(1) Actions brought on the basis of section 84 or section 84a(1) may also be brought before the court in whose district the claimant has his or her domicile at the time the action is brought or, in the absence of a domicile, his or her habitual residence.

(2) Subsection (1) shall be disregarded when determining the international jurisdiction of the courts of a foreign state under section 328(1) item 1 of the Code of Civil Procedure (Zivilprozessordnung).
(2) Absatz 1 bleibt bei der Ermittlung der internationalen Zuständigkeit der Gerichte eines ausländischen Staates nach § 328 Abs. 1 Nr. 1 der Zivilprozessordnung außer Betracht.
