(1) Manufacturers and authorised representatives having their registered place of business within the territorial scope of this Act shall ensure that, even if they have ceased their business activity or their business activity is terminated for other reasons, the documentation referred to in the following provisions is available to the competent authority within the periods specified therein:
(1) Hersteller und Bevollmächtigte, die ihren Sitz im Geltungsbereich dieses Gesetzes haben, stellen sicher, dass, auch wenn sie ihre Geschäftstätigkeit eingestellt haben oder ihre Geschäftstätigkeit aus anderen Gründen beendet wird, der zuständigen Behörde die in den nachfolgenden Vorschriften genannten Unterlagen innerhalb der dort bestimmten Zeiträume zur Verfügung stehen:

(2) Sponsors and legal representatives of a sponsor under Article 62(2) of Regulation (EU) 2017/745 or Article 58(4) of Regulation (EU) 2017/746 having their registered place of business within the territorial scope of this Act shall ensure that the documentation referred to in Annex XV, Chapter III, point 3 of Regulation (EU) 2017/745 and Annex XIV, Chapter II, point 3 of Regulation (EU) 2017/746 is available to the competent authority within the periods specified therein, even if they have ceased their business activity or their business activity is terminated for other reasons.
(2) Sponsoren und rechtliche Vertreter eines Sponsors nach Artikel 62 Absatz 2 der Verordnung (EU) 2017/745 oder Artikel 58 Absatz 4 der Verordnung (EU) 2017/746, die ihren Sitz im Geltungsbereich dieses Gesetzes haben, stellen sicher, dass die in Anhang XV Kapitel III Nummer 3 der Verordnung (EU) 2017/745 und Anhang XIV Kapitel II Nummer 3 der Verordnung (EU) 2017/746 genannten Unterlagen der zuständigen Behörde innerhalb der dort bestimmten Zeiträume zur Verfügung stehen, auch wenn sie ihre Geschäftstätigkeit eingestellt haben oder ihre Geschäftstätigkeit aus anderen Gründen beendet wird.
(2a) Manufacturers and authorised representatives, sponsors and legal representatives of sponsors established within the territorial scope of this Act shall, in the event of the cessation or termination of their business activity, inform the competent authority without undue delay of the body with which the documentation under subsections (1) and (2) is retained.
(2a) Die im Geltungsbereich dieses Gesetzes ansässigen Hersteller und Bevollmächtigten, Sponsoren und rechtlichen Vertreter von Sponsoren teilen der zuständigen Behörde im Fall der Einstellung oder Beendigung ihrer Geschäftstätigkeit unverzüglich die Stelle mit, bei der die Unterlagen nach den Absätzen 1 und 2 aufbewahrt werden.
(3) The Federal Ministry of Health is empowered, in agreement with the Federal Ministry for Economic Affairs and Energy, to lay down by statutory ordinance not requiring the consent of the Bundesrat (Federal Council) the details of the retention of documentation under subsections (1) and (2), in order to ensure that this documentation remains available to the competent authorities for inspection even after the termination of the business activity of manufacturers or authorised representatives, sponsors or legal representatives of sponsors, and in particular
(3) Das Bundesministerium für Gesundheit wird ermächtigt, im Einvernehmen mit dem Bundesministerium für Wirtschaft und Energie durch Rechtsverordnung, die nicht der Zustimmung des Bundesrates bedarf, das Nähere zur Aufbewahrung von Unterlagen nach den Absätzen 1 und 2 zu regeln, um sicherzustellen, dass den zuständigen Behörden diese Unterlagen auch nach Beendigung der Geschäftstätigkeit von Herstellern oder Bevollmächtigten, Sponsoren oder rechtlichen Vertretern von Sponsoren zur Einsicht zur Verfügung stehen, insbesondere
1. to regulate the body with which the documentation is to be retained and the form in which the documentation is to be retained, and

2. to oblige manufacturers and authorised representatives, sponsors and legal representatives of sponsors established within the territorial scope of this Act to set up a body which takes over the retention of documentation under subsections (1) and (2) upon the cessation of business activities and ensures that documentation retained in the form of electronic storage media remains legible throughout the entire retention periods.
