The Federal Ministry is empowered, in agreement with the Federal Ministry for Economic Affairs and Energy, by statutory ordinance with the consent of the Bundesrat, where this is necessary to fulfil the purposes set out in section 1(1) item 2 or 3, in each case also in conjunction with section 1(3),
Das Bundesministerium wird ermächtigt, im Einvernehmen mit dem Bundesministerium für Wirtschaft und Energie durch Rechtsverordnung mit Zustimmung des Bundesrates, soweit es zur Erfüllung der in § 1 Absatz 1 Nummer 2 oder 3, jeweils auch in Verbindung mit § 1 Absatz 3, genannten Zwecke erforderlich ist,
1. to regulate the content, manner and scope of the labelling of products when they are placed on the market or treated, and in doing so to require in particular
1. Inhalt, Art und Weise und Umfang der Kennzeichnung von Erzeugnissen bei deren Inverkehrbringen oder Behandeln zu regeln und dabei insbesondere
a) the indication of the name, the mass or the volume, and
a) die Angabe der Bezeichnung, der Masse oder des Volumens sowie
aa) the contents, in particular on the composition, the properties, ingredients or energy values,
aa) den Inhalt, insbesondere über die Zusammensetzung, die Beschaffenheit, Inhaltsstoffe oder Energiewerte,
bb) the manufacturer, the person responsible for placing on the market, the use of processes, the time or method of manufacture, the shelf life, the origin, the preparation, the intended use or, for certain products, a withdrawal period,
bb) den Hersteller, den für das Inverkehrbringen Verantwortlichen, die Anwendung von Verfahren, den Zeitpunkt oder die Art und Weise der Herstellung, die Haltbarkeit, die Herkunft, die Zubereitung, den Verwendungszweck oder, für bestimmte Erzeugnisse, eine Wartezeit
1a. to regulate the content, manner and scope of information on food conveyed other than through labelling, and of information relevant in business dealings between food business operators which does not constitute food information directed at the final consumer,
1a. Inhalt, Art und Weise sowie Umfang von anderen als über die Kennzeichnung vermittelten Informationen über Lebensmittel sowie von im Geschäftsverkehr zwischen Lebensmittelunternehmern relevante Informationen, bei denen es sich nicht um an den Endverbraucher gerichtete Informationen über Lebensmittel handelt, zu regeln,
a) they may be placed on the market only in packages, containers or other wrappings, including sealed wrappings or wrappings of a particular type, and in this connection to regulate the type or securing of a closure,
a) sie nur in Packungen, Behältnissen oder sonstigen Umhüllungen, auch verschlossen oder von bestimmter Art, in den Verkehr gebracht werden dürfen und dabei die Art oder Sicherung eines Verschlusses zu regeln,
b) the contents shall be indicated on the storage vessels or similar containers in which products are offered for sale or otherwise kept in stock for sale,
b) an den Vorratsgefäßen oder ähnlichen Behältnissen, in denen Erzeugnisse feilgehalten oder sonst zum Verkauf vorrätig gehalten werden, der Inhalt anzugeben ist,
c) certain storage conditions shall be indicated for them,
c) für sie bestimmte Lagerungsbedingungen anzugeben sind,
3. to issue provisions for certain products on their manufacture or treatment,
3. für bestimmte Erzeugnisse Vorschriften über das Herstellen oder das Behandeln zu erlassen,
4. to lay down for certain products permissible deviations (tolerances) in respect of certain mandatory particulars,
4. für bestimmte Erzeugnisse duldbare Abweichungen bei bestimmten vorgeschriebenen Angaben festzulegen,
5. to require that any person who manufactures, treats, imports or places on the market certain products keep available, or transmit to the competent authority on request, certain information, in particular on the use of the products, and to regulate the content, manner and limitations of keeping such information available.
5. vorzuschreiben, dass derjenige, der bestimmte Erzeugnisse herstellt, behandelt, einführt oder in den Verkehr bringt, bestimmte Informationen, insbesondere über die Verwendung der Erzeugnisse, bereitzuhalten oder der zuständigen Behörde auf Aufforderung zu übermitteln hat, sowie Inhalt, Art und Weise und Beschränkungen des Bereithaltens zu regeln.
