(1) An administrative offence is committed by anyone who, intentionally or negligently,

1. contrary to section 3a, advertises a medicinal product which is subject to the marketing authorisation requirement and which is not authorised, or deemed to be authorised, under the provisions of medicinal products law,
1. entgegen § 3a eine Werbung für ein Arzneimittel betreibt, das der Pflicht zur Zulassung unterliegt und das nicht nach den arzneimittelrechtlichen Vorschriften zugelassen ist oder als zugelassen gilt,
2. carries out advertising which does not contain the particulars prescribed under section 4, or, contrary to section 5, advertises by stating indications,
2. eine Werbung betreibt, die die nach § 4 vorgeschriebenen Angaben nicht enthält oder entgegen § 5 mit der Angabe von Anwendungsgebieten wirbt,
3. advertises with expert opinions, certificates or references to publications in a manner prohibited under section 6,
3. in einer nach § 6 unzulässigen Weise mit Gutachten, Zeugnissen oder Bezugnahmen auf Veröffentlichungen wirbt,
4. contrary to section 7(1) and (3), carries out advertising combined with gifts or other promotional items,
4. entgegen § 7 Abs. 1 und 3 eine mit Zuwendungen oder sonstigen Werbegaben verbundene Werbung betreibt,
4a. contrary to section 7(1), accepts a gift or other promotional item as a member of the healthcare professionals (Fachkreise),
4a. entgegen § 7 Abs. 1 als Angehöriger der Fachkreise eine Zuwendung oder sonstige Werbegabe annimmt,
5. contrary to section 8 sentence 1 or sentence 2, carries out teleshopping or advertising referred to therein,
5. entgegen § 8 Satz 1 oder Satz 2 Teleshopping oder eine dort genannte Werbung betreibt,
6. contrary to section 9, advertises remote treatment,
6. entgegen § 9 für eine Fernbehandlung wirbt,
7. contrary to section 10, advertises the medicinal products specified therein,
7. entgegen § 10 für die dort bezeichneten Arzneimittel wirbt,
8. advertises outside healthcare professionals in a manner prohibited by section 11,
8. auf eine durch § 11 verbotene Weise außerhalb der Fachkreise wirbt,
9. contrary to section 12, carries out advertising relating to the diseases or suffering listed in the Annex to section 12,
9. entgegen § 12 eine Werbung betreibt, die sich auf die in der Anlage zu § 12 aufgeführten Krankheiten oder Leiden bezieht,
10. carries out advertising prohibited under section 13.
10. eine nach § 13 unzulässige Werbung betreibt.
(2) An administrative offence is also committed by anyone who negligently contravenes the prohibition of misleading advertising (section 3).
(2) Ordnungswidrig handelt ferner, wer fahrlässig dem Verbot der irreführenden Werbung (§ 3) zuwiderhandelt.
(3) The administrative offence under subsection (1) may be punished by an administrative fine of up to EUR 50,000, and the administrative offence under subsection (2) by an administrative fine of up to EUR 20,000.
(3) Die Ordnungswidrigkeit nach Absatz 1 kann mit einer Geldbuße bis zu fünfzigtausend Euro, die Ordnungswidrigkeit nach Absatz 2 mit einer Geldbuße bis zu zwanzigtausend Euro geahndet werden.
