(1) Insofar as experts are to be heard under section 45(1) and section 46(1) before statutory ordinances are issued, the Federal Ministry shall establish an expert committee for this purpose by statutory ordinance without the consent of the Bundesrat.
(1) Soweit nach § 45 Abs. 1 und § 46 Abs. 1 vor Erlass von Rechtsverordnungen Sachverständige anzuhören sind, errichtet hierzu das Bundesministerium durch Rechtsverordnung ohne Zustimmung des Bundesrates einen Sachverständigen-Ausschuss.
The committee shall include experts from medical and pharmaceutical science, hospitals, the health professions, the business circles concerned and the social insurance institutions.
Dem Ausschuss sollen Sachverständige aus der medizinischen und pharmazeutischen Wissenschaft, den Krankenhäusern, den Heilberufen, den beteiligten Wirtschaftskreisen und den Sozialversicherungsträgern angehören.
The details of the composition, the appointment of the members and the procedure of the committee may be specified in the statutory ordinance.
In der Rechtsverordnung kann das Nähere über die Zusammensetzung, die Berufung der Mitglieder und das Verfahren des Ausschusses bestimmt werden.
(2) Insofar as experts are to be heard under section 48(2) before the statutory ordinance is issued, subsection (1) shall apply mutatis mutandis, subject to the proviso that the committee shall include experts from medical and pharmaceutical science as well as experts from the drug commissions of the physicians and pharmacists.
(2) Soweit nach § 48 Abs. 2 vor Erlass der Rechtsverordnung Sachverständige anzuhören sind, gilt Absatz 1 entsprechend mit der Maßgabe, dass dem Ausschuss Sachverständige aus der medizinischen und pharmazeutischen Wissenschaft sowie Sachverständige der Arzneimittelkommissionen der Ärzte und Apotheker angehören sollen.
