4. and of the statutory ordinances issued on the basis of this Act shall not apply to products within the meaning of the Wine Act (Weingesetz) – with the exception of the products referred to in section 1(2) of the Wine Act –; they shall, however, apply insofar as the Wine Act or statutory ordinances issued on the basis of the Wine Act refer to provisions of this Act or of the statutory ordinances issued on the basis of this Act.

(3) The Federal Ministry of Food and Agriculture (Federal Ministry) is hereby empowered, in agreement with the Federal Ministry for Economic Affairs and Energy, by statutory ordinance with the consent of the Bundesrat, insofar as this is necessary to achieve the purposes referred to in section 1(1) item 1, also in conjunction with section 1(3), to treat other articles and products for personal or household use as equivalent to consumer goods if, when used as intended or in a foreseeable manner, such articles and products for personal or household use may, owing to their material composition, in particular through toxicologically active substances or through impurities, have effects on the human body that are hazardous to health.
(3) Das Bundesministerium für Ernährung und Landwirtschaft (Bundesministerium) wird ermächtigt, im Einvernehmen mit dem Bundesministerium für Wirtschaft und Energie durch Rechtsverordnung mit Zustimmung des Bundesrates, soweit es zur Erfüllung der in § 1 Absatz 1 Nummer 1, auch in Verbindung mit § 1 Absatz 3, genannten Zwecke erforderlich ist, den Bedarfsgegenständen andere Gegenstände und Mittel des persönlichen oder häuslichen Bedarfs gleichzustellen, wenn von diesen Gegenständen und Mitteln des persönlichen oder häuslichen Bedarfs bei bestimmungsgemäßem oder vorauszusehendem Gebrauch aufgrund ihrer stofflichen Zusammensetzung, insbesondere durch toxikologisch wirksame Stoffe oder durch Verunreinigungen, gesundheitsgefährdende Einwirkungen auf den menschlichen Körper ausgehen können.
