(1) Exemptions from the provisions of this Act and of the statutory ordinances issued on the basis of this Act may be granted in individual cases upon application in accordance with subsections (2) and (3).
(1) Von den Vorschriften dieses Gesetzes und der aufgrund dieses Gesetzes erlassenen Rechtsverordnungen können im Einzelfall auf Antrag Ausnahmen nach Maßgabe der Absätze 2 und 3 zugelassen werden.
1. the prohibitions of section 5 and section 17(1) sentence 1 item 1 and of sections 20, 26 and 30, and
1. die Verbote der §§ 5 und 17 Absatz 1 Satz 1 Nummer 1 und der §§ 20, 26 und 30 und
2. statutory ordinances issued under section 13(1) items 1 to 4 and subsection (5) sentence 1, section 14(2) item 1 and section 34.
2. nach § 13 Absatz 1 Nummer 1 bis 4 und Absatz 5 Satz 1, § 14 Absatz 2 Nummer 1 und § 34 erlassene Rechtsverordnungen.
1. for the manufacture, treatment and placing on the market of certain foods, tattoo agents, cosmetic products or consumer goods (Bedarfsgegenstände), where results are to be expected that may be of significance for an amendment or supplementation of the provisions applicable to food, tattoo agents, cosmetic products or consumer goods, under official observation, or where the legislation has not yet been aligned with legal acts of the European Community or the European Union; in this connection, the legitimate interests of the individual and all factors that may affect the general competitive situation of the industry concerned shall be taken into due account,
1. für das Herstellen, Behandeln und Inverkehrbringen bestimmter Lebensmittel, Mittel zum Tätowieren, kosmetischer Mittel oder Bedarfsgegenstände, sofern Ergebnisse zu erwarten sind, die für eine Änderung oder Ergänzung der für Lebensmittel, Mittel zum Tätowieren, kosmetische Mittel oder Bedarfsgegenstände geltenden Vorschriften von Bedeutung sein können, unter amtlicher Beobachtung oder sofern eine Angleichung der Rechtsvorschriften an Rechtsakte der Europäischen Gemeinschaft oder der Europäischen Union noch nicht erfolgt ist; dabei sollen die schutzwürdigen Interessen des Einzelnen sowie alle Faktoren, die die allgemeine Wettbewerbslage des betreffenden Industriezweiges beeinflussen können, angemessen berücksichtigt werden,
2. for the manufacture, treatment and placing on the market of certain foods as special rations for members of
2. für das Herstellen, Behandeln und Inverkehrbringen bestimmter Lebensmittel als Sonderverpflegung für Angehörige
a) the Bundeswehr (Federal Armed Forces) and allied armed forces,
a) der Bundeswehr und verbündeter Streitkräfte,
c) civil protection, the warning and alarm service and the other relief and emergency services
c) des Katastrophenschutzes, des Warn- und Alarmdienstes und der sonstigen Hilfs- und Notdienste
including the trials required for this purpose and the supply of such foods to others where this is necessary for proper stockkeeping,
einschließlich der hierfür erforderlichen Versuche sowie der Abgabe solcher Lebensmittel an andere, wenn dies zur ordnungsgemäßen Vorratshaltung erforderlich ist,
3. for the manufacture, distribution and issue of certain foods as emergency rations for the population,
3. für das Herstellen, den Vertrieb und die Ausgabe bestimmter Lebensmittel als Notrationen für die Bevölkerung,
4. in other cases in which special circumstances, in particular the threatened spoilage of food or of feed materials or compound feed, make this appear necessary in order to avoid undue hardship; the Federal Ministry shall be informed of the measures taken.
4. in sonstigen Fällen, in denen besondere Umstände, insbesondere der drohende Verderb von Lebensmitteln oder Einzelfuttermitteln oder Mischfuttermitteln, dies zur Vermeidung unbilliger Härten geboten erscheinen lassen; das Bundesministerium ist von den getroffenen Maßnahmen zu unterrichten.
