(1) The Federal Ministry for Economic Affairs and Energy is empowered, in agreement with the Federal Ministry, by statutory ordinance with the consent of the Bundesrat, to set

2. prices for medicinal products prepared and dispensed in pharmacies, and for dispensing containers,

3. prices for special services provided by pharmacies when dispensing medicinal products.

Notwithstanding sentence 1, the Federal Ministry for Economic Affairs and Energy is empowered, in agreement with the Federal Ministry, by statutory ordinance not requiring the consent of the Bundesrat, to adjust the portion of the fixed surcharge that does not serve to promote the provision of emergency pharmacy services in line with the cost trends of pharmacies operated on an economically efficient basis. For the purpose of determining the cost trends referred to in sentence 2, the Federal Ministry for Economic Affairs and Energy or the Federal Ministry may request official information on the business performance indicators of pharmacies from the Federal Statistical Office. The pricing rules for wholesale distribution adopted on the basis of sentence 1 item 1 shall also apply to pharmaceutical companies or other natural or legal persons carrying out an activity under section 4 subsection (22) when supplying pharmacies which purchase the medicinal products for dispensing to the consumer.

(2) The prices and price margins shall take account of the legitimate interests of consumers of medicinal products, of pharmacies and of wholesale distribution; the legitimate interests of consumers of medicinal products also include ensuring supply and the provision of medicinal products under section 52b.

A uniform pharmacy retail price shall be ensured for medicinal products that are excluded from distribution outside pharmacies.
Ein einheitlicher Apothekenabgabepreis für Arzneimittel, die vom Verkehr außerhalb der Apotheken ausgeschlossen sind, ist zu gewährleisten.
Sentence 2 shall not apply to non-prescription medicinal products that are not dispensed at the expense of statutory health insurance.
Satz 2 gilt nicht für nicht verschreibungspflichtige Arzneimittel, die nicht zu Lasten der gesetzlichen Krankenversicherung abgegeben werden.
(3) For medicinal products under subsection (2) sentence 2 for which prices and price margins are determined by the ordinance under subsection (1), pharmaceutical companies shall ensure a uniform selling price; for non-prescription medicinal products dispensed at the expense of statutory health insurance, pharmaceutical companies shall state their uniform selling price for the purpose of the pharmacies' billing with the health insurance funds, from which deviation is permitted when dispensing in individual cases.
(3) Für Arzneimittel nach Absatz 2 Satz 2, für die durch die Verordnung nach Absatz 1 Preise und Preisspannen bestimmt sind, haben die pharmazeutischen Unternehmer einen einheitlichen Abgabepreis sicherzustellen; für nicht verschreibungspflichtige Arzneimittel, die zu Lasten der gesetzlichen Krankenversicherung abgegeben werden, haben die pharmazeutischen Unternehmer zum Zwecke der Abrechnung der Apotheken mit den Krankenkassen ihren einheitlichen Abgabepreis anzugeben, von dem bei der Abgabe im Einzelfall abgewichen werden kann.
Social security institutions, private health insurance companies and their respective associations may agree with pharmaceutical companies on price discounts on the pharmaceutical company's uniform selling price for the prescription-only medicinal products dispensed at their expense.
Sozialleistungsträger, private Krankenversicherungen sowie deren jeweilige Verbände können mit pharmazeutischen Unternehmern für die zu ihren Lasten abgegebenen verschreibungspflichtigen Arzneimittel Preisnachlässe auf den einheitlichen Abgabepreis des pharmazeutischen Unternehmers vereinbaren.
When medicinal products are dispensed for which the prices and price margins are exempted from being set under the ordinance under subsection (1), the uniform selling price under sentence 1 shall not be exceeded.

(3a) Where a reimbursement amount under section 130b of Book V of the Social Code (Fünftes Buch Sozialgesetzbuch) applies to a medicinal product, the pharmaceutical company shall supply the medicinal product at the reimbursement amount; this shall not apply in the case of a determination under section 130b subsection (1c) of Book V of the Social Code for the medicinal product.
(3a) Gilt für ein Arzneimittel ein Erstattungsbetrag nach § 130b des Fünften Buches Sozialgesetzbuch, gibt der pharmazeutische Unternehmer das Arzneimittel zum Erstattungsbetrag ab; dies gilt nicht im Fall einer Bestimmung nach § 130b Absatz 1c des Fünften Buches Sozialgesetzbuch für das Arzneimittel.
Notwithstanding sentence 1, the pharmaceutical company may supply the medicinal product at an amount below the reimbursement amount; the obligation under subsection (3) sentence 1 first half-sentence shall remain unaffected.

In cases not covered by the compensation under section 130b subsection (3a) sentence 9 or subsection (4) sentence 3 of Book V of the Social Code, the legal person that acquired the medicinal product may demand from the pharmaceutical company compensation for the difference between the reimbursement amount applicable under section 130b subsection (3a) or subsection (4) sentence 3 of Book V of the Social Code and the selling price actually paid until that amount was agreed or set, including the surcharges overpaid under the Medicinal Products Price Ordinance (Arzneimittelpreisverordnung) and the value added tax overpaid.

The pharmaceutical company shall satisfy the claim under sentence 5 within ten days of its being asserted.

The claim under sentence 4 or sentence 5 shall not exist where a medicinal product is acquired by pharmacies or wholesalers.

(4) For medicinal products which, in the event of a threatening communicable disease whose spread requires the immediate provision of specific medicinal products considerably exceeding the usual level, are dispensed by pharmacies and which were stockpiled for this purpose under section 47 subsection (1) item 3c, the selling price charged by the Länder (Länderabgabepreis) shall serve as the basis for the prices and price margins to be set under subsection (2).
(4) Bei Arzneimitteln, die im Fall einer bedrohlichen übertragbaren Krankheit, deren Ausbreitung eine sofortige und das übliche Maß erheblich überschreitende Bereitstellung von spezifischen Arzneimitteln erforderlich macht, durch Apotheken abgegeben werden und die zu diesem Zweck nach § 47 Absatz 1 Nummer 3c bevorratet wurden, gilt als Grundlage für die nach Absatz 2 festzusetzenden Preise und Preisspannen der Länderabgabepreis.
