(1) In the area of operation and use, the provisions of this Act and the provisions of the statutory ordinances issued on the basis of this Act shall apply mutatis mutandis to facilities that serve to supply the Federal Armed Forces (Bundeswehr) with devices.
(1) Im Bereich des Betreibens und Anwendens sind die Vorschriften dieses Gesetzes und die Vorschriften der auf Grund dieses Gesetzes erlassenen Rechtsverordnungen auf Einrichtungen, die der Versorgung der Bundeswehr mit Produkten dienen, entsprechend anzuwenden.
(2) Within the Federal Armed Forces, the enforcement of Regulation (EU) 2017/745, of Regulation (EU) 2017/746, of this Act and of the statutory ordinances issued on the basis of this Act, as well as supervision, shall be the responsibility of the competent bodies and experts of the Federal Armed Forces.
(2) Im Bereich der Bundeswehr obliegen der Vollzug der Verordnung (EU) 2017/745, der Verordnung (EU) 2017/746, dieses Gesetzes und der auf Grund dieses Gesetzes erlassenen Rechtsverordnungen und die Überwachung den zuständigen Stellen und Sachverständigen der Bundeswehr.
(3) The Federal Ministry of Defence shall be competent, within its remit, for granting a derogation (special authorisation) under Article 59 of Regulation (EU) 2017/745 or Article 54 of Regulation (EU) 2017/746 where the device is to be used for the performance of special tasks of the Federal Armed Forces.
(3) Zuständig für die Erteilung einer Sonderzulassung nach Artikel 59 der Verordnung (EU) 2017/745 oder Artikel 54 der Verordnung (EU) 2017/746 für seinen Geschäftsbereich ist das Bundesministerium der Verteidigung, soweit das Produkt für die Durchführung besonderer Aufgaben der Bundeswehr verwendet werden soll.
The Federal Ministry of Defence shall inform the European Commission and the other Member States of the granting of derogations under sentence 1 in accordance with Article 59(2) of Regulation (EU) 2017/745 and Article 54(2) of Regulation (EU) 2017/746.
