(1) The statement of the expiry date prescribed in section 10(1) sentence 1 item 9 and subsection (8) may be omitted in the case of medicinal products that are supplied to the Federal Armed Forces or the Federal Police, or to the Federation or the Länder for the purposes of civil protection and disaster control, or that are procured and placed on the market by the Federal Ministry under section 79(4a).
(1) Die in § 10 Absatz 1 Satz 1 Nummer 9 und Absatz 8 vorgeschriebene Angabe des Verfalldatums kann entfallen bei Arzneimitteln, die an die Bundeswehr, die Bundespolizei sowie für Zwecke des Zivil- und Katastrophenschutzes an Bund oder Länder abgegeben oder die nach § 79 Absatz 4a vom Bundesministerium beschafft und in den Verkehr gebracht werden.
The competent federal ministries or, where medicinal products are supplied to the Länder, the competent authorities of the Länder shall ensure that quality, efficacy and safety are guaranteed in the case of such medicinal products as well.
Die zuständigen Bundesministerien oder, soweit Arzneimittel an Länder abgegeben werden, die zuständigen Behörden der Länder stellen sicher, dass Qualität, Wirksamkeit und Unbedenklichkeit auch bei solchen Arzneimitteln gewährleistet sind.
(2) The Federal Ministry is hereby empowered to permit, by statutory ordinance, exemptions from the provisions of this Act and of the statutory ordinances issued on the basis of this Act for the sphere of the Federal Armed Forces, the Federal Police, the stand-by police forces of the Länder, civil protection and disaster control, and for tasks of the Federal Ministry under section 79(4a), insofar as this is justified for the performance of the special tasks in these spheres, including participation in international relief operations, and the protection of human health remains safeguarded.
(2) Das Bundesministerium wird ermächtigt, durch Rechtsverordnung Ausnahmen von den Vorschriften dieses Gesetzes und der auf Grund dieses Gesetzes erlassenen Rechtsverordnungen für den Bereich der Bundeswehr, der Bundespolizei, der Bereitschaftspolizeien der Länder, des Zivilschutzes, des Katastrophenschutzes und für Aufgaben des Bundesministeriums nach § 79 Absatz 4a zuzulassen, soweit dies zur Durchführung der besonderen Aufgaben einschließlich der Teilnahme an internationalen Hilfsaktionen in diesen Bereichen gerechtfertigt ist und der Schutz der menschlichen Gesundheit gewahrt bleibt.
(3) Insofar as it affects the sphere of the Federal Armed Forces, the statutory ordinance shall be issued in agreement with the Federal Ministry of Defence and, insofar as it affects the sphere of the Federal Police and civil protection, in agreement with the Federal Ministry of the Interior, Building and Community, in each case without the consent of the Bundesrat; insofar as the statutory ordinance affects the sphere of the stand-by police forces of the Länder or disaster control, it shall be issued in agreement with the Federal Ministry of the Interior, Building and Community with the consent of the Bundesrat.
(3) Die Rechtsverordnung ergeht, soweit sie den Bereich der Bundeswehr berührt, im Einvernehmen mit dem Bundesministerium der Verteidigung, und, soweit sie den Bereich der Bundespolizei und des Zivilschutzes berührt, im Einvernehmen mit dem Bundesministerium des Innern, für Bau und Heimat, jeweils ohne Zustimmung des Bundesrates; soweit die Rechtsverordnung den Bereich der Bereitschaftspolizeien der Länder oder des Katastrophenschutzes berührt, ergeht sie im Einvernehmen mit dem Bundesministerium des Innern, für Bau und Heimat mit Zustimmung des Bundesrates.
