federal Armed Forces).
(2) Im Geschäftsbereich des Bundesministeriums der Verteidigung obliegt die Durchführung dieses Gesetzes, der aufgrund dieses Gesetzes erlassenen Rechtsverordnungen und der unmittelbar geltenden Rechtsakte der Europäischen Gemeinschaft oder der Europäischen Union im Anwendungsbereich dieses Gesetzes den zuständigen Stellen und Sachverständigen der Bundeswehr.
The Federal Ministry of Defence may, for its remit and in agreement with the Federal Ministry, permit exemptions from this Act and from statutory ordinances issued on the basis of this Act where this is justified for the performance of the special tasks of the Bundeswehr and preventive health protection is safeguarded.
Das Bundesministerium der Verteidigung kann für seinen Geschäftsbereich im Einvernehmen mit dem Bundesministerium Ausnahmen von diesem Gesetz und aufgrund dieses Gesetzes erlassenen Rechtsverordnungen zulassen, wenn dies zur Durchführung der besonderen Aufgaben der Bundeswehr gerechtfertigt ist und der vorbeugende Gesundheitsschutz gewahrt bleibt.
(2a) Supervision of compliance with the provisions of this Act, of the statutory ordinances issued on the basis of this Act and of the directly applicable legal acts of the European Community or the European Union within the scope of this Act concerning products and live animals within the meaning of section 4(1) item 1 shall be the task of the competent authorities.
(2a) Die Überwachung der Einhaltung der Vorschriften dieses Gesetzes, der aufgrund dieses Gesetzes erlassenen Rechtsverordnungen und der unmittelbar geltenden Rechtsakte der Europäischen Gemeinschaft oder der Europäischen Union im Anwendungsbereich dieses Gesetzes über Erzeugnisse und lebende Tiere im Sinne des § 4 Absatz 1 Nummer 1 ist Aufgabe der zuständigen Behörden.
To that end, they shall satisfy themselves, by means of regular inspections and sampling, that the provisions are being complied with.
Dazu haben sie sich durch regelmäßige Überprüfungen und Probenahmen davon zu überzeugen, dass die Vorschriften eingehalten werden.
(3) The authorities and offices of the Federation and the Länder competent for implementing this Act shall

1. notify one another of the offices competent for enforcing the Act and
1. die für den Vollzug des Gesetzes zuständigen Stellen mitzuteilen und
2. support one another in investigative activities.
2. bei der Ermittlungstätigkeit zu unterstützen.
(4) The authorities competent for the official control of food, feed and consumer goods (Bedarfsgegenstände) within the meaning of section 2(6) sentence 1 item 1 shall cooperate with the competent authorities of other Member States in accordance with Articles 104 to 107 of Regulation (EU) 2017/625 of the European Parliament and of the Council of 15 March 2017 on official controls and other official activities performed to ensure the application of food and feed law, rules on animal health and welfare, plant health and plant protection products, amending Regulations (EC) No 999/2001, (EC) No 396/2005, (EC) No 1069/2009, (EC) No 1107/2009, (EU) No 1151/2012, (EU) No 652/2014, (EU) 2016/429 and (EU) 2016/2031 of the European Parliament and of the Council, Council Regulations (EC) No 1/2005 and (EC) No 1099/2009 and Council Directives 98/58/EC, 1999/74/EC, 2007/43/EC, 2008/119/EC and 2008/120/EC, and repealing Regulations (EC) No 854/2004 and (EC) No 882/2004 of the European Parliament and of the Council, Council Directives 89/608/EEC, 89/662/EEC, 90/425/EEC, 91/496/EEC, 96/23/EC, 96/93/EC and 97/78/EC and Council Decision 92/438/EEC (Official Controls Regulation) (OJ L 95, 7.4.2017, p. 1; L 137, 24.5.2017, p. 40; L 48, 21.2.2018, p. 44; L 322, 18.12.2018, p. 85), as last amended by Delegated Regulation (EU) 2019/2127 (OJ L 321, 12.12.2019, p. 111).
(4) Die für die Überwachung von Lebensmitteln, Futtermitteln und Bedarfsgegenständen im Sinne von § 2 Absatz 6 Satz 1 Nummer 1 zuständigen Behörden arbeiten nach Maßgabe der Artikel 104 bis 107 der Verordnung (EU) 2017/625 des Europäischen Parlaments und des Rates vom 15. März 2017 über amtliche Kontrollen und andere amtliche Tätigkeiten zur Gewährleistung der Anwendung des Lebens- und Futtermittelrechts und der Vorschriften über Tiergesundheit und Tierschutz, Pflanzengesundheit und Pflanzenschutzmittel, zur Änderung der Verordnungen (EG) Nr. 999/2001, (EG) Nr. 396/2005, (EG) Nr. 1069/2009, (EG) Nr. 1107/2009, (EU) Nr. 1151/2012, (EU) Nr. 652/2014, (EU) 2016/429 und (EU) 2016/2031 des Europäischen Parlaments und des Rates, der Verordnungen (EG) Nr. 1/2005 und (EG) Nr. 1099/2009 des Rates sowie der Richtlinien 98/58/EG, 1999/74/EG, 2007/43/EG, 2008/119/EG und 2008/120/EG des Rates und zur Aufhebung der Verordnungen (EG) Nr. 854/2004 und (EG) Nr. 882/2004 des Europäischen Parlaments und des Rates, der Richtlinien 89/608/EWG, 89/662/EWG, 90/425/EWG, 91/496/EEG, 96/23/EG, 96/93/EG und 97/78/EG des Rates und des Beschlusses 92/438/EWG des Rates (Verordnung über amtliche Kontrollen) (ABl. (5) Where the authority competent under subsection (2a) sentence 1 for compliance with the provisions on trade in feed has reason to believe that feed capable of impairing the safety for human health of products obtained from farmed animals has been fed, it shall inform the authority competent for implementing Delegated Regulation (EU) 2019/2090 of the facts known to it.
