(1) The Federal Government is empowered, after consulting the associations and organisations concerned, to lay down, by statutory ordinance with the consent of the Bundesrat, standard contractual clauses on the rights and obligations of the sponsor and of the clinical trial site in the conduct of a clinical trial.

(1) Die Bundesregierung wird ermächtigt, nach Anhörung der betroffenen Verbände und Organisationen durch Rechtsverordnung mit Zustimmung des Bundesrates Standardvertragsklauseln über die Rechte und Pflichten des Sponsors und des Prüfzentrums bei der Durchführung einer klinischen Prüfung festzulegen.

The statutory ordinance under sentence 1 may provide for possibilities of derogation.

The standard contractual clauses may lay down details

1. on the creation of the commissioning party's right to results obtained merely in connection with the clinical trial, and on the granting or transfer of that right,

9. on documentation and archiving,

9. zur Dokumentation und Archivierung,

10. zum Datenschutz,

11. on the expiry and termination of the contract.

(2) When concluding contracts on the conduct of clinical trials, the sponsor and the clinical trial site shall use the standard contractual clauses for the conduct of clinical trials under subsection (1) sentence 1, unless the sponsor and the clinical trial site have agreed to derogate from the standard contractual clauses.

(2) Bei dem Abschluss von Verträgen über die Durchführung klinischer Prüfungen haben der Sponsor und das Prüfzentrum die Standardvertragsklauseln für die Durchführung klinischer Prüfungen nach Absatz 1 Satz 1 zu verwenden, es sei denn, der Sponsor und das Prüfzentrum haben vereinbart, von den Standardvertragsklauseln abzuweichen.
