(1) The competent higher federal authority shall register the traditional herbal medicinal product and notify the applicant of the registration number in writing.

Section 25(4) and (5) sentence 5 shall apply accordingly.

The registration shall apply only to the traditional herbal medicinal product specified in the decision.

(2) The competent higher federal authority shall refuse registration if the application does not contain the particulars and documents prescribed in section 39b, or if

1. the qualitative or quantitative composition does not correspond to the particulars under section 39b(1) or the pharmaceutical quality is otherwise inadequate,
1. die qualitative oder quantitative Zusammensetzung nicht den Angaben nach § 39b Abs. 1 entspricht oder sonst die pharmazeutische Qualität nicht angemessen ist,
2. the indications are not exclusively those of traditional herbal medicinal products which, by virtue of their composition and purpose, are intended to be used without the supervision of a medical practitioner for diagnostic purposes, for prescription or for monitoring of treatment,
2. die Anwendungsgebiete nicht ausschließlich denen traditioneller pflanzlicher Arzneimittel entsprechen, die nach ihrer Zusammensetzung und dem Zweck ihrer Anwendung dazu bestimmt sind, angewendet zu werden, ohne dass es der ärztlichen Aufsicht im Hinblick auf die Stellung einer Diagnose, die Verschreibung oder die Überwachung der Behandlung bedarf,
3. the medicinal product may be harmful when used as intended,
3. das Arzneimittel bei bestimmungsgemäßem Gebrauch schädlich sein kann,
4. the safety of vitamins or minerals contained in the medicinal product has not been demonstrated,
4. die Unbedenklichkeit von Vitaminen oder Mineralstoffen, die in dem Arzneimittel enthalten sind, nicht nachgewiesen ist,
5. the data on traditional use are insufficient, in particular if the pharmacological effects or efficacy are not plausible on the basis of long-standing use and experience,
5. die Angaben über die traditionelle Anwendung unzureichend sind, insbesondere die pharmakologischen Wirkungen oder die Wirksamkeit auf der Grundlage der langjährigen Anwendung und Erfahrung nicht plausibel sind,
6. the medicinal product is not exclusively for administration in accordance with a specified strength and posology,
6. das Arzneimittel nicht ausschließlich in einer bestimmten Stärke und Dosierung zu verabreichen ist,
7. the medicinal product is not intended exclusively for oral or external use or for inhalation,
7. das Arzneimittel nicht ausschließlich zur oralen oder äußerlichen Anwendung oder zur Inhalation bestimmt ist,
8. the period of time required under section 39b(1) sentence 1 item 4 has not been met,
8. die nach § 39b Abs. 1 Satz 1 Nr. 4 erforderliche zeitliche Vorgabe nicht erfüllt ist,
9. a marketing authorisation under section 25 or a registration under section 39 has been granted for the traditional herbal medicinal product or a corresponding medicinal product,
9. für das traditionelle pflanzliche Arzneimittel oder ein entsprechendes Arzneimittel eine Zulassung gemäß § 25 oder eine Registrierung nach § 39 erteilt wurde,
10. placing the medicinal product on the market would infringe statutory provisions.
10. das Inverkehrbringen des Arzneimittels gegen gesetzliche Vorschriften verstoßen würde.
(3) The registration shall expire on the expiry of five years from the date on which it was granted, unless an application for renewal is submitted no later than nine months before the expiry of that period.
(3) Die Registrierung erlischt nach Ablauf von fünf Jahren seit ihrer Erteilung, es sei denn, dass spätestens neun Monate vor Ablauf der Frist ein Antrag auf Verlängerung gestellt wird.
Section 31 shall apply accordingly to the expiry and renewal of the registration, subject to the proviso that the grounds for refusal under subsection (2) shall apply.
Für das Erlöschen und die Verlängerung der Registrierung gilt § 31 entsprechend mit der Maßgabe, dass die Versagungsgründe nach Absatz 2 Anwendung finden.