(3) Exemptions may be granted only where facts justify the assumption that no danger to human or animal health is to be expected; exemptions shall not be granted
(3) Ausnahmen dürfen nur zugelassen werden, wenn Tatsachen die Annahme rechtfertigen, dass eine Gefahr für die menschliche oder tierische Gesundheit nicht zu erwarten ist; Ausnahmen dürfen nicht zugelassen werden
1. in the cases referred to in subsection (2) items 1 and 4, from the legal provisions on adequate identification (Kenntlichmachung),
1. in den Fällen des Absatzes 2 Nummer 1 und 4 von den Rechtsvorschriften über ausreichende Kenntlichmachung,
2. in the cases referred to in subsection (2) item 4, from the prohibitions of sections 8 and 10.
2. in den Fällen des Absatzes 2 Nummer 4 von den Verboten der §§ 8 und 10.
(4) The Federal Office of Consumer Protection and Food Safety (BVL) shall be competent for granting exemptions under subsection (2) items 1 and 3, in agreement with the Federal Office for Economic Affairs and Export Control (BAFA) and, in the case of subsection (2) item 3, also in agreement with the Federal Agency for Technical Relief (THW).
(4) Zuständig für die Zulassung von Ausnahmen nach Absatz 2 Nummer 1 und 3 ist das Bundesamt für Verbraucherschutz und Lebensmittelsicherheit, im Einvernehmen mit dem Bundesamt für Wirtschaft und Ausfuhrkontrolle, im Fall des Absatzes 2 Nummer 3 auch im Einvernehmen mit der Bundesanstalt Technisches Hilfswerk.
In the cases referred to in subsection (2) item 2, the Federal Ministry, in agreement with the Federal Ministry having technical responsibility for them, shall be competent with regard to the organisations of the Federation and the allied armed forces.
In den Fällen des Absatzes 2 Nummer 2 ist hinsichtlich der Organisationen des Bundes und der verbündeten Streitkräfte das Bundesministerium im Einvernehmen mit dem für diese fachlich zuständigen Bundesministerium zuständig.
In the other cases referred to in subsection (2) item 2 and in the cases referred to in subsection (2) item 4, the authorities designated by the Land governments shall be competent.
In den übrigen Fällen des Absatzes 2 Nummer 2 sowie in den Fällen des Absatzes 2 Nummer 4 sind die von den Landesregierungen bestimmten Behörden zuständig.
(5) The grant of an exemption under subsection (2) shall be limited to a maximum period of three years.
(5) Die Zulassung einer Ausnahme nach Absatz 2 ist auf längstens drei Jahre zu befristen.
In the cases referred to in subsection (2) item 1 it may be extended upon application three times, and in the cases referred to in subsection (2) items 2 and 3 repeatedly, in each case by a maximum of three years, provided that the conditions for the grant continue to be met.
In den Fällen des Absatzes 2 Nummer 1 kann sie auf Antrag dreimal, in den Fällen des Absatzes 2 Nummer 2 und 3 wiederholt um jeweils längstens drei Jahre verlängert werden, sofern die Voraussetzungen für die Zulassung fortdauern.
(6) The grant of an exemption may be revoked at any time for good cause.
(6) Die Zulassung einer Ausnahme kann jederzeit aus wichtigem Grund widerrufen werden.
Attention shall be drawn to this when the exemption is granted.
Hierauf ist bei der Zulassung hinzuweisen.
(7) The Federal Ministry is hereby empowered, by statutory ordinance with the consent of the Bundesrat, in the cases referred to in subsection (2) item 1, item 2 in so far as organisations of the Federation or allied armed forces are concerned, and item 3, to issue provisions on the procedure for granting exemptions, in particular on the type and scope of the evidence and other documents to be submitted by the applicant and on the publication of applications or of exemptions granted.
(7) Das Bundesministerium wird ermächtigt, durch Rechtsverordnung mit Zustimmung des Bundesrates in den Fällen des Absatzes 2 Nummer 1, 2, soweit es sich um Organisationen des Bundes oder um verbündete Streitkräfte handelt, und Nummer 3 Vorschriften über das Verfahren bei der Zulassung von Ausnahmen, insbesondere über Art und Umfang der vom Antragsteller beizubringenden Nachweise und sonstigen Unterlagen sowie über die Veröffentlichung von Anträgen oder erteilten Ausnahmen zu erlassen.
