(1) Anyone who, intentionally or negligently, uses a nutrient contrary to section 3(1) shall be liable to penalty under section 58(1) item 18 and (4) to (6) of the Food and Feed Code (Lebensmittel- und Futtermittelgesetzbuch).
(1) Nach § 58 Abs. 1 Nr. 18, Abs. 4 bis 6 des Lebensmittel- und Futtermittelgesetzbuches wird bestraft, wer vorsätzlich oder fahrlässig entgegen § 3 Abs. 1 einen Nährstoff verwendet.
(2) Anyone who places a food supplement on the market on a commercial basis contrary to section 4(2) item 3 or section 4(4) shall be liable to penalty under section 59(1) item 21(a) of the Food and Feed Code.
(2) Nach § 59 Abs. 1 Nr. 21 Buchstabe a des Lebensmittel- und Futtermittelgesetzbuches wird bestraft, wer entgegen § 4 Abs. 2 Nr. 3 oder Absatz 4 ein Nahrungsergänzungsmittel gewerbsmäßig in den Verkehr bringt.
(3) Anyone who negligently commits an act referred to in subsection (2) commits an administrative offence under section 60(1) item 2 of the Food and Feed Code.
(3) Wer eine in Absatz 2 bezeichnete Handlung fahrlässig begeht, handelt nach § 60 Absatz 1 Nummer 2 des Lebensmittel- und Futtermittelgesetzbuches ordnungswidrig.
(3a) An administrative offence within the meaning of section 60(2) item 26(a) of the Food and Feed Code is committed by anyone who, intentionally or negligently, contrary to section 5(1), also in conjunction with section 5(2), fails to make a notification or fails to make it correctly, completely or in good time.
(3a) Ordnungswidrig im Sinne des § 60 Absatz 2 Nummer 26 Buchstabe a des Lebensmittel- und Futtermittelgesetzbuches handelt, wer vorsätzlich oder fahrlässig entgegen § 5 Absatz 1, auch in Verbindung mit Absatz 2, eine Anzeige nicht, nicht richtig, nicht vollständig oder nicht rechtzeitig erstattet.
(4) An administrative offence within the meaning of section 60(2) item 26(b) of the Food and Feed Code is committed by anyone who, intentionally or negligently, places a food supplement on the market on a commercial basis contrary to section 2, section 4(2) item 1, 2, 4 or 5 or section 4(3) sentence 1.
(4) Ordnungswidrig im Sinne des § 60 Abs. 2 Nr. 26 Buchstabe b des Lebensmittel- und Futtermittelgesetzbuches handelt, wer vorsätzlich oder fahrlässig entgegen § 2, § 4 Absatz 2 Nummer 1, 2, 4 oder Nummer 5 oder Absatz 3 Satz 1 ein Nahrungsergänzungsmittel gewerbsmäßig in den Verkehr bringt.
