(1) The appropriate comparator therapy shall, as a rule, be determined in accordance with criteria derived from the international standards of evidence-based medicine.

(2) The appropriate comparator therapy shall be a therapy that is appropriate in the therapeutic indication according to the generally recognised state of medical knowledge (section 12 of Book V of the Social Code (Fünftes Buch Sozialgesetzbuch)), preferably a therapy for which endpoint studies are available and which has proven itself in practical use, unless directives under section 92 subsection (1) of Book V of the Social Code or the principle of cost-effectiveness (Wirtschaftlichkeitsgebot) preclude this.
(2) Die zweckmäßige Vergleichstherapie muss eine nach dem allgemein anerkannten Stand der medizinischen Erkenntnisse zweckmäßige Therapie im Anwendungsgebiet sein (§ 12 des Fünften Buches Sozialgesetzbuch), vorzugsweise eine Therapie, für die Endpunktstudien vorliegen und die sich in der praktischen Anwendung bewährt hat, soweit nicht Richtlinien nach § 92 Absatz 1 des Fünften Buches Sozialgesetzbuch oder das Wirtschaftlichkeitsgebot dagegensprechen.

Als zweckmäßige Vergleichstherapie oder als Teil der zweckmäßigen Vergleichstherapie kann der Gemeinsame Bundesausschuss ausnahmsweise die zulassungsüberschreitende Anwendung von Arzneimitteln bestimmen, wenn er im Beschluss über die Nutzenbewertung nach § 7 Absatz 4 feststellt, dass diese nach dem allgemein anerkannten Stand der medizinischen Erkenntnisse im zu bewertenden Anwendungsgebiet als Therapiestandard oder als Teil des Therapiestandards in der Versorgungssituation, auf die nach Satz 2 abzustellen ist, gilt und
1. the medicinal product to be assessed is the first medicinal product authorised in the therapeutic indication to become available,
1. erstmals mit dem zu bewertenden Arzneimittel ein im Anwendungsgebiet zugelassenes Arzneimittel zur Verfügung steht,
2. according to the generally recognised state of medical knowledge, the off-label use is, as a rule, to be preferred to the medicinal products previously authorised in the therapeutic indication, or
2. die zulassungsüberschreitende Anwendung nach dem allgemein anerkannten Stand der medizinischen Erkenntnisse den im Anwendungsgebiet bislang zugelassenen Arzneimitteln regelhaft vorzuziehen ist oder
3. according to the generally recognised state of medical knowledge, the off-label use is, as a rule, to be preferred, for relevant patient groups or indication areas, to the medicinal products previously authorised in the therapeutic indication.
3. die zulassungsüberschreitende Anwendung nach dem allgemein anerkannten Stand der medizinischen Erkenntnisse für relevante Patientengruppen oder Indikationsbereiche den im Anwendungsgebiet bislang zugelassenen Arzneimitteln regelhaft vorzuziehen ist.
An appropriate comparator therapy may also be a non-drug therapy, best supportive care including symptomatic or palliative treatment, or watchful waiting.

(2a) If, under subsections (1) and (2), several alternatives for the comparator therapy are equally appropriate, the added benefit may be demonstrated against any of these therapies.
