The Federal Ministry is empowered, in agreement with the Federal Ministry for Economic Affairs and Energy, by statutory ordinance with the consent of the Bundesrat, where this is necessary to fulfil the purposes set out in section 1(1) item 1 or 4(a)(aa), also in conjunction with section 1(3),
Das Bundesministerium wird ermächtigt, im Einvernehmen mit dem Bundesministerium für Wirtschaft und Energie durch Rechtsverordnung mit Zustimmung des Bundesrates, soweit es zur Erfüllung der in § 1 Absatz 1 Nummer 1 oder 4 Buchstabe a Doppelbuchstabe aa, auch in Verbindung mit § 1 Absatz 3, genannten Zwecke erforderlich ist,
1. to require that establishments which manufacture, treat or place on the market certain products carry out certain in-house controls and measures as well as instruction or training of persons in the necessary hygiene and keep records thereof, and that establishments be subject to certain testing and notification obligations,
1. vorzuschreiben, dass Betriebe, die bestimmte Erzeugnisse herstellen, behandeln oder in den Verkehr bringen, bestimmte betriebseigene Kontrollen und Maßnahmen sowie Unterrichtungen oder Schulungen von Personen in der erforderlichen Hygiene durchzuführen und darüber Nachweise zu führen haben, sowie dass Betriebe bestimmten Prüfungs- und Mitteilungspflichten unterliegen,
2. to regulate the details of the type, scope and frequency of the in-house controls and measures under item 1 and of the evaluation and notification of the control results,
2. das Nähere über Art, Umfang und Häufigkeit der betriebseigenen Kontrollen und Maßnahmen nach Nummer 1 sowie die Auswertung und Mitteilung der Kontrollergebnisse zu regeln,
3. to regulate the details of the type, form and content of the records under item 1 and of the period for which they are to be retained,
3. das Nähere über Art, Form und Inhalt der Nachweise nach Nummer 1 sowie über die Dauer ihrer Aufbewahrung zu regeln,
4. to require that establishments which manufacture, treat or place on the market certain products, or laboratories commissioned by such establishments, retain certain test material when carrying out microbiological examinations in the course of the in-house controls under item 1 and hand it over to the competent authority on request, and to regulate the appropriate manner and the period of retention and the use of the test material handed over.
4. vorzuschreiben, dass Betriebe, die bestimmte Erzeugnisse herstellen, behandeln oder in den Verkehr bringen, oder von diesen Betrieben beauftragte Labors, bei der Durchführung mikrobiologischer Untersuchungen im Rahmen der betriebseigenen Kontrollen nach Nummer 1 bestimmtes Untersuchungsmaterial aufzubewahren und der zuständigen Behörde auf Verlangen auszuhändigen haben sowie die geeignete Art und Weise und die Dauer der Aufbewahrung und die Verwendung des ausgehändigten Untersuchungsmaterials zu regeln.
Sentence 1 shall apply mutatis mutandis to food businesses in which live animals within the meaning of section 4(1) item 1 are kept.
Satz 1 gilt entsprechend für Lebensmittelunternehmen, in denen lebende Tiere im Sinne des § 4 Absatz 1 Nummer 1 gehalten werden.
A notification made on the basis of a statutory ordinance under sentence 1 item 2, or a handing over of test material on the basis of a statutory ordinance under sentence 1 item 4, shall not be used for the criminal prosecution of the person making the notification or handing over the material, or for proceedings under the Administrative Offences Act (Gesetz über Ordnungswidrigkeiten) against the person making the notification or handing over the material.
Eine Mitteilung aufgrund einer Rechtsverordnung nach Satz 1 Nummer 2 oder eine Aushändigung von Untersuchungsmaterial aufgrund einer Rechtsverordnung nach Satz 1 Nummer 4 darf nicht zur strafrechtlichen Verfolgung des Mitteilenden oder Aushändigenden oder für ein Verfahren nach dem Gesetz über Ordnungswidrigkeiten gegen den Mitteilenden oder Aushändigenden verwendet werden.
