(1) The benefit assessment under section 35a subsection (1) of Book V of the Social Code (Fünftes Buch Sozialgesetzbuch) shall be carried out for reimbursable medicinal products with new active substances and new combinations of active substances
(1) Die Nutzenbewertung nach § 35a Absatz 1 des Fünften Buches Sozialgesetzbuch wird durchgeführt für erstattungsfähige Arzneimittel mit neuen Wirkstoffen und neuen Wirkstoffkombinationen,
1. which are placed on the market for the first time on or after 1 January 2011, provided that a medicinal product containing this active substance is being placed on the market for the first time,
1. die ab dem 1. Januar 2011 erstmals in den Verkehr gebracht werden, sofern erstmals ein Arzneimittel mit diesem Wirkstoff in den Verkehr gebracht wird,
2. which were placed on the market for the first time on or after 1 January 2011 and which receive a new therapeutic indication under section 2 subsection (2) after 1 January 2011,
2. die ab dem 1. Januar 2011 erstmals in den Verkehr gebracht worden sind und die nach dem 1. Januar 2011 ein neues Anwendungsgebiet nach § 2 Absatz 2 erhalten,
3. at the earliest one year after the resolution on the benefit assessment under section 7 subsection (4), upon application by the pharmaceutical company,
3. frühestens ein Jahr nach dem Beschluss über die Nutzenbewertung nach § 7 Absatz 4 auf Antrag des pharmazeutischen Unternehmers,
4. at the earliest one year after the resolution on the benefit assessment under section 7 subsection (4), where new findings are available, at the instigation of the Federal Joint Committee,
4. frühestens ein Jahr nach dem Beschluss über die Nutzenbewertung nach § 7 Absatz 4 bei Vorliegen neuer Erkenntnisse auf Veranlassung des Gemeinsamen Bundesausschusses,
5. for which the Federal Joint Committee has adopted a resolution on a time-limited benefit assessment, once the time limit has expired.
5. für die der Gemeinsame Bundesausschuss über eine Nutzenbewertung mit Befristung beschlossen hat, wenn die Frist abgelaufen ist.
(2) The benefit assessment under section 35a subsection (6) of Book V of the Social Code shall be carried out for reimbursable medicinal products with active substances that are not new active substances within the meaning of this Ordinance where the Federal Joint Committee initiates a benefit assessment under section 35a subsection (6) of Book V of the Social Code.
(2) Die Nutzenbewertung nach § 35a Absatz 6 des Fünften Buches Sozialgesetzbuch wird durchgeführt für erstattungsfähige Arzneimittel mit Wirkstoffen, die keine neuen Wirkstoffe im Sinne dieser Verordnung sind, wenn der Gemeinsame Bundesausschuss eine Nutzenbewertung nach § 35a Absatz 6 des Fünften Buches Sozialgesetzbuch veranlasst.