(5) Hat die nach Absatz 2a Satz 1 für die Einhaltung der Vorschriften über den Verkehr mit Futtermitteln zuständige Behörde Grund zu der Annahme, dass Futtermittel, die geeignet sind, die von Nutztieren gewonnenen Erzeugnisse im Hinblick auf ihre Unbedenklichkeit für die menschliche Gesundheit zu beeinträchtigen, verfüttert worden sind, so unterrichtet sie die für die Durchführung der Delegierten Verordnung (EU) 2019/2090 zuständige Behörde über die ihr bekannten Tatsachen.
(6) The authorities competent for the supervision of tattoo agents, cosmetic products and consumer goods within the meaning of section 2(6) sentence 1 items 2 to 9
(6) Die für die Überwachung von Mitteln zum Tätowieren, kosmetischen Mitteln und Bedarfsgegenständen im Sinne von § 2 Absatz 6 Satz 1 Nummer 2 bis 9 zuständigen Behörden
1. shall, upon a reasoned request, provide information to the competent authority of another Member State and transmit the necessary certificates and documents so that the competent authority of the other Member State can monitor whether the provisions applicable to these products are being complied with,
1. erteilen der zuständigen Behörde eines anderen Mitgliedstaates auf begründetes Ersuchen Auskünfte und übermitteln die erforderlichen Urkunden und Schriftstücke, damit die zuständige Behörde des anderen Mitgliedstaates überwachen kann, ob die Vorschriften, die für diese Erzeugnisse gelten, eingehalten werden,
2. shall examine all matters communicated by the requesting authority of another Member State, inform it of the outcome of the examination and notify the Federal Ministry thereof,
2. überprüfen alle von der ersuchenden Behörde eines anderen Mitgliedstaates mitgeteilten Sachverhalte, teilen ihr das Ergebnis der Prüfung mit und unterrichten das Bundesministerium darüber,
3. shall communicate to the competent authorities of another Member State all facts and matters necessary for monitoring compliance in that Member State with the provisions applicable to these products, in particular in the event of infringements and suspected infringements of provisions applicable to these products.
3. teilen den zuständigen Behörden eines anderen Mitgliedstaates alle Tatsachen und Sachverhalte mit, die für die Überwachung der Einhaltung der für diese Erzeugnisse geltenden Vorschriften in diesem Mitgliedstaat erforderlich sind, insbesondere bei Zuwiderhandlungen und bei Verdacht auf Zuwiderhandlungen gegen für diese Erzeugnisse geltende Vorschriften.
(7) Where this is necessary to ensure compliance with the requirements of this Act or of the statutory ordinances issued on the basis of this Act, or is prescribed by legal acts of the European Community or the European Union, the competent authorities may communicate data obtained in the course of supervision to other competent authorities of the same Land, to the competent authorities of other Länder, of the Federation or of other Member States, or to the European Commission.
(7) Die zuständigen Behörden können, soweit dies zur Einhaltung der Anforderungen dieses Gesetzes oder der aufgrund dieses Gesetzes erlassenen Rechtsverordnungen erforderlich oder durch Rechtsakte der Europäischen Gemeinschaft oder der Europäischen Union vorgeschrieben ist, Daten, die sie im Rahmen der Überwachung gewonnen haben, anderen zuständigen Behörden desselben Landes, den zuständigen Behörden anderer Länder, des Bundes oder anderer Mitgliedstaaten oder der Europäischen Kommission mitteilen.
(7a) The competent authorities may inform the authorities of the same Land, of other Länder or of the Federation that are competent for the supervision of trade in veterinary medicinal products of matters which have come to their knowledge in the course of supervising the rules on medicated feed and intermediate products and knowledge of which is necessary for monitoring compliance with the requirements of the Veterinary Medicinal Products Act (Tierarzneimittelgesetz).
(7a) Die zuständigen Behörden können die für die Überwachung des Verkehrs mit Tierarzneimitteln zuständigen Behörden desselben Landes, anderer Länder oder des Bundes über Sachverhalte unterrichten, die ihnen bei der Überwachung der Regelungen über Arzneifuttermittel und Zwischenerzeugnisse bekannt geworden sind und deren Kenntnis für die Überwachung der Einhaltung der Anforderungen des Tierarzneimittelgesetzes erforderlich sind.
(8) Information, communications and the transmission of certificates and documents concerning food and feed law controls under subsections (4), (6) and (7) shall, where they concern Contracting States to the Agreement on the European Economic Area other than Member States, be addressed to the European Commission.
(8) Auskünfte, Mitteilungen und Übermittlung von Urkunden und Schriftstücken über lebensmittel- und futtermittelrechtliche Kontrollen nach den Absätzen 4, 6 und 7 erfolgen, sofern sie andere Vertragsstaaten des Abkommens über den Europäischen Wirtschaftsraum als Mitgliedstaaten betreffen, an die Europäische Kommission.
