(1) It shall be prohibited to offer, announce or grant gifts and other promotional items (goods or services) or, as a member of the healthcare professionals (Fachkreise), to accept them, unless

1. the gifts or promotional items are articles of low value marked with a durable and clearly visible designation of the advertiser or of the advertised product or of both, or are low-value trifles; gifts or promotional items shall be prohibited for medicinal products insofar as they are granted contrary to the pricing rules applicable on the basis of the Medicinal Products Act (Arzneimittelgesetz) or Book V of the Social Code;
1. es sich bei den Zuwendungen oder Werbegaben um Gegenstände von geringem Wert, die durch eine dauerhafte und deutlich sichtbare Bezeichnung des Werbenden oder des beworbenen Produktes oder beider gekennzeichnet sind, oder um geringwertige Kleinigkeiten handelt; Zuwendungen oder Werbegaben sind für Arzneimittel unzulässig, soweit sie entgegen den Preisvorschriften gewährt werden, die auf Grund des Arzneimittelgesetzes oder des Fünften Buches Sozialgesetzbuch gelten;
a) a specified sum of money or a sum of money to be calculated in a specified manner, or
a) einem bestimmten oder auf bestimmte Art zu berechnenden Geldbetrag oder
b) a specified quantity of the same goods or a quantity to be calculated in a specified manner;
b) einer bestimmten oder auf bestimmte Art zu berechnenden Menge gleicher Ware gewährt werden;
gifts or promotional items under letter a shall be prohibited for medicinal products insofar as they are granted contrary to the pricing rules applicable on the basis of the Medicinal Products Act or Book V of the Social Code; letter b shall not apply to medicinal products whose dispensing is restricted to pharmacies;
Zuwendungen oder Werbegaben nach Buchstabe a sind für Arzneimittel unzulässig, soweit sie entgegen den Preisvorschriften gewährt werden, die aufgrund des Arzneimittelgesetzes oder des Fünften Buches Sozialgesetzbuch gelten; Buchstabe b gilt nicht für Arzneimittel, deren Abgabe den Apotheken vorbehalten ist;
3. the gifts or promotional items consist solely of accessories customary in trade for the goods or of ancillary services customary in trade; in particular, partial or full reimbursement or assumption of travel costs for means of local public passenger transport, appropriate in view of the value of the goods or service, which may be incurred in connection with visiting the business premises or the place where the service is provided, shall be deemed customary in trade;
3. die Zuwendungen oder Werbegaben nur in handelsüblichem Zubehör zur Ware oder in handelsüblichen Nebenleistungen bestehen; als handelsüblich gilt insbesondere eine im Hinblick auf den Wert der Ware oder Leistung angemessene teilweise oder vollständige Erstattung oder Übernahme von Fahrtkosten für Verkehrsmittel des öffentlichen Personennahverkehrs, die im Zusammenhang mit dem Besuch des Geschäftslokals oder des Orts der Erbringung der Leistung aufgewendet werden darf;
4. the gifts or promotional items consist of the provision of information or advice, or
4. die Zuwendungen oder Werbegaben in der Erteilung von Auskünften oder Ratschlägen bestehen oder
5. they are magazines to be distributed free of charge to consumers which, by their presentation and design, serve customer advertising and the interests of the distributing person, make this purpose recognisable by an appropriate imprint on the front page, and are of low value in terms of their production costs (customer magazines).
5. es sich um unentgeltlich an Verbraucherinnen und Verbraucher abzugebende Zeitschriften handelt, die nach ihrer Aufmachung und Ausgestaltung der Kundenwerbung und den Interessen der verteilenden Person dienen, durch einen entsprechenden Aufdruck auf der Titelseite diesen Zweck erkennbar machen und in ihren Herstellungskosten geringwertig sind (Kundenzeitschriften).
Notwithstanding sentence 1, promotional items for members of the healing professions shall be permissible only if they are intended for use in medical or pharmaceutical practice.
Werbegaben für Angehörige der Heilberufe sind unbeschadet des Satzes 1 nur dann zulässig, wenn sie zur Verwendung in der ärztlichen oder pharmazeutischen Praxis bestimmt sind.
Section 47(3) of the Medicinal Products Act shall remain unaffected.
§ 47 Abs. 3 des Arzneimittelgesetzes bleibt unberührt.
(2) Subsection (1) shall not apply to hospitality (gifts) provided in the context of exclusively profession-related scientific events, provided that it does not exceed a reasonable level, in particular is of secondary importance in relation to the scientific purpose of the event, and does not extend to persons other than those working in the health sector.
(2) Absatz 1 gilt nicht für Zuwendungen im Rahmen ausschließlich berufsbezogener wissenschaftlicher Veranstaltungen, sofern diese einen vertretbaren Rahmen nicht überschreiten, insbesondere in bezug auf den wissenschaftlichen Zweck der Veranstaltung von untergeordneter Bedeutung sind und sich nicht auf andere als im Gesundheitswesen tätige Personen erstrecken.
(3) It shall be prohibited to advertise the collection or other procurement of blood, plasma or tissue donations for the manufacture of blood and tissue products and other products for use in humans by referring to the payment of a financial benefit or compensation for expenses.
